VENDOR QUESTIONS

A1) No. Offeror’s must have an active Facilities Clearance at the secret level at the time of proposal submission.

Q2) Is there cell phone service at the site?

A2) Yes, but the quality of the signal may depend on the carrier.

Q3) Are the guard patrols performed on foot or vehicles?

A3) Patrols are performed with vehicles. In some cases where heavy rains or snow melt oversaturate the ground, foot patrols may be necessary.

Q4) The solicitation requires offerors to submit relevant projects where the vendor complied with regulatory guidance 10 CFR Part 73, or a project involving the protection of special nuclear materials as defined in Title I of the Atomic Energy Act of 1954, Chapter 2, Section 11. Can this requirement be waived?

A4) No. All projects submitted by an offeror must meet the Factor 1 and Factor 4 requirements to be deemed relevant.

The following have been modified:

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Award will be made to the lowest priced technically acceptable offeror.

All proposals submitted will be evaluated against the Non-price Technical Evaluation Factors and Price Proposal as listed below:

FACTOR 1: EXPERIENCE. Offerors will be evaluated on their experience. To receive an “Acceptable” rating for this Factor, an Offeror must provide evidence of two (2) relevant projects performed within the last ten (10) years of the date of proposal submission. For this acquisition, a relevant project is defined as a project where the vendor complied with regulatory guidance 10 CFR Part 73, or a project involving the protection of special nuclear materials as defined in Title I of the Atomic Energy Act of 1954, Chapter 2, Section 11, aa. In addition, submitted projects must have been at least six (6) months in duration and include the services of multiple armed guards per shift providing 24/7 service in order to be deemed relevant. Offerors shall include the following minimum descriptive information for each job submitted for evaluation:

1. Job title

2. Geographic location

3. Period of performance

4. Final U.S. dollar value of the job

5. Detailed description of the job requirements including how the job required 10 CFR 73 compliance or the protection of Special Nuclear Materials

6. Description of the Offeror’s actual involvement in performance of the job

7. Role as Prime Contractor or Subcontractor

FACTOR 2: SECURITY/TRAINING PLAN. Offerors must have an active Facilities Clearance (FCL) at the secret level from the date of proposal submission through the life of the contract. Offerors shall provide a training plan that demonstrates all site security guards will pass and maintain the training and qualification requirements of Paragraph 4.2 of the Performance Work Statement (PWS). To receive an “Acceptable” rating for this Factor, the offeror must meet the FCL requirements in Paragraph 4.1.2 of the PWS from the date of proposal submission through the life of the contract, and the training plan must meet all of the requirements of Paragraph 4.2 of the PWS.

The Training Plan submitted for evaluation shall include at a minimum:

1. Course Names

2. Course Provider

3. Schedule for Course Completion

4. Schedule for Required Refresher Training

FACTOR 3: WEAPONRY. Offerors will be evaluated on their security guard Weapon Safety and Handling Policy. To receive an “Acceptable” rating for this Factor, an Offeror’s Weapon Safety and Handling Policy must meet the requirements of Paragraph 1.3 of the PWS. Safety and Handling Policy submitted for evaluation shall include at a minimum:

1. Types of Firearms Available for Issue to Security Personnel

2. Firearm Safety Guidelines

3. Firearm Handling Guidelines

4. Use of Force Guidelines

FACTOR 4: PAST PERFORMANCE. Past performance pertains to how well an offeror has performed past jobs that is an indicator of future performance. Past performance information is not the same as experience information.

Experience pertains to what type of jobs an offeror has performed. Past performance pertains to how well an offeror performs.

Offeror’s past performance shall be evaluated on two (2) relevant projects performed within the last ten (10) years of the date of proposal submission that are same/similar in nature to the project requirements solicited by the RFP.

Past performance will be evaluated to determine technical capability to perform the proposed contract and how well it satisfied its customers. To receive an “Acceptable” rating for this factor, an Offeror’s performance record must demonstrate that there is a reasonable expectation the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.

Offerors shall submit with their proposals:

1. Completed Contractor Performance Assessment Reporting System (CPARS) Reports and Past Performance Questionnaires (PPQ) (See Attachment 1) for the offeror. Offerors shall not incorporate CPARS/PPQs by reference into their proposal CPARS/PPQs. previously submitted for other RFPs. This does not preclude the Government from utilizing previously submitted CPARS/PPQ information in the past performance evaluation. The CPARS/PPQs must be submitted by the offeror with the proposal submission and not sent directly to USACE from the reference.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the CPARS system, using all CAGE/Unique Entity Identifier numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative (s), Federal Awardee Performance and Integrity Information System (FAPIIS), and any other known sources not provided by the offeror.

Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (See FAR 15.305(a)(2)(iv). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

PRICE PROPOSAL. The price proposal corresponding to each “Acceptable” technical proposal will be ranked in order of price (base + all options) and evaluated in accordance with FAR 15.404-1. A fair and reasonable price determination is expected to be based on adequate price competition, comparison with the Independent Government Estimate (IGE), or previously proposed prices for same or similar services. However, if a determination of fair and reasonable price requires additional information, the Contracting Officer may conduct a cost analysis to support the determination of whether the proposed price is fair and reasonable.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
