SUMMARY OF CHANGES

SECTION 00010 - SOLICITATION CONTRACT FORM

The contractor period of performance end date has increased by 60 days from 540 days to 600 days.

The following have been added by full text:

QUESTIONS AND ANSWERS

1. In order that we may complete our quote, please extend the bid due date 3 weeks from the time you will provide all requested data and answers to the questions.

Answer. Due to funding constraints, the bid date cannot be extended.

2. “Special Procedures” paragraph 3.2.2.2 States that the installation of the crane at the main channel dam may be performed by floating equipment from the upper pool side of the dam. If this work is to be completed within 540 days, then the estimated installation will need to be performed in March 2018. Even though the air temperature may be greater than 32 degrees, there is the likelihood of ice being present making the use of floating equipment impossible. Can you please extend the time of completion to 730 days?

Answer. The base contract will be increased by 60 days from 540 to 600 calendar days by amendment.

3. Based on our manufacturing schedule, and your potential purchase of optional back channel crane (purchased before end of 2016), can we opt to bid the work consecutive – install the back channel crane right after the front channel crane?

Answer. The installation schedule is to be developed by the Contractor and must comply with the contract requirements.

As stated in Section 00700 Contract Clauses, 52.211-10 Commencement, Prosecution, and Completion of Work (as amended) and Section 00800 00800-6 Awardable Options, the first crane must be installed within 600 calendar days after receipt of Notice to Proceed and the contract completion time will be extended 180 calendar days if the awardable options are exercised for a total of 780 calendar days. Clauses 52.211-10 and 00800-6 have been revised by amendment to clarify this.

4. Solicitation clause 52.211-12 (LD’s). What is the basis of the value of LD’s? Can you change the LD’s to $1,121 / week?

Answer. Liquidated damages are based on the Government’s cost to administer the contract. The liquidated damages will not be changed.

5. In order for us to offer the best price, please revise the solicitation to include Installment Payments for purchase of the crane – FAR Clause 52.232-30.

Answer. This is a construction contract solicitation, not a Commercial Item Purchase, so the requested clause does not apply.

6. It is our experience that Government purchases and purchase such as this (where crane is used in the production and subsequent sale of electricity or other end product) is not subject to sales tax. Can Purchaser provide a tax exemption certificate or tax withholding certificate for some or all items purchased? Please provide details of the certificate?

Answer. The sales tax exemption does not apply in Pennsylvania.

7. What is the basis of award? Please provide the selection criteria and method of scoring or selection?

Answer. The award will be made to the responsive bidder with the lowest total price inclusive of the total price for all options and the total price for the basic requirement in accordance with FAR 52.217-5.

8. Please clarify the description of the crane use, in specification section on “Auxiliary Crane” paragraph 1.3? During the meeting it was stated that the crane only performs lifting tools and equipment to maintain the lock and dam and that the crane is not used to lift the gates or lift stuck debris in the river. Therefore, can we justify and design the crane with standard service factors typical for this application and operating speeds?

Answer. A requirement has been added by Amendment to also require compliance with ASME B30.23 (2011) Personnel

Lifting Systems for use with a man basket. Standard service factors for the intended use and operating environment are acceptable.

9. What is the maximum weight that can be placed on the runway? Can the test weights be placed on the runway along with the 2 cranes? Can 2 cranes be placed on the runway?

Answer. Per spec section 41 22 13.29 08 paragraph 1.3.2.2, the maximum load would be 95,000 pounds plus the 15 ton maximum load. This load restriction is for each bridge span. A second crane can be on the dam as long as the two cranes are not located on the same bridge span. The dam bridge consists of a short solid section on top of each pier with a separate bridge span between each set of piers.

10. “Auxiliary Crane” paragraph 1.3. The existing crane has a single non-telescoping mast. Can the new crane also be supplied with a single non-telescoping mast?

Answer. No, a telescoping mast is required as specified.

11. The following are in regards to the installation of the back channel crane. See attached sketch:

a. Who owns the property just to the east (up-river) from the back channel dam (e.g. provide contact information)?

Where is the property line separating the dam property from the business property to the east of the back channel dam?

Answer. Property ownership information is not currently available. The Government property extends to approximately the light pole and Jersey barriers.

b. Can the Corps get permission from the business owner to allow us to utilize a portion of the parking lot for delivery of trucks and set-up of a mobile crane?

Answer. The area between the fence and the Jersey barriers is Government property. Obtaining rights to use additional property would require a real estate action which is not feasible at this time and is not considered to be necessary for this work.

c. Can we remove some of the trees on the Neville Island Shore immediately up-river from the back channel dam?

Answer. Removal of trees will not be permitted.

d. What is the dimension from the fence on the east side of the dam property to the light pole? (“D”).

Answer. We do not have a drawing showing this dimension, using Google maps distance D is approximately 50ft. The accuracy of the Google maps dimension has not been verified.

e. What is the clearance footprint ground dimensions from the dam, near the 30 Ton monorail service structure, to the building (within the fence)? (“A”, “B”, “C”).

Answer. Distance A is approximately 27ft, distance B is approximately 25ft, and distance C is approximately 25ft.

12. In order for us to submit a bid, please allow the use of our standard design which will meet the intent of your specification.

“Electrical Work”:

a. (2.2) Instead of a 120/240 single phase generator - We will use a 3 phase generator and transformer to supply control circuits.

Answer. A 3 phase generator is acceptable provided a transformer is used to derive the 120/240V single phase.

b. (2.4) Wiring and cabling and grounding shall be in accordance with NFPA and NEC requirements.

Answer. Wiring shall conform to specs paragraph 2.4. Electrical installation shall conform to NFPA70 as specified in 3.1.

c. (2.5) Junctions boxes shall be mounted with zinc plated hardware.

Answer. Mounting hardware shall be stainless steel as stated in specs paragraph 2.5, please bid accordingly.

d. (2.12) Our standard oil heater is 3ph. We request that you supply 480 V / 3 / 60 standby power to our receptacle.

Answer. 480 V 3 phase stand-by power can be provided if required.

e. (2.15) We understand that “sump” heater is the same as oil reservoir heater.

Answer. The paragraph has been revised to “oil reservoir and engine sump heaters” by amendment.

f. (2.16) Sensing devices will be provided as commercially available for the application. Answer. Sensing devices will be evaluated during the shop drawing submittal process.

g. (2.16.2.3) A load pin with design factor of 5:1 will be placed in the wire rope dead end termination and be in accordance with industry standards – This will provide the best system accuracy and is common industry practice.

The load pin can be provided with a certificate of conformance and optional factory load test and inspection by the pin manufacturer.

Answer. Load pins can be used in place of load cells.

“Auxiliary Crane”:

a. (1.3 & 2.2) The engine is a liquid cooled type with forced-air radiator.

Answer. The requirement for an air cooled engine has been deleted by amendment.

b. (2.1) States that the wheels shall be not less than 24” in diameter for ASCE 85 # rail. Instead, can we justify - with an industry standard (e.g. CMAA #70) - the use of a smaller diameter wheel?

Answer. The minimum wheel diameter is 24” as specified, this is already reduced from the diameter of the existing crane wheels.

c. (2.1) We normally provide higher efficiency anti-friction bearings with provisions for grease lubrication.

Answer. Anti-friction bearings are acceptable and have been added by amendment.

d. (2.3) The minimum (preliminary) calculated line-pull is 7,800 lbs. An appropriate hoist and rope with industry applicable design factors will be selected.

Answer. The single line pull and wire rope size/type shall be as specified.

e. (2.3) Maximum line speeds of 87 FPM (loaded) and 204 FPM (unloaded) will be requested and verified at final design and in accordance with hoist manufactures standard speeds. Final selected speeds may be different.

Answer. “Approximately” has been added to the lines speeds by amendment.

f. (2.14) We will supply a T.B.D. HP continuous duty diesel engine which will drive a pump drive having a series of variable volume hydraulic pumps at 2,200 RPM with a max flow of 128 GPM total. This will be a load sensing, open-loop torque limiting system, which will only use the horse power required without staling the diesel engine.

Answer. “two” pumps has been changed by to “one or more by amendment”.

13. In accordance with the specifications – section 01 35 00.00 08 (Special Procedures) item 1.5.1. – Can you please send me the “prints of shop drawings for the existing locomotive crane car body”? Also please send any installation plans or calculations if available.

Answer: A pdf file containing the available car body shop drawings of the existing cranes is attached. The drawings are not complete, but they are all that we have on file.

14. Can you send me data for the 30 Ton monorail gate maintenance hoist (general arrangement with hoist weights) and details (drawings and calculations) of the steel supporting structure and footings?

Answer: The 15 Ton Locomotive Cranes are the maintenance cranes, not the monorail 30 Ton Bulkhead Hoist. The

Bulkhead Hoist is designed specifically to handle the bulkheads with a special lifting beam that can only engage the lifting eyes on each bulkhead section. The Bulkhead Hoist cannot be used to assist in the installation of the new locomotive cranes or removal of the existing locomotive cranes.

15. At the site visit there was an indication your forces would remove the conductor rail support & repaint the exposed surfaces. You would also cut off the anchor bolts & grind flush.

Answer: The conductor rail system on both the Main Channel Dam and Back Channel Dam will be completely removed by the Corps prior to installation of the new cranes. This includes the conductor rail, supports and all mounting hardware. Spec Section 01 35 00.00 08 Paragraph 3.2.3 Removal of Existing Equipment will be revised by amendment. In addition, Shore Power requirements are already covered in Spec Section 26 05 00.00 08 Paragraph

2.12 Stand-by Power.

00800-7 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

a. This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the clause entitled "Default (Fixed- Price Construction)". In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied.

(1) The weather experienced at the project site during the contract period must be found to be unusually severe; that is, more severe than the adverse weather anticipated for the project location during any given month.

(2) The unusually severe weather must actually cause a delay to the completion of the project. This delay must be beyond the control and without the fault or negligence of the Contractor.

b. The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

MONTHLY ANTICIPATED ADVERSE WEATHER DELAY

WORK DAYS BASED ON (5) DAY WORK WEEK

JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC

11 8 6 5 6 5 5 4 4 4 5 8

c. Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more on the Contractor's scheduled work day. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph b. above, the Contracting Officer will convert any qualifying delays to work days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the clause entitled, "Default (Fixed-Price Construction)".

d. The anticipated adverse weather work days listed above are based on days with precipitation greater than 0.1 inch and/or maximum temperature below 32 degrees F.

The numbers shown represent the number of work days (not calendar days) normally expected to have these particular weather conditions based on historical data obtained from the "Climatography of the United States No. 20". The actual number of days will vary. This information is furnished for computation of possible time extensions due to weather delays and is not intended to imply that no work can be done on these days. The Contractor shall make his own determination of the effect of these conditions on his operations under this contract, and schedule his work accordingly.

00800-8 WORK PERFORMED BY CONTRACTOR

Within ten (10) days after award of the contract, the successful bidder will be required to furnish a description of the work which he intends to perform with his own organization, the percentage of the total work this represents, and the estimated cost thereof.

00800-9 CONTRACTOR QUALITY CONTROL

Section 01 45 01, USACE QUALITY CONTROL, of this specification requires that the Contractor's Quality Control System Manager or person responsible for Contractor Quality Control complete the Corps of Engineers' "Construction Quality Management for Contractors" course not later than 90 days after receipt of the Notice to Proceed. The course consists of approximately 12 hours of classroom instruction and is offered periodically by the Pittsburgh District. For additional information on scheduling and location of the training, contact Theresa Bon Anno, U.S. Army Engineer District, Pittsburgh, Upper Ohio Area Office, 3510 Grand Ave., Pittsburgh, Pennsylvania 15225, telephone (412) 395-7677.

Certification of course completion is valid for 5 years. Completion of training offered by other Corps of Engineers Districts will be acceptable provided a valid certification is presented.

00800-10 COPYING, DISSEMINATION OR DISTRIBUTION OF INFORMATION.

Those who disseminate information contained in the solicitations and/or drawings must ensure that the recipients have a legitimate need for the information and maintain a record of each recipient. Legitimate need means recognized business entities seeking to do business, or having business, with the Government as prime contractors, subcontractors or suppliers.

You shall maintain a record of the following information on each recipient: Business name and address, DUNS Number and IRS Tax ID Number, and name and telephone number of person receiving the information.

00800-11 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE

(a) This special contract requirement does not apply to terminations. See 52.249-5000, Basis for Settlement of Proposals, and FAR Part 49.

(b) Allowable cost for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a contractor or subcontractor at any tier shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor's accounting records, costs for that equipment shall be based upon the applicable provisions of EP 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region I. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the contracting officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.

(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36, Rental Costs. Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.

(d) When actual equipment costs are proposed and the total amount of the pricing action exceeds the SAT, the contracting officer shall request the contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data shall be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.
