AMENDMENT 0001
SPECIFICATIONS
Specifications and drawings are incorporated into the solicitation and are posted at www.fbo.gov as separate files.
Q1. Will the Corps shut off the outside gate during the work?
A1. Due to work on the main channel, no gate can be closed during the Back Channel Right Abutment work. An estimated gate schedule is shown in the specifications at the end of section 01 11 00. Gate 10, the closest gate to the right abutment will be restricted as much as possible but as the river elevation rises, so will the gate.
Q2. Can the scour rock at the base of the abutment be placed in the river?
A2. Drawing S-1120 states that the future work will have "reused derrick stone." As long as the scour stone is acceptable per section 35 31 19, the stone can be placed in a location that is approved by the contracting officer.
Q3. Special Provision 01 11 00, Paragraph 1.5.3.1 defines the Ordinary High Water Level (OHWL) as elevation 703.8. The last paragraph of this section requires the contractor to obtain all permits for placing fill material below the OHWL. Does this requirement include the Incremental Pre-Excavation and Backfill below Normal Pool (elevation 692.0) shown on Sheet S-3124 of the Contract Drawings?
A3. No, a permit does not need to be obtained for permanent work efforts below the OHWL.
The Government has a Section 404 permit from the state. If a contractor proposes to construct any temporary moorings/ramps/etc in the river, then he is responsible to get the additional permits then.
http://www.fbo.gov/
Q4. Section 00 41 00, Bid Schedule, Item 0006 includes 228 LF of New Fence, 1 each 12-foot and 24-foot wide double swing gates and 2 each 6-foot wide personnel gates. Section 01 22 00.00, Paragraph 1.1.6 indicates that there is 143 LF of New Fence, 1 double swing entrance gate and 1 personnel gate. Please review and clarify this discrepancy.
A4. Section 01 22 00.00, Paragraph 1.1.6 will be revised to indicate 228 LF of New Fence, 1 each 12-foot and 24-foot wide double swing gates and 2 each 6-foot wide personnel gates.
Q5. Section 01 22 00.00, Paragraph 1.1.10 references a Lump Sum Bid Item 0049 for Project and Safety Signs. This Bid Item is not listed on the Bid Schedule in Section 00 41 00.
A5. The Bid Item 0049 will be added to the Bid Schedule.
Q6. The solicitation allows for 450 calendar days (approximately 15 months) to complete the work. The bid quantity for Bid Item 0004, Monthly Progress Images is only 9 Months.
A6. Bid Item 0004, Monthly Progress Images will be revised to be 15 months.
Q7. The work required in Special Provision 13 50 00 involves installing 2 digital tilt meters, taking initial readings every 7 days over a 30-day period and then taking readings every 7 days during excavation work. The personnel requirement is to provide a full time on-site instrumentation coordinator for the life of the contract. Do you really intend to pay for a full time instrumentation coordinator for this work?
A7. This will be revised to the following: The On-Site Instrumentation Coordinator shall be employed at the site during the time the instrumentation is being installed. It is permissible for the CQC-SM to perform the collection and reporting as long as they are adequately trained to do so.
Q8. Division 1 - section 01 11 00. Can you please provide the phone no. for Mr. Bisbey?
A8. The cell phone number for James R. Bisbey is 412-812-5479.
Q9. Division 1 - section 01 18 00. Can you please provide the name and phone no. for Contact at Robinson Twp Municipal Authority?
A9. Phone number for Robinson Township Municipal Authority is 412-264-9520.
Q10. Division 2, section 02 41 00, paragraph 1.9.5 states that the contractor is to remove and dispose or re-Iocate existing debris in the Temporary Work Area Easement. At the prebid meeting on June 30, 2009 it was stated that the contractor will coordinate with the property owner to remove the debris and box trailers.
In the event the contractor is to dispose of the debris, can the Government provide us with a quantity and a better description of what is to be disposed? Would there be anything within the debris that would require special handling or treatment before disposal?
A10. To clarify, coordination with Mr. Bisby is needed for the placement of the trailers. There is no estimate for the quantity of material to be disposed of but there is no special handling or treatment required.
Q11. Division 2 - section 02 61 13 - Should the contractor assume the contaminated material excavated from the site is non-hazardous? There is a significant difference in handling and disposal costs if the material is hazardous versus non-hazardous.
A11. The contractor can assume that the contaminated material is non-hazardous, according to the HTRW phase II, but this is not a release of responsibility if hazardous material is found. Due diligence must be taken to ensure that excavated material is properly tested and properly disposed based on the testing.
Q12. Will the Government sign the manifests required for disposal of contaminated material?
A12. Yes, the Government will sign the waste manifests.
Q13. Division 3 - section 03 31 01.00 - Paragraph 1.4 states at the Government's option, samples and of aggregate for concrete will be taken and performed. Will the Government pay the costs for this sampling and testing?
A13. A Government representative will perform the testing on the aggregate.
Q14. Division 31 - section 31 6333 - If the contractor encounters obstructions during the micropile installation, and is required to abandon a drill hole, re-Iocate the drilling operation, and re-drill, will he be paid for the work in drilling the initial hole and the time required to re-Iocate?
A14. The drilling for the abandoned hole and the re-drill will be paid at the bid item unit price.
No payment for time will be made.
Q15. Division 35 - section 35 20 23 - If the contractor encounters deep obstructions during the drilling for the pipe and sheet piles, which cannot be penetrated or removed in accordance with the specifications, will he be paid for the time expended in attempting to penetrate the obstruction and the costs of re-design? In the event a re-design is necessary due to deep obstructions, will the Government require a review and approval of the re-design? If so, can you estimate the length of time the process will take?
A15. Payment will be made at the applicable bid item unit prices. No payment for time or re-design will be made. Any re-designs will be required to be reviewed and approved. The Government will expedite the review as quickly as possible upon submission of all applicable information.
Q16. Due to the complexities of the logistics of this project, would it be possible to postpone the bid date to July 30, 2009?
A16. The Government has obligations to meet for this fiscal year for the American Recovery and Reinvestment Act so the bid date can not be postponed.
Q17. Lump Sum Bid Item 0026 is for cleaning out existing weep holes. Special Provision 01 22
00.00 10, Section 1.1.8.1 states that weep holes are shown on the plans. The sections on sheets S- 3128 and S-3133 show weep holes, but none are in shown on the elevation views of the wall.
Please provide a quantity of weep holes that may need cleaned out.
A17. The exact number of existing weep holes has not been confirmed; however, it should be anticipated that four (4) weep holes will have to be cleaned out.
Q18. Please review and clarify the following apparent discrepancy in the earthwork bid items.
* Bid Item 0008 - 1,200 CY: Special Provision 01 22 00.00 10, Section 1.2.4 states this item is for earthwork for work bench behind wall.
* Bid Item 0013 - 960 CY: Special Provision 01 22 00.00 10, Section 1.2.8 states this item is for excavation, loading, hauling and disposal at off-site landfill.
* Bid Item 0014 - 240 CY: Special Provision 01 22 00.00 10, Section 1.2.9 states this item is for loading excavated material, hauling and disposal at off-site landfill.
A18. The Bid Item 0008 quantity is unchanged, as it only relates to work bench earthwork.
The Bid Item 0013 quantity should be changed to 1,004 CY to encompass micropile and anchor drilling spoils (additional 44 CY).
The Bid Item 0014 quantity is unchanged.
Also, refer to response to Question 19 (Q19).
Q19. Is the intent that Item 0008 is for excavation of all materials and Items 0013 & 0014 are for disposal only of non-contaminated or contaminated materials?
A19. Yes, it is the intent that Bid Item 0008 cover the excavation, grading, and related earthwork activities to develop the work bench behind the existing abutment wall, and that Bid Item 0013 and Bid Item 0014 cover the temporary storage and off-site disposition of excess materials from the work bench earthwork, and first drilling of micropiles and anchors (excludes redrilling), whether the excess materials are non-contaminated (Bid Item 0013) or contaminated (Bid Item 0014), recognizing that the material might have to be temporarily stored on site pending the results of analytical testing/chemical characterization.
Special Provision 01 22 00.00 10, Section 1.2.8 should state that this item is for loading excavated material, hauling and disposal at off-site landfill, similar to the language for Section
1.2.9. The excess material should include the drilling spoils from installation of the micropiles and rock anchors.
Q20. How many photographs need to be taken each month for job # W911WN-09-B-0007, Emsworth Back Channel Right Abutment Stabilization?
A20. Typically 25-30 photographs per month for the the thumbnails from which the monthly progress photos are selected.
Q21. Concerning Progress Photographs, Page 3, SD-11 Closeout Submittals. I understand everything about the Electronic Copy. I also understand Thumbnail Hard Copy prints. My question concerns the Glossy Prints of Selected Official Progress Images. How many prints are required per photograph taken and what size prints?
A21. Per Spec Sec 01 32 33, para. 3.1 - a minimum of 10 thumbnails are selected on a monthly basis for submission as the progress photos (8"x10" glossy prints) & 1 copy only needs to be submitted.
Q22. If 8X10 Glossy Prints are required for Closeout Submittals, does the identifying information need to be included on the back of each print?
A22. Per Spec Sec 01 32 33, para. 1.2.2 provides the answer. Identifying information needs to be provided on all photos taken.
Q23. Special Provision 35 20 23, Paragraph 1.5 indicates that the Bid Schedule lists estimated quantities of material to be removed/reused. Bid Item 0045 is a Lump Sum bid item for Remove/Replace Salvaged Rip Rap. Please provide the bid quantity.
A23. We don’t have a quantity for the Remove/Replace Salvaged Rip Rap because it is unknown.

WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
