Performance Work Statement (PWS) Laundry and Dry Cleaning Vision Statement

The contractor shall provide pickup and delivery at designated location as specified in TE 1 Introduction

Laundry and Dry Cleaning contract service is to clean and press textiles, garments, linens, OCIE and other fabrics for Active and Reserve components on a direct or reimbursable basis and is in direct support of organizational health and sanitation requirements and meal preparation attire as it relates to life, health and safety.

1.1 Mission

The Army's installation Laundry and Dry Cleaning Program provides pick-up and delivery at designated locations, washing, drying, pressing, packaging, drop-off, and direct exchange services for Government-owned items for cleaning. This program also provides exchange services for linens and laundry pick-up points. Includes the following: Coordinate and recommend local policy and procedures for the Garrison Commander; Planning for equipment replacement/maintenance at government owed facilities; program accountability for: Blankets, pillows, sheets, pillowcases, mattress covers, bedspreads, tablecloths, special categories, i.e., individual piece rate and DOD reimbursable work, OCIE, Cook and medical non-reimbursable whites; confinement uniforms. Provides dry cleaning services in accordance with environmental OSHA/host nation, and other applicable regulations and policies. Includes providing dry cleaning services, including equipment replacement/maintenance program and accountability for such items as: Flags; bunting; draperies; ceremonial uniforms; funeral detail clothing; and special categories. Includes manpower authorizations, contracts, dry cleaning and laundry specific and support equipment, and the associated costs to provide or make available laundry and dry cleaning services to clean and press textiles, garments, linens, and other fabrics for Active and Reserve Components.

1.2 Background

The Army Sustainment Command (ASC) has provided or made available, Laundry & Dry Cleaning services to clean and press textiles, garments, linens, OCIE and fabrics for active or reserve components on a direct or reimbursable basis. Laundry & Dry Cleaning operations are primarily governed by AR 210-130. ASC provides manpower and contracts for L&DC at specific installations, both CONUS and OCONUS.

1.3 Scope

The Contractor shall furnish labor, supervision, transportation for pickup and delivery services, supplies, vehicles, tools, materials, facilities and equipment (except as specified in this contract as Government-furnished) necessary for the performance of dry cleaning, organizational bulk and piece rate customer laundry services at West Point New York, This contract includes functions, tasks and responsibilities normally inherent to a laundry and dry cleaning facility. The Contractor shall receive, account for, process and return articles tendered for laundry. The Contractor shall establish and maintain a system of records to quantify work performed and shall prepare administrative correspondence and reports incidental to the work covered in this contract. The Contractor shall ensure that only authorized individuals are afforded laundry services and shall operate piece rate services and collect monies from individuals for piece rate cash services. Services shall be performed in compliance with the standards as contained or referenced in this contract. The Contractor shall schedule and manage operations to maximize responsiveness, efficiency and economy to the West Point community.

2 General Requirements

The contractor shall operate and manage the Laundry Distribution and Collection Point Facility for the issue, receipt, requisition, exchange, warehousing, and turn-in of linens in accordance with AR 710-2, DOD 4145-19-R and other regulatory requirements. The Contractor shall pick-up soiled items/equipment from __________ daily by ______ and clean items shall be returned to the location it was received from. The contractor shall maintain hand receipt responsibility for linens in accordance with AR 710-2, DA Pam 710-2-1, AR 735-5, and other regulatory requirements. The contractor shall receive, account for, process and return all organizational and individual articles tendered for laundering. The contractor shall establish and maintain a system of records to quantify all work performed and shall be responsible for the preparation of reports incidental to the work covered by this contract. The contractor shall ensure that only authorized individuals are afforded laundry service. All work and services provided by the contractor shall be performed in accordance with the standards as contained or referenced herein. The contractor shall utilize a mobile app (a computer program to run on a mobile device such as a phone/tablet or watch) platform and a web application (utilizes web browsers for desktop usage) platform for the purpose of ticket submissions and service requests as to capture “real time” data and to facilitate customer requests/completion of services efficiently.

2.1.

FIRE PROTECTION: The Contractor is responsible for establishing and implementing a fire plan for buildings occupied by Contractor personnel in accordance with USMA Regulation 420-3.

2.2.

ACCIDENT REPORTING: The Contractor shall maintain an accurate record of accidents resulting in traumatic injury or death and accidents resulting in damage to Government property, supplies, and equipment. The Contractor shall report accidents in accordance with the requirements of AR 385-40. Notification must be made to the COR and to the West Point Safety Office.

2.3.

SAFETY: The Contractor shall safeguard and maintain all Government property as well as provide for the safety and well-being of personnel employed in the administration of this contract. The Contractor shall comply with all rules of safety which are set forth in Public Law 91-596, as amended (Occupational Safety and Health Act), and the following regulations: ARs 385-10, 385-40, 385-55 with West Point supplements thereto; ARs 385-63 and

385-64 and state and federal safety regulations. The Contractor shall take proper safety and health precautions to protect the work, the employees, the public, and property of others and the Government.

2.3.1.

The Contractor shall provide all required Personal Protective Equipment (PPE) as required by all federal, state and local safety regulations.

2.3.2.

The Contractor shall provide Contractor personnel with training and continuing instruction to enable them to conduct their work in a safe manner and to recognize and report hazardous conditions. Training shall include instructions in safe practices, proper use, care and maintenance of tools and equipment, reporting of all accidents, and individual responsibility for accident prevention. Training records shall be maintained on file subject to review by the KO or designated representative.

2.3.3.

The Contractor shall be responsible for complying with all standards prescribed by OSHA regarding the handling of “blood borne pathogens.” The cost of employee inoculations and medical maintenance as well as any other cost associated with compliance with this OSHA standard shall be borne in total by the Contractor.

2.4.

FILES: The Contractor shall maintain complete and accurate files of all written and electronically produced documentation, records, and reports required under the terms of this contract in accordance with the AR 25-400-2 series. The Contractor shall not allow access to the files by any Government agency, non-Government agency, or individual unless specifically authorized by the KO or designated representative. The Contractor shall make files available to the KO or designated representative upon request. All files will become the property of the Government and shall be turned over to the KO or designated representative, at the completion or termination of this contract.

2.5.

DISCLOSURE OF INFORMATION: Performance under this contract may require the Contractor to access data and information proprietary to a Government agency, another Government Contractor, or of such nature that its dissemination or use other than as specified in this performance work statement would be adverse to the interests of the Government or others. Neither the Contractor, nor Contractor personnel, shall divulge nor release data or information developed or obtained under performance of this work statement, except to authorized Government personnel or upon written approval of the KO. The Contractor shall not use, disclose, or reproduce proprietary data that bears a restrictive legend, other than as specified in this work statement.

2.5.1. Disclosure of information regarding operations and services of the activity to persons not entitled to receive it, or failure to safeguard classified information that may come to the Contractor (or any persons under the Contractor's control) in connection with work under this work statement, may subject the Contractor, Contractor's agent, or employees to criminal liability under Title 18, Sections 793 and 798 of the United States Code. Neither the Contractor nor the Contractor's employees shall disclose or cause to be disseminated, any information concerning the operations of the activity which could result in, or increase the likelihood of, the possibility of a breach of the activities' security or interrupt the continuity of its operation.

2.5.2. The Contractor shall direct to the KO or designated representative, all inquiries, comments, or complaints arising from matters observed, experienced, or learned as a result of, or in connection with the performance of this contract, the resolution of which may require the dissemination of official information.

2.6.

SMOKING: The Contractor shall comply with DOD Directives, Army regulations and West Point Policy Memorandum 17-05, which establish uniform policies governing smoking within Department of Defense facilities.

2.7.

RECYCLING PROGRAM: The Contractor and its employees will comply with New York State Law, Orange County Law No. 2 of 1989 and 2003 update, DoD Inst 4715.4 Pollution Prevention, Executive Order 12873, and GC Policy dated 10 June 2004. The Contractor shall utilize the Government provided containers for co- mingled and paper products. Bulk cardboard items shall also be stacked neatly and will be collected per the appropriate collection schedule. The collection of paper, co-mingle and cardboard will be accomplished by the Government. All other recycling shall be accomplished by the contractor IAW established guidelines.

2.8.

SOP PROCEDURES: The Contractor shall provide the KO within thirty (30) calendar days of contract award, a complete manual of Standard Operating Procedures (SOP), for review and approval. The SOP manual will include as a minimum but shall not be limited to the following:

Administrative Procedures.

b.

Supply and Procurement.

c.

Quality Control Plan.

d.

Accident Reporting.

e.

Safety.

f.

Fire Evacuation Plan for Bldg. 845 and for call office in Bldg. 745.

g.

Physical Security Plan.

h.

Key and Essential Personnel.

i.

Energy Conservation Plan.

j.

Environmental Pollution/Hazardous Waste Area.

k.

Contingency Plan for Labor Disputes, Contractor’s Ability to Perform.

l.

Sexual Harassment Policy.

m.

Key Control Plan.

n.

Wash Formulas and Chemicals.

2.8.1. LOCATIONS AND HOURS OF OPERATION: The Contractor shall establish work schedules which provide adequate staffing to meet all requirements of this contract. At a minimum, services shall be provided during the hours specified for each of the below listed locations. Operational workloads will vary during months with special events (e.g. football season, graduation, cadet summer training). Adjustments in schedules may be submitted for approval by the Contracting Officer.

*Call offices located in Bldg. 745/845 will be closed on home football game days (normally Saturdays), approximately six times between 1 September and 30 November each year. Call offices will also be closed on both Graduation and Reception Day. Hours of Operation for all facilities and functions may be changed with COR approval based on customer needs with advance notice of 5 business days.

2.9. The Contractor shall provide laundry and dry cleaning services to authorized individuals and organizations.

All work performed under the contract shall be provided in accordance with the terms and conditions of the contract and AR 210-130.

2.9.1 SPECIAL MISSION REQUIREMENTS: The Contract Officer (KO) shall give estimates and workload data for the Contractor’s scheduling of any anticipated off-schedule workloads. Special situations (e.g. structural fire, accident and rescue operations, civil disturbance, severe weather conditions, and mobilization) may require that the facility operate on an extended basis 24 hours per day.

2.9.2 BACKGROUND INFORMATION: This contract consists of the major categories of L&DC service provided and other functional areas indicated below, but are not limited to the following:

a. Organizational.

b. Medical Treatment Facility (MTF).

c. Individual Piece Rate (IPR) L&DC on a Cash and Carry basis.

d. USCC/USMAPS Cadet L&DC Service.

e. Custodial Service and Grounds Maintenance.

f. Facilities Upkeep and Minor Maintenance.

g. Equipment Maintenance.

h. Operation of Call Offices.

i. Processing of Claims.

j. Pick-up and Delivery Service.

k. Conducting Periodic Cadet and VIP Tours of the Laundry Facility.

l. Retrieval of All Laundry Carts and Garment Racks from Designated Pick Up Points.

2.9.3 OVERTIME: If the Government directs the Contractor to operate beyond the required schedule, then the Government will pay costs. The Contractor shall itemize and invoice for the additional cost(s).

2.9.3.1 West Point is a world-renowned military institution and a national historical landmark. Therefore, items that will be processed contain historical and military significance and require special handling during the laundering process. Such items and handling techniques include but not limited to:

a.

Army-Navy tablecloths and other textile articles are to be hand processed (laundered and finished on hot head steam presses instead of flatwork ironing).

b.

Flacoti rugs (cleaned and combed) c.

Gowns (lace and beaded - hand processed) d.

Oriental and domestic rugs (dry cleaned – maximum size limit 3 feet wide X 5 feet long) e.

Wedding gowns, heirlooms (hand processed)

2.9.4. The Contractor shall clean Organizational Clothing and Individual Equipment (OCIE) for authorized customers.

Performance Standards

a) STD: All items shall be laundered in accordance with customer/manufacturer's instructions.

AQL: 100%,

b) STD: Each item shall be clean (free of soil, spots, water-soluble stains, bacteria, fungi, and other microorganisms, including pathogens or disease-producing organisms), odor and lint free.

AQL: 100%

c) STD: All items shall be thoroughly dried.

AQL: 100%

d) STD: All items turned in for laundry will be completed within forty eight (48) hours.

AQL: 90%

e) STD: Finished products shall be protected from any contaminants that would require items to be re-cleaned.

AQL: 100%

f) STD: All items shall be packaged to provide ease of item count and in a manner to preserve the sanitary condition of the finished work during all phases of handling and transit.

AQL: 100%

g) STD: The contractor shall comply with federal, state, local and Department of Health regulations, and the Center for Disease control (CDC) and the Healthcare Infection control Practices Advisory Committee (HICPAC) regulations.

AQL: 100%

h) STD: All items that fail to meet quality standards shall be returned for re-cleaning at no additional costs.

AQL: 100%

2.9.5. The Contractor shall provide laundry services for linens.

Performance Standards

a) STD: All linens (sheets, pillowcases, mattress covers/pads, bedspreads and blankets) and pillows shall be clean (free of soil, spots, water-soluble stains, bacteria, fungi, and other microorganisms, including pathogens or disease-producing organisms), odor and lint free.

AQL: 100%

b) STD: Bedspreads shall be cleaned in accordance with care label and instructions.

AQL: 100%

c) STD: All items shall be thoroughly dried in accordance with manufacturer care label/instructions.

AQL: 100%

d) STD: All finished flatwork shall be dried, folded and bundled as necessary per customer/mission requirements and requests.

AQL: 90%

e) STD: Finished products shall be protected from any contaminants that would require items to be recleaned.

AQL: 100%

f) STD: All items turned in for laundry will be completed within forty eight (48) hours.

AQL: 90%

2.9.6. The contractor shall provide Dry Cleaning Service

Performance Standards

a) STD: The contractor shall dry clean and press coats and trousers or skirts of Dress Uniforms. AQL: 100%

b) STD: Each item shall be clean (free of soil, spots, water-soluble stains, bacteria, fungi, and other microorganisms, including pathogens or disease-producing organisms), odor and lint free.

AQL: 100%

c) STD: All items turned in for dry cleaning will be completed within forty eight (48) hours.

AQL: 90%

d) STD: All items shall be dry cleaned in accordance with customer/manufacturer's instructions.

AQL: 100%

e) STD: All items that fail to meet quality standards shall be returned for recleaning at no additional costs.

AQL: 100%

f) STD: Finished products shall be protected from any contaminants that would require items to be recleaned.

AQL: 100%

g) STD: At training installations. Dress uniforms shall be dry cleaned and pressed, and returned to the unit representative five (5) business days prior to the unit's scheduled inspection or graduation.

2.9.7. The contractor shall clean Specialty Items

Performance Standards

a) STD: Processing time shall normally be three (3) work days.

AQL: 100%

b) STD: Shall clean specialty items in accordance with customer/manufacturer's instructions.

c) STD: The contractor shall provide the Government representative with professional advice concerning the advisability and possible outcome of drapery processing.

AQL: 100%

d) STD: Draperies accepted by the contractor for processing shall be invoiced by the contractor at the established rate per square foot. This price shall include appropriate processing, ironing, and delivery of the completed work to the requiring organization.

AQL: 100%

e) STD: In the event the contractor recommends against processing draperies but the Government representative insists upon such processing, the contractor shall obtain a written release from the Government representative prior to beginning any processing.

AQL: 100%

2.9.8. The contractor shall provide repairs to individual garments or organizational items.

Performance Standards

a) STD: Missing buttons shall be replaced on garments. Small rips and tears (one (1) inch or less) shall be mended, if possible unless they are identified as being damaged at time of turn-in.

AQL: 100%

b) STD: Thread, material, zippers and buttons of the same type, texture, manufacture quality, color, and colorfastness used for repair and replacement shall match and be equal to or better than those used in the manufacture of the article.

AQL: 100%

c) STD: The contractor at their expense shall repair (minor snags, holes, open seams, replacement of buttons, and repair or replacement of broken zippers) or replace items damaged during the cleaning process. Any existing damages discovered at the time of turn in shall be so noted on the laundry or dry cleaning ticket.

2.10. Non-Personal Services

The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any action constitutes, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Procuring Contractor Officer (PCO) immediately.

2.11. Business Relations - NA

2.12. Contract Administration and Management

(a) Applies to contracts for laundry and dry cleaning services within the United States;

2.12.1. Contract Management

2.4.1.1 The contract shall provide a Project Manager who shall be responsible for the overall management, performance and coordination of this contract. The Project Manager shall act as the central point of contact with the Government. The Project Manager shall have signature authority and the authority to make independent decisions concerning the performance of the contract to include personnel staffing, work beyond normal operating hours and contract negotiations. An alternative shall be designated to act in the same capacity as the Project Manager during his absence.

2.12.1.1 The contractor shall provide the names, addresses, and telephone numbers of the Project Manager and designated alternate to the KO/COR, not later than 10 calendar days prior to contract start date. The contractor shall provide written notice to the KO/COR as specified in Figure 1-1.

2.12.1.2. The contractor's Project Manager and Alternate shall each possess three years specialized experience in supervising, administering and managing a laundry and dry cleaning operation.

2.12.1.3 The Project Manager or Alternate shall be present during normal operating hours. At other times when employees are working the Project Manager shall be on call to handle contractual matters that may arise.

2.12.2 Contract Administration

An individual duly assigned by appropriate authority to administer a contract.

2.12.3 Personnel Administration

The contractor shall provide the following management and support as required. The contractor shall maintain the currency of their employees by providing initial and refresher training as required to meet the PWS requirements. The contractor shall make necessary travel arrangements for employees, if required. The contractor shall provide administrative support to employees in a timely fashion (time keeping, leave processing, pay, emergency needs).

2.13 Contractor Personnel, Disciplines, and Specialties

2.13.1 Contractor Personnel Requirements

2.13.1.1 The services provided under this contract are strictly non-personal in nature. Under this contract, no employer-employee relationship will exist between the Government and the contractor and/or between the Government and the contractor's employees. No contractor employee will be directly supervised by the Government. All individual employee assignment and daily work direction shall be given by the contractor. If the contractor believes any Government action, inaction or communication would create a personal services relationship, or appearance of, between the Government and any contractor employee, the contractor shall promptly notify the contracting officer. Additionally, the contractor shall ensure all contracted employees fully understand the Government contractor relationship. All contractor employees must be fully aware that Government personnel do not have direct authority over contractor personnel. Additionally, all contractor employees must fully understand that only the KO has the authority to change the terms of the contract, only the KO has authority to direct work, and both the KO & COR can provide guidance.

2.13.1.2 The contractor shall provide the appropriate amount of personnel with required training, skills and experience in order to accomplish the work required under this PWS. Additionally, the contractor must exercise due diligence in its hiring practices to validate required skills and ensure employee probity. Moreover, the contractor shall provide its employees with detailed instruction on Government policies and regulations in the areas of safety, security, and environmental compliance as they pertain to the operations specified or implied in this PWS and subsequent modifications. The contractor shall not allow any employee that is not certified, trained or licensed for a particular task to perform such work.

2.13.1.3 The contractor shall ensure all required interviews, background checks, and forms are up to date and on file at all times.

2.13.1.4 The contractor shall develop a training program addressing both Government training and contractor-provided training to ensure contractor personnel are trained and required skills are maintained to accomplish the requirements of this effort. Additionally, the contractor will be advised of mandatory Government sponsored training (e.g., anti-terrorism training) and shall request, in writing, authorization for additional training to be approved by the KO. The contractor shall maintain records of all accomplished training.

2.13.1.5 The contractor shall ensure that all contractor personnel meet the physical requirements to perform the function(s) and task(s) to which they are assigned.

2.13.1.6 Contractor employees or representatives will, at all times, be clearly identified as such and must be distinct from Government personnel. Contractor employees shall not act, advertise, or willfully appear to be Government employees, agents, or representatives. Contractor employees are required to appropriately identify themselves as contractor employees. Contractor employees will be introduced as contractor personnel and must wear contractor furnished identification badges that display the employees name, photograph and company name in a conspicuous place on exterior clothing, above the waist, except when safety or health reasons prohibit. Upon termination of this contract or the employment of any individual, the contractor shall destroy the affected individuals’ badge(s). 2.13.1.7 While on a Department of Defense installation: Contractor personnel shall be appropriately dressed, including individual protective clothing and equipment, for the work to be performed. At no time will contractor employees, or representatives wear or display any clothing, garment or accessory that is offensive, racial, gang-related, otherwise derogatory, or contrary to the Army values. Government rules and policies, regulations, laws, directives and requirements which are in place or issued during the contract term relating to law, order, and security shall be applicable to all contractor employees. Contractor personnel who violate such rules, policies, regulations, laws, directives or requirements may be denied access to the installation, either temporarily or permanently. The contractor shall provide employees with appropriate dress code information.

2.13.1.8The contractor shall not hire any person whose employment would result in a conflict of interest or employment that is prohibited by the latest Department of Defense (DoD) 5500.7.R entitled "Joint Ethics Regulation".

2.13.1.9 The contractor shall not employ persons considered by the Government to be a potential threat to the health, safety, security, general well-being, or mission of the installation and its population.

2.13.1.10Employment of off-duty military personnel or Government civilian personnel is permissible provided such employment does not contravene the policies set forth in DoD Joint Ethics Regulation 5500.7-R as determined by local Staff Judge Advocate (SJA).

2.13.1.11. The contractor shall ensure the contractor project manager and the alternate project manager possess basic proficiency in the English language (reading & writing).

2.13.1.12 Contractor employees having duties on a DoD installation shall not loiter in any work or patron area. Upon completion of their assigned duties on the installation, contractor employees will depart the facility within a reasonable amount of time.

2.13.1.13. The contractor shall establish a drug-free workplace and ensure all employees are drug free.

2.13.1.14 All contractor personnel required to access a Government installation in performance of their duties under this effort must possess a Common Access Card (CAC); non-CAC eligible contractor employees must possess the appropriate Government issued identification for entry to the installation (e.g. DA Form 1602), as required. The Government will issue a CAC to all qualified contractor employees performing work under this contract in accordance with Homeland Security Presidential Directive-12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24, Federal Information Processing Standards Publication (FIPS PUB) Number 201, and the Department of Defense, and Directive Type Memorandum (DTM) 08-003. The Government reserves the right, in its sole discretion, to refuse a CAC to any employee or to revoke one for security or other reasons.

2.13.1.15 Contractors that require a CAC (before CAC issuance) must, at a minimum, have a favorably adjudicated National Agency Check with inquiries (NACI) or an equivalent or higher investigation in accordance with Army Directive 2014-05. At the discretion of the sponsoring activity, an initial CAC may be issued based on favorable review of the FBI fingerprint check and successfully scheduled NACI at the Office of Personnel Management.

2.14 Holidays

The Federal Government observes the following holidays and except for emergencies, 24/7 operations, or as otherwise noted in this PWS or subsequent modifications, Government personnel in CONUS locations (to include Alaska and Hawaii) will not be available on the following days:

2.15.

ADJUSTMENT OF SCHEDULES FOR HOLIDAYS. In cases in which a holiday is declared or celebrated on a Monday through Friday, the schedule of services required by the terms of this contract shall be performed on the next regular workday, (i.e., a normal pickup on Monday for a 72 hour delivery on Wednesday, might be interrupted by a holiday on Monday. In this event, the pickup will be on Tuesday and delivery will be on Thursday).

2.16 Contractor Planning, Resource Management

2.16.1 If the Senior Mission Commander or Installation (Garrison) manager declares an installation closed or road conditions red or black [or otherwise deemed unsafe for routine travel/use] due to inclement weather, the contractor will not pick up or deliver laundry to the installation. The remuneration of contractor employees for lost time due to weather or other allowable causes is at the sole discretion of the company and is not an allowable cost under this effort.

2.16.2 When required and directed by the KO, the contractor shall provide technical support or assistance at customer locations within the LRC area of responsibility. The impact of this additional customer support to current workload / capability must be assessed by the contractor prior to the assistance being provided. If the support or assistance is anticipated to impact cost or mission capability, the contractor must contact the COR prior to performing support or assistance.

2.16.3 The contractor shall ensure that all contractor-generated technical records, reports, files, and other documentation are made available to the KO/COR during the performance of this contract. This contractor shall obtain KO approval before releasing any information that has been stored, generated, or archived related to this contract to the contractors corporate or other off-site offices, to other Government activities or agencies, to other contractors, or to private parties. This restriction does not apply to contractor data needed to properly execute this effort (e.g. man-hour reporting).

2.16.4 The contractor shall report all contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk at: http://www.ecmra.mil.

3 Performance Requirements - See paragraph 2

4 Special Requirements

This section describes the special requirements for this effort. The following sub-sections provide details of various considerations on this effort.

4.1 Security and Safety

4.1.1 Physical Security, Anti-terrorism & Operations Security

4.1.1.1 Neither the contractor nor any of its employees will disclose, or cause to be disclosed, any information concerning operations which could result in or increase the likelihood of the possibility of a breach of the activity's security or interrupt the continuity of operations. Additionally, the INSERT INSTALLATION NME Public Affairs Office (PAO) is the only official spokesperson for the installation. No information regarding performance of this contract will be released to the media without prior approval of the PAO, KO or their authorized representative(s).

4.1.1.2 When securing all non-classified Army property, the contractor will abide by the requirements of AR 190-11, AR 190-13, AR 190-51, AR 190-45, local installation and unit physical security policies, plans and procedures along with all applicable supplements. All contractor physical security plans, policies and procedures will conform to the applicable installation and local ASC Unit plans, policies and procedures.

4.1.1.3 Upon notice to proceed date, the contractor will request and obtain CAC and badges required for personnel to access work locations. Specific contractor security access requirements are outlined in the Contract Security Classification Specification, DD Form 254 and respective Government Trusted Agent (TA) will be responsible for approving and facilitating contractor acquisition of contractor CACs and badges through the contractor Verification System and local security offices. Temporary employees (employed 90 calendar days or less) will be allowed access as long as they have a visitors badge and comply with Installation policy. Once a contractor is no longer eligible to perform work on a contract, the CAC must be turned in to the Government (e.g., TASS trusted agent). CACs cannot be transferred between contracts.

4.1.1.4 As directed by the KO / COR, the contractor will remove, at no additional cost to the Government, any employee who endangers operational or national security. The contractor is reminded that the Government has the right to exclude individuals from its facilities. If this action results in any employee being unable to perform his/her duties, the contractor shall replace him/her at no additional cost to the Government.

4.1.1.5 The contractor employees will comply with applicable installation / facility access including local security policies and procedures (provided by the Government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by the installation Provost Marshal Office, Director of Emergency Services, or Security Office. The contractor workforce will comply with all personal identity verification requirements. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

4.2.

KEY CONTROL: The Contractor shall be responsible for keys provided to the Contractor by the Government. Keys shall not be duplicated by Contractor personnel, nor used by unauthorized Contractor personnel. The Contractor shall implement procedures to insure that keys issued to the Contractor by the Government are safeguarded. The Contractor shall document procedures and usage of the key control register in the physical security plan. As a minimum, all such keys shall be kept in a locked key box in the office of the Contractor. A single individual shall be designated as the Key Control Officer for each work site, building, or group of buildings. The Contractor shall supply the COR or designated representative with a key inventory list for all buildings. At the close of business, the responsible Contractor personnel shall sign the physical security/security check sheet (GSA SF 701 Active Security Checklist).

4.2.1 The Contractor shall report occurrence of misplaced, or lost keys to the COR by close of business the same day the occurrence is discovered, and submit a written report by close of business the next work day. The written report shall provide complete details relating to misplaced or lost keys.

4.2.2 In the event a key is duplicated, misplaced, or lost, all locks and keys will be replaced by the Government. The Contractor shall reimburse the Government for replacement of locks or rekeying required as a result of keys being duplicated, misplaced, or lost by the Contractor. The Contractor shall also reimburse the Government for Government property lost or stolen as a result of unauthorized key duplication, misplaced key, or loss of key by the Contractor or Contractor personnel.

4.3 PERFORMANCE EVALUATION MEETINGS: The Project Manager shall meet with the COR at least weekly during the first month of the contract to discuss performance. Meetings will be held as often as necessary thereafter but not less than once during each quarter of performance under this contract.

4.4 Transition

4.4.1 One week prior to contract start date, concurrent formal inventories shall be performed jointly by the successful offeror and the outgoing contractor. Parties to these inventories shall provide sufficient personnel to perform the inventories.

4.4.1.1 As each area is inventoried, the outgoing contractor and incoming contractor shall reconcile the inventory results. Within 48 hours after reconciliation is completed, the incoming contractor shall review the results of the inventory, and reconciliation thereof. The incoming contractor shall assume direct responsibility for the reconciled on-hand balances on contract start date. Should the incoming contractor take exception to any or all of the balances or the manner in which they were reconciled, a mutual effort shall be made within 5 working days to resolve the conflict. If the conflict cannot be resolved to the contractor's and the Contracting Officer's mutual satisfaction, additional inventories of selected items or of entire areas may be required.

4.4.2 PHASE IN PERIOD: To minimize any decreases in productivity and to prevent negative impacts on additional services, the Contractor shall have personnel on board, during the 30 day phase in period. During the phase in period, the Contractor shall become familiar with performance requirements in order to commence full performance of services on the contract start date (base period commencement).

5 Government Furnished Materials

5.1 GOVERNMENT FURNISHED PROPERTY (GFP) AND SERVICES: The Government shall provide the Contractor the use of certain Government owned facilities (except for the office space retained for Government use), services, equipment, materials and utilities for use only in connection with this contract. All such facilities, equipment, materials, services and utilities will be provided in “as is” condition. Upon completion or termination of the contract, all Government owned property shall be returned to the Government in the same condition as received, except for normal wear and tear. The Contractor shall be responsible for the cost of any repairs or replacement caused by the negligence or abuse by the Contractor.

5.2 PROPERTY: The Contractor shall not use property provided by the Government for any purpose other than in the performance of this contract.

5.3 FACILITIES: The Government will furnish or make available to the Contractor the facilities listed in Technical Exhibit #TBD. The Contractor shall be responsible and accountable for such facilities provided for his/her use and shall take adequate precautions to prevent fire hazards, odors and vermin. Janitorial services for Government furnished facilities shall be provided by the Contractor. Building or room(s) made available by the Government for use by the Contractor shall be used for office, storage or support of this contract only. The Government will not be liable for damage or loss to parts, materials, supplies, or equipment that are stored in the building or room(s). The Contractor shall obtain written approval of the COR prior to making modifications or alterations to the facilities. Modifications or alterations approved by the Government will be made at the expense of the Contractor. The building or room(s) shall be subject to inspection by the Government at all times. At completion of the contract, all facilities shall be returned to the Government in the same condition as received, except for reasonable wear and tear. The Contractor shall be responsible for the cost of repairs caused by negligence or abuse on his/her part, or on the part of his/her employees.

5.4 EQUIPMENT: The Government will provide the Contractor the use of the Government owned laundry and dry cleaning equipment listed in Technical Exhibit #4.

5.4.1.

The Government will replace all Government furnished non-expendable items, which by virtue of fair wear and tear, obsolescence, and or damage are no longer considered serviceable, provided the damage is not due to Contractor negligence, or responsibility pursuant to FAR 52.245-2, Government Property.

5.5 FACILITY EQUIPMENT OPERATION: The Government will maintain the operation of the boiler, steam, water softeners, air compressors, steam traps, and condensate return lines.

5.6 FORMS AND PUBLICATIONS: West Point, Army and Department of Defense forms, regulations and directives will be provided to the Contractor electronically. The contractor is required to use electronically available forms, regulations and directives. Forms or publications that are not available electronically will be furnished by the Government.

5.7 PARKING: The Government will furnish parking spaces for Contractor employees' privately owned vehicles (POV). There is limited parking in the cadet area for the Cadet Laundry and Dry Cleaning Service at Building 745 and parking is not allowed in this vicinity. Parking is allowed within the Central Area and will be coordinated with the COR as to proper procedures.

5.8 SUPPLIES: The Government will not furnish supplies utilized in the performance of this contract.

6. Environmental Requirements

6.1 The contractor shall be knowledgeable of, and comply with, all applicable local, installation, federal and state environmental laws and regulations (note: roads and highways are considered public throughways).

6.1.1 The contractor shall use bio based cleaning products to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer Representative (COR).

6.1.2 The contractor shall ensure their vehicles do not drip fuel, grease, oil or other environmentally hazardous components on the installation. Where dripping occurs, the contractor shall place drip pans to catch the dripping material and discard of it in accordance with 40 CFR Parts 262-268.

6.1.3 The Contractor may generate hazardous waste in the performance of this contract. The Contractor shall perform all work in such a manner as to prevent pollution of air, water and land. The Contractor shall comply with West Point Regulation 200-3, ARs 200-1, 200-2, 200-3, 200-4, and all federal, state and local environmental protection laws, statutes and their implementing regulations pertaining to air, noise and water pollution control and abatement; solid and hazardous waste management, including recycling hazardous material transportation, storage, handling and disposal; spill prevention, control and countermeasures; cultural resource conservation and protection; wetlands; soils and geology; vegetation; threatened and endangered species and other protected plants and wildlife; and, energy conservation. Questions regarding specific requirements may be directed to the West Point Environmental Management Division (EMD) at (845) 938-3224. All environmental protection matters shall be coordinated with the West Point EMD. The Contractor shall comply with newly enacted environmental laws and their implementing regulations, which become effective during the course of this contract. The contractor shall utilize the EESOHI web based platform from the Air Force website to monitor inventory and usages of all reportable hazardous material IAW Army, Air Force and USMA policies and regulations.

6.1.4 The Contractor shall provide to the Government a single point of contact (POC) on hazardous material issues. See Technical Exhibit #TBD.

6.1.5 All of the facilities operated by the Contractor may be inspected on a no-notice basis for compliance with the terms and conditions of this contract pertaining to environmental, energy, and natural and cultural resources; and federal, state and local environmental regulations. The Contractor shall provide access for inspections when required by the KO or designated representative.

6.1.6.

Citations against GOCO facilities for non-compliance with environmental standards are a matter for resolution between the installation representatives and the issuing office of the Environmental Protection Agency (EPA). Fines or penalty charges associated with citations issued by federal, state, or local officials due to faulty operation or maintenance practices on the part of the Contractor, except when incurred as a result of compliance with specification provisions of the contract or instructions in writing from the KO, shall be paid by the Contractor and shall not be considered an allowable cost.

6.1.7 The Contractor shall control all discharges, leaks, spills and disposal of fuels, oils, bitumen, calcium chloride, acids, Perchlorethylene or harmful materials, both on and off Government premises and shall comply with applicable federal, state and local laws, including West Point Spill Prevention, Control and Countermeasures Plan (SPCCP), and Installation Spill Contingency Plans (ISCP), concerning spill prevention and control; spill response; and spill notification.

6.1.8 The Contractor shall monitor vehicle parking, equipment storage sites and hazardous material and/or waste handling, and storage areas included in the spill prevention and response section of the plan at least daily, and while in use; a record of all such inspections shall be retained on-site.

6.1.9 The Contractor shall have available at each work site where hazardous materials are used, the applicable Material Safety Data Sheets (SDS). All SDS shall be readily available to employees and the KO or designated representative. The Contractor shall ensure employees are trained in the proper handling of hazardous materials to be used in accordance with OSHA and the West Point Hazard Communication Program.

6.1.10 The Contractor shall provide the Hazardous Material Management System (HMMS) Manager, LRC, with a listing of applicable SDS for the contract period. The Contractor shall ensure that all hazardous material containers are clearly labeled as to contents. All hazardous materials shall be stored in accordance with requirements in the SDS and installation Fire, Safety and Environmental Regulations. The Contractor shall ensure that materials stored together are compatible. Flammable materials shall be stored in properly marked, fireproof lockers or other approved container. Disposal of pails, drums, or other containers, which contain or did contain hazardous materials shall be disposed of in accordance with federal, state and local regulations.

6.1.11 The Contractor shall ensure that hazardous waste generated as a result of operations on West Point are properly manifested, transported, stored, inspected and disposed of in accordance with federal, state and local regulations and West Point Reg. 200-3. Hazardous waste shall be stored in a secure, clearly marked area approved by the COR. All hazardous waste handling and storage areas shall be inspected at least weekly, and daily during use for leaks and spills; container integrity and labeling; integrity of spill containment devices; inspection and other records; and equipment operational status. All such inspections and corrective actions taken shall be documented as outlined in West Point Reg. 200-3. Hazardous materials and hazardous waste training records shall be maintained on-site.
