QUESTIONS & ANSWERS
Q1. Should vendors include the cancellation fees in pricing, or should we add another CLIN?
A1. This Amendment adds another CLIN in each Period of Performance for early termination fees.
Q2. Will you provide a tax exemption form?
A2. The Federal Government is tax exempt, please contact the state’s IRS for more information regarding the exemption.
Q3. Will there be an allowance to adjust the rates if per diem rates are increased in the option years?
A3. No, this is a firm-fixed-price contract. FY24 GSA per diem rates are applicable.
Q4. If the hotel has a full kitchen that includes a two-burner stove without an oven, would this be acceptable?
A4. No. We need a full kitchen with burners and oven. A countertop convection oven and in-unit 2 burner stovetop will be acceptable; however the preference is a full oven.
Q5. Will the same guests be staying in the same room for the entire year? Or will there be different guests checking in and out every month? Is there a stay pattern?
A5. It is the intent to have the same occupant occupay the dwelling for the entire year; however it is mission dependent and is possible for the occupant or duration to change.
Q6. Are we able to utilize more than one hotel for this request?
A6. Yes, as long as it’s within our acceptable radius.
Q7. Washer and dryer – required in the single dwelling or on the premises?
A7. On premises
Q8. Pet friendly – is the US Government paying for the pet deposit and monthly pet rental fee?
A8. Individual occupants will be personally responsible for the deposit and pet rental fee.
Q9. Safe – is it mandatory as most apartments do not have them?
A9. Not for an apartment, but yes for a hotel.
Q10. Within a 5-mile radius of 103 Soldier E, Salt Lake City, Utah 84113, the lodging needs identified are extremely limited with the 5-mile radius, will you consider expanding the radius?
A10. This amendment extends the radius to 10 miles.
Q11. Housewares – there is no listing of the type of housewares needed, (as there is no mention regarding housekeeping services), it would seem likely cleaning aids would be included in the housewares listing, will you provide a listing?
A11. Pots & pans, glasses, plates, and utensils.
Q12. Most Apartment Rental Companies require a background check of all apartment occupants prior to issuing a lease, will that information be provided to the awarded vendors?
A12. No, this is a contract, and the government is liable for the contract as agreed to.
Q13. Will the occupant be responsible for cleaning the unit and all linens (bedsheets, towels, etc.)? Is a cleaning service needed for each unit if so, how often?
A13. The individual occupant will be personally responsible for cleaning the unit and all linens.
Q14. Will the government pay a security deposit amount for damages for each unit? If not, then who is responsible for paying the security deposit?
A14. Individual occupants will be personally responsible for the security deposit.
Q15. Does fully furnished mean TV?
A15. No, a TV is not mandatory.
Q16. By enclosed parking do you mean covered parking or gate code access parking?
A16. Either is acceptable.
Q17. When is the rent payment due to the landlord? Is it paid in full ahead of time for all units rented or is it paid monthly? If monthly, then what date will payment be made?
A17. Monthly. Advance payments are not authorized. See solicitation clause 52.212-4 Contract Terms and Conditions – Commerical Products and Commerical Services, paragraph (i) for payment terms.
Q18. Does a fully furnished dwelling mean the living room is furnished with a sofa and table? Bedroom furnished with bed, etc. If so, please specify what is required for these rooms?
A18. Yes. Living room should include a sofa and table. The bedroom should include a bed, clothes dresser, and bedside table. Kitchen should include a table and chairs.
Q19. What is the invoicing process?
A19. Refer to solicitation clause 252.232-7006 – Wide Area Workflow Payment Instructions.
Q20. If there is extensive damage after the lease ends, who is responsible for paying for repairs?
A20. The government is self-insured and responsible for any damages.
Q21. Will a rooming list be provided in coordination with the 30-day dwelling stop/start policy?
A21. Yes.
Q22. Is there flexibility on the closet space requirements? Could this be reduced to 20sq ft with a preference for those that exceed this?
A22. This amendment updates the closet space requirements.
Q23. Can you clarify the stop and start policy? We will sign 12-month leases for all units requested with local apartment communities, does the Army anticipate cancelling units before the 12 months is up? If so, will the Army provide vendors with an early termination fee?
A23. Yes, we would have an individual occupant stay for 12 months. However, due to mission requirements people can change positions and need to terminate the lease early. An early termination fee is reasonable.
Q24. To confirm, this request is for 4 - 14 single occupancy rooms per month.
A24. Yes, This is an Indefinite Delivery / Indefinite Quantity (IDIQ) contract and the quantities are estimates only.
The minimum guarantee is 4 dwellings for 365 days each per solicitation Supplemental Information section, paragraph 5. Also refer to solicitation clauses 52.216-18 – Ordering, 52.216-19 – Order Limitations, and 52.216-22
– Indefinite Quantity.
Q25. Is this a new requirement or is there a current incumbent?
A25. The incumbent contractor is MDR Services under Contract Number is W911SA22D1005 with a total estimated value of $719,506.25.
Q26. The solicitation is posted under NAICS code 531110 which is defined as “Lessors of Residential Buildings and Dwellings” usually associated with leasing apartments, however the description of services needed states single occupancy dwelling, is this a request for 1-bedroom apartments or hotel rooms? Will a studio dwelling or condominiums be acceptable?
A26. 1-bedroom apartments, studio dwellings, condominiums and/or hotel rooms are acceptable if they meet the requirements.
Q27. What is the move in/check- in date?
A27. Anticipated start date is 1 October 2023
Q28. Why is this contract being renewed?
A28. Mission Requirements
Q29. Can 30-day notice to stop lodging be given on any existing unit prior to September 30, 2024?
A29. The minimum guarantee for the first year is 4 dwellings for 365 days.
Q30. When considering how the awarded priced will be accepted, will the decisions be limited to the per diem rate thresholds for area hotels or in line with negotiated rates associated with apartment rentals?
A30. This amendment updates the Solicitation Purchase Description: Room (dwelling) rate cannot exceed the Joint Travel Regulation (JTR) per diem rate for zip code 84113.
Q31. If we acquire apartments under an annual lease, there is no clause that allows termination with 30 days’ notice, nor will it be allowed to start again after terminating. Since if it is stated, the government will only pay for units that are occupied can the Government guarantee that the lease will be fulfilled for the 1-year lease?
A31. This amendment removes "The Government only pays for the units that are utilized if the proper written 30-day notice is given" in the Purchase Description. This amendment adds a CLIN for early termination fees if a replacement person is not found to finish out the lease. Otherwise, when one person leaves, the replacement will take over that same dwelling.
Q32. We would be submitting a proposal as a third-party vendor; however, Apartment Rental Companies sign leases for apartments not Teaming Agreements, we do know hotels are willing to sign Teaming Agreements. Will the Government accept a copy of the signed lease as a testament that our company has secured the apartments in lieu of a Teaming Agreement?
A32. A signed lease is acceptable.
Q33. (1) Para 5 of Supplemental instructions at the top of page 4 on the Solicitation states; “This requirement will be awarded as a firm-fixed-price”. (protects GOV that vendor cannot change price, protects vendor that task order amount will remain unchanged) and (2) Purchase Description on the bottom of page 6 states; “The Government only pays for the units that are utilized if the proper written 30-day notice has been given.” For our industry these 2 statements can be seen as contradictory. E.g. if firm fixed price, when a task order is issued for 4 units at $128 for 365 days at a value of $186,600 on October 1; then no matter when the GOV gives notice whether its 2 days or 2 months into the contract and no matter how much notice they give, the billable amount to the GOV will remain $186,600 as the Task order describes. Your line from the purchase description contradicts this firm fixed price award structure. Please advise if my example describing how firm fixed pricing is incorrect and what is the correct way to interpret those 2 statements together? This is valuable info to have because if it is incorrect, it is industry standard to have break lease fees in the amount of 2 months’ rent and those will have to be built into the rates.
Q33. (1) This is a firm-fixed-price IDIQ and a firm-fixed-price delivery order will be issued for the minimum guarantee of 4 dwellings. If additional dwellings are needed, a separate, firm-fixed-price delivery order will be issued when the need arises at the prices established in the basic IDIQ. (2) The Purchase Description is changed to remove the statement, "The Government only pays for the units that are utilized if the proper written 30-day notice has been given." A separate CLIN has been added to each ordering period to allow for pricing of early termination fees.
