QUESTIONS & ANSWERS

Q1) Who are the current Contractor and/or Incumbent?

A1) The incumbent/current contractor is Amerigas.

Q2) Are they a large or Small Business (SB)?

A2) The incumbent is a Large Business.

Q3) What is the Contract # for the expiring requirement?

A3) W911SA15P0134

Q4) When was the current contract awarded?

A4) The current contract was awarded on May 5, 2015.

Q5) How was a quantity of 15,000 calculated on Line Item 0003 (Phase In)?

A5) The quantity will be changed per Amendment 0001 from 15,000 Job to 1 Job.

Q6) How was the quantity of 30 calculated on Line Item 0005, 0007, 0009, 0011 (Set/Move/Removal of LP Tanks)?

A6) The quantity was calculated based on the historical amount of set/move/removals of tanks for a given option year.

Q7) How was the quantity of 7,500 calculated on Line Item 0012 (Phase Out)?

A7) The quantity will be changed per Amendment 0001 from 7,500 Job to 1 Job.

Q8) What is the current price?

A8) The current price for Option Year 4 is $302,399.00.

Q9) Why is this RFQ NOT Set Aside as for Small Business?

A9) The non-manufacturer rule applies to this requirement. Therefore, if set aside for a small business, the small business would have to manufacture or produce the LP or it would have to come from a small business manufacturer/producer. However, when conducting market research, in analyzing the business capabilities, none of the small businesses we found reflected the capability of producing/manufacturing propane. However, these small businesses appear to be propane distributors. If this RFQ was set aside for small businesses, the propane would HAVE to be produced/manufactured by the small business or another small business. But if we solicit this on an unrestricted basis, then the non-manufacturer rule does not apply and a small business would be able to quote even if they do not manufacture/produce the LP.

Invoices for orders placed by the ordering officer will be submitted directly to the ordering officer.

However, use of WAWF to create and accept receiving reports is mandatory when the GPC is used as a method of payment against a contract. In order to ensure proper routing of contract transactions paid with the GPC, use the code "CRCARD" in the Pay Official/DoDAAC field. The contractor is required to generate a receiving report in WAWF, and the Government acceptor is required to accept the receiving report in WAWF. The Cardholder is required to verify that acceptance has occurred in WAWF prior to submitting the invoice to the Certifying Official for certification.

21. INFORMATION FOR EVALUATION

This section supplements clause 52.212-1 and 52.212-2 which is included elsewhere in this request for quotes. The Government intends to evaluate offers and award a contract without discussions with offerors.

Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

In case of discrepancy between a unit price and an extended price listed in the Item number, the unit price will be presumed to be correct, subject, however, to correction to the same extent and in the same manner as any other mistake.

This solicitation shall be evaluated by awarding to the quote that is technically acceptable and the lowest price.

TECHNICAL FACTOR:

**In response to the solicitation/request for quote for this requirement, Offerors shall submit supporting documentation explicitly showing how the salient features/specifications/statement of work and contract terms and conditions will be met. Supporting documentation can be documents such as brochures, pamphlets, screenshots, etc of the proposed item that specifically lists the salient features/specifications/statement of work, and can be compared to the salient features/specifications/statement of work in the solicitation.

Evaluation –For Offers evaluated in order of price (beginning with the lowest priced offer, and working up in order of price (lowest to highest), as required, if the low is found not to be technically acceptable): not all offers will be technically evaluated unless required, as deemed by the Contracting Officer; each item in the below Technical Criteria Table will receive one of the adjectival ratings defined below. Any criterion that receives “U” rating will result in an overall unacceptable rating for the factor and the offer(s) is/are not eligible for award.

ADJECTIVAL RATING DEFINITION

Acceptable (A) Quote clearly meets the minimum requirements of the solicitation.

Unacceptable (U) Quote does not clearly meet the minimum requirements of the solicitation.

TECHNICAL CRITERIA A or U Meets all technical salient features/specifications/statement of work identified in the solicitation.

PRICE FACTOR:

Submission Instructions – Offeror shall submit a fully completed SF 1449, Pricing Schedule, or acceptable alternative as identified in 52.212-1 or elsewhere in the RFQ.

The agreed upon items and quantities will be multiplied times their respective unit prices found in the RFQ.

Price will not be assigned an adjectival rating; and will be evaluated to determine if the offeror quoted price is fair and reasonable. The government may determine that an offer is unacceptable if prices are significantly under or over market pricing. Price shall be evaluated at estimated quantities multiplied times their respective unit price, not to exceed two (2) decimal points.

In accordance with FAR 52.217-8, the government will evaluate its option to extend as part of price evaluation. Offerors are required only to price the base and option periods. The Government may choose to exercise the Option to Extend at the end of any performance period (base or option periods), utilizing the rates of that performance period.

In accordance with FAR 52.217-6, the government will evaluate an increase of 30% quantities for the total value of the contract as part of the price evaluation. Offerors are required only to price the base and option periods. Offerors shall not submit a price for the 30% increase.

Unrealistically Low Prices: Unrealistically low quoted prices, initially or subsequently, may be grounds for rejection for this solicitation.

22. ALTERNATE DISPUTES RESOLUTION: In furtherance of Federal policy and the Administrative Dispute Resolution Act of 1990 (ADR Act), Public Law 101-552 and FAR Clause 52.233-1, Subparagraph

(d) (2) (1) (B) (2), the Contracting Officer will try to resolve all post award acquisition issues in controversy by mutual agreement of both parties. Interested parties are encouraged to use alternative dispute resolution procedures to the maximum.
