3. Site Visit. The Government will not be conducting a site visit due to the nature of the entitled requirement. However, if industry dictates that a site visit is needed to adequately assess the requirement at hand, then proposers have 5 calendar days from solicitation release on FBO to request a site visit be conducted. If a site visit is to be conducted, all questions incorporated from the site visit are to be submitted in writing no later than one business day following the site visit. Answers and clarification of contract requirements will be incorporated into an amendment to the solicitation and posted to FBO for viewing by all potential offerors. Industry questions and answers may or may not have a bearing on the substantive content of the solicitation or the contract requirements, and it should not be assumed that the date set for receipt of proposals will be extended.
B. General Instructions
1. The basis of award for this requirement is Lowest Priced Technically Acceptable.
Offers will be evaluated using the criteria under Addendum to FAR Clause 52.215-1, Instruction to Offerors. 5. If an offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise deemed unsound, the offeror shall immediately notify the KO in writing with supporting rationale. 52.209-7 -- Information Regarding Responsibility Matters (Jul 2013)
EVALUATION FACTORS FOR AWARD
M. EVALUATION FACTORS FOR AWARD
1. Basis for Contract Award
a. This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR) 15.3, Source Selection, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). Award will be made to a single offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the Lowest Priced offer with an Acceptable or neutral past performance evaluation rating.
b. Trade-offs between cost/price and non-cost/price factors are not permitted. Unreasonably high, unbalanced, inaccurate or incomplete price proposals, may be the grounds for eliminating a proposal from the competition. The Government will evaluate proposed prices for reasonableness using price analysis techniques. Proposed prices evaluated as unreasonable may be grounds for eliminating a proposal from the competition.
c. Award for All of the Work. The Government intends to award one (1) contract as a result of this solicitation. Offers received for less than the stated number of items listed in the Schedule of Proposed Coefficients (Section B-Supplies or Services and Prices of this solicitation) will be considered ineligible for award. As set forth in FAR 52.215-1 (f)(4), the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a), Clarifications and award without discussions). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In the event that discussions are held, a competitive range determination will be made. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
2. Evaluation Criteria
a. Evaluation criteria consist of factors. The proposals will be evaluated under three (3) evaluation factors:
Factor 1: Technical
Subfactor A - Management Approach Subfactor B - Experience
Factor 2: Past Performance Factor 3: Price
b. FACTOR 1 – TECHNICAL
The Government’s technical evaluation team will evaluate the technical proposals on an “Acceptable” or “Unacceptable” basis, assigning one of the ratings described below for each subfactor. Any subfactor evaluated as “Unacceptable” will render the entire Technical proposal “Unacceptable” and, therefore, in eligible for award. The Government will consider for award only those proposals determined to be technically “Acceptable”.
TECHNICAL RATINGS
Rating Description
Acceptable Proposal clearly meets the minimum standards and requirements of the technical factors and subfactors as stipulated within the solicitation.
Unacceptable Proposal does not clearly meet the minimum standards and requirements of ALL the technical factors and subfactors within the solicitation.
b.1 SUBFACTOR A – MANAGEMENT APPROACH
The Offeror must demonstrate the ability to manage multiple work efforts of relevant size and complexity at multiple sites often with different subcontractors. The Offeror’s proposal must demonstrate management processes addressing selecting subcontractors, awarding contracts, subcontract administration, management, and performance of services, scheduling, and correction of defects prior to, and after Government review. Proposal must address Offeror’s plan to provide a Program Manager and Project Managers for each TO.
SUBFACTOR A – MANAGEMENT APPROACH
Acceptable
1. Proposal clearly demonstrated the Offeror’s ability to structure its organization to allow for successful performance and demonstrates that the Offeror has the requisite qualifications and experience to perform under the contract and on future task orders.
2. Proposal clearly demonstrates the Offeror’s ability to successfully respond to Requests for Proposals (RFP), warranty work, and Daily Report as well proposal preparation, subcontract management, surveillance of work, acceptance, rejection, documentation, and resolution of deficiencies, trend analysis and shall include corrective actions, and interface with Government inspectors and engineers at each stage of construction.

8. Proposal clearly demonstrated the Offeror’s ability to provide a Project Manager with at least five years of demonstrated experience with the type of work found in this requirement to include experience managing the disciplines and multiple projects simultaneously.
Unacceptable Proposal does not clearly demonstrate all items (1-8) in above Acceptable criteria.
b.2 SUBFACTOR B – EXPERIENCE
The Government will evaluate the Offeror’s experience on an acceptable/unacceptable basis and assign one of the ratings described below based on the criteria listed.
SUBFACTOR B – EXPERIENCE RATINGS
Proposal clearly demonstrates the Offeror has experience in completing multiple projects simultaneously utilizing a variety of construction disciplines that are comparable in magnitude of construction to those projects expected under this contract.
Unacceptable
Proposal does not clearly demonstrates the Offeror has experience in completing multiple projects simultaneously utilizing a variety of construction disciplines that are comparable in magnitude of construction to those projects expected under this contract.
c. Factor 2 - Past Performance. The Past Performance evaluation will assess the offeror’s probability of meeting the solicitation’s requirements as indicated by that offeror’s record of past performance. Past Performance is assessed at the factor level after evaluating aspects of the offeror’s recent past performance and focusing on performance that is relevant to the services being procured under this solicitation. Offerors are cautioned that in conducting the performance risk assessment, the Government may use data provided in the offeror’s proposal and data obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems and State Department Watch Lists. Past performance areas of evaluation include:
- Business Relations
- Quality of Service
- Schedule
- Cost Control
- Customer Satisfaction
(1) Each offeror will receive a performance confidence assessment rating based on the Offeror’s recent past performance, focusing on performance that is relevant to the Contract requirements.
(2) Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past 6 years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.
(3) Relevancy Assessment. To be relevant, the effort must be similar in nature of work, size, and complexity. The Government will conduct an in-depth evaluation of all recent performance information obtained to determine if it is the same or similar in nature of work, size, and complexity to the services/products being procured under this solicitation. A relevancy determination of the offeror’s (including joint venture partner(s) and major and critical subcontractor(s)) past performance will be made. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated. In establishing what is relevant for the acquisition, consideration should be given to what aspects of an offeror’s contract history would give the most confidence that the offeror will satisfy the current procurement. The past performance information provided in the proposal and obtained from other sources will be used to establish the relevancy of past performance.
(4) The Past Performance Evaluation Team will review this past performance information and determine the quality and usefulness as it applies to the performance confidence assessment.
(5) Assigning Ratings. The Past Performance Factor will be assigned one of the ratings defined below.
PAST PERFORMANCE EVALUATION RATINGS
Rating Definition
Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.
Unacceptable
Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
(6) Offerors without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
d. Factor 3 – Price. Price will not be scored or rated. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 15.404-1(b). Through these techniques the Government will determine whether prices are reasonable, complete and balanced.
(1) Options. Since the option year coefficient is determined by a preset formula, offerors are not required to propose a coefficient for the option years. Evaluation of options shall not obligate the Government to exercise the option(s).
(2) The Government will calculate and evaluate each offeror’s Base Year Total Evaluated Price (BYTEP) for award purposes as shown in paragraph (3) below. Since option year coefficients are determined by a preset formula, all offerors’ coefficients would increase or decrease by the same amount from one option period to the next. Thus, the evaluation of the BYTEP (determined as a function of the proposed base year coefficient) results in the same outcome as evaluating the total price consisting of the base year, all the option years, and the ½ of the fourth option period since each option year price would equal the base year price. Therefore, evaluating the BYTEP satisfies the requirement to evaluate all of the option periods and the Government’s evaluation of its option to extend services. (FAR clause 52.217-8.).
(3) The BYTEP will be calculated as follows:
BYTEP = BYP JBLM + BYP YTC
Where:
BYTEP = Base Year Total Evaluated Price BYP JBLM = Base Year Price JBLM BYP YTC = Base Year Price YTC BYP JBLM is calculated as follows:
Multiply the prices of Line Items 1-39 in Technical Exhibit #1, Work Price List (Section J, List of Documents, Exhibits and Other Attachments) by the quantities as listed in Section L, Table 3 Estimated Base Year Quantities Line Items 1 – 39, Column Estimated Quantities JBLM
Add the extended totals for Line Items 1 – 39
Multiply the total by the proposed coefficient for JBLM
BYP YTC is calculated as follows:
Multiply the prices of Line Items 1-39 in Technical Exhibit #1, Work Price List (Section J, List of Documents, Exhibits and Other Attachments) by the quantities as listed in Section L, Table 3 Estimated Base Year Quantities Line Items 1 – 39, Column Estimated Quantities YTC
Add the extended totals for Line Items 1 – 39 Multiply the total by the proposed coefficient for YTC
(4) The BYTEP is to evaluate offers for award purposes and shall not obligate the Government to place orders totaling this amount.
(5) Unbalanced Pricing may be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential performance risk which could result in unreasonably high prices.
Definitions.
Reasonableness. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.
Completeness/Accuracy. The offeror’s proposal is in compliance with the Price
Volume instructions in the solicitation.
CONTRACTOR LINE ITEM TOTALS
Contractor shall fill in the total of the contract line items for Technical Exhibit 1 for each individual period, as appropriate.

(a) Definitions. As used in this clause--
Original contract price means the award price of the contract; or, for requirements contracts, the price payable for the estimated total quantity; or, for indefinite-quantity contracts, the price payable for the specified minimum quantity. Original contract price does not include the price of any options, except those options exercised at the time of contract award.
(b) Amount of required bonds. Unless the resulting contract price is $150,000 or less, the successful offeror shall furnish performance and payment bonds to the Contracting Officer as follows:
(1) Performance bonds (Standard Form 25). The penal amount of performance bonds at the time of contract award shall be 100 percent of the original contract price.
(2) Payment Bonds (Standard Form 25-A). The penal amount of payment bonds at the time of contract award shall be 100 percent of the original contract price.
(3) Additional bond protection. (i) The Government may require additional performance and payment bond protection if the contract price is increased. The increase in protection generally will equal 100 percent of the increase in contract price.
(ii) The Government may secure the additional protection by directing the Contractor to increase the penal amount of the existing bond or to obtain an additional bond.
(c) Furnishing executed bonds. The Contractor shall furnish all executed bonds, including any necessary reinsurance agreements, to the Contracting Officer, within the time period specified in the Bid Guarantee provision of the solicitation, or otherwise specified by the Contracting Officer, but in any event, before starting work.
(d) Surety or other security for bonds. The bonds shall be in the form of firm commitment, supported by corporate sureties whose names appear on the list contained in Treasury Department Circular 570, individual sureties, or by other acceptable security such as postal money order, certified check, cashier's check, irrevocable letter of credit, or, in accordance with Treasury Department regulations, certain bonds or notes of the United States. Treasury Circular 570 is published in the Federal Register or may be obtained from the U.S. Department of the Treasury, Financial Management Service, Surety Bond Branch, 3700 East West Highway, Room 6F01, Hyattsville, MD 20782. Or via the internet at http://www.fms.treas.gov/c570/.
(e) Notice of subcontractor waiver of protection (40 U.S.C. 3133(c)). Any waiver of the right to sue on the payment bond is void unless it is in writing, signed by the person whose right is waived, and executed after such person has first furnished labor or material for use in the performance of the contract.
