1. Contractor question:
One additional follow up and it may be why I was not certain I was finding the permit prior to you providing the link. The PWS references to the permit include “Appendix/Appendices” such as:
| • | DPG Utah Permit B, Appendix 1-01, paragraphs 2.03 and 2.2 |
| • | Utah Permit B, Appendices 1-01 and 3-01 |
| • | DPG’s Permit B, Appendix 1-01 |
I have not been able to find any Appendices in the Permit. I do find Attachments, specifically Attachment 1-1 CHWSF Waste Analysis Plan and Attachment 3-1 DTTF Waste Analysis Plan. Are these the two items referred to in the PWS as Appendices?
Government Answer:
Module IV (4) has appendices – Module IV is the RCRA Corrective Action Program.
If it is referring to the CHWSF and/or the DTTF then is should be corrected to read Attachment and not Appendix.
Module 4 it could potentially be an appendix.
2. Contractor Question:
Could you please upload the following to the Solicitation - W911S620R0002 Central Hazardous Waste Management posting on sam.gov for all potential offerors to have access to:
· The last four Final Biennial Reports defined in solicitation W911S620R0002 PWS Section 5.1.9 or current contract PWS equivalent
· The last 12 (complete year) monthly RCRA Regulatory Compliance Reports defined in solicitation W911S620R0002 PWS Section 5.1.10 or current contract PWS equivalent
· The last 12 (complete year) monthly CAA Regulatory Compliance Reports defined in solicitation W911S620R0002 PWS Section 5.1.11 or current contract PWS equivalent
· The last 12 (complete year) monthly Quality Control Reports defined in solicitation W911S620R0002 PWS Section 5.1.12 or current contract PWS equivalent
Government Answer:
See link below for the Biennial Reports https://rcrapublic.epa.gov/rcrainfoweb/action/modules/facility/search/false/UT3750211259/2019/UT QC Reports were accepted by the government and contained all requested info. The government will not post these reports as the format, personal information, etc. is proprietary/personal to the incumbent.
Additional link for reports:
Detailed Search | US Environmental Protection Agency https://rcrapublic.epa.gov/rcrainfoweb/action/modules/br/search/view Select the year (i.e. 2019) type in DPG EPA ID: UT3750211259 then “submit” to pull up 2019 biennial report information.
3. Contractor Questions:
PWS Section 1.6.10 states “These "Key Personnel" are identified by name within the Contractor’s proposal and their resumes submitted for evaluation during the source selection process.” Section L of the solicitation does not include a requirement to submit resumes for key personnel. Please confirm that we should submit Key Personnel resumes with Volume II Mission Capability.
Government Answer: Section L describes the vendor qualification for Key Personnel being the bachelor degree, Certification, time in job, etc. The government requires a resume to describe the person’s qualifications as well as diploma, certificates, etc. to affirm the education portion.
4. Contractor Question:
With regards to transportation and disposal:
0. Section L of the solicitation states “The offeror’s proposal shall state their plan for transporting and disposing of all waste in accordance with the PWS, paragraphs 5.2 and 5.12, DPG’s Utah Permit B, Appendices 1-01 and 3-01, and provide evidence of a minimum of three (3) years of experience in transporting of waste, non-hazardous and non-chemical agent-related hazardous waste by both the offeror, its teaming or joint venture partners, and subcontractors during which time there no instances of violations, fines, citations or other adverse performance records.”
0. Section M of the solicitation states
1. “The Government will evaluate the offeror’s proposed transportation and disposal process. To receive an acceptable rating the offeror’s process shall address the below in compliance with the performance Work Statement, DPG’s Utah Permit B, and applicable federal and state laws and regulations.”
1. “The offeror shall certify that it possess, or its subcontractor, possess all required transportation permits, certifications (both for the company/subcontractor and the individual (e.g. drives and those who do sampling)) and equipment to perform the contract.”
1. “The offeror shall identify all waste disposal sites site to be used, the type of waste that will be disposed at each site (non-hazardous, non-chemical agent-related hazardous, and chemical agent-related hazardous) and certify that each site is properly licensed/certified to handle that type of waste in accordance with the DPG Utah Permit B and all applicable federal and state laws and regulations.”
1. “Offeror’s certification of a minimum of three years of waste transportation and disposal experience with no violations, fines, citations or other adverse performance record by the offeror, its teaming or joint venture partners and its subcontractors.”

1. “The offeror’s proposal shall identify the offeror’s process to identify the type of chemical agent-related hazardous waste (e.g. mask filters), how and by what personnel the appropriate waste analysis parameter will be determined, and the unique health and safety protocols applicable to the receipt, storage, transportation and disposal of chemical agent-related hazardous waste”
0. PWS Section 5.12 states
2. “Transportation and disposal of waste and materials off-site, utilizing the most cost-effective means, shall be the responsibility of the Contractors.”
0. Considering the above Section L, Section M and PWS information:
3. Can you please confirm that any transportation or disposal of waste (non-hazardous, non-chemical agent-related hazardous, and chemical agent-related hazardous) and materials off-site via DLADS under a separate Government contract will be at no cost to the awarded Contractor?
3. If awarded the contract, are we allowed to transport and dispose of all waste and materials off-site via DLADS?
1. If so and if that is our plan, can you please provide a contact with DLADS or applicable DLADS information so that we can provide the information required by Sections L and M of the solicitation as it relates to our planned role and responsibilities for DLADS?
3. If we are not allowed to transport and dispose of all waste and materials off-site via DLADS, can you provide a breakdown of the items in “TE - 5 Waste Reports 2016-2020.xls” transported and disposed of via DLADS as well as a contact with DLADS or applicable DLADS information so that we can provide the information required by Sections L and M of the solicitation as it relates to our planned role and responsibilities for DLADS?
2. And for waste and materials not transported and disposed of off-site via DLADS can you please provide the waste disposal site used?
Government Answer: The DLADS contract does manage the shipments of Hazardous Waste and the cost is not the environmental support contractor responsibility. DLADS is available under a separate Government contract at no cost to the Contractor for transportation and disposal of waste.
5. Contractor Question:
We have found the following SOPs referenced in the B Permit documents on the State’s site but have not been able to locate them on the site. Any insight/guidance on where these SOPs are located would be much appreciated:
· SOP HWSF-01 for the CHWSF,
· SOP HWSF-02 for Sampling Hazardous Waste/Materials
· SOP HWSF-20 for Lab Pack Packaging
· SOP WDC-ENV-003: Chemical Test Division Hazardous Waste Management Plan
· SOP HWSF-03 for Pick-Up and Transportation of Hazardous Waste
· SOP HWSF-13 for Management of Orphan Wastes
· SOP HWSF-14 for Tracking Hazardous Waste
Government Answer:
SOP’s are created by the contractor. The current ones would be available to the new contractor if the incumbent contractor is not selected.
6. Contractor Question:
The RFP states that the RCRA Specialist or equivalent, shall have a BS degree (or equivalent). Can you please confirm that 5 years of experience performing RCRA functions on similar environmental projects will be considered equivalent to a BS degree?
Government Answer:
PER the PWS - BS degree (or equivalent), Certified Hazardous Material Manager (CHMM) or Registered Environmental Manager (REM) and a minimum of five years of demonstrated professional experience in the area of RCRA regulatory enforcement or compliance program work.
The applicant will possess a BS degree or a certification that is equivalent, or be “registered” as an REM. The 5 years RCRA regulatory experience is in addition to the degree or certification.
A minimum of three years professional experience is desired to be directly applicable to the management of chemical warfare agent-related wastes within the State of Utah. A minimum of three (3) years professional experience is desired to be directly applicable RCRA permitting Treatment Storage and Disposal facilities or through the Research, Development and Demonstration (RD&D) process. A minimum of three (3) years professional experience is desired to be directly applicable to technical writing.
7. Contractor Question:
The PWS states that the RCRA Specialist must be a Certified Hazardous Material Manager (CHMM) or Registered Environmental Manager (REM) AND have a minimum of five years of demonstrated experience in the area of RCRA regulatory enforcement or compliance program work; however, the RFP states that this individual only needs to be a CHMM. Can you please confirm that the proposal Regulatory Specialist can be either a CHMM or REM as long as they meet the minimum of five years of demonstrated experience in the area of RCRA regulatory enforcement or compliance program work?
Government Answer: The specialist can be either CHMM or REM as long as they meet the minimum of five years of demonstrated experience in the area of RCRA.
8. Contractor Question:
Tab D states that, "The offeror shall ensure that Certs and Reps are thoroughly completed with all blocks in each certification/representation completed truthfully and completely." Is this in reference to the various FAR and DFAR clauses located throughout the RFP OR is this referring to the Reps & Certs on sam.gov < Caution-http://sam.gov/ > as this is how Tab D will be evaluated?
Government Answer: This is referring to your official representation in SAM.GOV. If your SAM is current and representations are correct, then FAR 52.212-3 is redundant and it’s completion is optional. If there is a discrepancy, please complete the 52.212-3 and notify the government contract specialist Paul Frailey (paul.e.frailey.civ@army.mil or paul.e.frailey.civ@mail.mil).
9. Contractor Question:
Page 65 of the RFP states that the SF 1449 must contain an original signature. Since this is an electronic submission, can you please confirm that an electronic signature is acceptable?
Government Answer: Yes, That is Acceptable
10. Contractor Question:
Tab B references an SF1449; however, the RFP includes an SF33. Will the government be issuing and SF 1449 for this solicitation?
Government Answer: RFP issued as SF 33 due to potential for negotiation if single proposal received.
11. Contractor Question:
Due to the page limitations, can you please confirm that the Cover Sheet/Front Cover, Title Page, Tab Dividers, Table of Contents and Glossary are EXCLUDED from the page count?
Government Answer: Government confirms that Cover Sheet/Front Cover, Title Page, Tab Dividers, Table of Contents and Glossary, if necessary, will not be counted towards total.
12. Contractor Question:
Given the number of pages required by Tabs C and D, can the government please increase the page limitations for Volume I - Price/General to 40 pages?
Government Answer: Yes, government will accept up to 40 pp. Font “10” may be used if necessary.
13. Contractor Questions:
Will there be GFP?
Government Answer: No. Contractor will provide all equipment, including but not limited to: Trailers, Computers, barrels, etc.
14. Contractor Question: Will an alternate level of qualifications for the RCRA be allowed, as detailed by the PWS? As the Evaluation criteria in section M only provides one certification.
