(1) This is a lowest priced technically acceptable (LPTA) source selection conducted in accordance with Federal Acquisition Regulation (FAR) Part 15, Contracting by Negotiation, Source Selection, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). The Government intends to make multiple contract awards to the successful offerors providing they satisfy the Performance Work Statement (PWS) and requirements set forth in the solicitation. Award(s) will encompass the entire PWS. Partial awards will not be made. Offeror must propose to perform all aspects of the PWS and address all factors/subfactors in the evaluation criteria. The award(s) will be based on the best value and must show that Offeror’s proposal is beneficial to the Government, with appropriate consideration given to the evaluation factors specified below. The Government intends to award up to five (5) contracts resulting from this solicitation.

However, the Government reserves the right to award less contracts or no contracts if the Government determines it is in the Government’s best interest.

(2) The Government will utilize a Lowest-Price, Technically Acceptable (LPTA) evaluation method for this requirement. To be eligible of award, Offerors must be deemed responsible in accordance with the FAR Part 9.1, as supplemented, submit proposals which conform to the solicitation requirements, and receive an acceptable technical proposal and past performance rating. Award(s) will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors.

(3) The LPTA process does not permit tradeoffs among price and non-price factors.

(4) The Government will evaluate the Offeror’s technical proposal to ensure that it reflects a sound understanding of this requirement and complies with the requirements in the solicitation. An evaluation will be made to verify that the contractor is capable of providing the required services at a fair market price. Award is also subject to acceptance of all terms and conditions of the contract and a determination of a fair market price. The Federal Acquisition Regulation (FAR), as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS) and the Army Federal Acquisition Regulation Supplement (AFARS) will be used to evaluate the offer and award this requirement

(5) Technical Acceptability, Determination of Fair Market Price, and Responsibility:

As Authorized under FAR Part 15, Contracting by Negotiation procedures are being used to evaluate the Offeror’s offer and award this requirement. The Government will evaluate the contractor’s technical proposal to ensure that it reflects a sound understanding of this requirement. The proposed price will be evaluated in accordance with FAR 15.4, using the Independent Government Estimate (IGE) to estimate the fair market price of the work to be performed in accordance with FAR 19.502-2 and will make a determination that the offered price does not exceed the fair market price. The Government will complete a determination of responsibility utilizing the System of Award Management (SAM). Regarding Past Performance information, the Contract Performance and Reporting System (CPARS) will be utilized. The Government intends to award this procurement based on contractor’s responsibility, technical acceptability, and determination of a fair market price that complies with the requirements in the solicitation.

(6) As part of the fair market price determination, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding six (6) months of the offeror's final option year price to the offeror's total price. The offeror is required to price the base period and all option periods. The offeror shall not submit a price for the potential six-month extension of services period. Per the solicitation, the Offeror understands that the Government may choose to exercise the Extension of Services at the end of any performance period, utilizing the rates of that performance period.

(7) Award Without Discussions: As set forth in FAR 52.215-1(f)(4), the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a), Clarifications and award without discussions). Accordingly, offerors are advised to submit initial proposals that are fully and clearly satisfactory without the need for additional information or explanation and contain the offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer determines them to be necessary.

Evaluation Criteria

Evaluation criteria consist of factors and subfactors. The proposals will be evaluated under three evaluation factors: Price, Technical Acceptability and Past Performance.

Factor 1: Factor 1 Price was not assigned an adjectival rating. All pricing information was addressed within this proposal volume. The offeror’s CLIN prices will be evaluated for reasonableness and balance.

Regarding reasonableness, Price Analysis techniques in accordance with FAR 15.404-1(b) is being used to validate price reasonableness. Total Evaluated Price (TEP) – The TEP to be used for the determination of price Reasonableness will be calculated as follows:

The sum of all CLINs’, the base period, option periods, and ½ of the final option period price as an evaluation of potential pricing under FAR Clause 52.217-8.

The document will be evaluated based on the soundness of the approach, the feasibility of the approach, and the comprehensiveness of the document. An assessment of the proposed management roles, controls, , communications, Resource management, Risk Management, and Compliance will be evaluated on likelihood of success.

The QCP, shall describe your approach for ensuring performance is IAW the standards in the PWS throughout the life of the contract.

Table A-1. Technical Acceptable/Unacceptable Ratings Adjectival Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum, requirements of the solicitation.

Factor 3: The Government will evaluate the submission of information substantiating the Offeror’s past performance in complying with FAR 52.219-8, “Utilization of Small Business” to maximize opportunities for U.S. small business subcontractors.

The Past Performance evaluation will be accomplished by reviewing aspects of the Offeror's recent and relevant Past Performance, focusing on and targeting performance which is relevant to the effort as it directly relates to the work under the Army’s Performance Work Statement for this Solicitation and as defined as “Relevant.” The past performance data shall be evaluated based on the demonstration of a successful history of past contract performance as outlined under the Recency and Relevancy Assessment paragraphs below.

Recency Assessment: An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be substantially complete (80% or more) or must have been performed during the past three years from the date of issuance of this Solicitation. Past performance information that fails this condition will not be evaluated.

Relevancy Assessment: The Government will conduct an in-depth evaluation of all recent performance information obtained to determine how closely the services performed under those projects relate to this requirement. For each recent past performance citation reviewed, the relevance of the work performed will be assessed. Consideration will be given to criteria such as similarity, complexity, and diversity of tasks, type of effort, scope, value, and performance period. With respect to relevancy, more relevant past performance is a stronger predictor of future success and will have more influence on the past performance confidence assessment than past performance of lesser relevance. A relevancy determination of the Offeror’s and major and critical subcontractor(s)’ past performance will be made. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the Offeror or subcontractor whose contract is being reviewed and evaluated.

The past performance information provided in the response and obtained from other sources will be used to establish the degree of relevancy of past performance. The Past Performance Relevancy definitions below will be used when assessing recent, relevant contracts:

Table A-2. Past Performance Relevancy Ratings Adjectival Rating Definition Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this Solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this Solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this Solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this Solicitation requires.

In addition to requesting past performance information, the Contract Performance and Reporting System (CPARS) will be utilized.

The Government intends to award this procurement based on contractor’s responsibility, technical acceptability, and determination of a fair market price that complies with the requirements in the solicitation.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

See Addendum to FAR 52.212-2, Evaluation-Commercial Products and Commercial Services

Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
