2. Evaluation Procedures A. IAW FAR 13.106-2(b), at the discretion of the Contracting Officer, the evaluation procedures of FAR Parts 14 and 15 may be used in the evaluation of submitted quotes.
B. IAW FAR 14.404-2, the following evaluation procedures will be utilized by the Contracting Officer in evaluating submitted quotes:
Any quote that fails to conform to the essential requirements of the RFQ shall be rejected.
Any quote that does not conform to the applicable specifications shall be rejected unless the RFQ authorized the submission of alternate quotes and the supplies offered as alternates meet the requirements specified in the RFQ.
Any quote that fails to conform to the delivery schedule or permissible alternates stated in the RFQ shall be rejected.
A quote shall be rejected when the offeror imposes conditions that would modify requirements of the RFQ or limit the offeror’s liability to the Government, since to allow the offeror to impose such conditions would be prejudicial to other offerors. See FAR 14.404-2(d) for examples.
A low priced quote may be requested to delete objectionable conditions from a quote provided the conditions do not go to the substance, as distinguished from the form, of the bid, or work an injustice on other offerors. A condition goes to the substance of a bid where it affects price, quantity, quality, or delivery of the items offered.
Any quote may be rejected if the contracting officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only the total price of the quote, but the prices for individual line items as well.
Any quote may be rejected if the prices for any line items or subline items are materially unbalanced.
Quotes received from any person or concern that is suspended, debarred, proposed for debarment or declared ineligible as of the RFQ closing date or prior to award shall be rejected unless a compelling reason determination is made.
Low quotes received from concerns determined to be not responsible pursuant to Subpart 9.1 shall be rejected.
C. Determination of Responsibility IAW FAR 14.408-2, the Contracting Officer shall determine that a prospective contractor is responsible IAW Subpart 9.1. To be determined responsible, a prospective Contractor must:
Have adequate financial resources to perform the contract, or the ability to obtain them;
Vendors shall provide the Contracting Officer with the relevant corporate financial information contained within this RFQ if applicable or required. Failure to provide the financial information required with the quote shall be the basis to determine the vendor as non-responsible and eliminated from the award process;
Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;
Have a satisfactory performance record. A prospective Contractor shall not be determined responsible or not responsible solely on the basis of a lack of relevant performance history, except as provided in 9.104-2. The Contracting Officer may obtain a Certificate of Competency from the Small Business Administration if the bidder has no relevant past performance. Relevancy is defined as having performed contracts successfully under NAICS 712110 as a prime contractor.
A review of the System for Award Management, SAM.gov, show no active exclusions or debarments.
Have a satisfactory record of integrity and business ethics.
A review of the FAPPIS website returns no negative reviews or terminations.
Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors).
Have the necessary equipment and facilities, or the ability to obtain them.
Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
D. Pricing Evaluation and Price Related Factors IAW FAR 14.408-2, the Contracting Officer shall determine that the prices offered are fair and reasonable before awarding the contract.
At RFQ closing, the Contracting Officer or designated representative, shall sum the total of each line item in order to obtain overall contract price. Mistakes or omissions in pricing will be conducted IAW FAR 14.407.
Contractor Manpower Reporting (CMR). If the RFQ contains a CMR line item, the Contracting Officer shall determine that the unit price submitted is fair and reasonable. Contracting Officer’s determination that the pricing is not fair and reasonable shall make the vendor ineligible for award.
The price analysis techniques in 15.404-1(b) may be used as guidelines and the price analysis shall consider whether quotes are materially unbalanced IAW 15.404-1. Unbalanced pricing of individual line items may eliminate the vendor from consideration for award and be determined a non-responsible vendor if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly over or understated as indicated by the application of cost or price analysis techniques.
All line item pricing shall be evaluated among all bids received and/or against the Government Estimate if applicable. A line item unit price difference of greater than or less than 20% for individual prices when evaluated against the Government Estimate may be determined as an unacceptable risk to the Government unless evaluation shows that all bidders submitted pricing is relatively equal when compared to the Government Estimate.
As part of price evaluation if applicable, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding six (6) months of the offeror’s final option period price to the offeror’s total price. Vendors are required only to price the base and option periods. Vendors shall not submit a price for the potential six month extension of services period. The Government may choose to exercise the Extension of Services at the end of any performance period (base or option periods), utilizing the rates of that performance period.
IAW FAR 14.201-8, the following Price Related Factors shall be evaluated prior to award as applicable:
Changes made, or requested by the bidder, in any of the provisions of the RFQ, if the change does not constitute a ground for rejection under 14.404.
No federal, state or local taxes shall apply to the quotes. A Kansas Tax Exemption Certificate shall be forwarded to the awarded contractor if required.
