3.0 VOLUME 1, TAB B – FACTOR 2: PAST PERFORMANCE (CONFIDENCE ASSESSMENT)

3.1 SUBMISSION REQUIREMENTS

A maximum of six (6) environmental quality (EQ) projects as indicated below in Paragraphs 3.1.1 thru

3.1.2 will be evaluated. If an offeror disregards these instructions and submits more than six projects, only the first six projects will be evaluated. Offerors should describe each project with enough detail to ensure that the Government can meaningfully assess the projects against the evaluation criteria described in the RFP.

**Substantially complete is defined as being 50% complete by the date that proposals are due. If an offeror submits a project that it represents as “substantially complete,” the offeror must reasonably explain why the project is considered at least 50% complete. If an offeror submits an ongoing project without providing an accompanying reasonable explanation that explains how the project is at least 50% complete, the Government reserves the right to reject the project.

3.1.1 The offeror shall submit information for no more than six (6) EQ projects. Attachments L-1 (A) and L-1

(B) AM#1 shall include projects that are similar in size, scope, and complexity that best demonstrate the offeror’s Environmental Quality experience (including but not limited to environmental conservation, environmental compliance, pollution prevention, and environmental operations and maintenance) as a prime contractor as described in this solicitation. To be evaluated, each project must have been completed or must be substantially complete** by the offeror within six (6) years of the date that proposals are due.

3.1.2 Provide one (1) page consolidated list of submitted projects for prime contractor, as well as any key subcontractors (the subcontractors required to be submitted for Factor 3 if applicable) to include a matrix that identifies project Past Performance relevant experience and the firms that worked on each (teaming). This should be the front page of submitted Attachment L-2 forms.

3.1.3 For each project submitted, the offeror shall provide:

a ) Project description and information using “Project/Offeror Experience Form” (Attachment L-1).

The offeror must address all items included on Attachment 1 (no more than two (2) pages per project). The “Project/Offeror Experience Form” may also be used for key subcontractor experience (Para: 4.1.4) if included as part of the team. Offerors may identify state and local government and private contracts that are like the requirements of this solicitation.

b) If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, submit it with the proposal.

c) If there is not a completed CPARS evaluation, submit a completed Past Performance Questionnaire (PPQ) (Attachment L-4) for the project. Offerors are advised to ensure correct phone numbers and email addresses are provided for the Client point of contact. (Do not submit a PPQ when a completed CPARS evaluation is available).

o If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with proposal the first page of the PPQ, Offerors should follow up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Derek Hitt (Contract Specialist) at email derek.hitt@usace.army.mil and Phil Charles in email at phil.charles@usace.army.mil prior to proposal closing date. Offerors shall instruct the clients to refer to the solicitation number in the subject line.

o PPQs are source selection materials. All successfully submitted PPQs will receive an email confirmation upon receipt. If the offeror does not receive the confirmation, it is the offeror’s responsibility to follow up to ensure the Government has received the information.

o Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other procurements. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

o Offerors may provide explanation on problems encountered on past projects and the corrective actions taken by the offeror.

d) In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the CPARS, using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), telephone interviews with organizations familiar with the offeror’s performance, Government personnel with personal knowledge of the offeror’s performance capability, and any other known sources not provided by the offeror.

mailto:derek.hitt@usace.army.mil mailto:phil.charles@usace.army.mil o Describe any previous teaming experience between current team members, if not described on the project experience forms.

Note: An offeror may receive credit for relevant experience under a previous business arrangement (ex. joint venture) if the offeror demonstrates that their role on the submitted project is relevant to their proposed role on this project. If the offeror is a joint venture, each firm of the joint venture shall provide information, demonstrating experience relevant to their role on this requirement. Clearly identify the role and responsibilities of each joint venture partner. Offerors who submit experience information of a parent, sister or other affiliated company must describe what involvement such company will have on the instant acquisition.

The Government may discount the experience of a parent, sister or other affiliated company unless the prime contractor clearly provides evidence of a binding teaming agreement or other contractual agreement which creates legal responsibility on the part of the parent, sister or other affiliated company or provides a Meaningful Relationship Commitment Letter (Attachment L-3), as it applies to proposal, include the following:

1. A statement of commitment as to the performance and utilization of the identified entity’s resources on the project.

2. Signatures of both the Offeror and Meaningful Relationship Entity.

a. Include performance recognition documents received within the last six (6) years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

The offeror shall complete the “FFP Ceiling Burdened Hourly Rates” tables in Section B for submission under this Volume 2. The rates proposed in Section B will be binding and will become the maximum allowable rates for the Seed Task Order proposal and any subsequent task orders issued during the ordering period of the contract awarded as a result of this solicitation. Thus, the rates proposed on a task order may be less than those proposed in Section B but may not exceed the maximum rates included unless the applicable wage determination is higher than the offeror’s base rate in the contract. Required supporting documentation (if any) shall be provided with the offeror’s proposal.

Information for completing the tables and identification of required supporting documentation is provided below:

“FFP Ceiling Burdened Hourly Rates” tables - For FFP efforts, offerors shall propose burdened labor rates (excluding profit) for all labor categories provided in the “FFP Ceiling Burdened Hourly Rates” tables in Section B.

Rates shall include application of all indirect rates but shall exclude profit. The labor rates proposed for the offeror's personnel are the maximum allowable rates for task orders issued during the ordering period of any contract awarded as a result of this solicitation. Therefore, labor rates for the offeror's proposed personnel may be less per individual task order but may not exceed the maximum rates included in the IDIQ MATOC award. The offeror must propose a rate for each, and every labor category listed in the table regardless of whether the offeror employs personnel in every required category or intends to rely on key subcontractors for the particular labor categories.

Offeror shall not propose additional labor categories.

General and Administration (G&A) - G&A overhead percentage proposed must be fully supported. If a recent audit or financial statement of corporate overhead expenses, performed by a government or private auditor or certified public accountant exists that supports the rate proposed, submit it as part of the offer. The G&A rate will be a binding element that will become the maximum allowable rate for task orders issued during the respective contract ordering period.

Escalation Factors - The offeror shall provide the escalation factors applied to the labor categories for each calendar year after Base Period Year 1. The offeror shall also provide the basis for any proposed/projected price escalation and the assumptions used, if any.
