Control No. 18-14

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. CONTRACTING AGENCY: U.S. Army Engineer District, Alaska, Contracting Division, P.O. Box 6898, JBER, Alaska 99506-0898.

2. DESCRIPTION OF ACTION: This is a Limited Sources Justification for Other than Full and Open Competition to include a sole source Eaton Power Xpert 8000 power quality meter in solicitation W911KB-19-R-00XX for FTG218 Mechanical Electrical Building at Missile Field #4 (FTG218 MF#4 CP#03 MEB#4) on Fort Greely, Alaska. The solicitation will be a competitive Request for Proposal resulting in a new firm-fixed price construction contract to be awarded with FY19 MILCON funds.

3. DESCRIPTION OF SUPPLIES/SERVICES: This Limited Sources Justification is for the inclusion of a brand name specification for the Eaton Power Xpert 8000 power quality meter in the solicitation and resultant contract for the FTG218 MF#4 CP#03 MEB#4 project.

The Missile Defencse Complex (MDC) Power Quality and Monitoring System (PQMS) quality meter is an Eaton Power Xpert 8000 and all individual building power components are required to communicate and integrate with the PQMS head-end.

Approval authority for this Limited Source Justification is the Procuring Contracting Officer.

4. AUTHORITY CITED: Other than Full and Open Competition is authorized pursuant to 10 U.S.C. 2304(c)(1), FAR 6.302-1(a)(2), when only one responsible source and no other supplies or services will satisfy agency requirements.

5. REASON FOR AUTHORITY CITED:

Background: The power consumption and quality of all buildings on the MDC is monitored and controlled remotely from the Power Plant. The MDC utilizes Eaton Power Quality software to monitor the MDC Power consumption and quality. The power consumption and quality is monitor at each building through the PQMS head-end control system at the Power Plant.

b. Justification: The Power Plants PQMS monitoring software is only compatitable with the Eaton Power Xpert 8000 meter. The Eaton Power Xpert 8000 power quality meter is essential to the Government’s mission and all new power systems are integrated into the PQMS using the proprietary Eaton meter for proper monitoring of power quality to prevent inoperability of the missiles.

c. Impact: Failure to incorporate the requirement for compatibility with the MDC with the existing PQMS system will result in a failure to meet MDC’s functional and operation requirements and could result in a mission failure.

d. Alternatives: None. Specifying a Eaton Power Xpert 8000 power quality meter for FTG218 MF#4 CP#03 MEB#4 is essential to the Government’s requirements, precluding consideration of replacing the entire monitoring system with a product manufactured by another company.

6. EFFORTS TO OBTAIN COMPETITION: In an attempt to solicit offers from as many potential sources as practical, market research was conducted as described in paragraph 8 below. Effective competition is not anticipated for this system. There are no other known sources that are compatible with the head-end PQMS system, therefore no competition is proposed for the acquistion of this system.

7. ACTIONS TO INCREASE COMPETITION: Based on information in paragraph 5, above, competition for the sole source brand name items to be included in solicitation W911KB-19-R-00XX is not feasible.

8. MARKET SURVEY: An internet search was performed to search for alternatives to this product as well as vendors. There was not a suitable alternative located. There are a substantial number of vendors who will be able to provide cmpetitive quotes for the prime contractor selected.

9. INTERESTED SOURCE: In accordance with FAR 5.102(a)(6), this J&A will be posted with the solicitation when the solicitation is made available through the Government Point of Entry (www.fedbizopps.gov). Any sources that indicate interest as a result of the publication will be evaluated. To date, no other sources have written to express interest.

10. OTHER FACTORS:

a. Procurement History: The Eaton Power Xpert 8000 power quality meter has been provided under prior Missile Defenese Complex contracts at Fort Greely; ie. g at Missile Field #1, Mechanical Electrical Building at Missile Field #2, Mechanical Electrical Building at Missile Field #3, MDC Power Plan, MDC Readiness and Control Buildiung.

b. Acquisition Data Availability: Not applicable.

c. Unusual and Compelling Urgency: Not applicable.

d. Subcontracting Competition: Subcontracting opportunities exist for suppliers, distributors, and/or installers. This is a restrictive specification that only precludes consideration of a product manufactured by another company. Subcontracting competition will be the responsibility of the Prime contractor awarded the contract.
