(a) Goals. The U.S. Army Corps of Engineers considers the following subcontracting goals reasonable and achievable for the performance of the resultant contract:

1.0 BUY AMERICAN ACT FOR CONSTRUCTION MATERIALS

Your attention is invited to Clause 52.225-12 Notice of Buy American Act Requirement-Construction Materials under Trade Agreements. You are advised to inform your potential subcontractors and suppliers of the Buy American Act requirements contained in this solicitation. Subparagraph (b) of the clause provides instructions for pre-award determinations as follows: “Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American Act should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-11 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American Act before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.” In accordance with FAR Part 25 Foreign Acquisition, subpart 25.205, entitled Post Award determinations, subparagraph (a), if a contractor requests a determination regarding the inapplicability of the Buy American Act after contract award, the contractor must explain why it could not request the determination before contract award or why the need for such determination otherwise was not reasonably foreseeable.

2.0 SOLICITIATION PROVISIONS

Attachment 4). The Government will target areas covered in the requirements of this proposal including records of conforming to quality, schedule, cost control, customer satisfaction, level of support for such things as as-built documentation, O&M manuals, training, problem resolution for construction errors, warranty work, and safety. The Government also places a higher value on recent, relevant projects which document successful outcomes and are supported by outside source confirmation, for example, but not limited to telephone interviews with points of contact identified in the proposal, CPARS or other agency performance databases, offeror furnished references, or personal knowledge. The Government also places a higher value on projects, which provided particularly difficult or unique challenges and the innovative methods the contractor used to resolve problems successfully. The Government’s evaluation is not limited to past performance information on the cited example projects and may also consider past performance on other recent, relevant projects which may be indicative of how the offeror may perform on this project.

8.2.2 Each entity (firm) will be rated on its own performance or that of its predecessor, if relevant. An entity may not establish past performance based on the past performance of its proposed key personnel, apart from that of the entity. If the Government does not obtain past performance information for the projects identified by the offeror and cannot establish a past performance record for the offeror through other sources, past performance will be rated neither favorably nor unfavorably. The performance confidence assessment will be considered “Unknown (Neutral)” and receive a relevance rating of “Not Relevant.”

9.0 VOLUME 2 – TAB B - FACTOR 3 – SMALL BUSINESS PARTICIPATION PLAN

9.1 Submission Requirements:

9.1.1 All offerors shall identify the extent to which Small Businesses (SBs), Veteran-Owned Small Businesses (VOSBs), Service-Disabled Veteran-Owned Small Businesses (SDVOSBs), HUBZone Small Businesses, Small Disadvantaged Businesses (SDBs), Woman-Owned Small Businesses (WOSBs) and Historically Black Colleges/Universities or Minority Institutions (HBCU/MIs) would be utilized in the performance of this proposed contract. For small businesses, as defined by the North American Industry Classification System (NAICS) Code applicable to this solicitation, the offeror shall identify their own participation as a SB, VOSB, SDVOSB, HUBZONE SB, SDB, WOSB, or HBCU/MI, and it will be considered in evaluating the proposed small business participation plan (use Attachment 7 - Small Business Participation Plan).

9.1.2 Offerors must propose goals for Small Business Participation. Small business participation goals are to be an estimated percentage of AM#5…total contract dollars (total proposed amount including options) planned subcontracted dollars (including options). … AM #5 Provide an overall goal to be accomplished through collective small business participation from any type of small business, to include all small business programs, and propose individual goals for each small business program. The work to be performed directly by a small business prime offeror will be included the offeror’s Small Business Participation goal.

9.1.3 The offeror’s proposal must meet the minimum mandatory Total Small Business Participation goal (all types of small business combined) of

20% of total proposed AM#2… contract subcontracted …AM#2 value including all options for this acquisition.

AM #5… Offeror’s shall use their best effort in proposing goals for the following small business types:

9.2 Evaluation Criteria:

9.2.1 All Offerors (both large and small businesses) will be evaluated on the level of small business commitment that they demonstrate for the proposed acquisition.

9.2.2 A small business offeror also receives credit for their small business participation as a Prime Contractor and can apply their dollar value when calculating percentages in all the applicable small business categories.

9.2.3 Small Business Participation Plans will be evaluated in accordance with the following criteria by the Contract Specialist, Contracting Officer, and the Alaska District Small Business Advisor.

9.2.4 Small Business Participation Plans (from large and small businesses) will be evaluated on the basis of:

(a) The extent to which Small Business firm, as defined in FAR Part 19, are specifically identified in proposals;

(b) The extent of commitment to utilize the identified Small Business firms (for example, enforceable commitments are to be weighed more heavily than non-enforceable ones);

(c) The complexity and variety of the work small business firms are to perform;

(d) Past performance of the offerors in complying with requirement of the clauses at FAR 52.219-8, Utilization of Small Business Concerns, and 52.219-9, Small Business Subcontracting Plan (large businesses only); and

(e) The extent of participation of SB firms in terms of AM #5… total proposed contract dollars (including options) total planned subcontracted dollars (including options) … AM #5 and the extent to which the proposal meets or exceeds the small business participation goals (total and for each small business category) for this acquisition. Higher goals will be considered more favorably during evaluation.

10.0 VOLUME 3 – PRICE AND PRO FORMA INFORMATION

10.1 GENERAL

Submit the Pro Forma information in a separate binder labeled: “Volume 3 - Pro Forma Requirements.”

9 Competed Representations and Certifications included by full text in Section 00 45 00. List any changes to ORCA (Online Representations and Certifications Application) system in 52.204-8 for FAR Clauses and 252.204- 7007 for DFAR clauses. Provide for any certification where vendor indicated in ORCA that certification would be provided with specific offer.

10 One copy of the following information shall be provided:

(1) Proof of Financial Ability (Most recent financial statement covering assets and liabilities)

(2) Number of years the firm has been in business

(3) Name, address and telephone number of firm’s bonding company

(4) Information showing offeror’s bondability for this project. Submit a letter from the prime contractor’s bonding company indicating the offeror’s ability to obtain performance and payment bonds in the amount of their proposal price.

(5) Name, address and telephone numbers of two credit/trade references.

10.3.2. Evaluation Criteria:

In addition to the other proposal information, the Contracting Officer shall use this information in making an affirmative responsibility determination for award to the Successful Offeror, in accordance with FAR Part 9.

10.4 TAB C – SMALL BUSINESS SUBCONTRACTING PLAN

10.4.1 Submission Requirements: Subcontracting plans are due at the time of proposal submission, no later than the proposal due date in Block 13.A. of the SF1442. (NOTE: This requirement applies to Large Businesses only.)

10.4.1.1 If the Offeror proposing on this solicitation is a large business concern, in accordance with the definition as identified in FAR Clause 52.219-1, “SMALL BUSINESS PROGRAM REPRESENTATION”, the firm must submit a small business subcontracting plan in accordance with FAR Clause 52.219-9, SMALL BUSINESS SUBCONTRACTING PLAN and DFARS 252.219-7003, “SMALL BUSINESS SUBCONTRACTING PLAN” (see Section 00 72 00 of this solicitation for the full Clauses). AM #5… The subcontracting goals established for small business, small disadvantaged business, woman-owned business, HUBZone business, veteran-owned small business and service disabled veteran-owned small business are described in Section 00 21 00, Instructions to Offerors. See Sec. 00 22 10, Para. 9.1.4, for recommended small business subcontracting goals. … AM #5

10.4.1.2 The Small Business Subcontracting Plan shall be thorough, complete, and in accordance with AFARS Appendix DD and FAR Clause 52.219-9, as it will be incorporated into the contract upon award of the contract to the Offeror, if acceptable and upon final approval of the Contracting Officer. The Small Business Subcontracting Plan format at Attachment 6 may be utilized.

10.4.1.3 The Plan shall include a description of the types of services the firm proposes to subcontract with small business (SB), small disadvantaged business (SDB) (to include historically black colleges and universities/minority institutions (HBCU/MI)), woman-owned small business (WOSB), HUBZone business, veteran-owned small business (VOSB) and service-disabled veteran-owned small business (SDVOSB), along with the proposed

Section 00 22 11 Page 31 percentages of their participation, to demonstrate a plan to meet the subcontracting goals that will apply to these contracts. If practical, the Offeror shall provide specific information on proposed subcontracted effort for this project. AM #5… Note: The dollar amounts on the subcontracting plan must match the dollars proposed in Small Business Participation Plan. …AM #5

10.4.2 Evaluation Criteria:

The Government will evaluate the Plan in accordance with the rating scheme in Air Force FAR Supplement Appendix DD and with the requirements of FAR Clause 52.219-9. Offerors are encouraged to review AFARs Appendix DD for how the subcontracting plan will be scored. To be acceptable, subcontracting plans must score a minimum of 70 points under the AFARS evaluation system. Evaluations will consider the following:

(a) The Plan must adequately address the required statutory elements (SB and SDB).

(b) The Plan must provide sufficient information to enable the Contracting Officer to answer affirmatively questions A through H of Appendix DD, Part 2, number 8, (Air Force FAR Supplement 19.705).

(c) A subcontracting plan that is rated 70 points or less under the AFARS evaluation system will not be considered acceptable. The Government will review those areas where the plan is deficient with the Offeror with the goal of correcting deficiencies.

(d) As part of the evaluation, the Government will compare the small business subcontracting opportunities in the plan with the goals established in the solicitation with additional consideration given for a proposed subcontracting plan that exceeds the goals established in Section 00 21 00 of this solicitation. The Government will give additional credit for a plan which is more specific in nature as to the proposed subcontracting opportunities for Small Business Community (small business (SB), small disadvantaged business (SDB), woman-owned small business (WOSB), HUBZone business (HUBZone), veteran-owned small business (VOSB) and service-disabled veteran-owned small business (SDVOSB), and historically black colleges and universities/minority institutions

(HBCU/MI).

(e) Subcontracting Plans shall reflect and be consistent with the commitments offered in the Small Business Participation Plan. In accordance with DFARS 215.304 (c), when an evaluation assesses the extent that small businesses and HBCUs are specifically identified in proposals, the small businesses and HBCUs considered in the evaluation shall be listed in any subcontracting plan submitted.

(f) As part of the subcontracting plan evaluation, the Government will also review information submitted or obtained for Volume 1, Tab D, Small Business Participation Plan, to evaluate the Offeror’s past performance in establishing realistic yet challenging goals, and in achieving them.

11.0 EVALUATION PROCEDURES

11.1 SOURCE SELECTION EVALUATION BOARD (SSEB)

11.1.1 The SSEB will be established to conduct the evaluation of proposals received in response to this solicitation. The evaluation will be based on the content of the proposal and any subsequent discussions required, as

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

1.14 PROPOSAL FORMAT

(ii) Volume number, section, page number and date submitted shall appear in the bottom right corner of each page (along with the revision number for the amended page, if necessary).

We request that the requirement to include "date submitted" on the bottom right corner of each page be waived for this procurement. Our experience has been that this requirement creates unnecessary re-printing, in the event of a bid extension, simply to correct a revised bid date to an entire proposal.

1. Proposal Price Schedule – The "Evaluation of Offers" page states that CLIN's 0007 through 0036 may be exercised as optional bid items. Is the Contractor to assume that if the COE elects to exercise the optional bid items, all bid items will be exercised or is there a possibility that only a portion would be exercised by Inclement. If that is the case would it not be best to have the "Price Schedule" subtotal each Inclement.

2. Optional Bid Items – In the event the optional Inclement's are exercised will they be done in the order they are listed in the "Price Schedule".

The evaluation factors state that all offers will be evaluated on their "Small Business Participation Plan" (Vol 2, Tab B, Factor 3), in the event that the contractor proposing on the project is a SBA approved small business how will they be evaluated since they are not required to submit a "Small Business Participation Plan".

Government Response.. The requirement for the Small Business Participation Plan under Vol. 2, Tab B, Factor 3, applies to ALL OFFERORS. Small Businesses ARE required to submit a Small Business Participation Plan as per Sec. 00 22 11, Para. 9.1.1 ("All offerors shall identify the extent to which Small Businesses...would be utilized in the performance of this proposed contract.") Para.
