Conference Highlights
Reference Section 00 21 00 - Instructions, Conditions and Notices To Offerors and Section 00 22 11 - Evaluation Factors for Award, Part 1: GENERAL INFORMATION, paragraph 7. PROPOSAL SUBMISSION
INSTRUCTIONS
It is the responsibility of the contractor to get their proposals on base. It was noted that the procedures for getting proposals to the contracting office had changed and that contracting will no longer be providing personnel at the base gates to receive proposals. Contractors can use a number of courier services here in town that have access to base. Delivery of proposals is the responsibility of the contractor. Proposals are to be delivered to room 30 (contracting office area).
1. Proposal due date 1 September 2010 at 1400hrs Alaska time
2. Date and Time stamp must be on proposal
3. Proposals are to remain unopened until the proposal due date and time.
4. In accordance with the solicitation, Volume 2 will only be accepted by email or fax. Offerors shall submit Volume I – Technical Proposal via hardcopy in accordance with the instructions below in this section.
Contract Type is a firm fixed-price construction contract. The RFP consists of a Base Item and 8 option Items.
(Please note that the number of option Items is changed to 5 as a result of this amendment.) The method of procurement is Lowest Price Technically Acceptable. A firm fixed price construction contract will be awarded to the offeror who submits a proposal with the lowest total evaluated price for the base and optional items meeting or exceeding the acceptability standards for all the non-cost factors.
Project will be partially funded by ARRA funding and therefore subject to the additional ARRA reporting requirements. Christine Dale covered the ARRA clauses in full detailed and the reporting responsibility that the contractor will have to complete.
The following areas of the solicitation, specification, and drawings were discussed.
Page 3 of the solicitation will be corrected to reflect the actual hours for acceptance of proposals to the Contracting Office. The delivery time information should read as on page 22 of the solicitation.
Page 26 of the Solicitation, Tab C - Understanding of Requirements— Sub Factor 3 Alternate Designs. Contractors were reminded that if the full-design provided is used, contractors shall provide a simple statement to that effect for this sub factor. The offeror shall understand that this is not a design build contract.

Amendment AM0001
Date of Question(s): 9 August, 2010
Question 101: Section 01 19 41 states:
1.4 DESIGN REQUIREMENTS
“The floating breakwater material shall be post-tensioned concrete. The configuration shall be such as to provide a minimum width of 6.4 meters and a minimum unladen draft of 1.3 meters
a) Will alternate design materials and configurations (such as galvanized steel float sections with corrosion protection) be considered if shown to meet the performance requirements identified in Section 01 19 41 through submitted calculations?
b) If not, this requirement severely limits the scope of any alternative designs. Is that the intent?
Answer 101:
a) No. The solicitation documents remain unchanged as a result of this question.
b) No. The solicitation documents remain unchanged as a result of this question.
Question 102:
a) How are alternate designs submitted?
b) Is the Bidder’s RFP response to include a response for both the USACE floating breakwater
AND an alternate design?
c) Is submission of only an alternate design proposal acceptable?
d) Can a bidder get pre-approval of an alternate design prior to submission of proposal?
Answer 102:
a) Please see Section 00 22 11 – Evaluation Factors for Award, Part III: PROPOSAL
SUBMITTAL REQUIREMENTS, VOLUME I – TECHNICAL PROPOSAL, TAB C –
UNDERSTANDING OF REQUIREMENTS on Page 26 of 88. Sub-factor “3. Alternate Designs” identifies whether the proposal will be for the full design provided, or for an alternate design. The solicitation documents remain unchanged as a result of this question.
b) No. The solicitation documents remain unchanged as a result of this question.
c) Yes. The solicitation documents remain unchanged as a result of this question.
d) No. The solicitation documents remain unchanged as a result of this question.
Question 103:
a) Will alternate breakwater layouts be considered which provide better vessel access and more room within the harbor?
b) Does the permit allow relocation/reconfiguration of the breakwater?
Answer 103:
a) No. The solicitation documents remain unchanged as a result of this question.
b) The U.S. Army Corps of Engineers does not issue itself permits for our projects. Significant changes to the floating breakwater location/configuration would require additional coordination with state and federal agencies. Acceptance of changes cannot be guaranteed.
The solicitation documents remain unchanged as a result of this question.
Question 104: Could you provide a schedule and float configuration for the ongoing harbor project? We will need to determine if there will be conflicts with our installation vessels and the floats or float contractor’s vessels. Of most concern is the harbor side anchor installation.
Answer 104: No. Responsibility for coordination shall remain with the Contractor. Recommend contacting the
City of Unalaska for information on other contract work. The solicitation documents remain unchanged as a result of this question.
Date of Question(s): 10 August, 2010
Question 105: SF 1442 states performance must be completed within 920 days. 52.211-10, Commencement, Prosecution, and Completion of Work, Page 50 of 88, states completion no later than February 15, 2013. Please clarify.
Answer 105: Please see revised SF 1442 on sheet 1 of 88, which is part of this amendment (AM0001).
Date of Question(s): 11 August, 2010
Question 106: Drawing S3.02, Section “Module End Elevation”, indicates a draft of 1.5 meters (approximate). It that the intended draft with the module alone or with the tensioned anchor chains and clump weights?
Answer 106: The 1500mm dimension shown is to the center of the top row of post tensioning anchorages. The approximate still water line is shown just below the upper extension line of this dimension. Final, in-place, draft will depend on many things, including tide level, and will not be precisely the same for each module. The water line shown is approximate – as stated. The solicitation documents remain unchanged as a result of this question.
Question 107: With the design shown, could these modules be picked if the pick points were at the ends and webs?
Answer 107: Please see Section 03 31 29, paragraph 1.4.1 Analysis Requirements which requires the Contractor to submit analysis calculations, for approval, for all construction related activities. The Government does not preclude the possibility of safely lifting the modules; however the means and methods would be required to be per the Contractor’s registered engineer’s analysis. The solicitation documents remain unchanged as a result of this question.
Question 108: Will the contractor be paid for each float module after it is constructed by the vendor in Seattle (or nearby area) as stockpiled material?
Similar Question from 8/12/10: Clause 52.232-5, Payments under Fixed-Price Construction Contracts, allows for payment for off-site work at the Contracting Officer’s discretion. Since much of the work will be accomplished off-site (i.e.: fabrication of floating breakwater units), please elaborate on how and when this work is to be measured and paid.
Answer 108: Please see new clause EFARS 52.232-5000 PAYMENT FOR MATERIALS DELIVERED OFF-
SITE (MAR 1995), which is part of this amendment (AM0001).
Question 109:
a) Seems like there could be 2 scenarios on manufacturing the floats. Some contractors may build their own, some will go to a vendor.
b) Is it correct that the Davis/Bacon rates would only apply if the floats are built by the contractor, not purchased by a vendor?
c) Another question along the same line, this contract requires only Alaska residents work on the project. There again, would this apply only if the contractor built their own floats, or would it apply to a vendor as well?
d) If a vendor who, in the normal course of business, hauls freight, tows barges, etc., is hired to move the modules to Unalaska, it is my understanding that they would not have to be Alaska residents or pay Davis Bacon. Do you concur?
e) If the contractor uses their own personnel and equipment to move the modules from Washington (or general area), would we have to use Alaska residents and pay Davis Bacon?
Answer 109:
a) Please see: Section 01 19 41, paragraph 2.1 Concrete, page 5, which states in part, “Relaxation of the PCI Plant Certification requirements shall not be acceptable.”; Section 01 19 41, paragraph 1.5 QUALITY REQUIREMENTS, page 5, which states in part, “… the precast plant shall be certified by the PCI Plant Certification Program for Category C1 work for casting of floating breakwater modules.”; and Section 03 31 29, paragraph 1.9.1 Precast Plant Qualifications and Quality Control Procedures, page 13, which states in part, “Plants shall be certified by the PCI Certification Program for Category C3 work for casting of floating breakwater modules.” In order for Contractors to build their own floating breakwater modules, they must be PCI certified as indicated. The solicitation documents remain unchanged as a result of this question.
b) In accordance with FAR CLAUSE 22.404 -- Davis-Bacon Act Wage Determinations: “The wage determinations apply only to those laborers and mechanics employed by a contractor upon the site of the work including drivers who transport to or from the site materials and equipment used in the course of contract operations. Determinations are issued for different types of construction, such as building, heavy, highway, and residential (referred to as rate schedules), and apply only to the types of construction designated in the determination.”
FAR CLAUSE 22.401 describes the Definition of what is considered “Site of the work”—
(1) Means—
(i) The primary site of the work. The physical place or places where the construction called for in the contract will remain when work on it is completed; and
(ii) The secondary site of the work, if any. Any other site where a significant portion of the building or work is constructed, provided that such site is—
(A) Located in the United States; and
(B) Established specifically for the performance of the contract or project;
(2) Except as provided in paragraph (3) of this definition, includes fabrication plants, mobile factories, batch plants, borrow pits, job headquarters, tool yards, etc., provided—
(i) They are dedicated exclusively, or nearly so, to performance of the contract or project;
and
(ii) They are adjacent or virtually adjacent to the “primary site of the work” as defined in paragraphs (1)(i) of “the secondary site of the work” as defined in paragraph (1)(ii) of this definition;
(3) Does not include permanent home offices, branch plant establishments, fabrication plants, or tool yards of a contractor or subcontractor whose locations and continuance in operation are determined wholly without regard to a particular Federal contract or project. In addition, fabrication plants, batch plants, borrow pits, job headquarters, yards, etc., of a commercial or material supplier which are established by a supplier of materials for the project before opening of bids and not on the project site, are not included in the “site of the work.” Such permanent, previously established facilities are not a part of the “site of the work,” even if the operations for a period of time may be dedicated exclusively, or nearly so, to the performance of a contract.
c) U.S. Bureau of labor statistics indicate that National Unemployment rate is higher than Alaska’s unemployment rate therefore DFARS 252.222-7000 will be removed
d) Answer is the same as stated in 109(b)
e) Answer is the same as stated in 109(b) and (c)
Question 110: Could the concrete anchors be cast in the contractor’s yard using carpenters, etc., or do they have to be cast in some certified facility? It appears they are similar to what contractor’s normally build.
Similar Question from 8/12/10: Section 03 31 29-1.9.1 requires precast concrete work to be done in a precast concrete plant certified under PCI MNL-116 and meeting certain experience criteria.
May the anchor blocks and clump weights be manufactured by the contractor or must they be built in a PCI certified plant?
Answer 110: Please see: Section 01 19 41, paragraph 1.5 QUALITY REQUIREMENTS, page 5; and Section
03 31 29, paragraph 1.9.1 Precast Plant Qualifications and Quality Control Procedures, page 13.
Both of these paragraphs are specific that PCI certification requirements are for floating breakwater modules. Also please see Section 03 31 29, paragraph 2.2.3 e. which states in part, “Use of aggregate representative of that traditionally used in the Unalaska area shall be considered historically adequate for use in clump weight and anchor block concrete.” The solicitation documents remain unchanged as a result of this question.
Date of Question(s): 12 August, 2010
Question 111: Clause 52.236-7 requires the contractor to obtain any permits. Please state what permits, if any, are required for installation of the breakwater.
Answer 111: No additional permits are required for the Contractor to complete the contract work required within the construction boundary shown. Any permits required for the Contractor’s operations that are not explicitly part of the contractually required work shall be the responsibility of the Contractor. The solicitation documents remain unchanged as a result of this question.
Question 112:
a) Is a Corps of Engineers Permit required for this work?
b) Please provide copies of the E.I.S. and any permits furnished by the Government.
Answer 112:
a) No. The solicitation documents remain unchanged as a result of this question.
b) The E.I.S. (and associated Feasibility Report) is a planning document based, in part, on preliminary and conceptual designs. The final project design varies from what is presented in the E.I.S. and Feasibility Report. The solicitation documents take precedence in all cases where there are differences. The solicitation documents remain unchanged as a result of this question.
Question 113:
a) Is any of the project to be performed on Indian-owned land?
b) Is any tribal tax to be paid?
Answer 113:
a) No. All Real Estate requirements have been obtained for the Contractor to complete the contract work required within the construction boundary shown - without any third-party involvement. The Contractor shall be responsible to coordinate with local land owners for any of his requirements outside the construction boundary. The solicitation documents remain unchanged as a result of this question.
b) Not for the Contractor to complete the contract work required within the construction boundary shown. The Contractor shall be responsible to coordinate with local land owners for any of his requirements outside the construction boundary. The solicitation documents remain unchanged as a result of this question.
At the conclusion of the conference it was mentioned again that all questions need to be submitted to the contracting office via e-mail so that full attention can be given to the questions and all questions and answers will be posted to FedBizOps with all other corrections needing to be made to the solicitation.

Notes:
1. See SECTION 01 22 00.00 10 Measurement and Payment for work included in Bid Items.
EVALUATION OF BIDS:
1. INCOMPLETE BIDS: Failure to submit a bid on all items in the schedule will result in an incomplete bid and the bid will be rejected. Unit or lump sum prices must be shown for each item within the schedule.
2. AWARD: Award will be made to the low, responsive, responsible bidder on the total of all items.
3. EXTENSIONS: All extensions of the unit prices shown will be subject to verification by the Government.
In case of variation between the unit price and the extension, the unit price will be considered to be the bid.
4. SPECIAL BID CONDITION: If a modification to a bid based on unit prices is submitted which provides for a lump sum adjustment to the total estimated cost, the application of the lump sum adjustment to each unit price in the bid schedule must be stated. If it is not stated, the bidder agrees that the lump sum adjustment shall be applied on a pro rata basis to every unit price in the bid schedule.
5. EVALUATION OF OPTIONS (52.217-5 Jul 1990): The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the options.
