Appendix C: Superintendents
Superintendents
Refer to the FAR, part 52.236-6 “Superintendence by the Contractor”
As prescribed in 36.506:
“At all times during performance of this contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the work a competent superintendent who is satisfactory to the Contracting Officer and has authority to act for the Contractor.”
For the Paving IDIQ, a superintendent will be required for each task order and must be present when active construction is being conducted.
It is acknowledged by the Government that the number of active task orders (TO) will increase with time. Historically, similar type contracts have developed between twenty (20) to sixty (60) concurrent, active task orders. A typical TO period of performance (POP) may range from thirty (30) to one-hundred eighty (180) days. Because of this, Period of Performances between schedules will overlap.
Where TO’s are within close proximity and otherwise operate as a single worksite, the contracting officer (KO) may permit the contractor to provide superintendence for separate task orders with a single superintendent. This is solely at the discretion of the contract KO. The contractor must submit a request with supporting justification to the KO via an official RFI.
Examples
1. A task order is awarded for paving work on a specific street within the Fort Hood Main Cantonment. A separate paving task order has ongoing construction on an adjacent or intersecting street. The contractor finds that periods of active construction will overlap and feels this instance may qualify to be considered a single work site. The contractor then requests permission to permit a single superintendent for both TO’s. After review, the contract KO validates the contractor’s request and permits superintendence by a single person.
2. A task order is awarded for the paving of a parking lot located at North Fort Hood. A separate task order is awarded in the same week for paving work within the Main Cantonment. Because of the distance between the two task orders, a dedicated superintendent for each task order is required.
