About this file

This file is an addendum to FAR 52.212-2 establishing evaluation criteria for a commercial items acquisition for Non-Tactical Vehicle Rental under solicitation W90VN926QA021 issued by the Department of the Army Materiel Command Army Contracting Command. The Government intends to award one Firm Fixed Price contract for the complete scope of work as specified in the Performance Work Statement, with quotes that include fewer items or work than specified deemed ineligible for award. The Government plans to evaluate and award without interchanges, though reserves the right to conduct interchanges if deemed necessary by the Contracting Officer.

Quotes will be evaluated on two primary factors: (1) Technical, rated as Acceptable or Unacceptable, which assesses the offeror's technical capability to perform all required tasks per the PWS including staffing, skill sets, resources, production outputs, service delivery, and infrastructure; and Local Source Eligibility demonstrating ROK licensing compliance and authorization to perform as a local Korean contractor under the US-ROK SOFA; and (2) Past Performance, rated as Acceptable or Unacceptable, evaluated based on recent and relevant experience in shower trailer service within the last five years, with neutral past performance considered acceptable. Price analysis will be conducted to ensure completeness and reasonableness. Notably, the acquisition is limited to local contractors already doing business in Korea or those that can demonstrate requisite authorization and capacity from the ROK Government in their initial quote; failure to fully demonstrate this authorization will result in elimination from consideration.

Addendum to FAR 52.212-2 Evaluation – Commercial Items

Basis of Award: This source selection follows the procedures outlined in the Federal Acquisition Regulation. Offers will be evaluated based on criteria outlined in ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS -COMMERCIAL ITEMS. The Government will base the award decision on price and other factors. Noncompliance with the Request for Quote (RFQ) requirements may hinder the Government's ability to properly assess the quote, potentially leading to its elimination from further consideration for contract award.

Award for the Entirety of the Work: The Government intends to award one Firm Fixed Price (FFP) contract based on the complete specifications in the Performance Work Statement (PWS). Quotes that include fewer items or work than those listed in the specifications will be deemed ineligible for award. The Government plans to evaluate and award the contract without interchanges with contractors. Therefore, contractors should submit their quote best terms in their initial, considering both price and technical aspects. However, the Government reserves the right to conduct interchanges in if quote deemed necessary by the Contracting Officer.

Evaluation Criteria: Quotes will be evaluated based on two factors and will be applied in accordance with the Performance Work Statement (PWS):

FACTOR I - TECHNICAL: The quote shall be evaluated to determine the offeror's ability and technical approach to satisfactorily accomplish the quote Government's intent and achieve the desired quality end-products. A demonstration of an adequate understanding and approach to meeting the quote requirements will be deemed technically acceptable. If an offeror fails to meet the minimum requirements outlined in one of the two (2) subfactors below, the subfactor, and overall quote will be rated "unacceptable" and will not be eligible for award

b. References will be contacted by phone or email to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.

c. The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)).
