Army Contract Writing System (ACWS) Transition Information for Offerors
a. The Army Contracting Enterprise (ACE) is in the process of deploying new solicitation and contract writing software to Army contracting offices worldwide. Known as the Army Contract Writing System (ACWS), this modern software suite will soon replace most existing Army contract writing systems, including the system used to create and release this Solicitation.
b. During this transition period, Offerors are hereby advised:
1. The Contracting Office may use any combination of contract writing systems to create and release documents related to this solicitation (e.g. solicitation amendments and awards, if any). Due to this:
i. This solicitation may contain different offer submission instructions than other solicitations released by the same Contracting Office (e.g. requiring offer submission via the PIEE Solicitation Module vs. e-mail). Offerors should review all offer submission instructions contained in the solicitation documents and direct any questions or concerns to the Contract Specialist or Contracting Officer.
ii. If the Contracting Office switches contract writing systems prior to award, documents you receive from the Contracting Officer or view on SAM.gov or other forums may appear noticeably different than the initial solicitation or previous solicitations or awards from the same Contracting Office. This is normal and expected.
iii. A change between contract writing systems may cause important information concerning solicitation response (amendments) or accepted terms (awards) to take on different formatting or appear in different parts of later documents issued. Offerors shall review all documents carefully to locate this important information and direct any questions or concerns to the Contract Specialist or Contracting Officer.
2. The Government does not intend to use the transition between contract writing systems to effect any changes to solicitation or award terms and conditions without accompanying document narratives explicitly stating such changes are deliberate and desired. While the Contract Specialist and Contracting Officer will take care to minimize or eliminate any inadvertent changes when adapting to the new contract writing software, you, as the Offeror, may still be the first to spot such errors. Therefore, Offerors shall:
i. Notify the Contracting Officer immediately if any observed changes, removals, or additions affect your award eligibility, violate or alter existing quote/proposal terms, or could affect Contract performance post-award.
ii. Take special care to ensure all fill-in Clauses are populated and remain populated across documents received from the Contracting Office throughout the Solicitation and Award process.
iii. Contact the Contracting Officer listed on the first page of the solicitation or solicitation amendment for guidance if you notice or suspect any inadvertent change has occurred between document issuances.
3. The Contracting Officer will correct problems affecting award documents (if any) via bilateral modification, at no cost to the Contractor. Any such modification will reconcile the award with the latest version of this solicitation reflecting deliberate action by the Contracting Officer (e.g. the first issuance if no amendments, or the latest amendment with accompanying narratives), inclusive of any documented pre-award negotiations or accepted supplemental offer terms.
4. In the unlikely event a network disruption, contract writing system error, or financial system error threatens timely award of the requirement set forth in this solicitation, the Contracting Officer:
i. May elect to use alternative mechanisms to obligate funds and allow work or deliveries to legally begin to the benefit of, and with legal protection for, both parties.
ii. Will incorporate the latest version of this Solicitation into such mechanisms to serve as a framework for contract execution until any such system problems are resolved.
iii. Will ensure any action taken does not conflict with the stated offer evaluation and award methodology of this requirement.
iv. Will issue a complete, properly-formatted award accurately reflecting this requirement and all applicable terms and conditions once systems return to normal.
(END OF ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES (SEP 2023))
ADDENDUM TO FAR 52.212-2
ADDENDUM TO FAR 52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL
SERVICES (NOV 2021)
The Government will establish multiple-award BPAs resulting from this solicitation to the responsible offerors submitting the lowest priced technically acceptable offer that satisfies all terms and conditions of this solicitation.
Award will be made to the responsible offeror submitting the Lowest Priced Technically Acceptable (LPTA) offer that satisfies all terms and conditions of the solicitation. Offers will be evaluated for acceptability, but not ranked using the non-price factors/subfactors. All non-price factors and subfactors will be rated as either “acceptable” or “unacceptable”. In order to be considered for award, there must be an “acceptable” rating in every non-price factor/subfactor. In other words, a rating of “unacceptable” for any factor or subfactor will result in the entire offer being rated “unacceptable”.
Award will be based on all or none basis.
FACTOR I. TECHNICAL: Each factor and subfactor will be rated either acceptable or unacceptable. A rating of unacceptable for any factor or subfactor will result in an overall unacceptable rating. If an offeror fails to meet the minimum requirements outlined in one of the three (3) subfactors below, the subfactor, and overall proposal will be rated “unacceptable” and will not be eligible for award.
Technical Ratings Rating Description Acceptable Proposal meets the minimum requirements of the solicitation Unacceptable Proposal does not meet the minimum requirements of the solicitation
Sub-Factor 1 - Prime BPA Holder’s Business License/Registration: The offeror shall have (1) Cargo Vehicle
Transportation Business Permission (화물자동차 운송사업 허가) issued by Republic of Korea (ROK) and Cargo
Vehicle Arrangement Business Permission (화물자동차 운송 주선 사업 허가증) issued by Republic of Korea (ROK). Submission of subcontractor’s business permissions is not allowable. (2) Gas Safety Management
Certification (가스안전관리 자격증) issued by Korea Gas Safety Corporation (한국가스 안전공사) or a Gas
Craftsman Certification (가스기능사자격증) issued by Human Resources Development Service of Korea
(한국산업 인력공단). This license shall maintain throughout the life of BPA, and a copy of it shall be submitted to the Contracting Officer (KO) as a part of technical proposal.
Sub-Factor 2 - Prime BPA Holder’s Prior Experience: The offeror shall have an evidence at least two (2) years of same or similar prior work experience in moving furniture and appliances last seven (7) years from the issuance date of solicitation. The BPA holder shall provide all necessary information of prior experience as a part of technical evaluation factor when submitting the proposal. The offeror shall provide evidence of relevant past experience as required below:
- Title of the contract/project
- A brief description of work completed
- Value of contract
- Length of contract/project (year/month/date – year/month/date)
- Complete name of point of contact for client organization.
Sub-Factor 3 – Minimum transportation and manpower requirement: The offeror shall have 1 Truck (2.5~5 ton) licensed, registered as commercial (business) use by a company or owner of a company in accordance with
Cargo Vehicle Transportation Business Permission (화물자동차 운송사업 허가) issued by Republic of Korea
(ROK) and Cargo Vehicle Arrangement Business Permission (화물자동차 운송 주선 사업 허가증) issued by Republic of Korea (ROK) and 2 field staff per delivery/pick-up call.
Note 1: To be determined responsible, a prospective contractor must meet FAR 9.104-1 General standards.
Note 2: To be determined technically acceptable, the submitted specification must meet salient characteristics stated in the PWS of this solicitation.
FACTOR II. PAST PERFORMANCE:
The past performance will be evaluated for all offeror’s proposals by the Contract Specialist / Contracting Officer in the following manner:
(1) Review of the detailed explanation submitted by Offerors demonstrating the relevance of the references to the requirements of the solicitation.
(2) References will be contacted by phone or email to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.
(3) The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance The following ratings will be used in evaluating Past Performance:
Technical Ratings Rating Description Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown (see note below).
Unacceptable Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a) (2) (iv)).
Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.
FACTOR III. PRICE PROPOSAL: Proposed price will be evaluated Price Schedule identified for five (5) years.
Any underlying assumption including proposed escalation rates between the base and subsequent periods shall be clearly explained. All pricing shall be quoted in Korean currency. Proposed price will be evaluated to ensure completeness, reasonableness, and balanced to assess the offeror's understanding of the solicitation. The pricing quote will be evaluated in accordance with FAR 15.404-1 (b).
The following applies to that evaluation.
(1) Completeness. The offeror shall complete the pricing information for all CLINs/Sub-CLINs identified for base period plus four (4) ordering periods. Any underlying assumptions including proposed escalation rates between the 1st and subsequent periods shall be clearly explained.
(2) Price Reasonableness. Price should also reflect fair market value and be reasonable when compared to the independent government estimate, current market prices for same or similar services and/or when compared among other technically acceptable offerors.
(3) Unbalanced Pricing. As part of the price evaluation, proposals will be evaluated to identify any unbalanced pricing. IAW FAR 15.404-1(g)(3), Unbalanced Pricing, a quote may be rejected if the Contracting Officer determines the lack of balance poses an unacceptable risk to the Government.
(4) Price is not scored. The Government will review the price proposal to determine the extent to which it is reasonable balance, and consistent with the technical proposal. The lowest price for award purposes will be the combined total of the effective period of five (5) ordering period from the date of award. Price must include all CLINs as listed on the Price Schedule. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.
NOTICE OF AWARD: A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award than minor clarifications unless discussions are later determined to be necessary.
