The Army Contracting Command - Rock Island (ACC-RI) hereby issues the solicitation, W9099S21R0020, for Concrete Work at Rock Island Arsenal, Joint Manufacturing and Technology Center (RIA-JMTC).
This Request for Proposal (RFP) is issued as a 100% Small Business Set Aside.
In accordance w ith Federal Acquisition Regulation (FAR) 36.204, Disclosure of the magnitude of construction projects, the total estimated magnitude of construction is betw een $250,000 and $500,000.
A pre-construction site visit is scheduled for 10:00 AM CT on 31 August 2021, at Rock Island Arsenal - Joint Manufacturing and Technology Center (RIA-JMTC) w ith Government representatices at the large parking lot turn-style (only one cannon on desplay). The large parking lot is located off of Beck Avenue by Building 212. See Attachment 0002 Site VIsit Meeting Place Map. RESERVATIONS FOR THIS SITE VISIT ARE MANDATORY AT LEAST THREE (3) BUSINESS DAYS PRIOR TO THE SITE VISIT. See Solicitation Narrative Number 4 and FAR 52.236-27 Site Visit (Construction) (Feb 1995) for furhter information and for registration instructions.

Section 00 10 00 - Solicitation
SOLICITATION NARRATIVE
ADDENDUM TO 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL
1. The Army Contracting Command – Rock Island (ACC-RI) hereby issues the solicitation, W9098S21R0020, for Concrete Work Project at Rock Island Arsenal, Joint Manufacturing and Technology Center (RIA-JMTC). This solicitation is issued in accordance with Federal Acquisition Regulation (FAR) Part 12 (Acquisition of Commercial Items) and FAR Part 13 (Simplified Acquisition Procedures).
The Government intends to award one (1) Firm Fixed Price (FFP) Contract to the lowest price, responsive, and responsible contractor whose proposal conforms to the terms and conditions of the solicitation and represents the lowest total evaluated price. Contractors are responsible for providing their best price at the time of the proposal submission. Contractor’s responsibility will be determined as outlined in FAR 9.104-1. The Government intends to evaluate the proposals and issue an award without discussions with Offerors (except for clarifications as described in FAR 15.306(a)).
2. The Government anticipates price competition, therefore, cost data is not required to be submitted with the offeror’s proposal. However, the Government reserves the right to request cost data in the event price competition does not exist.
3. The Period of Performance begins 3 January 2022 with completion no later than 17 February 2022.
4. SITE VISIT INFORMATION
52.236-27 SITE VISIT (CONSTRUCTION) (Feb 1995)
(a) The clauses at 52.236-2, Differing Site Conditions, and 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed.
(b) A pre-construction site visit is scheduled for 10:00AM Central Time on 31 August 2021, at Rock Island Arsenal

********PLEASE READ CAREFULLY – VERY IMPORTANT********
DUE TO THE CURRENT CONDITIONS WITH COVID-19 THE SITE VISIT WILL BE CONDUCTED
UTILIZING THE FOLLOWING SOCIAL DISTANCIING GUIDELINES IN ACCORDANCE WITH THE
CENTER FOR DISEASE CONTROL (CDC).
THE SITE VISIT WILL BE LIMITED TO 10 PEOPLE INCLUDING GOVERNMENT PERSONNEL. IF
NECESSARY MULTIPLE SITE VISITS WILL BE SCHEDULED AND YOU WILL BE NOTIFIED OF AN
ALTERNATE TIME.
ONLY ONE (1) REPRESENTATIVE FROM YOUR COMPANY IS ALLOWED TO ATTEND THE SITE VISIT.
ALL ATTENDEES WILL BE REQUIRED TO WEAR STEEL TOED SAFETY SHOES, SAFETY GLASSES
AND FACE COVERING IN ACCORDANCE WITH CDC GUIDELINES.
ALL ATTENDEES AND GOVERNMENT PERSONNEL WILL REMAIN A MINIMUM OF 6 FEET APART AT
ALL TIMES.
RESERVATIONS FOR THIS SITE VISIT ARE MANDATORY FOR ALL ATTENDEES AT LEAST

5. Offerors are cautioned to ensure their proposals are fully complete, including all fill-ins and blanks in the Request For Proposal (RFP). Any offeror submitting a proposal agrees by submission that their proposal and the prices contained therein will be valid for a period of 60 calendar days after receipt of final proposals. Proposals shall be submitted via email to Contract Specialist, MichelleAnn Sanchez at michelleann.g.sanchez.civ@mail.mil.
6. PLEASE NOTE: Offerors must complete the following provisions. Failure to comply may result in your proposal being considered non-compliant.

PLEASE NOTE: Offerors are cautioned to ensure that their quote is fully complete, including all fill-ins and blanks in the solicitation. Pricing should be documented directly on the CLIN information and proposed pricing is limited to two decimal places in the solicitation.
7. Payment will be made by the Defense Finance and Accounting Service (DFAS) via Wide Area Workflow
(WAWF).
Attention: Rock Island Arsenal (RIA) is at a Health Force Protection Condition (HPCON) Bravo. The installation is restricted to key and essential personnel only, contractors and deliveries; it remains closed to non-official visitors and recreational visitors. RIA will suspend all current year-long passes and make other changes limiting access to RIA to official business. These changes are being made to limit the opportunity for COVID-19 transmission.
Effective Immediately: Rock Island Arsenal (RIA) Visitor Access Passes are issued to individuals, not companies.
All visitors, to include transportation and freight services, official and unofficial, are highly suggested to pre-register at least three (3) business days in advance. Pre-registering visitors allows for the NCIC-III background check to be conducted before the individual visits RIA, reducing the wait time necessary to complete the check.
All visitors must complete a Visitor Access Request Form. Access Request Forms should be emailed or faxed prior to the delivery. The Visitor Access Request Form can be found at http://www.usagria.army.mil/AccessRequests.
Follow the instructions on How to Obtain a Visitor Pass. All first time visitors must process through the Moline Gate Visitor Center.
TRUCKS MUST ENTER THROUGH MOLINE, IL GATE, OFF OF RIVER DRIVE IN MOLINE I-74.
Transportation Service Providers are required to send drivers with proper identification who meet all the installation access requirements. Transportation Service Providers are required to send United States Citizens and drivers that will pass applicable background checks. Failure to do so can result in warnings or non-use. Real-ID access implementation is active at Rock Island Arsenal, IL. Individuals using a driver’s license from the states of Minnesota, Missouri, and Washington are not compliant with the standards of the REAL ID Act and cannot be used on their own as a primary means of identification to apply for access to Rock Island Arsenal. Drivers Licenses that have written on the top of them, “NOT FOR FEDERAL IDENTIFICATION PURPOSES” are also non-compliant.
These non-compliant driver’s license or state issued identification cards may still be presented at the Rock Island Visitor Control Center, but they must be accompanied by one of the following secondary forms of identification before a records check is conducted and installation access is granted:

SUPPLEMENTAL INFORMATION
1. ROCK ISLAND ARSENAL SAFETY REQUIREMENTS
A. All Contractors and Contractor personnel coming on to Arsenal Island must comply with the Rock Island Arsenal/Joint Manufacturing and Technology Center (RIA-JMTC), other Arsenal Island safety requirements and all federal, state, and local safety laws and regulations.
B. Contractors must provide their employees with, and the employees must use, all required safety equipment necessary for the work they are performing and/or the areas they are in.
C. This includes safety glasses, safety shoes, proper clothing, proper protective equipment and rigging.
D. All drivers on Arsenal Island must use seatbelts at all times when driving a motor vehicle.

2. ROCK ISLAND ARSENAL LAW ENFORCEMENT, SECURITY, AND FIRE PREVENTION
REQUIREMENTS
A. Any contractor personnel entering Rock Island Arsenal (RIA) as a result of this order/contract are required to adhere to all regulations governing safety, law enforcement, security, and fire prevention in effect at the time of entrance. Failure to comply with said regulations may result in immediate removal from RIA. The contractor shall bear full responsibility of the consequences of said removal. Further clarifications of RIA regulations are available from the Contracting Officer of this order/contract.
B. BADGING: ALL contractors who are performing services within the confines of Rock Island Arsenal are required to obtain a visitor badge. Contractors shall coordinate with Contracting Officer/Specialist and (if applicable) the Contracting Officer’s Representative (COR) designated for the contract/order.
C. Contractors are required to display provided visitor badges above the waist in a conspicuous place on the upper part of the body. Badges are accountable and are required by the recipient to be safeguarded at all times to prevent theft, loss of misuse by unauthorized personnel.
D. PARKING: All parking is on a first come, first served basis, provided the parking space is not posted with a reserved, visitor, or Handicapped parking sign. Parking is allowed in “marked” spaces only. All valid spaces are clearly marked with white lines on both sides of the space. Vehicles parked in other than valid spaces are subject to being issued parking tickets.
E. Contractors will not be allowed in restricted areas of the Arsenal without proper identification and authorization.
F. INSEPCTIONS: All contractor employee’s vehicles, equipment, and packages are subject to inspection or examination at entry/exit of the Arsenal.
G. SMOKING POLICY: Indoor smoking is not permitted. Outside smoking must occur at least 50 feet from any building entrance and exit.

3. PHOTOGRAPHIC EQUIPMENT RESTRICTIONS
There are restrictions on the use of photographic devices in all non-public areas of Arsenal Island. This includes digital cameras, cell phones and PDAs with cameras. You must get permission to use any type of photographic device in any non-public area on Arsenal Island. All requests must be coordinated with the Contracting Officer’s Representative (COR) or designated Contracting Officer for this effort prior to using any photographic device.

4. CONCEALED CARRY RESTRICTIONS
Concealed carry permits do not apply on military installations. Contractors and delivery drivers shall ensure there are NO weapons or ammunition in their vehicles prior to entering the installation; a K-9 unit will find and alert if any prohibited items are detected.

(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 238110.

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (AUG 2020)
(a)(1) The Offeror certifies, to the best of its knowledge and belief, that-
(i) The Offeror and/or any of its Principals-
(A) Are ( ) are not ( ) presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(B) Have ( ) have not ( ), within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and

A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
(ii) The Offeror has ( ) has not ( ), within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager;
head of a division or business segment; and similar positions).
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (NOV 2020)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern--
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13
CFR 121.103.
(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract.
(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract.
