Please resolve conflicting instructions.
L.8.8. moved to L.9.7. The Business System Information and Accounting System Information shall be contained in Volume VII.
L.8.1 Paragraph 2: "Offerors shall submit the basis of estimates and include other than cost or pricing data (CLIN-by-CLIN) in support of all CLINs." Please clarify and provide the definition of "other than cost or pricing data". This statement seems to be in conflict with L.8.1 Paragraph 1 - "All information relating to cost or pricing must be included in this section of the proposal and defined as cost data."
There is no conflict. Such data may include the identical types of data as certified cost or pricing data, consistent with Table 15-2 of 15.408, but without the certification.”
RFP L.8 The last paragraph of L.8 states: The Offeror shall identify their proposed hours, by labor category, for a
30 day phase in period for each Task Order. Please clarify these hours should be contained in the Pricing Worksheet for TO#1 (Attachment 4.3) or TO#2 (Attachment 5.3), not Attachment 7.
That is correct

Each tasking area will be evaluated independently so offerors that bid two tasking areas are not given a higher "priority" than an offeror that bids only one. The Government realizes that offerors may not have the expertise in more than one tasking area. There are no limitations on SBs to compete across all 5 tasking areas.
Solicitation L.4 (Volume II: Factor 2 - Technical Approach) & Section L.1.5 Section L.4 of the solicitation indicates "If there are risks in the Offeror’s proposed technical approach, the Offeror shall identify the risks and provide their plan to mitigate the identified risks. Section L.1.5 indicates "Proposals shall clearly and convincingly demonstrate that the Offeror has a thorough understanding of the entire requirement and associated risks, has the resources necessary to meet the requirement, and a valid and practical solution for the requirement "
To clarify, is the offeror to describe known risks and their proposed mitigation approach to these risks in Volume II, or are they to identify risks in their management approach in Volume I?
In accordance with the Instructions to Offerors L.4 Volume II: Factor 2 - Technical Approach: "If there are risks in the Offeror’s proposed technical approach, the Offeror shall identify the risks and provide their plan to mitigate the identified risks."
Solicitation L.7.3… Section L.7.3 of the solicitation requires:
"For each identified effort for a commercial customer, the offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the Offeror's performance."
Are state and local Government entities considered a "commercial customer" for the purposes of this requirement?
That is correct. State and local government entities may be considered a "commercial customer'.
Solicitation L.7.4 Section L.7.4 of the solicitation requires relevant past performance documentation that is within three years of the proposal due date. Which date does the three year restriction apply to - the award date or the completion date? This is important in instances where a contract might have been awarded more than 3 years ago, but was a multi-year contract/had option years that were executed within the last three years.
Past performance within 3 years refers to work that is being performed within the last 3 years regardless of when the award was made.
Solicitation L.7.4 Section L.7.4 of the solicitation requires relevant past performance documentation that is within three years of the proposal due date. Is the offeror allowed to list one IDIQ contract, or must they provide past performance at the task order level?
Past performance documentation should include relevant work performed. If the IDIQ is relevant, then the offeror may list the IDIQ. However, in order to obtain performance information, the task order level would provide more comprehensive information on performance.
Solicitation Section L.8.6. Price Workbook The Offeror shall complete Attachment 7 - Cost-Pricing Workbook provided with this solicitation (to include all Worksheets within the Workbook) to submit labor categories for the entire period of performance. Offerors may not alter pre-existing formulas within the workbook except as noted in the instructions.
Request the Government either 1) remove this requirement, or 2) provide the list of Labor Categories (and specific site locations) for offerors to price.
Labor rates are highly sensitive to locality, and providing ceiling rates without locality presents very high risk for the offerors. Recommend the Government provide specific locations for its proposed pricing.
On past versions of the TSS / TSS-E solicitation, the Government has provided a standard list of labor categories to price. We recommend removing the overall list of LCATS or, if the Government believes this is an important component of the IDIQ, then we recommend the Government issue standard LCATS for all offerors to utilize. This at least gives the Government an "apples to apples" comparison between offerors
1. No
2. No
Solicitation Section L.8.6.
If the Government intends to require "ceiling rates" across multiple labor categories, request they also provide a method for adjusting those rates to account for significant changes in local labor markets, inflation, recession, or other impacts to employee compensation that are not known at the present time.
The majority of the labor rates are subject to wage determinations and will be adjusted accordingly. Those labor rates that are not may be adjusted throughout the period of the MAIDIQ if needed.
Section L.8.6. Section L.8.6. states “Narratives regarding the Cost/Price Volume may be submitted in MS Word 2007 or higher format” in order to preserve formatting integrity, will the Government consider accepting a Pdf for the Narrative?
Narratives may be submitted as a .pdf.
Solicitation Section L.8.11.1 TAB A- Contractor Pricing for
MAIDIQ.
The offeror’s proposal shall be for a five year ordering period.
The Offeror is required to complete the attached Cost-Pricing Workbook (Attachment 7). In addition, the Offeror shall provide a basis of estimate (BOE) along with supporting documentation for the base labor rate and the indirect rates including the buildup to the fully burdened rates.
We do not understand the Government's intent when it asked for a Basis of Estimate (BOE) at the MAIDIQ level. The BOE is normally conducted at the Task Order level to determine the correct amount of hours and labor categories required to accomplish the tasks on that Task Order. Our BOE at the IDIQ level would have to make several assumptions about winning a percentage of task orders. This information is not currently available in the published documents. Recommend the Government provide standardized labor categories, with locations, and with expected hours, in order to allow offerors to bid reasonable rates.
Section L.8.11.1 revised. The original purpose was for each Offeror to provide the build-up of fully burdened labor rates along with a BOE for the base labor and indirect rates. The Government agrees that a list of labor categories should have been provided in the workbook IF we want to have not to exceed labor rates negotiated into the basis contract for which all contractors will use those rates as a not to exceed rate for pricing future TOs. However, there will not be any cost type CLINs requiring labor.
Solicitation Section M.8 (Vol I MAIDIX evaluation factors) Section M.8 of the solicitation indicates the Government will evaluate each resume for the contract manager and alternate contract manager as it relates to the TSS-E objectives. If the Offeror identifies other key personnel positions and provides resumes, will those resumes also be evaluated and rated?
Only those resumes requested by the Government and indicated as key will be evaluated and rated.
Solicitation Section M.8 (Volume I: Factor 1 - MAIDIQ…) Section M.8 of the solicitation contains the following sentence:
"Resumes indicating historical experience within the appropriate tasking area, while clearly demonstrates the ability to effectively lead and manage the TSS-E TO based on previous experience, proven skill to invoke positive change and process improvements, will be rated more favorably."
Will the Government re-word to clarify intent? The Government encourages all offerors to review Section M - Evaluation Factors for Award which identifies all the significant factors and any significant subfactors that will be considered in awarding the contract and their relative importance. Section M.8 states the Staffing, Recruitment, Retention Plan and Management Approach factors being evaluated, the adjectival ratings and description, and insight into how the evaluation occur.
Solicitation Section M.9 (Volume 2 Evaluation Factors) How will a small business proposing on both sub tasking areas be evaluated against a small business that proposes on only one?
The Government encourages all offerors to review section M.5 "Basis for Award" to gain understanding of the stated source selection process and relative order of importance. As stated in M.5.1, "The source selection process for TSS-E will be a Best Value, Subjective Tradeoff. The Source Selection Authority’s (SSA’s) award decision will be based on the SSA’s independent judgement of which proposals are the most advantageous to the Government. The award decision will be based on a comparative assessment of proposals against the source selection criteria (Sections L&M of the solicitation. "
Section K Clause 52.204-8 Around March 31, 2022 the Small Business Administration (SBA) increased the size standard for NAICS 541990 to $17M However, Section K Clause 52.204-8 in the RFP states the size standard as the outdated $16.5M. Would the Government consider updating Clause 52.204-8 to reflect the updated size standard of $17M for NAICS 541990?
The clause has been updated.
Section L.2.2.2(a) & Section L2.2.1 & Section L.2.2.(b) Section L.2.2.(a) states “Offerors shall submit an original and copies of its proposal in the formats and quantities identified herein.” The table in Section L.2.1. directs one (1) copy for each Volume. Given that the proposal will be submitted electronically in accordance with Section L.2.2.(b), does the Government require Offerors submit the original (e.g., MS Word) document AND a Read Only copy (e.g., Pdf)?
L.2.2 (a) changed to "Offerors shall submit only an original of its proposal in the formats identified herein."
Section L.2.2. (c)(5) & Section L.9.2. Section L.2.2. (c)(5) directs Offerors to submit the completed and signed SF33 with its’ Cover Letter.
Section L.9.2. directs Offerors to provide the completed and signed SF33 with Volume VII. Is it the Government’s intention to receive the same attachment with both Proposal documents (Cover Letter and Volume VII)?
Please insert the SF33 in Volume VII General Tab B.
Section L.4. Section L.4. states "The Small Business Offeror shall provide their technical approach to successfully perform the contract requirements for one or both tasking areas (Sustainable Range Program and/or LVCIA Support), to include all subtasking areas specified in the MAIDIQ PWS Section 5." In the same section the Unrestricted Offeror is directed to propose against all 5 tasking areas, "Mission Training Complex and LVC-IA Support" being one of those task areas. Can the Government please clarify which PWS sections are required as part of the Small Business required LVC-IA Support area? Specifically, are any Section 5 tasks aside from PWS 5.35 LVC-IA support required to demonstrate performance in LVC-IA? If so, please identify which are required.
Please refer to Section 1.4 Scope. All 5 tasking areas have been revised to include the appropriate subtasking areas.
105 Attachment 7 Can the government please confirm that the entries in the "Basic IDIQ" tab of Attachment 7 will be used to establish the Offeror's IDIQ Ceiling?
The MAIDIQ ceiling is $610M and will not be delineated with each offeror's IDIQ.
106 Attachment 7 Can the government please provide guidance on what level of effort Offerors should utilize to build the ceiling amounts at the IDIQ Level?
The MAIDIQ ceiling is $610M and will not be delineated with each offeror's IDIQ.
Section M.13.2 Total Evaluated Price (TEP) TO#1 or TO#2 Section M.13.2 references Attachment 7, as this is in reference to evaluating the TO pricing should this reference Attachment 4.3 (Unrestricted) and Attachment 5.3 (Small Business)?
Section M.13.2 updated to "The Total Evaluated Price (TEP) will consist of TO #1 or TO #2. This will be developed by adding the proposed CLIN prices made by the Government utilizing the Cost/Price WorkbookPricing Worksheets – Attachments 4.3 and/or 5.3 7. "
Solicitation Section M.13.5 Section M.13.5 is called Volume VII: General. Shouldn't this section be labeled M.14: General? If so can the Government please make the change and also change the sub bullets to reflect M.14.1 - M.14.6?
Section M.13.5 Volume VII- General remains unchanged.
L.6.7.1. Offerors shall provide evidence of compliance with the requirements of FAR clause 52.219-9, entitled “Small Business Subcontracting Plan,” for the past three (3) calendar years, from the release date of this solicitation, under no more than five (5) separate relevant Federal Government contracts.
Relevancy is defined as efforts of the same scope of the PWS/SOW/Specification associated with this RFP.
Could a prime offeror confirm compliance with FAR clause 52-219-9 if they have a MAC IDIQ that requires a subcontracting plan, but they do not have a task order against the MAC IDIQ contract? If the prime offeror cannot provide evidence of complaince with FAR clause 52-219-9, could the prime offeror still submit a bid and not be thrown out on compliance?
A subcontracting plan is required for all Large Businesses regardless of task order award.
Attachment 7 (as related to Attachment 5.3) Will the Government please confirm that Attachment 7, "Cost Pricing Workbook" is not used for the Total Evaluated Price comparisons among Offerors, except to the extent to confirm that the Total Evaluated Price shown in Attachment 5.3, "Small Business Pricing Workbook", is based on the build-up provided in this Attachment 7?
Attachment 7 is to be utilized to provide the labor categories that the offeror anticipates utilizing throughout the period of performance. This workbook contains many yellow highlighted areas in the various worksheets (labor descriptions, indirect rates, labor rate buildup). This workbook provides the Government with the listing of labor categories and their associated rates. Attachments 4.3 and 5.3 are to be used to price the task order CLINs. It will not be used as a comparison among Offerors.
Refs. L.2.2 Proposal Format, “(b) Digital copies shall be provided in Microsoft Word 2007 or newer, PowerPoint, .pdf and/or Excel, in Times New Roman 12 pt font…”, and “(i) …Letter size and spacing requirements for illustrations and tables can be at the discretion of the Offeror but must be easily readable…”
Times New Roman is effectively a text font. For the sake of “easy readability” and simplicity, would it be acceptable to produce illustrations for this proposal in a sans-serif font (e.g., Arial)?
No
RFP B.4: Multiple Award Minimums This section details that, "Task orders will be issued against the contracts under the fair opportunity procedures specified in FAR 16.505." Will awardees in the Small Business Lot be given the opportunity to bid on task orders in the Unrestricted Lot?
Yes, contract holders in the Small Business Lot will be given an opportunity to bid at the same time as the Unrestricted contract holders.
RFP B.1.2 Material Burden B.1.2 states that the proposed offeror handling fee rate will become the fee rate for the contract and shall not be changed over the life of the contract. Please clarify as material handling rates/burden are variable rates not fee.
Each Offeror is requested to propose their mark up for handling materials which will become the set rate of markup for the life of the contract.
RFP L.1.3: Proposal Preparation Instructions Given the volume of questions and their importance to our proposal response, would the Government please provide a proposal due date extention of a minimum two (2) weeks AFTER answers are posted?
The Government will adjust the due dates as needed.
