CPARS

Contractor Performance Assessment Reporting System (CPARS) (June 2015) (USAMRAA)

A CPARS assesses a contractor's performance and provides a record, both positive and negative, on a given contractor during a specific period of time. Each assessment is based on objective facts and supported by program and contract management data, such as cost performance reports, customer comments, quality reviews, technical interchange meetings, financial solvency assessments, construction/production management reviews, contractor operations reviews, functional performance evaluations, and earned contract incentives. Performance evaluations are transmitted into the Past Performance Information Retrieval System (PPIRS) which is used by government agencies to assess contractor past performance for future acquisitions. The contractor shall appoint a Contractor Representative (CR) and provide this information to the Contracting Officer (KO) within 10 calendar days of award.

The contractor POC shall have the authority to comment on the CPAR assessment on behalf of their company and within the timeframes established.

A CPARS assessment must be completed within 120 calendar days after the evaluation. Evaluations are sent to PPIRS within 14 calendar days after the government Assessing Official (AO) has submitted the rating. If the CR has not concurred/non- concurred with the rating; PPIRS will show the government evaluation as “Contractor Comment Pending Review”. The CR has a total of 60 calendar days to concur/non- concur with the assessment.

After 60 days, the CR can either concur/non-cur. The CR has the authority to: access the Government evaluation;

review/comment/concur or non-concur with the assessment within 60 calendar days after notification of the government’s assessment. The CR has the right to request a meeting (in writing) with the government within 7 calendar days of notification of an assessment. Once the government and the CR complete the evaluation; an automatic update will be sent to PPIRS and visible for Source Selection. If the CR fails to respond within 60 days, the assessment will be finalized. Training for CPARS can be found on the CPARS website: https://www.cpars.gov/

To access CPARS, the contractor must have a Public Key Infrastructure (PKI). It is suggested an ECA certificate of Medium Assurance should be purchased. This should be a Department of Defense identity certificate, not an e-mail certificate.

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Each offer submitted will be evaluated separately. – NOT APPLICABLE

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Order of Importance (in acceding order):

Factor (1) Technical Approach Factor (2) Experience Factor (3) Past Performance Factor (4) Price

Basis for Award: Award of this requirement will be made on a competitive best value basis, using “best value tradeoff” among cost/price and non-cost/price factors. A best value tradeoff process will be used, thus, the Government may elect to award to other than the lowest priced offeror, or other than the offeror with the highest rated non-cost/price proposal. Past Performance will be evaluated independently from the other non-cost/price evaluation factors using different standards.

Government evaluators will not assume that the Offeror possesses any capability or knowledge unless it is specified in the proposal. After each of the non-cost/price factors is rated individually, an overall rating will be assigned collectively to these factors. If any of the above non-cost/price evaluation factors receives an individual rating of “Unacceptable,” the collective overall rating will also be “Unacceptable.” Only proposals receiving an overall rating of “Acceptable” or higher will be considered for award.

The non-cost/price factors are more important than cost/price. However, as Offeror’s non-cost/price factors are rated similar or equal, cost/price becomes more important.

Non-Cost/Price Evaluation Criteria:

The following criteria will be used to evaluate the non-cost/price aspects of the proposal.

(1) Technical Approach: The technical approach shall be evaluated to the degree to which the Offeror’s technical approach demonstrates:

Offeror’s approach to overall understanding of industrial hygiene assessments at industrial, medical, and administrative facilities that shall include: Basic Characterization, Re-Baseline Survey, Ventilation System Evaluation, Noise Source Surveys, and Noise Dosimetry.

Offeror’s clear understanding of the tasks, methodology and flexibility that will be used in accomplishing the tasks set forth in the PWS.

How Offeror’s approach is likely to yield the required results within the required timeframe of fifteen (15) business days for CONUS onsite assessments (not including travel time) and twenty (20) business days (not including travel time) for OCONUS onsite assessments.

(2) Experience: The Offeror’s proposal will be evaluated to the degree to which the Offeror’s proposal effectively demonstrates the Offeror’s relevant corporate experience identical to, similar to or related to performing services contained within the PWS. The Offeror’s experience (for this purpose, experience refers to what an Offeror has done, not how well it was accomplished) in performing proposed processes and procedures; the amount of relevant corporate experience the Offeror possesses, as well as demonstrate the amount of relevant experience possessed by the proposed Key Personnel; and that the organization has current capabilities for assuring performance of this requirement, which includes but not limited to use of the Defense Occupational and Environmental Health Readiness System-Industrial Hygiene (DOEHRS-IH). Evidence of supporting subcontractors, consultants, and business partners will be considered. The Offeror will be evaluated to the degree to which the Offeror demonstrates Key Personnel’s experience that is identical to, similar to or related to that reflects appropriate mix and balance of education and training.

Key Personnel experience:

(1) Program Manager - Demonstrated broad base experience in safety and occupational health in executing and managing performance/Industrial hygiene assessments.

(2) Certified Industrial Hygienist (CIH) – Demonstrated broad base experience in performing evaluation of work environments and industrial processes and shall be currently certified by the American Board of Industrial Hygiene

(ABIH).

(3) Quality Assurance Manager – Demonstrated broad base experience in performing industrial hygiene and industrial processes.

For all individuals proposed to fill Key Personnel positions, Offeror shall submit resumes and signed letter(s) of commitment. Resumes of Key Personnel do not count against the page totals. These resumes shall include a list of relevant training, education, and certifications.

NOTE: Experience limited to one (1) specific industrial hazard (e.g. Asbestos abatement) shall NOT meet the definition of broad scope industrial hygiene experience. Additionally, environmental health experience (e.g. air pollution, water pollution, soil sampling) shall NOT be a substitute for industrial hygiene experience.

(3) Past Performance: The Government will conduct an evaluation of the Offerors Past Performance as well as that of its subcontractors. Past Performance consists of two aspects for evaluation, past performance relevancy and performance confidence; thus, the Offeror will be assigned two ratings for past performance. First, the Government will evaluate the Offeror’s past performance references to determine how relevant a recent effort accomplished by the Offeror is to the requirement to be acquired through this source selection. Common aspects of relevance include similarity of service/support, complexity, magnitude of effort, dollar value, and contract type.

Second, the Government will evaluate the Offeror’s past performance references to determine the quality of work performed and assess the level of expectation that the Offeror can successfully perform the required effort.

Cost/Price Evaluation Criteria:

Price will be evaluated separately from non-price/cost and past performance factors. A price analysis will be performed in order to evaluate the fairness and reasonableness of the proposed…
