52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

**INCLUDES ADDENDUM. STARTING AT SECTION “A” BELOW**

A. BASIS FOR AWARD

A.1.1. Award of Multiple-Award Blanket Purchase Agreements (BPA) shall be made on a competitive basis, using the best value Lowest Price Technically Acceptable (LPTA) source selection procedures among price and non-price factors IAW FAR 15.101-2. The LPTA source selection process is appropriate when best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. The Government may award up to five (5) Multiple-Award (MA) BPAs to the lowest priced technically acceptable Offerors; however, the

Government reserves the right to make the final determination on the number of BPAs to award based on the

Offerors ability to provide the required supplies, mission requirements, and the Government’s administrative costs to efficiently administer each BPA awarded as a result of this solicitation.

A.1.2. The resulting Call Orders from the BPAs shall be competitive Firm-Fixed Price (FFP) Contract Line Item

Numbers (CLINs) for general laboratory supplies, chemicals, scientific and laboratory equipment, and animal supplies. The Government anticipates the use of cost reimbursable CLINs for shipping and handling of the supplies.

A.1.3. The Government intends to evaluate and award without discussions; however, the Government reserves the right to conduct discussions. If discussions are required, they will be conducted with Offerors IAW Federal

Acquisition Regulation (FAR) 15.306.

A.1.4. Past Performance will be evaluated independently from the other non-price evaluation factor in accordance with FAR 15.305 and DFARS 215.305. The comparative assessment required by FAR 15.305(a)(2)(i) for Past

Performance does not apply. Therefore, past performance will be rated on an “acceptable” or “unacceptable” basis.

The evaluation factors are listed below:

Factor 1 – Technical Capability/Specifications

Factor 2 – Corporate Experience

Factor 3 – Past Performance

Factor 4 – Price

A.1.4. The non-price Factors 1, 2, and 3 will be evaluated to determine whether the Offeror’s proposal is acceptable or unacceptable.

A.1.5. The Government will not assume that the Offeror possesses any capability or knowledge unless it is specified in the proposal.

A.1.6. The non-price Factors 1, 2, and 3 will be rated individually from Factor 4. If Factors 1, 2, and 3 above receives an individual rating of “Unacceptable”, the collective overall rating will also be “Unacceptable.” Only proposals receiving an overall rating of “Acceptable” will be considered for award.

A.2. EVALUATION CRITERIA

A.2.1. Factor 1 – Technical Capability/Specifications: The Offeror’s proposal will be evaluated to the degree which the Offeror meets all of the following:

(1) The Offeror shall provide a response to all supply items in Attachments A through G by stating “Yes” or “No” in the column titled “Capable of Supplying” under Exhibit C. A response to each line item is required and failure to provide a response will be interpreted as “No” (non-response = No).

(2) The Offeror is capable of delivering a minimum of 80% or 334 of the 418 supply items in Attachments A through G as evidence from #1 above. (AMENDMENT 0002)

(3) The Offeror shall provide three (3) different copies of previous shipping records, dated within the last three (3) years as evidence of the capacity to accommodate the special handling, packaging, or temperature sensitive medical products for shipment of the required supplies.

(4) The Offeror shall provide a Draft Quality Control Plan (QCP) regardless of the number of products the Offeror is capable of delivering. The Draft QCP cannot exceed five (5) pages and must address the following:

(a) A description of internal review procedures that facilitate high-quality standards (i.e., inspection, identifying and correcting deficiencies) to ensure compliance with BPA requirements.

(b) Identification of individuals responsible for ensuring quality control.

(c) Whether or not subcontractors are used and, if so, the quality control measures used to ensure acceptable subcontractor performance.

(d) How potential problem areas and solutions are handled.

(e) The procedures for ensuring quality performance when meeting urgent requirements.

(f) How quality control will be managed when completing multiple projects for multiple agencies simultaneously.

A.2.2. Factor 2 – Corporate Experience: The Offeror must submit a narrative description of its corporate experience. This narrative cannot exceed two pages and must address the following:

(1) The number of years of corporate experience in providing the supplies described under Attachments A through

G, regardless of the specific products being proposed – a minimum of two (2) years of corporate experience within the last 10 years is required.

(2) The Offeror’s number of employees, experience in the field, and resources to enable it to fulfill the requirements.

(3) Brief history of the Offeror’s activities contributing to the development of expertise and capabilities related to this requirement.

(4) Information that demonstrates the Offeror's organizational and accounting controls.

(5) A description of the resources presently in-house and the ability to acquire the type and kind of supplies required.

(6) How the proposed subcontractor’s corporate experience is identical, similar, or related to providing the required supplies.

A.2.2. Factor 3 - Past Performance: The past performance shall be evaluated on the basis of the Offeror’s demonstrated recent and relevant record of performance in providing general laboratory supplies, chemical, scientific, and laboratory equipment, and animal supplies that meets the requirements of the SoN. The Government will use available sources to obtain past performance information from established systems such as the Past

Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information

System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; and may be obtained from other sources available to the Government, such as the Defense Contract Management Agency (DCMA) and

Contracting Officers to determine the how well the Offeror performed on prior contracts within the past three (3) years.

(a) The past performance evaluation performed does not establish, create, or change the existing record and history of the Offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information on how well the Offeror performed on those past contracts.

(b) Recency is defined as past performance efforts in the past three (3) years.

(c) Relevancy is defined as how relevant a recent effort accomplished by the Offeror is to the requirement.

The Government will measure the extent of similarity of recent efforts in terms of size, scope, complexity, dollar value, and award type to this requirement.

(d) In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305

(a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/ unacceptability, a neutral rating shall be considered “acceptable.”

A.2.3. Factor 4 – Price: The price will be evaluated separately from the non-price evaluation factors. The Offeror’s price proposal is the result of completing Exhibit A Price Sheet (AMENDMENT 0002) which is the 30 random sample of supplies found as Attachment J. Price proposal evaluation is to determine whether the Offeror’s price proposal is fair and reasonable in accordance with FAR 15.404-1(b). The Government will evaluate the consistency, completeness, fairness and reasonableness of the Offeror’s price proposal. Price analysis will be used to determine the total evaluated price to support the selection of the lowest priced, technically acceptable Offeror.

A.3. EVALUATION RATING STANDARDS

A.3.1. RATING STANDARDS FOR THE NON-PRICE PROPOSAL (EXCLUDING PAST

PERFORMANCE)

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

A.3.2. RATING STANDARDS FOR PAST PERFORMANCE

Rating Description

Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the

Offeror’s performance record is unknown.

Unacceptable Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.

A.4. DEFINITIONS

Term Definition

Clarifications Limited exchanges between the Government and Offerors that may occur when award without discussions is contemplated.

Discussions Negotiations conducted in a competitive acquisition. Discussions take place after establishment of the competitive range.

Recency

As it pertains to past performance information, is a measure of the time that has elapsed since the past performance reference occurred. Recency is generally expressed as a time period during which past performance references are considered relevant.

*For the purpose of this requirement, Recency is defined as past performance efforts in the past three (3) years.

Relevancy

As it pertains to past performance information, is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/teaming or other comparable attributes of past performance examples and the source solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance.

*For the purpose of this requirement, the Government will measure the extent of similarity of recent efforts in terms of size, scope, complexity, dollar value, and award type to this requirement.

**END OF ADDENDUM**

b. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
