Response: Prosperitus Solutions, LLC, W81K00-18-C-0011

8. Question: Regarding solicitation # W81K0024R0006. In the instructions to offerors document under the Factor 3 Past Performance section, it says: ‘To demonstrate the Offerors has successfully managed a stand-alone contract/task order comparable to the magnitude, scope and complexity as this solicitation, the Government will consider Relevant past performance if the offeror has managed over 75 full time equivalent positions on one requirement in a Federal

Government environment, public and/or private sector.’

In regard to the portion requiring 75 FTE positions, we wanted to reach out and see if you’d be willing to reduce that requirement to 35 people? It is very difficult for any 8a other than an ANC to have met this past performance requirement.

Response: The scope and magnitude of the government’s requirement has increased from the current requirement. The government will not decrease the past performance requirement due to the complexity and number of personnel required for this action.

9. Question: What is the current price of the Incumbent per year/contract total?

Response: See response to Question #4

10. Question: Is the Performance Work Statement for the Incumbent the same? If not, what is the difference between the previous and current solicitation?

Response: The government will not delineate the differences in the PWS for the current contract and the PWS for this solicitation. However, the number of FTEs has increased.

11. Question: When is the date and time of the Site Visit?

Response: We are not planning a site visit day; However, the successful offeror can request a date and time.

12. Question: In the Wage Determination dated 12/26/23, there isn't a listed wage rate determination for the following:

a. Database Sustainment Specialist

b. Facilities Planner

c. Project Manager IV

d. Quality Assurance Specialist

e. System Administrator

Response: It is up to the offeror to ensure that they are in compliance with all state and applicable federal regulations for the appropriate positions.

13. Question: Attachment 3: Will the Government provide an example of how they would like to see the total compensation plan filled out including formulas?

Response: See Attachment 3_Sample Compensation Plan_24R0006

14. Question: Attachment 1 Factor 2: Will the Government update the second paragraph to state the more current WD included in the solicitation files?

Response: The most current paragraph has been updated as the most current WD was included with the solicitation release.

15. Question: Attachment 2, RFP Section B: Will the Government change Section B units to

Monthly?

Response: No, This is an FTE based contract, therefore the Government will only pay for hours worked.

16. Question: Attachment 2, RFP Section B - Pricing Worksheet: The Unit of Issue contains hours that appear to be based on a productive hour basis of 1,920 hours per Full Time Employee per year (12 months). Since there are positions under this effort that qualify under the referenced

Service Contract Act Area Wage Determination, the standard productive hours based on 2080 annual hours, 80 hours of vacation, 88 hours of holiday time (11 holidays) and 56 hours of sick leave equals 1,856 hours per year. Are offerors allowed to update the productive hours in the

Unit of Issue to line up with SCA requirements? Or will the Government update the Attachment

2 – Pricing Worksheet and the hours listed in the SF1449 – Continuation Sheet to line up with the SCA productive hours?

Response: No, offerors are not allowed to update the productive hours in the Unit of Issue established in the solicitation. The production hours listed in the SF1449 are based off historical baselines set within the organization policy. It is up to the offeror to ensure that they are in compliance with all state and applicable federal regulations for the appropriate positions.

17.Question: Attachment 1, Page 3, PWS Compliance: All offerors must provide specific evidence that they are capable of fulfilling the requirement. Specific evidence must reflect a thorough understanding of the Performance Work Statement and describe how the offeror will fulfill the requirements of the PWS. Question: Will the Government provide examples of what qualifies as "specific evidence?"

Response: See subfactor 1A: “Specific evidence must reflect a thorough understanding of the

Performance Work Statement and describe how the offeror will fulfill the requirements of the

PWS.”

18. Question: Attachment 1, Page 5, Factor 3, Past Performance: Past performance reference projects performed by a proposed teaming partner or a proposed subcontractor will only be considered if: (1) the Offeror submits at least one recent and relevant past performance project that the Offeror has performed, as a prime. Prime contracts of 75+ FTEs are rare for 8(a) companies. Question: Will the Government consider changing this requirement to allow Past performance reference projects performed by a proposed teaming partner or subcontractor to be considered if the Offeror submits at least one recent and relevant past performance project that the Offeror has performed as either a prime of a subcontractor?

Response: No, the offeror must submit at least one recent and relevant past performance project that the offeror has performed as a Prime.

19. Question: PWS 1.6.2 and 4.5 Background Checks: The PWS requires background checks by section. The PWS states the COR will advise the requirement. If there is a cost to the contractor for required back ground checks will the contractor be able to bill that cost under a cost reimbursable CLIN?

Response: There is no cost to the contract company for background investigations, this is not a reimbursable expense.

20. Question: PWS 4.6 Immunizations and Vaccinations: Will the Govt provide the list of current Incumbent Staff and their SCA hire dates as well as their dates for immunizations?

Bidders will need to ensure all incumbent personnel PTO accruals and immunizations and vaccinations are properly accounted for in the pricing.

Response: See Question #5 for Anniversary dates. All personnel are up to date on immunizations at this time.

21. Question: PWS 5.2, Tasks: The Government states there are 108 FTEs requirements. Will the Government please advise at this time how many of the 108 FTE slots are vacant and which labor categories those vacancies represent?

Response: See response to Question #6

22. Question: PWS 1.10 and 5.25 (Key Personnel): Can the Contract Manager and Project

Manager be the same position/person?

Response: It is up to the offeror to determine if the Contract Manager and the FTE position of

Project Manager will be the same individual, however the Project Manager is a Full Time FTE as indicated in 5.25 of the PWS and the Contract Manager will coordinate the implementation of services and be responsible for the performance under this contract and need to have oversight of 108 FTE’s on this contract and be accessible to the COR and KO.

23. Question: Can vendors use their own version of a ‘sample compensation plan’ that reflects the various compensation by labor category along with other cost elements?

Response: Yes, Attachment 3_Sample Compensation Plan_24R0006 was provided as a sample.

24. Question: Does the government see the Contracts Manager and the Alternate Contracts manager performing in the same role as a Project Manager(s) for the overall program?

Response: The Contract Manager role is identified in Section 1.10 and the Project Manager role is identified in Section 5.25 of the PWS.

Response: See response to Question #16

28. Question: Does the government intend to issue a FFP Level of Effort (LOE) contract to awardee?

Response: No. This is an FTE based contract; therefore, the Government will only pay for hours worked.

29. Question: For pricing purposes, can the government provide the average length of tenure for current SCA employees?

Response: See response to Question #5

30. Question: According to the RFP recent is deemed “within the past three (3) years”. Would the Government consider changing recent to be within the past 5 years?

Response: No

31. Question: Solicitation page 66 of 128 has the table for the listed SCA positions with GS level ‘equivalent’ rates. The Govt is representing H&W rates well above the DOL mandatory

$4.57/hr. H&W rate for all LCATS. In addition, they represent base rates for some SCA well below the DOL SCA WD mandatory rates. The concern is that under an LPTA acquisition, some vendors will use these rates provided by the government to artificially reduce their costs, yet not meet DOL standards, representing unrealistic pricing. Will the government update these rates to reflect current DOL requirements at a minimum?

Response: Per Clause 52.222-42, This statement is for information only: It is not a Wage

Determination. It is up to the Offeror to map/propose occupation codes based on the requirements of the Performance Work Statement (PWS), SCA Directory of Occupations and salary market research for the service area. Offerors are required to ensure their proposals are compliant with all applicable laws and regulations to include the Service Contact Act Wage

Determinations and Executive Orders.

35. Question: Attachment A, Page 4: Factor 4 Past Performance: Performance must have been by the Offeror (not by a subsidiary or sister company) either as the prime contractor or subcontractor: “In light of GAO rulings, please confirm that the Government will permit the use of sister company experience and past performance if a meaningful relationship is documented in a commitment letter” and that an agency properly may attribute the experience or past performance of a parent or affiliated company to an offeror where the firm's proposal demonstrates that the resources of the parent or affiliate will affect the performance of the offeror

The relevant consideration is whether the resources of the parent or affiliated company-its workforce, management, facilities or other resources-will be provided or relied upon for contract performance such that the parent or affiliate will have meaningful involvement in contract performance. Ecompex, Inc., B–292865.4et al., June 18, 2004, 2004 CPD ¶149 at 5.

Response: Yes

36. Question: Solicitation SF Form 1449, Page 1 Block 8, Offer Due 2:00PM 22 March, 2024:

Our DCAA compliant accounting practice uses a fringe pool methodology which averages/”pools” our total fringe costs for a group divided by the total labor cost for that group, generating a percentage. We use this percentage to track our cost and to develop our pricing. If you can please confirm if utilizing a fringe “pool” percentage would be acceptable in our proposed pricing? (we can still show the breakout of cost but it may not match exactly as employees benefit cost vary due to their selection of benefits i.e. Employee only, employee plus family, etc).

Response: DCAA compliant accounting practices are acceptable. Offerors who have DCAA approved accounting practices should include a copy of approved DCAA rates in their Pricing

Volume

44. Question: Attachment 1 Instructions to Offerors- page 5 indicates CPARS will be accepted in lieu of PPQs. If you can please confirm that the CPARS are not a part of the page limitation

113. Question: The CLIN structure appears to have been developed using a 1,920 hour year.

With the addition of the Juneteenth holiday, a full hourly year is 1,912 hours. Additionally, SCA positions will require at least 40 hours of PTO and may require 80 hours or 120 hours. As such, it is an extreme risk to the contractor if this PTO is not reflected in the pricing structure.

Specifically, this equates to up to 180,000 hours of potential risk. We recommend that 1832 hours be reflected in the pricing, allowing for 80 hours of PTO. Would the government consider basing pricing on the 1832 hours to mitigate this risk. In the alternate, would the government consider allowing the winning contractor to invoice for SCA-mandated PTO?

Response: See response to Question #16

114. Question: Given the complexity of the hour requirements for SCA and non-SCA personnel on this engagement, as evidenced by our question above, would the government consider changing the invoicing structure to Firm Fixed Price? This would mitigate the risk to the winning contractor, streamline delivery, and reduce contract complexity for the government.

Response: This is an FTE based contract; therefore, the Government will only pay for hours worked.

117. Question: Government will consider Relevant past performance if the offeror has managed over 75 full time equivalent positions on one requirement in a Federal Government environment, public and/or private sector. Performance must have been by the Offeror (not by a subsidiary or sister company) either as the prime contractor or subcontractor.

The requirement for consideration of relevant past performance of managing over 75 FTE positions on one requirement may limit the ability for small businesses to compete. Would the

Government consider reducing the number of FTE positions for relevancy to 50

Response: See response to Question #8

118. Question: Government will consider Relevant past performance if the offeror has managed over 75 full time equivalent positions on one requirement in a Federal Government environment, public and/or private sector. Performance must have been by the Offeror (not by a subsidiary or sister company) either as the prime contractor or subcontractor.

Would the Government consider allowing for the total number of FTE positions to be added across Task/Delivery Orders executed simultaneously, for a purchasing vehicle i.e. IDIQ, "D" type contracts.

Response: Per Attachment 1_Intructions to Offerors_24R0006: If the Task Order or Contract being submitted is an ordering type contractual vehicle (for example, including but not limited to an Indefinite Delivery “D” type contract per FAR 16.5 or Blanket Purchase Agreement (BPA), only after issuance of a delivery/task order does performance occur. The Contract Number, Total Contract Dollar Value, Period of Performance, Type and Complexity of Services provided submitted shall be for the Task/Delivery Order the Offeror has performed under this ordering type contractual vehicle. Not the ordering vehicle itself or a combination of orders under the vehicle. The Government will not evaluate the PPI if the offeror fails to submit a specific delivery/task order or elects to submit a combination of delivery/task orders.

119. Question: Government will consider Relevant past performance if the offeror has managed over 75 full time equivalent positions on one requirement in a Federal Government environment, public and/or private sector. Performance must have been by the Offeror (not by a subsidiary or sister company) either as the prime contractor or subcontractor.

Will the Government please confirm that if NO Past Performance References are submitted, the

Offeror will be Rated as "Neutral" and that a Neutral Rating will be considered Acceptable in the

Evaluation Process? Please confirm that such an offer would be awardable?

Response: Per Attachment 1_Intructions to Offerors_24R0006: “In the case of offerors for which there is no information on past contract performance or where past contract performance information is not available, the offeror will not be evaluated favorably or unfavorably on the factor of past performance. In this case, the offeror’s past performance is unknown and assigned a performance confidence rating of “neutral”. A neutral rating will be considered Acceptable.”

Performance Work Statement. Paragraph 1.5 (Hours of Performance), Paragraph 1.10

(Qualifications, Experience, Education, Certification), and Part 5 (Specific Tasks) shall be addressed in detail. Address each paragraph number and identify each response in the order listed in Paragraph 1.5, Paragraph 1.10 and Part 5 (ex: PWS 1.5 (offeror’s response), PWS 1.10

(offeror’s response) etc). All offerors must provide specific evidence that they are capable of fulfilling the requirement. Specific evidence must reflect a thorough understanding of the

Performance Work Statement and describe how the offeror will fulfill requirements of the PWS.

Failure to address any paragraph and section of the PWS Part 1.5, 1.10 and Part 5 will make your proposal technically unacceptable.

For Subfactor 1A, the instructions state to explain how we plan to satisfy the minimum requirement for the Performance Work Statement, specifically Paragraphs 1.5 (Hours of

Performance). According to the PWS, Paragraph 1.5 is General Information and addresses the

Quality Control Plan, Notification of issues to the COR, Quality Assurance, Recognized

Holidays, Operating Hours, Government Facility Office Hours, Government Facility Operating

Hours, Contractor Support Hours, Scheduled Absences, Unscheduled Absenses, Telework, Place of Performance, and Overtime. Does the Government want each of these addressed or only those areas related to the hours of performance?

Response: Offerors are to address 1.5.4 instead of the entire paragraph of 1.5.

124. Question: Per the requirements "Explain how your firm intends to satisfy the minimum requirements of the Performance Work Statement. Paragraph 1.5 (Hours of Performance)" :

PWS Section 1.5 is not only Hours of Performance but also Quality Control Plan. Would the government like a response to all sections under 1.5 to include Quality Control Plan?

As this is a non-personal services contract, the government has provided all the labor categories with their minimum qualifications (PWS 1.10) and a detailed description of their duties (Part 5).

Would the government be more specific as to how the response to these sections should be presented without parroting back the RFP.

Response: See Attachment 1_Instructions to Offerors_24R0006

126. Question: Per the requirements "Explain how your firm intends to satisfy the minimum requirements of the Performance Work Statement. Paragraph 1.5 (Hours of Performance)" under
