SECTION 00 0115, INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS
A. GENERAL INFORMATION
This solicitation is for a firm-fixed price contract to acquire construction services for the Police Academy Female Staff College, Kabul Province, Afghanistan.
In accordance with Federal Acquisition Regulation (FAR) Part 15, award will be made on the basis of the lowest evaluated price of proposals satisfying the requirements of the technical evaluation factors set forth in the solicitation. The offeror that submits the lowest complete and reasonably priced proposal that is also found technically acceptable by the evaluators will be selected for contract award. To be considered technically acceptable, an offeror’s proposal must be rated “acceptable” under all technical factors.
Magnitude of Construction: The estimated cost of this project is between U.S. $10,000,000.00 and $25,000,000.00.
The Primary NAICS code is 236220 - Commercial and Institutional Building Construction, with a small business size of $36.5 million.
B. PROPOSAL REQUIREMENTS, CONTENT, AND FORMAT
The Government will not reimburse any costs incurred or associated with preparation and submission of any responses to this solicitation. Oral explanations or instructions to offerors are not binding. Any information given to an offeror which impacts the solicitation and/or offer will be given in the form of a written amendment to the solicitation. Any and all amendments to the solicitation will be issued electronically via www.fbo.gov. It is the offeror’s responsibility to acknowledge any and all amendments in its proposal submission.
Offerors should not modify the terms and conditions of the solicitation in either the technical or price proposal or add conditions or qualifications to their offers. Should an offeror include terms and conditions that conflict with the terms and conditions of the solicitation, that offeror may be determined non-responsive and ineligible for award. Any questions related to specific terms and conditions contained within the solicitation should be resolved prior to submission of an offer. Notwithstanding the above, the offeror must clearly describe in its price proposal any modifications to the contractual and/or technical terms and conditions of the solicitation contained in its offer.
References to “confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can be provided to the Government as part of the offeror’s technical proposal. Offerors that include information in their proposals they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, must clearly mark their proposals in accordance with the instructions at FAR clause 52.215-1, Instructions to Offerors-Competitive Acquisition, paragraph (e), Restriction on Disclosure and Use of Data.
Use of the words “will”, “shall”, or “must” indicates a mandatory requirement for which failure to comply, at the time and date for submission of proposals, shall result in the offeror’s proposal being disqualified from consideration for award, unless the Government elects to initiate discussions with some or all of the offerors, thereby providing a means by which appropriate corrections by the offeror(s) involved can be made. Failure to comply with non-pricing or pricing requirements that are annotated with the words “should” or “may” can result in a lowering of an offeror’s non-pricing ratings, and may have a significant effect upon an offeror being selected for the contract award. Time periods, if stated as a number of days, are calendar days unless otherwise specified.
1. INSTALLATION ACCESS
In accordance with CENTCOM Clause 5152.225-5916, Mandatory Eligibility for Installation Access, the Government will determine an offeror non-responsible as a result of an offeror’s base access ineligibility. The Government reserves the right to make this determination at the time of receipt of proposals and prior to the start of evaluations. In this instance, the non-responsible offeror’s proposal will not be evaluated.
The Government also reserves the right to determine an offeror non-responsible at any time after receipt of proposals if an offeror becomes ineligible for installation access. A determination that an offeror is nonresponsible will result in the removal of the offeror’s proposal from the competition. No debriefing will be provided for those offerors found non-responsible as a result of their base access ineligibility as the determination may be made in advance of the offeror’s technical. No contract award will be made until funds are available.
2. REQUIRED REGISTRATIONS
Failure to provide proof of an active and completed registration in any one of the following databases at the time of proposal submission may determine an offeror’s proposal to be deficient and removed from competition. Offerors with incomplete or expired registrations at the time of proposal submission may not be eligible for award. Information contained within an offeror’s registration must be current and valid. The responsibility of maintaining current information contained in an offeror’s registration rests solely on the offeror.

c. Afghan Investment Support Agency (AISA) License: http://www.aisa.org.af/
If an offeror is a joint venture (JV), the JV entity must have a valid registration representing the JV as one business/firm/entity. This is applicable to SAM, JCCS, and AISA. The Government will not accept separate registrations and licenses for each separate entity representing the JV.
If, at the time of award, an offeror’s registration is no longer active in any one of the databases, the Government reserves the right to disqualify the offeror and to award to the next prospective offeror.
3. PROPOSAL CONTENT
Offerors are required to submit proposals with at least the minimum content specified herein.

All information intended to be evaluated as part of the technical proposal must be submitted within the technical proposal. SECTION 00120, BASIS OF EVALUATION AND EVALUATION FACTORS
E. EVALUATION FACTORS
All of the submission items to be evaluated pertain to the prime offeror, whether a single contractor entity, partnership, or a joint venture. The Government will consider information provided concerning principal or primary subcontractors; however, unless clear and convincing evidence is provided establishing the likelihood that those subcontractors will actually be available for this project, then that submitted information will largely be diminished in the evaluation and selection process. At the same time, an offeror that intends to have significant on-site subcontractor participation defined as (twenty (20) percent or more in the performance of its on-site management and construction efforts) should provide information pertaining to those subcontractors in accordance with the instructions provided below.
Joint Ventures: A joint venture is defined as a legal business entity formed between two or more companies (parties) to undertake the performance activities of a contract together. This does not include other arrangements, such as “teaming agreements” or “strategic alliances”, which are not recognized as bona fide joint ventures for the purposes of this solicitation.
Offerors proposing as joint ventures shall provide evidence that the joint venture as a legal entity has been duly formed. Joint ventures shall include a copy of the legal joint venture agreement signed by an authorized officer from each of the firms comprising the joint venture, with the chief executive of each entity identified. The Government will not evaluate the capability of any firms that are not included in the joint venture agreement.
If submitting a proposal as a joint venture, the experience and past performance of each of the joint venture partners can be submitted for the joint venture entity. The experience for each joint venture partner will be considered the experience of the joint venture entity. Page and project form limits apply to the joint venture as a whole, i.e., a submission limitation of three (3) projects under the experience factor is not an allowance of three (3) projects for each of the joint venture partners.
Prospective offerors that submit proposals may not change their firm (including LOC’s and proposed sub-contractors) or their joint venture firms, if selected for award. If the offeror proposes to change subcontractors or letters of commitment after award, the offeror may not change subcontractors or letters of commitment without the contracting officer’s approval. Approval will not be given unless the contracting officer considers the proposed substitute to be equal in all respects to the originally proposed subcontractor and that the substitution is in the best interests of the Government.
Subcontractors: The Government recognizes that completion of a project is often a team effort.
Therefore, if an offeror wishes to be credited with the experience and past performance of a subcontractor (i.e., a firm that is not a member of the joint venture), an unequivocal letter of commitment signed by the subcontractor must be submitted. The letter of commitment must be submitted even if the firm is in some way related to a joint venture partner (for example, the subcontractor is a subsidiary of a joint venture partner, or a subsidiary of a firm to which a joint venture partner is also a subsidiary). If such a letter of commitment is not submitted, the experience and past performance of subcontractor firms shall not be considered, and may cause a prime contractor’s proposal to be considered deficient. If the offeror’s proposal includes the use of subcontractors, the offeror may not change subcontractors without the contracting officer’s explicit approval. If the offeror proposes to change subcontractors or letters of commitment after award, the offeror may not change subcontractors or letters of commitment without the contracting officer’s explicit approval. Approval will not be given unless the contracting officer considers the proposed substitute to be equal in all respects to the originally proposed subcontractor and that the substitution is in the best interests of the Government.
NON-PRICING (TECHNICAL) EVALUATION FACTORS
FACTOR 1: EXPERIENCE
FACTOR 2: PAST PERFORMANCE
FACTOR 3: KEY PERSONNEL
1. FACTOR 1: EXPERIENCE
The offeror shall demonstrate relevant experience on same or similar projects to that of the solicitation requirements using the Experience Overview Sheet (Attachment B) and Experience Form (Attachment C).
Relevant is defined as: Construction of a project of same or similar scope, size, and complexity which requires a commensurate level of activities, labor, equipment, materials, management and supervision, to construct this project.
Same or similar is defined as Construction projects having the following:
Size: At least one (1) construction project provided to demonstrate experience must have had an awarded contract value (at time of award, including options) of over $10,000,000.00 (USD) as a prime contractor. This is a mandatory requirement. An offeror’s failure to meet this $10,000,000.00 previous project requirement will be deemed technically unacceptable.
Should offerors submit additional construction projects, in order to demonstrate relevant experience, those projects shall exceed $5,000,000.00 (USD) at time of award, including options.
Scope: A Construction project requiring a commensurate level of activities labor, equipment, materials, management and supervision, etc. to construct this project.
Offerors shall provide no more than three (3) projects that demonstrate the breadth and depth of an offeror’s relevant experience on same or similar construction projects to that of the solicitation requirements. Any three (3) or a combination of three (3) projects must demonstrate that they are the substantially the same or similar to the construction project described in the solicitation.
If the offeror is a joint venture (JV), each firm shall provide information demonstrating experience relevant to the firm’s role on the project. Experience of one JV partner will be considered experience of the JV. If the offeror has multiple functions or divisions, limit the project experience submitted to those performed by the division or unit submitting the offer. Experience of divisions or units not performing on this contract will not be considered. As twenty percent (20%) of work associated with this project is required to be self-performed, the offeror should demonstrate relevant experience as described above.
FACTOR 1 EXPERIENCE RATINGS AND DEFINITIONS
The evaluation will result in an assessment of the offeror’s probability of meeting the minimum experience level for the solicitation requirements. This assessment is based on the offeror’s record of relevant experience as it pertains to the solicitation requirements.
To be considered technically acceptable, an offeror’s proposal must be rated “acceptable” for all requirements that constitute the experience factor. An “acceptable” rating will be assigned to a proposal that has satisfied all of the minimum requirements of this technical evaluation factor. An “unacceptable” rating will be assigned to a proposal that has not satisfied one or more requirements of the experience evaluation factor.
EXPERIENCE EVALUATION RATINGS
RATING DESCRIPTION
Acceptable Based on the offeror’s record of experience, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Unacceptable Based on the offeror’s record of experience, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
2. FACTOR 2: PAST PERFORMANCE
Past performance refers to the quality relevant project experience from a client’s perspective. The criteria of what is relevant can be found in the experience evaluation factor. Offerors shall submit a Past Performance Questionnaire (PPQ – Attachment D) or DD Form 2626 (Performance Evaluation (Construction)) , or Contractor Performance Assessment Report (CPAR) for construction evaluations completed after June 2014, for each project submitted under Factor 1. Ensure correct phone numbers and email addresses are provided for the client point of contact on all PPQs. Offerors shall not incorporate by reference into their proposals PPQs previously submitted for other RFPs.
However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.
Performance recognition documents such as awards, customer letters of commendation, and any other forms of performance recognition, may be submitted in addition to the PPQs and performance evaluation forms. This information shall be limited to the projects submitted.
In addition to the above, the Government may review any other sources of information for evaluating current and past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal; inquiries of owner representative(s);
Federal Awardees Performance and Integrity Information System (FAPIIS); Electronic Subcontract Reporting System (eSRS); and any other known sources not provided by the offeror.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the offeror.
FACTOR 2 PAST PERFORMANCE RATINGS AND DEFINITIONS
The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.
The evaluation will result in an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant past performance information as it pertains to the solicitation requirements. There are two aspects to the past performance evaluation.
The first is to evaluate whether the offeror’s past performance is relevant or not relevant to the effort to be acquired. The criteria of what is relevant can be found in the experience evaluation factor.
PAST PERFORMANCE RELEVANCY RATINGS
RATING DEFINITION
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts.
PAST PERFORMANCE EVALUATION RATINGS
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully
The evaluation team will assess an offeror’s past performance information and assign an “acceptable” or “unacceptable” rating based on the information available. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability “unknown” shall be considered “acceptable”.
3. FACTOR 3: KEY PERSONNEL
The offeror shall demonstrate relevant and acceptable qualifications for the key personnel listed below through education/work experience on same or similar projects to that of the solicitation requirements using the Resume of Key Personnel Sheet (Attachment E)
Provide resumes for the following key personnel:
a. Overall Project Manager;
b. Construction Superintendent;
c. Quality Control Manager;
d. Senior Electrical Engineer;
e. Senior Fire Protection Engineer; and
f. Senior Civil Engineer.
The Overall Project Manager, Construction Superintendent, and Quality Control Manager must have:
a. a minimum of 5 years of experience in similar construction projects that is relevant to their positions on this project;
b. documentation identifying each person as a current full-time employee of the
Prime Contractor or indicating an intent to employ each such person for this project; and
c. FOR THE OVERALL PROJECT MANAGER, Degrees listed in resumes must be from recognized institutions of higher education, such as United States universities or colleges, Afghanistan universities, or international equivalents.
Degrees offered with key personnel candidates must be United States or European bachelors’ degree (B.A.), masters’ degree (M.A.), doctorate (Ph.D.), or Afghanistan or international equivalent.”
The resumes for Senior Electrical, Senior Fire Protection Engineer, and Senior Civil Engineer must:
a. Demonstrate that the Senior Electrical, Senior Fire Protection Engineer, and Senior Civil
Engineer each have a minimum 3 years of relevant experience in their assigned job positions on this project as it relates to similar construction projects.
b. Provide documentation identifying each person as a current full-time employee of either the Prime Contractor or subcontractor, or a signed letter of intent signifying their employment for this project; and
c. Provide documentation by transcript or otherwise of a four-year college Bachelor of
Science or Engineering degree from an accredited university in the respective field of study and assigned job positions. Degrees listed must be from recognized institutions of higher education, such as United States universities or colleges, Afghanistan universities, or international equivalents. Degrees offered with key personnel candidates must be United States or European bachelors’ degree (B.A.), masters’ degree (M.A.), doctorate (Ph.D.), or Afghanistan or international equivalent.”
Resumes must include the information on ‘Personnel Resume/Experience’ form attached at the end of this section. All information must be filled in and all data should be accurate, current, and complete.
NOTE: Identified personnel must be used on the project. Any substitution of identified persons will not be permitted without prior explicit approval of the Contracting Officer. Identification of two individuals proposed for a single position will result in the evaluation of only the least qualified person. A single individual cannot be identified as ‘key personnel’ for more than one ‘key personnel’ position. Failure to fulfill this requirement will cause the offeror to be technically unacceptable.
FACTOR 3 KEY PERSONNEL RATINGS AND DEFINITIONS
The evaluation will result in an assessment of the offeror’s key personnel qualifications as stated in the solicitation requirements.
A minimum of 5 years of experience for the Project Manager, Construction Superintendent, and Quality Control Manager in similar construction projects that is relevant to their positions on this construction projects. A minimum of 3 years of experience for the Senior Electrical, Senior Fire Protection Engineer, and Senior Civil Engineer in similar construction projects that is relevant to their positions on this construction projects;
KEY PERSONNEL EVALUATION RATINGS
Acceptable Based on the offeror’s key personnel qualifications, the Government has a reasonable expectation that the offeror will successfully perform the required effor.
Unacceptable Based on the offeror’s key personnel qualifications, the Government has no reasonable expectation that the offeror will be able to successfully
The evaluation team will assess an offeror’s key personnel qualifications and assign an “acceptable” or “unacceptable” rating based on the information available.
4. FACTOR 4: PRICE
An offeror should submit a complete CLIN Schedule and Cost Breakdown spreadsheet in PDF (Portable document Format) format. Failure by an offeror to do so may result in disqualification of the offeror’s proposal.
The Government will evaluate an offeror’s price proposal in order to identify risks to the Government based upon demonstration that:
a. The offeror can successfully perform at the proposed price.
b. The proposal is complete. Completeness is the degree to which an offeror has priced all aspects of the work to be performed as defined by the proposal schedule.
c. The proposal is reasonable. An offeror's price proposal is reasonable if it compares favorably to the Independent Government Estimate (IGE) and to other offerors' price proposals; and, if it provides best value to the Government taking market prices and the offeror's technical and functional capabilities into consideration.
d. The Government may reject any proposal that is determined Not Fair and Reasonable, unrealistically high or low in price when compared to Independent Government estimates, or are unbalanced, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the project.
e. All proposals will be evaluated, and the lowest price will be determined, by comparing the "Total of the Base and All Options" in Section B of the Fully Completed Bidding Schedule." The Government will award a contract to the offeror whose proposal constitutes the lowest reasonably- and responsibly-priced, technically acceptable offer.
Evaluation of Options: Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interest, the Government will evaluate offers for award purposes by adding the total price for all options to the total price of the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
SECTION 00130
I. PROPOSAL EVALUATION
A. SELECTION
The SSA will make the final determination of award. In making his/her independent determination, the SSA shall adhere to the solicitation evaluation criteria and shall meet all legal and procedural requirements of the evaluation process as defined in the source selection plan.
The SSA shall document his/her final determination in a source selection decision document.
B. ANNOUNCEMENT OF SELECTION
The contracting officer shall notify all successful and unsuccessful offerors of the contract award. If requested, the contracting officer shall debrief offerors with the assistance of the TET(technical evaluation team), price evaluator, and contract specialist in a manner prescribed by the contracting officer.
D. DEBRIEFING OF UNSUCCESSFUL OFFERORS
No debriefing will be granted if the proposal is not accepted due to unacceptable standing in the Joint Contingency Contracting System. Unsuccessful offerors will be notified in accordance with FAR Subpart 15.5. An unsuccessful offeror may request a preaward debriefing or a delayed debriefing after award by submitting a written request to the contracting officer within three (3) days after receipt of the notice excluding the offeror from the competition and award. Offerors are entitled to no more than one debriefing for each proposal. No debriefing will be provided for those offerors found non-responsible as a result of their base access ineligibility, as the determination may be made in advance of the offeror’s technical proposal being reviewed.
E. BASIS OF AWARD
Subject to the provisions contained herein, award will be made to one (1) offeror who is deemed responsible in accordance with the FAR; who conforms to the solicitation requirements; and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, meets the technically acceptable standard for each of the non-price factors and provides the lowest evaluated price.
To be considered technically acceptable, no technical factor in the proposal may be rated as “unacceptable”. The failure of a proposal to meet all of the requirements under any factor will result in a technically unacceptable rating and precluded from award.
There may be contained within the evaluation factors certain mandatory or minimum requirements to be met for evaluation. There are also contained within the described factors certain documents for submission. Failure to satisfy any mandatory or minimum requirement may result in a determination that an offer is unacceptable. A final determination that an offer is unacceptable means that an award to the offeror involved cannot be made.
The Government intends to award a contract without discussions, but reserves the right to hold discussions if the Government determines that to do so would be in its best interests. Therefore, an offeror’s initial proposal should contain the offeror’s best terms from a technical and pricing standpoint. The Government reserves the right to conduct discussions if it is determined by the contracting officer to be necessary or if requested by the source selection authority (SSA).
ATTACHMENT A
FINANCIAL STANDING QUESTIONNAIRE
A primary consideration in the source selection process is to determine an offeror’s qualification, responsibility, and financial standing. Prior to awarding a contract, per Federal Acquisition Regulation (FAR) Part 9, the Government must determine, through acceptable evidence, that an offeror has adequate financial resources, or the ability to obtain the financial resources, to perform the contract.
The Financial Standing Questionnaire is to be completed by the offeror’s…
