AMENDMENT 0001

The purpose of this amendment is to reply to the following Request for Information submitted by interested firms; to provide Attachment #12 and to revise Section J.

QUESTION 1:

In order to participate in this project, I see that it is requested OS24 class III OR OS6 class III. In case contractor is not SOA qualified category OS6, the installation of turf is required to be executed by a subcontractor with SOA qualified category OS6 classification III.

Being the bigger part of the project civil works as earthworks, civil works and irrigation, can contractor with SOA

OG3 (“pavimentazioni realizzate con materiali particolari, naturali ed artificiali”) and OG6 (OPERE DI

IRRIGAZIONE), perform the main works and subcontract the part of installation of artificial turf with SOA OS6 class I? I have reduced class of SOA because the total price in the market for installation of the artificial turf for this project is lower than 258.000 euros.

ANSWER:

The Government has evaluated that the installation of artificial turf and related civil works are works requiring SOA

0S6 or SOA OS24. If the prime Contractor is not in possession of SOA 0S6, the proposed subcontractor performing the portion relative to the installation of artificial turf shall possess SOA 0S6.

QUESTION 2:

We hereby request for Monday 14th of March 2022 (in the morning) the possibility of carrying out an instrumental survey of the tender area related to Project AD1-00137-8P Multi-purpose field installation Camp Darby Area.

The survey will be carried out by two of our employees using a total station and measuring wheels in order to correctly detect the positioning, the surface and its current elevation.

The duration of this survey will presumably be around 4 hours.

The Government will allow the interested companies to perform the survey on 15 April 2022. The companies will be required to submit the name of their representatives attending the survey at least three working days before the date established for the survey.

QUESTION 3:

We hereby ask if the provisional guarantee of 10% to be presented with the solicitation in question should be calculated on the price offered by our company for the execution of the works or calculated on the minimum amount

(Euro 435.150,00) or maximum (Euro 870.300,00) of the project.

The amount shall be calculated on the price offered by the company.

QUESTION 4:

We hereby ask whether the following documents are also available in CAD format, as specified on page 11 of

“PROJECT - AD1-00137-8P Multi-purpose field installation Camp Darby AREA STATEMENT OF

WORK”:

- “Conceptual Field layout” (available also in CAD format)

- “dimensional indications” (available also in CAD format)

- As Built Construction Running Track 2018 (available also in CAD format)

- Sheet V019- Camp Darby industrial water map

Information requested above is hereby provided in Section J, Attachment 12 (dwg. file). Note: The industrial water map is provided but it is not updated correctly.

QUESTION 5:

(1): Considering all below we cannot understand the characteristics required of the works therefore please indicate what performance and functional criteria should comply our bid.

1. Premise that the:

• The technical specifications referred to in point 1 of Annex XIII shall be included in the tender documents and shall define the characteristics required of the works, services, or supplies. These characteristics may also refer to the specific process or method of production or provision of the requested works, supplies or services, or to a specific process for another stage of their life cycle even if these factors are not part of their substantial content if they are linked to the subject-matter of the contract and proportionate to its value and objectives. Art. 68 paragraph 1 of D.Lgs. 50/2016

• Technical specifications have the task of rendering intelligible the need that the contracting authority intends to satisfy with the public tender rather than that of describing in detail the characteristics of the product offered by the

• competitors (see page 9-10 of the document attached or to the link The Council of State, section III,

17.08.2020 n. 5063

• • Technical specifications allow equal access of economic operators to the award procedure and must not lead directly or indirectly to unjustified obstacles to the opening of public procurement to competition. Art. 68 paragraph 4 of D.Lgs. 50/2016

• • Without prejudice to mandatory national technical rules, provided they are compatible with European

Union law, technical specifications shall be formulated in one of the following ways:

(a) in terms of performance or functional requirements, including environmental characteristics, provided that the parameters are sufficiently precise to allow tenderers to determine the subject-matter of the contract and to allow contracting authorities to award the contract

(b) by reference to technical specifications and, in order of preference, to standards transposing European standards, European technical approvals, common technical specifications, international standards, other technical reference systems established by the European standardization bodies or, failing that, to national standards, technical approvals or technical specifications relating to the design, calculation and execution of works and use of supplies.

Each reference shall contain the expression "or equivalent";

(c) in terms of performance or functional requirements as referred to in point (a), with reference to the specifications mentioned in point (b) as a means of presuming conformity with such performance or functional requirements;

(d) by reference to the technical specifications mentioned in point (b) for certain characteristics, and by reference to the performance or functional requirements mentioned in point (a) for other characteristics.

Art. 68 paragraph 5 of D.Lgs. 50/2016

• • Unless justified by the subject-matter of the contract, technical specifications shall not refer to a specific make or source, or a particular process, which is characteristic of the products or services provided by a particular economic operator, or to trademarks, patents, types or a specific origin or production with the effect of favoring or eliminating certain undertakings or certain products. Such reference shall, however, be permitted on an exceptional basis, where a sufficiently precise and intelligible description of the subject-matter of the contract is not possible by virtue of paragraph 5. In such cases, the reference shall be accompanied by the words

"or equivalent". Art. 68 paragraph 6 of D.Lgs. 50/2016

• • Where contracting authorities make use of the option of referring to the technical specifications referred to in point (b) of paragraph 5, they may not declare a tender inadmissible or exclude it on the grounds that the works, supplies or services tendered for do not comply with the technical specifications to which they have referred, if the tenderer proves in his tender, by any appropriate means including the means of proof referred to in Article 86, that the solutions he proposes satisfy in an equivalent manner the requirements defined by the technical specifications. Art. 68 paragraph 7 of D.Lgs. 50/2016

• Where a contracting authority makes use of the option laid down in point (a) of paragraph 5 of defining technical specifications in terms of performance or functional requirements, it may not declare inadmissible or exclude a tender for works, supplies or services which comply with a standard transposing a European standard, with a

European technical approval, a common technical specification, an international standard or a technical reference system adopted by a European standardization body, if these specifications address the performance or functional requirements which it has laid down. In its tender, the tenderer must prove by any appropriate means, including the means of proof referred to in Article 86, that the works, supplies or services in compliance with the standard meet the performance and functional requirements of the contracting authority.

This competition is not subject to Italian public competitions rules. SOW and technical specification show the minimum technical characteristics required for this project.

QUESTION 6:

It is the opinion of the bidder that most of the below certifications are related exclusively to the product indicated by the trademark with the effect of favoring or eliminating certain undertakings or certain products that can be provide even better characteristics. Many of the below mentioned certifications are not useful at all as most producers do not see the need of producing them as for example the odor of an organic product.

In sport fields constructions there are sufficient standards and norms like FIGC-LND or FIFA and, considering they are private bodies, equivalent demonstrations should be sufficient for the bidder. We believe the designers can indicate the characteristics precisely and the intelligible description of the subject-matter of the contract is possible, therefore should provide the minimal characteristics of the scope of the works.

(2). With reference to the system indicated "BIO SURFACE 2 GREEN BACK" and the infill "BIO

GROUND" (performance infill) commercialized by the company SOFISPORT S.R.L. invited for the bid and especially to all the below mentioned certification in chapter 10e-7.

10e-7 DOCUMENTATION REFERRING TO THE ARTIFICIAL GRASS SYSTEM System certificate F.I.G.C.-L.N.D. HTK / SF-002 "BIO SURFACE 2 GREEN BACK"

- "COMPLIANT" Authorized laboratory Report

With reference to Parag. 10e-7 DOCUMENTATION REFERRING TO THE ARTIFICIAL GRASS SYSTEM of technical specification, only the FIGC / LND requirements are to be considered mandatory.

QUESTION 7:

(3). With reference to the background of with multiples layers of 44 cm.

It is the tenderer's opinion that the background of multiple layers with a total thickness of 44 cm is also excessive, and it is not clear why.

FIGC-LND indicates such a base for newly built fields when the existing ground is not level enough and a significant amount of ground must be added to level the surface under the base. This is not the case, because the existing soil must be removed almost everywhere.

In addition, the environmental impact is extremely high, while a substantial quantity of natural resources (crashed stones) is consumed to prepare the background, without any real benefit. Is there a reason for these decisions?

We would like to ask if the designer can precisely indicate the characteristics in addition to the comprehensible description of the background to better guide the bidder during his bid.

44 cm substrate has been evaluated as adequate for the scope of the project and must be considered as a project requirement.

QUESTION 8:

(4). With reference to the bank guarantees for the bid of 10% and eventually for the execution of 20% of the total bid amount.

Considering that the amount is extremely high for a small company and unusual for the Italian market (in Italy the amount for the offer is 2% and is reduced to 1% in case of ISO certification and for the execution is normally 10% and, in addition, they are issued by an insurance company and not a bank) we would like to ask if those guarantees can be applied by the subcontractor who is willing to participate with us since in practice he will also provide the artificial grass which is the largest part of the contract value?

The application of the bank guarantees and the amount of the bid guarantee and performance bond are a free and autonomous decision of the Government. Both the bid guarantee and the performance bond are required to be submitted by the prime contractor.

QUESTION 9:

Documentation required for evaluation - FACTOR I Past Experience. Please clarify how many projects will be evaluated. At least 02 and a maximum of?

Not less than 2 projects. No maximum is required.

QUESTION 10:

Would like to ask you, when we submit documents (Visura Camerale, ISO & SOA certificates,)

A) Can they be submitted in Italian language?

B) IF they have to be in English, the documents have to be translated by a legal certified translator and certified by the tribunale and have to be apostilled?

A) They can be submitted in Italian language.

B) See reply above.
