The following have been added by full text:

QUESTIONS & ANSWERS

1. QUESTION: FACTOR III. Past Performance. If Contractor provides CPARS Evaluations and/or DD FORM 2626 with our proposal for Factor II Past Performance, will Attachment No. 07 Past Performance Questionnaire still be necessary?

ANSWER: Yes, the Past Performance Questionnaire shall be filled out

2. QUESTION: BID GUARANTEE. The submission of the hard copy of Bid Guarantee is requested; Page 67 of 81; Please clarify if electronic submission is acceptable.

ANSWER: Yes, the submission of the electronic copy of Bid Guarantee is acceptable

3. QUESTION: Clarify if the fiber optic cabling will end in manholes placed in front of the AGM as shown without any further connection work from those same manholes to each and every AGM. Reference drawing CD 101 throughout CD 104.

ANSWER: We confirm that cable ducts will end in manholes placed in front of the AGM as shown without any further connection work from those same manholes to each and every AGM.

4. QUESTION: Drawings show a thickness of the bituminous binder varying from 5 centimeters on the sides of the roads, to 17/18 cm in the center. Typical application of bituminous binder on roads should be 8 centimeters all along the surface without variances. Please clarify in order to estimate quantities correctly. Reference drawing CS 301 throughout CS 311 and CS 313.

ANSWER: On drawing CS313 (in particular detail #7 and #8) are shown the typical sections of the road stratigraphy. The foundation is a mixed aggregate foundation 45 cm thick. The base course layer (asphalt conglomerate) is 17 cm thick. The binder course layer has a minimum thickness of 5 cm on the edge of the road and increases towards the center with a 2% slope. In this condition the maximum thickness of the binder layer may reach 11 cm giving an average thickness of the binder layer of 8 cm (with the binder layer the KTR realizes the slope of the road). The final wearing course has a constant thickness of 5 cm. On drawings CS301 through CS311 sections show the foundation layer 45 cm thick, the base course layer (asphalt conglomerate) 17 cm thick and together shows wearing course and binder course as described on work item #2. A road mesh reinforcement must be placed between the base course layer and the binder layer across the enlargement area to avoid settlement and cracks as shown on details. Road materials and requirements are shown on drawing CS313 and on TECH SPECS.

5. QUESTION: Exceed material from excavation (provably sand material), could be transported and delivery inside AMMO area or KTR shall consider disposal of this material?

ANSWER: Exceeding material shall be delivered to disposal as required in demolition note 3 of drawing GI001 and in the chapter 1a of technical specification.

6. QUESTION: Regarding telecommunication lines and manholes, because viale del cassone is already built as per addendum 1,shall be considered to build manhole MH-07?

ANSWER: Manhole MH-07 is required to be built with this project; connection of new manhole MH-07 to the existing manhole MH-08 (located at the cross with vione del casone) with the new cable ducts is included in this project.

7. QUESTION: Regarding binder material, the thickness is variable because of the slopes of the new road, with the requirement of a minimum thickness of 5cm in the edges. Our company has calculated the total quantity of binder according to project sections, and we have a total quantity of binder of 1.444,28 m3 of binder, which means an average thickness of 10cm for the total area. Please could you confirm this quantity is correct?

ANSWER: Calculation of quantities is not a data provided to bidders

8. QUESTION: In order to achieve the requirements of the project, is evaluating the possibility to create a joint venture. Because we have short time to create a JV (ATI) what is the indispensable documentation to be sent with the solicitation regarding this joint venture?

ANSWER: The solicitation in Section L indicates only Pool of Firm (Consorzio Stabile), however we can accept JV (ATI) and the Company shall submit a copy of notarized legal document.

9. QUESTION: Reference drawing CS505, tech specs paragraph 10d-03. Please provide a clear indication of the diameter of the 250 trees to be planted.

ANSWER: See Attachment 1B, Addendum 0002 consisting of six pages ( english and italian version) dated 09 July

ANSWER: The price shall be in Euro and in Dollars for American Company

11. QUESTION: Please clarify if award will be made in Euro or in Dollars.

ANSWER: The award will be made in Euro and in Dollars for American Company

12.QUESTION: The offeror shall submit the bid guarantee in the amount of 10% of the bid. The bid guarantee shall be released by a bank. The hard copy of the bid guarantee shall be submitted.

SECTION M - EVALUATION FACTORS FOR AWARD

SECTION M

A. BASIS OF AWARD

The award will be made to the lowest priced technically acceptable proposal. Proposals will be evaluated for technical acceptability (including past performance), but will not be ranked using the non-price Factors. In order for an Offeror to be considered for award, the proposal must receive an "Acceptable" rating in every non-price Factor. A proposal receiving a rating of "Unacceptability" in any non-price Factor will not be eligible for award.

B. FACTORS

The solicitation provides for the followings:

Factor I – Technical -- Past Experience Factor II – Past Performance Factor III – Price

C. EVALUATION OF THE NON-PRICE FACTORS

Phase One. The Contract Specialist will screen each proposal for completeness to ensure that all mandatory requirements for this solicitation have been addressed. This level of evaluation does not include an in-depth reading of the proposal’s content but it is conducted solely to ensure that a complete proposal has been received and that meets the requirements of the solicitation. Failure to address all the mandatory requirements may be grounds to disqualify the proposal from further review.

Phase Two. In this phase, the evaluation team comprised of experts appointed by the SSA, evaluates the Technical Factor I (Past Experience) and Factor II (Past Performance).

Factor I – TECHNICAL -- PAST EXPERIENCE

The offeror shall demonstrate recent and relevant experience in scope, complexity and price. The Government will evaluate the information concerning at least two (2) recent and relevant projects provided by the offeror on the Attachment #6 entitled “Past Experience Questionnaire (in English)”.

The technical factor will be rated on an acceptable/unacceptable basis using the following ratings:

Acceptable Proposal clearly meets the minimum requirements of the solicitation

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation

In order to be considered relevant the value of each project shall be at least Euro 200,000.00 ($222,766.76). In addition, each project shall be of similar scope, size and complexity concerning “Repair/Upgrade of Roads.” In order to be considered recent the past contracts must be performed and completed within five (5) years from the date of this solicitation identified on Page 1, Block 3.

Factor II -- PAST PERFORMANCE

This factor will be rated acceptable or unacceptable based on whether the past performance submitted for consideration is recent and relevant and demonstrates successful past performance by the offeror, such as: no terminations for default, no ratings less than satisfactory by its customers/references, whether the quality of its work was satisfactory and completed in a timely manner and whether the offeror demonstrate reasonableness and cooperation during performance of the contracts. Past failure to apply sufficient tenacity and perseverance to perform acceptably is strong evidence of unacceptable past performance. In addition, failure to meet the quality requirements of a contract is a significant factor to consider in determining unsatisfactory performance. Offerors misunderstanding. Such clarifications shall not be used to cure proposal deficiencies or material omissions, and/or otherwise revise the proposal.

Past Performance Evaluation Ratings - Rating Descriptions:

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a) (2) (IV). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability “unknown” shall be considered “acceptable”.

For Past Performance to be considered relevant, the offeror shall submit information about at least two (2) relevant and recent projects concerning “Repair/Upgrade of Roads”. The magnitude must be not less than Euro 200,000.00 ($222,766.76) per individual project. To be considered recent, the project must be performed and completed within the past five years from the date of this solicitation (date shows at Block no. 3 of SF 1442).

The offeror is encourage to submit past performance information with evidence of customer satisfaction such as performance evaluation, special commendation, recognition, letters of appreciation, “certificato di regolare esecuzione” o “collaudo finale” photographs of the projects, etc.

The Past Performance is considered to be not relevant if it is not similar in work and the magnitude is less than Euro 200,000.00 ($ 222,766.76) per individual project. It will be considered not recent if it is not performed and completed within the last five (5) years from the date of this solicitation (date shows at Block no. 3 of SF 1442).

The Government will conduct a past performance assessment on all contracts, at least two (2), submitted by the offeror on the Past Performance Questionnaire (Attachment #7). The Government will consider the recency and relevance of the information, source of the information, context of the data, and general trends in contractors performance. The Government will consider the Past Performance Questionnaire information, as well as information obtained from any other sources.

D. FACTOR III -- EVALUATION OF THE PRICE

A contract will be awarded to the Lowest Priced Technically Acceptable Offeror (LPTA). The total price indicated at CLIN 0001 and CLIN 0002 will be evaluated for fair and reasonableness and for unbalanced pricing. Unrealistic, unbalanced or unreasonable pricing may cause a proposal to be determined unacceptable. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
