C.3.5.1.2 Emergency Spill Response. This section only applies when the COR determines that on site contractor staff can’t handle the spill because more specialized trained personnel and equipment or additional resources are needed to contain and clean up spill. The contractor shall provide all labor, equipment, material and supplies, unless otherwise indicated, to clean up hazardous material/waste spills. Disposal of the material shall be in accordance with the applicable pricing from the Schedule of Disposal Services and Supplies.
C.3.5.1.3 The contractor shall respond to a spill site no later than two (2) hours after receiving a verbal notification by the COR that a spill has occurred. The contractor shall have adequate supplies and equipment to contain and cleanup any spill. The contractor should provide documentation with the proposal if available, that it has agreements in place with other local commercial spill response companies for additional resources in case of even larger spills.
C.3.5.1.4 COR will attempt to contact the contractor telephonically when an emergency arises. If unable to reach the contractor within 30 minutes of the initial try, the two (2) hour response time will begin accruing. If the contractor is non-responsive after the two (2) hour timeframe lapses, the Government will take whatever action is necessary to remediate the spill in the most expeditious manner, to include, but not limited to, using another contractor to clean up, containerize and transport the spilled residue to the APG’s TSDF or 90 day site. The contractor may be subject to cost reimbursement to the Government’s due to inaction or non-responsiveness.
