ORDERING FOR MULTIPLE AWARDS
H.1 Ordering For Multiple Awards
H.1.1 For Task Orders beyond the guaranteed contract minimum, the Government intends to issue awards competitively in accordance with (IAW) Fair Opportunity provision of FAR 16.505(b), unless an exception exists in FAR 16.505(b)(2)(i).
H.1.2 Generally, offerors will be allowed at least one week to respond to a request for a task order proposal.
H.1.3 Firm Fixed Price CLINs: Base contract(s) unit range prices for CLINs 1001-5001 constitute ceiling prices. As such, offerors are not allowed to propose higher prices than the ceiling prices. An offeror may propose lower than the ceiling prices during Fair Opportunity competition.
(a) Each awardee shall be provided a fair opportunity to be considered for each order in excess of $3,500.00, unless one of the exceptions outlined in subparagraph (b) is met. The basis for award will be identified in Task Order Proposal Request(s). The Contracting Officer, in making the decision in the award of any individual task order, shall consider price or cost under each order as one of the factors in the selection decision; however, the decision may result in an award to other than the lowest priced proposal. The Contracting Officer may also consider the following criteria when developing factors in the selection decision tailored for each individual order:
The Contracting Officer may use streamlined procedures, including oral presentations, when selecting an order awardee. The competition requirements of FAR Part 6 and the policies of FAR subpart 15.3 do not apply to the ordering process and the Contracting Officer is not required to use a formal evaluation plan or scoring of offers.
Additionally, if the order does not exceed the simplified acquisition threshold, the Contracting Officer need not contact each of the multiple awardees under the contract before selecting an order awardee if the Contracting Officer has information available to ensure that each awardee is provided a fair opportunity to be considered for each order.
A multiple contract awardee may at any time after contract award offer a lower price than that provided for in this contract, and the Contracting Officer may accept the contractor's lower cost/price in making decisions in the award of any order.
The Government intends to evaluate and award task orders without discussions. However, the Government reserves the right to conduct discussions if the Contracting Officer determines them to be necessary.
(b) Awardees need not be given a fair opportunity to be considered for a particular order in excess of $3,500.00 under this contract if the Contracting Officer determines that:
(1) The agency need for the supplies or services is of such urgency that providing a fair opportunity would result in unacceptable delays;
(2) Only one contractor is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized;
(3) The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order; or
(4) It is necessary to place an order to satisfy a minimum guarantee.
