SECTION L - INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS
SECTION II
SOLICITATION PROVISIONS
SECTION L INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFEROR
L.1 The contract resulting from this solicitation will be awarded utilizing Subjective Best Value Trade-Off Analysis Procedures in accordance with Federal Acquisition Regulation (FAR) 15.101-1 to select the successful offeror. It is the Government's intent to award a single-source indefinite-delivery, indefinite-quantity (IDIQ) contract type award, in accordance with (IAW) FAR 16.5/Defense FAR
Supplement (DFARS) 216.5, with a five year ordering period covering September 2020 September 2025. The basic IDIQ contract and Task
Orders 0001 through 0005 will be evaluated. Once evaluated and a successful awardee selected, Task Order 0001 will be awarded at the same time as the basic contract. Task Order 0001 will satisfy the Governments minimum ordering liability. The basic contract type will be setup for award with cost-plus-fixed-fee (CPFF) task orders. The Government intends to evaluate proposals and award one contract without discussions. The Procuring Contracting Officer (PCO) may contact offerors for clarification, as described in FAR 15.306(a) and
FAR 52.215-1(f)(4), without opening discussions. However, the Government will reserve the right to open discussions, if deemed necessary. In the event that discussions are necessary, the PCO may establish a competitive range. The Government will only consider those Offerors within the competitive range for contract award. Therefore, each initial offer shall contain the offerors best terms for technical/management, past performance, cost/price, and small business participation.
L.1.1 These instructions are a guide for preparing a proposal. These instructions describe the type and extent of information required, and emphasizes the significant areas to be addressed in the proposal. Review the Performance Work Statements (PWSs) contained in this
RFP for further insight into the areas that must be addressed within the proposal. Include detailed information sufficient to enable the
Government evaluators to conduct a meaningful review and make a determination relative to the Offeror's understanding of the requirements in each of the evaluated areas.
L.1.2 The proposal will be composed of written submissions in English. The instructions below identify the information that will be required with the proposals. Each offeror shall submit one offer; alternate or multiple proposals will not be accepted. If revised proposal(s) are required, they shall be highlighted, gray barred or asterisked to identify the changes.
L.1.3 Proposals that merely offer to perform work IAW this solicitation or that fail to present more than an indication of capability of compliance with the technical requirements without elaboration will be deemed to be unacceptable and will not be considered further.
L.1.4 Due to the nature of the evaluation criteria, some duplication of material in the technical/management and past performance volumes may be necessary to adequately address the PWS and solicitation requirements. In such instances, cross-referencing is permissible.
L.1.5 Offeror must be registered in the System for Award Management (SAM) and have CAGE Code upon proposal submission to be considered for award.
L.1.6 Proposals, modifications, revisions, or withdrawals of proposals received after the date established in this RFP for receipt of proposals will be handled IAW FAR Clause 52.215-1.
L.1.7 IAW FAR Clause 52.215-1, Instructions to Offerors - Competitive Acquisition the Government intends to award a contract without discussions. Offerors are cautioned to examine this RFP in its entirety and to ensure that proposals contain all necessary information, provide all required documentation, and are complete in all respects. The Government is not obligated to make another request for the required information nor does the Government assume the duty to search for data to cure problems it finds in proposals. The Government reserves the right to conduct discussions in the evaluation process and to permit Offerors to revise proposals, if deemed necessary.
During the evaluation process, the Government may request clarifications as needed. Clarifications do not constitute discussions and an Offeror is not allowed to change its proposal in response to a request for clarification. IAW FAR 15.306(c)(2), if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. Any Offeror eliminated from further consideration will be notified in writing.
L.1.7 Updates related to this RFP, to include amendments, notices, and other information, will be made available on the Beta.SAM.gov website. Offerors are advised to continuously monitor the Beta.SAM.gov website for new information. Offerors are deemed to have knowledge of all information that is posted to the Beta.SAM.gov website.

Deviations shall be fully explained. Inclusion of cost/price information in the technical/management proposal is not considered an acceptable deviation.
L.2.8 Freedom of Information Act (FOIA). FOIA and its amendment have resulted in an increasing number of requests from outside the
Government for copies of contractors' proposals and other documents submitted to federal agencies. Therefore, in order for an Offeror to receive an award under this RFP, the successful Offeror will be required to demonstrate that the design of its accounting system by providing official documentation, from either a successful Defense Contract Audit Agency (DCAA) audit of the Offeror's accounting system; or a letter from the Defense Contract Management Agency (DCMA) documenting its approval/adequacy of the Offeror's accounting system; or provide rationale for why documentation cannot be presented at proposal submission and a proposed date for which required documentation will be available. The provided documentation should be redacted to ensure no Personally Identifiable Information (PII) is included in the submission. EXAMPLE: The proposed rate for a Supply Manager is based on the median salary for a Warehouse Manager
