1.6.1.1b
Organizational Conflicts of Interest (OCI). Per Federal Acquisition Regulation (FAR) 9.5, OCI may result when factors create an actual or potential conflict of interest on a contract, or when the nature of the work to be performed on the contract creates an actual or potential conflict of interest on a future acquisition. In this procurement, the Army has particular concerns that any proposal received from an offeror which would have the potential to perform services on any implementation contract to which that offeror is organizationally connected, is likely to result in an impermissible “Impaired Objectivity,” “Unequal Access to Information,” or “Biased Ground Rules” OCI (one or more), and thus be ineligible for award under FAR 9.5. Therefore, with respect to this contract, the Contractor agrees that, in consideration of the award of this contract, the Contractor, any Sub-Contractor, consultant, or employee of the Contractor, any joint venture involving the Contractor, any entity with which it is or becomes affiliated by common ownership or with or into which it merges, or any successor or assignee of the Contractor, shall not provide services as a prime, Sub-Contractor, or consultant under any systems integrator contract for current or future Army Program Executive Officer, Enterprise Information Systems programs. The Contractor shall include this requirement in sub-contracts at all tiers. The Contractor agrees that this restraint shall extend throughout this contract period of performance, including any exercised options. The Contractor agrees and acknowledges that compliance with this restraint at all tiers is a material requirement of this contract. (FAR 9.505-1) The only exception to these restrictions will be if the Contractor submits a comprehensive mitigation plan to the KO that, at the sole discretion of the KO, gives the Government confidence that any current or potential OCIs will be satisfactorily neutralized.
The Prime Contractor understands the requirement for Organizational Conflict of Interest (OCI), as required per Federal Acquisition Regulation (FAR) 9.5. However, Paragraph 1.6.1.1b, noted herein, implies the Governments intent to award a SETA contract. The ensuing requirements of the RFP implies the Government wants to award a Tier 1 Maintenance, Logistical & Services Support contract. Paragraph 1.6.1.1b limits the field of qualified SATCOM industry partners from bidding on this effort, at the risk of not being able to qualify for other PEO/EIS programs and opportunities. Based on the understanding of the effort to be performed upon award, the OCI statement provided herein is not required for this RFP. It is recommended that standard OCI language be used in place of this paragraph.
A9
The Government has removed paragraph b. Section 1.6.1.1, Non-Disclosure Agreement (NDA) from the PWS.

Q10

Will there be a technical library available to view to analyze work load data?

A10
No, a technical library is not available.

Q11

Does the T&M pricing matrix cover all labor categories anticipated on this contract?

A11
Yes, the price matrix covers all labor categories anticipated for this contract. The price matrix has been revised to include additional labor categories the Government omitted

Q12

Is the PMO and technical staff co-located in the warehouse?

A12
No. Some technical staff is co-located within the Warehouse proper. Other Technical SME’s can/may work remotely. Project Managers, Assistant Program Managers do not have to be co-located within the warehouse. The Warehouse personnel are on-site for day-to-day Warehouse operations and management purposes.

Q13

It would be helpful to visit the warehouse to determine the scope/size of the requirements. Will you entertain a site visit to the warehouse in Wilkes-Barre, Pa?

A13
Attachment 0007 "Master Inventory" provides the offerors with the size of the requirement. The scope would be categorized as warehouse operations and asset management, which the offerors are required to have experience supporting.

Q14

Given the short period of time before proposals are due and the many unknowns of the program that only the incumbent understands, we request a 30 day extension to the proposal due date. This would also give us time to construct our team that meets all the small business goals.

A14
The Government has granted an extension of seven days. Proposals are now due by 12:00 CT 1 OCT 18.

PWS Page # 43 Section L, I.,I2

PWS 4.1.2

I2. Sub factor 2. Program Management Plan (PMP): The Offeror shall submit a PMP that presents an overall picture that documents how they will meet and comply with the requirements established in the PWS. The plan shall address the items listed in the PWS, paragraph 4.1.2.

4.1.2 Program Management Plan (PMP)

The Contractor shall develop a PMP to be submitted with proposal. The PMP must be developed IAW DI-MGMT-80004A. The PMP must include the following:

· Organization diagram

· Program Management Methodology

· Subcontract Management Methodology

· Performance Management Methodology

· Risk Management Methodology

· Contractor Work Breakdown Structure (WBS) Directory with the names, labor categories, and contact information of all personnel who will be working on this effort The Government is requesting all Offerors to submit redacted proposals per page 45 of the RFP, including redacted names for key personnel resumes as part of the Staffing Plan requirements on page 49.

In contradiction to the above-redacted requirements, the Government is requesting all Offerors to provide a directory with the names, labor categories, and contact information of all personnel who will be working on this effort (Per RFP Section L, I., I2) in the Program Management Plan (PMP) per PWS section 4.1.2.

We request the Government to remove the requirement in PWS section 4.1.2, requesting all Offerors to develop a PMP to be submitted with proposals, which includes a directory with the names, labor categories, and contact information of all personnel who will be working on this effort. A requirement of this nature and magnitude will severely restrict competition for Offerors other than the incumbent.

A16
The Government has removed the requirement in RFP Section L, I, I2 and PWS 4.12 to list directory names and contact information of all personnel who will be working the effort via amendment 0002, however labor categories are still required.

Paragraph C.4
Quote: In order to initiate the use of the ASSIST2Industry, the Government requires the names, company titles, telephone numbers, and email addresses of two individuals that the Offeror has designated as responsible for receiving and responding to Government ENs through ASSIST2Industry. The designation of two individuals is for the purpose of ensuring availability of one individual if the other individual is not available. The required information regarding these two individuals must be submitted with the Offerors proposal and included in the cover letter.
Issue/Question: The Government stated that the “the alphanumeric offeror code is to be used throughout your proposal in lieu of your company's name or logo. Paragraph C.4 requires the offeror to provide two POCs in the Cover Letter including the POC’s email address. The POC email address contains the Offeror’s corporate name.

Question: Should Offerors include their POC email address, which contains their Corporate Name, in the Cover Letter? Please confirm if the Government intended Offerors to provide this information in the Cover Sheet, that will accompany our redacted proposal, rather than the Cover Letter.

A17
Yes, offerors shall include POC information as stated in the RFP page #45. The information shall be included in the Cover Letter. As identified in Q&A7, a cover page for each volume is optional, not required. The cover letter is required.
