About this file
This is a provisions and clauses attachment document that incorporates federal acquisition regulations and defense acquisition regulations into a Basic Ordering Agreement (BOA) for Low-Level Radioactive Waste (LLRW) identification, removal, remediation, processing, and disposal projects. The document lists approximately 90 FAR and DFARS clauses applicable to the contract, including standard requirements for payments, cost reimbursement, property management, subcontracting limitations, labor standards, ethics, security, and compliance certifications. Key contractual provisions include FAR 52.216-7 (Allowable Cost and Payment) governing invoicing and cost reimbursement procedures with interim payments made within specified timeframes and final indirect cost rate settlements required within six months of fiscal year expiration; FAR 52.216-18 (Ordering) establishing procedures for delivery and task order issuance through the contract expiration date; and FAR 52.219-14 (Limitations on Subcontracting) requiring that for service contracts, no more than 50 percent of government payments be subcontracted to non-similarly situated entities, with compliance verified by the end of each order's performance period. The clauses also incorporate DFARS 252.219-7009 regarding 8(a) direct award administration, confirming the SBA's role in certification and eligibility determinations, and DFARS 252.204-7012 requiring safeguarding of covered defense information and cyber incident reporting. Additional provisions address prohibited foreign telecommunications equipment and unmanned aircraft systems, property reporting and disposal procedures, whistleblower protections, equal employment opportunity requirements, and restrictions on contracting with debarred entities or foreign-connected organizations. The BOA is structured as a competitive 8(a) set-aside with a five-year ordering period and total duration not to exceed five years.
