SUBJECT: Request for Proposal (RFP) for W519TC-24-R-0022, a Five-Year Ordering Period Indefinite-Delivery Indefinite-Quantity (IDIQ) Contract for Active Radio Frequency Identification VI (aRFID-VI)

Dear Ms. Johnston:
The U.S. Government (USG) has a requirement for follow-on of commercial communications hardware, software, documentation, and warranty services to provide a common, integrated structure for logistics tracking, locating, and monitoring of assets and IUID marking. For the purposes of this contract, aRFID components are those commercially available items necessary for Radio Frequency Identification, the tracking of tagged commodities and assets, data collection, keyless data entry, data processing, and data storage and retrieval. The aRFID-VI contract will provide aRFID hardware and software that will be used in fixed and mobile installations.
This letter, its attachments, and its exhibits (i.e., this letter and its enclosures) contain the terms and conditions that will apply to this solicitation and the resultant contract.
The contract will be an ordering vehicle for authorized users worldwide, containing Firm- Fixed-Price (FFP) Contract Line Item Numbers (CLINs) for aRFID-VI hardware.
Savi shall submit as their proposal:
(1) A copy of the completed Attachment 0002, aRFID-VI Price Model,
(2) Copies of all technical specification sheets for each item (CLIN), listed in Attachment 0002.
(3) Historical pricing, latest available, for each item listed in Attachment 0002
a. If no historical pricing is available, Savi shall submit a short narrative explaining why.
(4) Other than certified cost or pricing data to support their proposed prices
a. Examples include, but are not limited to the following:
i. Vendor quotations,
ii. Information on changes in production methods and in production or purchasing volume,
iii. Unit-cost trends such as those associated with labor efficiency,
iv. Make-or-buy decisions,
v. Nonrecurring costs,
vi. Identical types of data as certified cost or pricing data, consistent with Table 15-2 of Federal Acquisition Regulation (FAR) 15.408, but without the certification,
vii. Judgmental factors applied, mathematical or other methods used in the estimate, including those used in projecting from known data,
viii. Nature and amount of any contingencies included in the proposed price
The proposal will be for a five-year ordering period in support of the aRFID follow-on effort. The guaranteed minimum buy is $25,000.00. The contract maximum is $21,793,181.16.
Savi’s proposal submission must be in accordance with (IAW) Attachment 0001 -aRFID-VI PWS, Attachment 0002 – aRFID-VI PM, Attachment 0003 - Addendum to FAR 52.212-4, and Exhibit A CDRLs, as well as the terms and conditions detailed below.
Proposal Instructions
Savi shall submit their proposal by electronic mail (e-mail) to both the Contracting Officer, Benjamin Geringer, and Contract Specialist, John Kerch, at benjamin.l.geringer.civ@army.mil and john.d.kerch.civ@army.mil.
The maximum e-mail attachment size allowed is 20 MB, which includes the e-mail itself and all attachments. The USG will not accept self-extracting .exe and .zip files. Savi is responsible to ensure electronic attachment files are virus free and functional. You may contact John Kerch and Benjamin Geringer, by separate e-mail, to confirm USG receipt of electronic proposal(s).
Savi shall provide a copy of this letter, dated and signed by an individual authorized to enter into a contractual arrangement with the USG.
Savi shall acknowledge all RFP amendments by signing and returning a copy of each letter that issues the amendments, if any.
Savi shall ensure all representations and certifications are up to date.
Technical Capability:
Savi shall submit a completed Attachment 0002, aRFID-VI Price Matrix. Savi shall also submit all technical specification sheets for each item (CLIN) listed in Attachment 0002.
Price
The USG intends to use price analysis to determine Savi’s proposed prices fair and reasonable. The USG intends to utilize the technique(s) outlined in FAR 15.404-1(b)(2).
However, the USG may, at its discretion, utilize other/additional methodologies such as cost analysis to determine a fair and reasonable price.
If available, Savi shall submit historical pricing for all the CLINs listed on Attachment 0002, aRFID-VI PM. Examples of historical pricing would be invoices for item(s) sold to USG or Non-USG customers for the same or similar item(s).
Savi shall include its proposed prices for the FFP CLINs. All proposed prices shall be stated in U.S. dollars, rounded and displayed to two decimal places.
The fully adequate price proposal shall be submitted electronically in a formula/algorithm-driven, fully calculating, compatible with current Microsoft 365, EXCEL file (e.g., .xlsx) and a supporting, compatible with current Microsoft 365, WORD file (e.g., .docx). Macro enabled format and use of macros within the proposal are allowed, but greatly discouraged.
The Contracting Officer is requiring Savi submit with its proposal other than certified cost or pricing data to support Savi’s proposed prices. Examples of cost or pricing data are shown below.
FAR 2.101 defines Cost or Pricing Data as, “all facts that, as of the date of price agreement, or, if applicable, an earlier date agreed upon between the parties that is as close as practicable to the date of agreement on price, prudent buyers and sellers would reasonably expect to affect price negotiations significantly. Cost or pricing data are factual, not judgmental; and are verifiable. While they do not indicate the accuracy of the prospective contractor’s judgment about estimated future costs or projections, they do include the data forming the basis for that judgment. Cost or pricing data are more than historical accounting data; they are all the facts that can be reasonably expected to contribute to the soundness of estimates of future costs and to the validity of determinations of costs already incurred. They also include, but are not limited to, such factors as-
(1) Vendor quotations;
(2) Nonrecurring costs;
(3) Information on changes in production methods and in production or purchasing volume;
(4) Data supporting projections of business prospects and objectives and related operations costs;
(5) Unit-cost trends such as those associated with labor efficiency;
(6) Make-or-buy decisions;
(7) Estimated resources to attain business goals; and
(8) Information on management decisions that could have a significant bearing on costs.”
Below are examples of other than certified cost and pricing data.
FAR 2.101 defines Data Other than Certified Cost or Pricing Data as, “pricing data, cost data, and judgmental information necessary for the contracting officer to determine a fair and reasonable price or to determine cost realism. Such data may include the identical types of data as certified cost or pricing data, consistent with Table 15-2 of 15.408, but without the certification. The data may also include, for example, sales data and any information reasonably required to explain the offeror’s estimating process, including, but not limited to–
(1) The judgmental factors applied and the mathematical or other methods used in the estimate, including those used in projecting from known data; and
(2) The nature and amount of any contingencies included in the proposed price.”
FAR 15.403-5(b)(2), explains the format in which this data must be submitted. It explains, “When required by the contracting officer, data other than certified cost or pricing data may be submitted in the offeror’s own format unless the contracting officer decides that use of a specific format is essential for evaluating and determining that the price is fair and reasonable and the format has been described in the solicitation.”
The Contracting Officer is not requiring the other than certified cost or pricing data (supporting information) be submitted in a specific format. While a specific format is not required, the USG may ask for additional information to support any submitted document(s) or may ask clarifying questions on the submissions.
Please note since this is a commercial acquisition certified cost and pricing data is not required.
Certified Cost and Pricing Data:
Per FAR 15.403-1(b)(3), since aRFID is commercial, certified cost and pricing data is not required. However, in order for the USG to determine Savi’s proposed pricing fair and reasonable, other than certified cost and pricing data will be required. Data other than certified cost or pricing data means pricing data, cost data, and judgmental information necessary for the contracting officer to determine a fair and reasonable price or to determine cost realism. Such data may include the identical types of data as certified cost or pricing data, consistent with Table 15-2 of 15.408, but without the certification.
The data may also include, for example, sales data and any information reasonably required to explain the offeror’s estimating process, including, but not limited to pricing data. In addition, the USG reserves the right to require the submission of any additional data necessary to validate the reasonableness of proposal price.
Small Business Subcontracting Plan:
Per FAR 19.702(b)(1), since Savi is a small business under North American Industry Classification System (NAICS), 334111 Electronic Computer Manufacturing, a Small Business Subcontracting Plan is not required for this effort.
Evaluation of Proposal(s):
In order to perform a compliance review, the signed RFP Letter, to include amendments if applicable, will be reviewed by the USG, but will not be evaluated. However, each document is a requirement for contract award.
Basis for Award: This procurement is not a competitive action. A justification and approval (J&A) has been prepared and approved for other than full and open competition and a redacted copy of this J&A will be posted to the System for Award Management (https://sam.gov/) website upon award of the contract.
Attachment 0002, aRFID-VI PM, provides an overview of the USG’s requested format for the CLIN layout of the proposal. Please note, Savi may propose other/additional CLINs/SLINs be used in its proposal/the contract per FAR 52.204-22, Alternative Line Item Proposal. Savi shall complete Attachment 0002, aRFID-VI PM, as part of its proposal submission.
Technical Capability The USG will evaluate Savi’s Attachment 0002 submission and the technical specification sheets to determine Savi’s technical acceptability.
The USG will review each product in Savi’s submission of Attachment 0002, aRFID-VI PM and each submitted technical specifications sheets to determine if the item meets the minimum technical specifications required in the Attachment 0001, aRFID-VI PWS.
Each product (CLIN) will be rated individually on a pass/fail basis.
Price The USG will also review Savi’s proposal for a fair and reasonable price. Price and/or cost analysis will be used to determine price reasonableness for the proposal. Additional analysis techniques may be used as determined necessary by the PCO. The methods of evaluation may include the use of information/input from sources such as (but not limited
to) other USG agencies and personnel.
Additional Considerations:
Please be advised that this is a RFP and your firm is not authorized to commence work or incur any cost to perform the proposed effort in advance of any contractual award.
Therefore, the contents of this document shall not be interpreted as authorizing work to commence and shall not serve as the basis for any future claims against the USG. Savi will only be directed to commence work upon issuance of a signed contract document.
Savi’s proposal shall remain valid for 120 days from the date of submission. This letter does not constitute an authorization to start work, nor is the USG required to award a contract based on responses received to this letter.
