Section C - Descriptions and Specifications
PURCHASE DESCRIPTION
F35 TEMPORARY OFFICE FACILITIES
1. Furnish all labor, material and equipment to deliver, place and set up five (5) fully functional and ready for occupancy, assembled temporary office trailer\modular office facilities.
a. The work includes: delivery, placement, leveling, blocking, skirting, stoop w\non-slip steps (non ADA), overhang covered (non-enclosed) entries w\railings; NEC (National Electrical Code) compliant electrical circuit breaker panel and data jacks terminating in a data panel; misc. hardware, racks, cables, and any other items that may be necessary for occupancy but not specifically mentioned.
b. The work includes teardown; at the end of the contract period of performance the teardown includes removing blocking, skirting, stoop w\ steps, overhangs, entries & railings. Disassemble modular unit connection to make ready for shipping. Remove each unit from Truax Field property.
c. As regards both delivery and teardown: Site restoration is “Not In Contract,” (NIC) however; the contractor shall be responsible for repairs to any part of the site or path on Truax Field property damaged from his\her operation including, pavement areas, curb & gutter, lawns fences and the like; and shall remove and dispose of materials and debris from His\Her operation.
d. Utility connection from each modular 24 x 60 (nominal) assembled unit to external utility services for power and communication shall be by others Not Included in this Contract (NIC).
e. The local authority has determined that these units do not need to be ADA compliant, however; all door openings both interior and exterior, shall be minimum 3’ wide and 80” high. Electrical and data devices shall located and installed in accordance with latest revision of NEC at time of manufacture.
f. The supplier shall determine what additional components, hardware and incidentals (if any) may be required and include said item(s) in the offer. Offers will be evaluated for completeness and quality.
g. The offeror shall confirm ability to deliver and place all 5 assembled units on Truax Field as sited, in not more than 105 calendar days from the date of the signed contract barring catastrophic unforeseen occurrence(s) of weather, COVID 19 outbreak or other recordable event.
a. Upon delivery, each assembled unit shall be placed, setup and ready for occupancy in not more than 2 days.
The offeror may schedule the work to setup each unit consecutively in not more than 10 days or all five together. In either case the work shall progress as scheduled without stop or break in work outside of the work schedule.
(a) Special Condition(s): The government prefers, but does not require, that the delivery and work be done during “off” hours. Truax Field has specific days called “Down Days” which coincide with weekends.
These days are the most advantageous for both the contractor and Truax Field Operations. The government will make every effort to cooperate with the contractor to make the process of delivery and setup and eventual takedown and removal as efficient and advantageous as possible for both the government and the contractor.
(b) Due to the expected seasonal timeframe of delivery and eventual removal; the government will be responsible for snow removal and traffic management from the immediate site and for a path to and from the site within the boundary of Truax Field property.
(c) All work under the Contract shall be arranged and carried on in such a manner as to complete the work in the least possible time. The offeror shall consult with the Contracting Officer as to methods or sequence of carrying on the work. A definite program of work shall be arranged before starting.
(d) Safety: The offeror shall assume full responsibility and liability for compliance with all applicable regulations pertaining to the health and safety of personnel during the execution of work. The Government shall not be held liable for any action on the part of the Contractor, his employees or Subcontractor, which result in illness, injury or death.
(e) Access and General Protection/Security Policy and Procedures. This includes all offerors employees with an area of performance within Government controlled installation, facility, or area. The contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the Contracting Officer’s Representative (COR). The offeror shall also provide all information required for background checks to meet installation access requirements to be accomplished by the local installation’s Security Forces, Director of Emergency Services or local Security Office. The offeror shall ensure compliance with all personal identity verification requirements as directed by DoD, HAF and/or local policy. Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes.
2. Minimum Requirements: 5 EA Temporary Double-Wide Trailers\Modular Offices.
a. Each trailer shall:
(1) Be the same or similar color and finish on the exterior. Surfaces shall be free of stickers, company logos, placards and signage except each assembled unit shall have a numeral (1-5) designation affixed to the wall on the exterior in an obvious visible location at each entry door (2 per unit). Each numeral shall be not less than 6” high in Helvetica font; made of wood, plastic or aluminum and shall be brown or bronze in color.
(2) Have interior finished spaces in new or good quality used, serviceable, disinfected and COVID-19 sanitized condition. Walls may be painted drywall or paneled. Floors shall be carpeted except entry areas shall have a floor suitable for wet or snow-covered shoes.
(3) Have assembled nominal outside dimensions 24’ wide by 60’ long not including the tongue.
(4) Have insulated walls, floors and ceiling for hot & cold weather environments; Min R-11 exterior walls and floors and R-19 roof.
(5) Be electrically heated & air-conditioned and ventilated for year-round use that maintains a uniform indoor temperature of 68 to 72 deg F (20 to 22 deg C) regardless of outdoor air temperature.
(6) Have dimmable LED 2000-4000k electric light fixtures throughout.
(7) Have one dusk-to-dawn controlled exterior light at each entry.
(8) Have interior general illumination within each walled space with wall mounted dimmer switches within and serving, each space (see Item 6 above). Not less than one ceiling light in each private office.
(9) Have interior convenience outlets and data jacks liberally throughout and along each wall in accordance with latest revision of NEC. See Floor plan for minimums.
(10) Have one electrical power circuit breaker panel serving each assembled unit. Include circuit breakers as required to serve the space and two unused spares; 100/125 Amp main, 120/240v, single phase, 3-wire, 60 Hz. 16 spaces located where shown on the Floor Plan.
(11) Include 4-port, CAT6 data jacks where shown on the Floor Plan.
(12) Include HVAC & Air Conditioning unit(s) see #5 above.
(13) Include thru-floor or thru-wall access for electric utility to get into the provided CB panel.
(14) Include thru-floor access for data utility to get into the provided box mounted high on the wall near entry in each assembled unit where shown on the Floor Plan.
(15) Include color matched or accent; base skirting all-around in good condition.
(16) Include anti-slip covered exterior access stoop and stairs with handrails at each Entry door.
(17) Include itemized price showing delivery (mobilization) to Truax Field, Madison WI, set-up, removal (demobilization) and rental for 1 year with annual renewal up to three years.
3. Option 1: Include price for one additional 24 x 60 temporary trailer\modular building the same as described above and shown on the Floor Plan. This unit, if accepted and required will be installed on Truax Field property in an alternate location as directed.

52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)
(a) Definitions. As used in this clause--
Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).
Covered foreign country means The People's Republic of China.
Covered telecommunications equipment or services means--
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or
(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
Critical technology means--
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled--
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).
Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.
Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.
Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.
Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
(c) Exceptions. This clause does not prohibit contractors from providing--
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(d) Reporting requirement.
(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause:
(i) Within one business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.
(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
The solicitation will be evaluated using technical, price and past performance under procedures in FAR Part 12 and FAR Part 13.
The Federal Awardee Performance and Integrity Information System (FAPIIS) will be used to review information on any of the offeror's previous contracts and information covering a five-year period.
Pricing: Pricing for each of the units will be based on monthly pricing whereas set-up and disassembly will be a one-time cost upon mobilization and de-mobilization of each unit. Provide pricing for each CLIN by completing the SF 1449 per solicitation instructions.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate the total price for the basic requirement together with any option(s) exercised at the time of award.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days (insert the period of time within which the Contracting Officer may exercise the option); provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days (60 days unless a different number of days is inserted) before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed three years.
52.222-19 CHILD LABOR--COOPERATION WITH AUTHORITIES AND REMEDIES (JAN 2020)
(a) Applicability. This clause does not apply to the extent that the Contractor is supplying end products mined, produced, or manufactured in--
(1) Canada, and the anticipated value of the acquisition is $25,000 or more;
(2) Israel, and the anticipated value of the acquisition is $50,000 or more;
(3) Mexico, and the anticipated value of the acquisition is $83,099 or more; or
(4) Armenia, Aruba, Australia, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Italy, Japan, Korea, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Moldova, Montenegro, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Singapore, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, Taiwan, Ukraine, or the United Kingdom and the anticipated value of the acquisition is $182,000 or more.
(b) Cooperation with Authorities. To enforce the laws prohibiting the manufacture or importation of products mined, produced, or manufactured by forced or indentured child labor, authorized officials may need to conduct investigations to determine whether forced or indentured child labor was used to mine, produce, or manufacture any product furnished under this contract. If the solicitation includes the provision 52.222-18, Certification Regarding Knowledge of Child Labor for Listed End Products, or the equivalent at 2.212-3(i), the Contractor agrees to cooperate fully with authorized officials of the contracting agency, the Department of the Treasury, or the
Department of Justice by providing reasonable access to records, documents, persons, or premises upon reasonable request by the authorized officials.
(c) Violations. The Government may impose remedies set forth in paragraph (d) for the following violations:
(1) The Contractor has submitted a false certification regarding knowledge of the use of forced or indentured child labor for listed end products.
(2) The Contractor has failed to cooperate, if required, in accordance with paragraph (b) of this clause, with an investigation of the use of forced or indentured child labor by an Inspector General, Attorney General, or the Secretary of the Treasury.
(3) The Contractor uses forced or indentured child labor in its mining, production, or manufacturing processes.
(4) The Contractor has furnished under the contract end products or components that have been mined, produced, or manufactured wholly or in part by forced or indentured child labor. (The Government will not pursue remedies at paragraph (d)(2) or paragraph (d)(3) of this clause unless sufficient evidence indicates that the Contractor knew of the violation.)
