REQUIREMENT: The contractor shall provide the requested number of light towers and generators for each location, as outlined in this Statement of Work.

1.0 PERIOD OF PERFORMANCE (POP)

1.1 Rotation 20-07 18 April 2020 – 1 June 2020

NOTE: The Government reserves the right to vary quantities by +/- 30% due to operational requirements and to make multiple awards to meet said requirements.

The Government also reserves the right to increase and decrease the Period of Performance dates due to mission requirements. In the event this happens, the Contracting Officer will notify the Contractor within 12-24 hours to make adjustments accordingly. The Government shall not be charged for mission changes.

2.0 SCOPE

2.1 (Light Sets) The contractor shall be responsible for furnishing all materials, labor and equipment necessary to deliver, set-up, maintain, tear down, and remove Light Towers in accordance with the Technical Instructions, at the National Training Center (NTC), Fort Irwin, CA. Prior to arrival, coordinate with Contracting Officer’s Representative (COR).

2.2 (Light Sets) The Light Towers must be equipped with a towing pintle capable of being attached to a standard military High Mobility Multipurpose Wheeled Vehicle (HMMWV). The contractor can use an interchangeable hitch to place equipment for each location; however, the towing pintle must be in place no later than the day prior to the start of each POP.

2.3 (Light Sets) The contractor shall ensure the light output equivalent of at least four (4) 1,000 watt bulbs. Also, the contractor shall ensure the light bulbs have a total power output of no less than 4kW and a total power output for the generator of no less than 7kW.

2.4 (Light Sets) The contractor shall ensure the Light Towers run on Ultra Low Sulfur Diesel (ULSD) and/or solar power; please see Appendix B. Equipment shall be compatible with ULSD fuel or be solar powered. Government will provide ULSD fuel. The contractor shall label each piece of equipment next to the fuel tank with the wording “Diesel Fuel Only.”

Failure to label accordingly will invalidate contractor claims regarding use of incorrect fuel.

2.5 (Light Sets) The contractor shall ensure all Light Towers are delivered with all necessary parts in accordance with (IAW) the operators’ manual and generators must have a full tank of fuel. The Government will not be responsible for returning equipment with a full tank of gas or paying to refuel the equipment at the end of the Period of Performance.

The contractor must acknowledge all repair calls within four hours of initial call and complete all necessary repairs within 24 hours.

2.6 The contractor shall be available 24 hours 7 days a week for services and be capable to repair or replace within 24 hours of a service call. All backup units utilized in the event of primary failure shall be at no additional cost to the Government.

2.7 The Government will return the light towers with any unused fuel and are not responsible for refueling nor pay any fees/cost associated with refueling of generators at the end of the Period of Performance for each location.

3.1 Contractor’s Representatives and Supervisors

3.1.1 The contractor shall have a company representative on call to respond to maintenance requests with full telephone coverage and authority to make decisions on behalf of the company. The time starts for a required maintenance call when the Government calls or texts the company\representative.

The contractor shall have functioning voicemail. Lack of receiving capabilities by the contractor does not relieve contractor of liability for required timeframe to make equipment operational.

3.2 Claims

3.2.1 If a claim is submitted, it will require the joint pre-and post- inspection/acceptance sheets to accompany the claim form. Both must be provided to the Contracting Officer at the time of claim submission. The pre-and post- inspection/acceptance sheets must be signed by the authorized receiving representative that is indicated in the contract. Inspection/acceptance sheets must be signed and dated. Both parties’ names must be printed legible and signed. In the event that the contractor is not available for a joint inspection, to include when the Government shortens the length of the Period of Performance, the Government will conduct its inspection unilaterally and submit the inspection to the contractor as evidence that the Government’s Period of Performance is complete. The contractor shall adjust the invoice in accordance with the adjusted Period of Performance.

3.2.2 If a claim is submitted without the pre-and post-inspection/acceptance sheets, the claim is subject to be denied.

4.0 TERMS

4.1 Delivery Instructions

4.1.1 Delivery must be made at the agreed upon time by the Government between the hours of 1200-1500 on the first day of the period of performance in accordance with the table under paragraph 3.0. All set up must be complete and equipment ready for use at that time.

4.1.2 The contractor shall coordinate with the Contracting Officers Representative (COR) at each site to assure placement at correct locations. At time of delivery, the contractor shall complete a joint pre- inspection with the COR verifying that items have been delivered, are in the correct location, and are operational in accordance with the contract. The contractor shall also provide a post inspection sheet. The contractor must stand by until these inspections are complete.

4.1.3 Items may require relocation within the same general area. Unit may or may not relocate as required. If items cannot be relocated by unit then the contractor is responsible for relocating items within the same general area. NOTE: Increased security may delay contractor’s delivery time. It is the contractors’ responsibility to plan and prepare prior to the beginning of the period of performance to gain access to the installation.

4.2 Removal of Equipment

4.2.1 The contractor shall remove all contracted/leased equipment from the specified locations within 48 hours after the period of performance ends. Should contracted/leased equipment remain in place beyond 48 hours or after the post- inspection (whichever comes first), the Government is not liable for usage, theft, loss, damages, or replacement cost due to contractor's negligence to take possession of owned items. If for some reason the contractor is unable to pick-up the equipment, the contractor shall notify the Contracting Specialist and Contracting Officer in writing of when equipment will be removed.

4.2.2 All pre- and post-inspection/acceptance sheets must be provided to the Contract Specialist and/or Contracting Officer.

5.0. FUEL

5.1. All internal combustion equipment supplied under this contract must operate on ULSD fuel, IAW California Code of Regulations Title 13, Section 2477, Airborne Toxic Control Measure for In-Use Diesel-Fueled Transportation Refrigeration Units (TRU) and TRU Generator Sets, and Facilities Where TRUs Operate or be solar powered.

5.2. All generated equipment (i.e. Light Set) must have a decal affixed to the light set (See Appendix C). No diesel powered equipment will be allowed on post without a decal from the State of California Air Resource Board.

5.3. It is the responsibility of the Government to provide Low Sulfur Diesel Fuel to the leased equipment.

5.4. The contractor shall label their equipment near the fuel tank with the wording “Diesel Fuel Only.” Failure to label accordingly will invalidate contractor claims regarding use of incorrect fuel.

6.0. Contracting Officer Representative

6.1 The Contracting Officer may designate individual(s) to act as the Contracting Officer's Representative(s) (COR) under this contract. Such designations will be made by letter from the Contracting Officer with an information copy furnished the Contractor at time of contract award. The COR staff will represent the Contracting Officer in the administration of the contract but will not be authorized to change any of the terms and conditions of the contract.

6.2 No oral statements of any person, whosoever will in any manner or degree modify or otherwise affect the terms of this contract. The Contracting Officer shall be the only person authorized to approve changes in any of the requirements under this contract, notwithstanding any provisions contained elsewhere in this contract, and said authority shall remain solely with the Contracting Officer. COR's shall be limited to the authority specified in their letter of appointment.

APPENDIX A

NTC MANUEVER AREA CONTROL PLAN

1. Purpose. The National Training Center (NTC) and Fort Irwin have established Maneuver Area Control Operational Procedures and Activities within the NTC Training Area to ensure training fidelity, safety and compliance with NTC and Army Regulations. The Maneuver Area Control Operational Procedures ensure that NTC has control over personnel entering and using the NTC maneuver area for tactical, training and support purposes.

2. Applicability. Maneuver area control procedures are applicable to all personnel (both military and civilian) who enter the training area in a non-tactical vehicle.

3. Responsibility. Organizations and activities requiring military, civilians or contractors access to the range complex are responsible for all approvals required by range regulations, SOPs and this directive. Sponsors will ensure that users understand the requirements and have the required equipment. Sponsors are the first source of Range Communications Systems (RCS) radios. If RCS radios are not available, Range Support will issue an RCS for the duration of the requirement only.

4. Range Passes. Range Access Passes will be issued only when the following criteria are met and only for the duration of the requirement:

(a) Valid driver’s license for type vehicle used.

(b) Valid range briefing and safety card.

(c) Possession of training area access handbook.

(d) Proof of need to go down range (contract number and period of performance, not the contract, work order, etc.)

5. Range Safety Briefings and Range Cards. All users of the training area are required to have received the range safety briefing within the last year and must carry and present the range card on demand. Range cards are valid for the calendar year from 1 January to 31 December.

Personnel who do not have a range safety card must be escorted in the maneuver area by a range safety card holder who accepts the responsibility for their control while down range.

6. NTC Vehicle Markings. All Non-Tactical Vehicles (NTVs) that enter the training area are required to have the required Physical Markings. Vehicles will be marked on the left and right door and the front with markings that are clearly legible from 100 feet and indicate the parent or sponsor of the vehicle.

Markings can be permanent, magnetic or other type signs that are temporarily used. Range Support will also have generic vehicle ID signs for vehicle not having other required markings. Rotation markings (such as UN or IP) may be used in addition to the identifying signs.

7. Range Communications. Range communications downrange must be maintained in one of two ways. FM communication may be used on the Range control frequency (38.90).

The Range Communications System (RCS) radio is the other permissible means. Cell phones are not permissible communications means unless specifically approved by the NTC Chief of Staff. NTVs will not be allowed into the training area without an operating RCS or an escort of a vehicle with an operational RCS.

8. Checkpoints. Checkpoints will serve as the entry control points to the maneuver area for all non- tactical vehicles (NTV) entry into the maneuver area. The checkpoints may not be bypassed by non- tactical vehicles. All NTVs will be physically checked for compliance (marking, range pass, range safety card, commo means) before admittance to the maneuver area. All checkpoints will be clearly marked with warning signs and access instructions. Common bypass routes will be clearly marked with instructions to use the nearest checkpoint.

(1) North -- Barstow Road at the water tower.

(2) East -- Langford Lake Road east of the cantonment area.

(3) West -- NASA Security Checkpoint (on the tank trail)

9. Violators and Enforcement. Military personnel and range patrols are authorized to require violators to leave the maneuver area. Other personnel are encouraged to report violations to Range Support for action. The Range Control Officer will withdraw or suspend installation training area privileges upon determination that any person, organization or agency willfully violated this directive, local range regulations and procedures; or from any person whose ability or conduct is incompatible with the safe use of Government range facilities.

10. The contractor is responsible for completing all necessary documentation below to gain access to the training areas and ranges.

Transportation Refrigeration Units (TRU) and TRU Generator Sets and

Facilities Where TRUs Operate

All vendors looking to conduct business with the Government by leasing or renting vehicles and equipment to the Government will ensure those vehicles have been reported to the California Air Resources Board (CARB) by providing the installation contracting agency, MICC, with a copy of the report or other valid documentation showing that the vehicles and equipment being leased or rented to the Government have in fact been reported to CARB. In addition, the vendor shall show proof that each vehicle and/or piece of equipment to be leased or rented to the Government is compliance regulation(s) that is applicable to the vehicle or equipment:

1. CCR Title 13, Section 2477, Airborne Toxic Control Measure for In-Use Diesel- Fueled Transportation Refrigeration Units (TRU) and TRU Generator Sets, and Facilities Where TRUs Operate.

2. CCR Title 13, Section 2449, General Requirements for In-Use Off-Road Diesel- Fueled Fleets.

3. CCR Title 13, Section 2025, Regulation to Reduce Emissions of Diesel Particulate Matter, Oxides of Nitrogen and Other Criteria Pollutants, from In- Use Heavy-Duty Diesel-Fueled Vehicles.

4. CCR Title 13, Section 2275, Large Spark-Ignition (LSI) Engine Fleet Requirements.

5. CCR Title 17, Section 93116, Airborne Toxic Control Measure for Diesel Particulate Matter from Portable Engines Rated at 50 Horsepower and Greater.

Equipment applicable to these regulations, but not in compliance with these regulations, shall not be leased to the Government under any circumstances.

Upon inspections of equipment(s) and if found to be non-compliance, contract will be modified or terminated at the convenience of the Government.
