1.0 PERIOD OF PERFORMANCE AND LOCATIONS (ROTATION 20-07)
NOTE 1: Location(s) and/or quantity may be subject to change. Please note, due to the nature of the training exercises conducted, the POP dates may shift slightly. In the event this happen, the contracting Officer will notify contractor within 12- 24 hrs to make adjustments accordingly. The U.S. Government shall not be charged for equipment returned early.
NOTE 2: The Government does reserve the option to vary quantities by+/- 30% due to operational requirements and to MAKE multiple awards to meet said requirements.

2.0 SCOPE
2.1 The contractor shall provide two (2) 44 passenger buses for in and around transportation on Fort Irwin. Contractor will also provide a block of training instruction specific to the type of bus provided for properly Military licensed Soldier operators.
Training to take place upon 1st day of period of performance. Training location will be at the delivery location to be determined upon contract award.
2.2 Maintenance. The contractor shall provide daily service and all necessary parts, equipment and maintenance necessary to assure proper and continuous, 24 hour, functioning of the equipment including weekends and holidays.
The contractor shall have 24 hour 7 days a week emergency services and be capable of being onsite for repair within 4 hours of a service call. The Contractor shall respond to all maintenance calls within 4 hours and repair or replace the vehicle within 12 hours. All backup units utilized in the event of primary failure shall be at no additional cost to the Government. All repairs or replacements for the leased equipment not completed within 12 hrs shall not be charged to the U.S. Government.
2.3 The contractor and COR will conduct joint inspection of the equipment to ensure that equipment is serviceable prior to the Rotational Training Unit Occupying Training Site. All Pre & Post inspection/acceptance sheets must be provided to the Contracting Specialist and/or Contracting Officer. Pre & Post Inspection Sheets will be hard copies only and not that of a vendor’s Portable Electronic Device (PED) or Portable Hand Held Device. The COR is not authorized to sign any electronic device that the vendor wants them to sign.
2.4 The contractor must label their equipment near the fuel tank with the wording “Diesel Fuel Only”.
3.0 CONTRACTOR VEHICLE, EQUIPMENT, AND SERVICES REQUIREMENT(S)
3.1 Each item of equipment or property furnished under this contract shall be in safe operational condition, and shall comply with the Federal Safety Standards, the American National Standards, and State Safety Regulations applicable to this equipment or property. If the Contracting Officer or their representative determines that any item of equipment or property furnished is not suitable for performance under this contract, the Contracting Officer shall promptly inform the contractor in writing.
3.2 All vehicles shall be under original manufactures warranty. All leased equipment shall have their original Load Capacity Data Plates attached legible and visible to the Soldier operator. The Government shall not accept any piece of equipment without this information present on the original data plate. The equipment must sustain in high wind gusts of the Fort Irwin high desert area. The vehicles will also need to be able to navigate the harsh terrain of Fort Irwin with no issues.
3.3 Unlimited Mileage – The U.S. Government shall have unlimited mileage during the performance of the contract.
3.4 All vehicles provided by vendor shall have an automatic transmission and meet Federal and State safety requirements for on road use.
3.5 Contractor will provide a full tank of fuel upon initial delivery however, the government will not be responsible for returning the equipment with full fuel tanks.
4.0 Fuel
4.1. All internal combustion equipment supplied under this contract must operate on ULSD fuel, IAW California Code of Regulations Title 13, Section 2477, Airborne Toxic Control Measure for In-Use Diesel-Fueled Transportation Refrigeration Units (TRU) and TRU Generator Sets, and Facilities Where TRUs Operate.
4.2. The contractor must label their equipment near the fuel tank with the wording “Diesel Fuel Only”.
5 DELIVERY INSTRUCTIONS: All equipment will be delivered and set up shall be complete, with equipment ready for use, by 10:00 AM PST on or before the first day of the Period of Performance (POP) but no sooner than 3 days prior to the POP. Specific location strip map on Fort Irwin, CA will be provided at time of award. Coordination POC will be the COR listed in section 9
6.0 FIRE EXTINGUISHERS
The contractor shall be responsible for furnishing all materials, labor, and equipment necessary to provide 1ea fire extinguisher per piece of equipment IAW appropriate classification, located in or on the vehicle. The fire extinguishers shall be at least 5lbs.
7.0 TERMS:
7.1. Price shall include delivery, pickup and operation of related equipment as applicable on the last POP day. Contractor shall ensure all vehicles are delivered with all necessary parts IAW Operators manual with a full tank of fuel upon first day of POP; No later than 10 am that morning. Each vehicle shall contain fire extinguishing equipment as specified in para 6.0 appropriate to the size of the vehicle.
7.2 Associated costs. All repairs and replacement costs are included in the price. All Federal, State or local taxes and/or fees are included in the price. The Government is not responsible for refueling nor pay any fees/cost associated with refueling of equipment at the end of the Period of Performance.
Please note, due to the nature of the training exercises conducted, the POP dates may shift slightly. In the event this happens, the Contracting Officer will notify Contractor within 12 - 24 hrs to make adjustments accordingly. The U.S. Government shall not be charged for equipment returned early. Equipment shall be paid for the days the Government utilizes the equipment, if equipment is turned in early or extended a modification shall be done to account for days of usage according the price quoted.
7.3 Contractor shall provide repair and / or replacement services for the leased equipment within 12 hours. Any repairs or replacements for the leased equipment not serviced within 12 hours will not be charged to the U.S. Government.
7.4 Inspections. The contractor and COR will conduct joint inspection of the equipment to ensure that equipment is serviceable prior to the Rotational Training Unit Occupying Training Site and following the period of performance end date. All Pre & Post-inspection/acceptance sheets must be provided to the Contracting Specialist and/or Contracting Officer.
7.5 Removal of Equipment
Contractor shall remove all contracted/leased equipment from the specified locations within 48 hours after the period of performance ends. Should contracted/leased equipment remain in place beyond 48 hours, the Government is not liable for usage, theft, lost, damages, or replacement cost due to contractor's negligence to take possession of owned items. If for some reason the contractor is unable to pick-up the equipment, please notify the Contracting Specialist and/or Contracting Officer in writing of when you will remove your equipment.
7.6 Claims
If a claim is submitted, it will require the joint inspection pre-and post-inspection/acceptance sheets to accompany the claim form. Both must be provided to the Contracting Officer at the time of claim submission. The pre-and post-inspection/acceptance sheets must only be signed by the authorized receiving representative that is indicated in the contract. Inspection/acceptance sheets must be signed and dated. Both parties’ names must be printed legible and signed.
If a claim is submitted without the pre-and post-inspection/acceptance sheets, the claim is subject to be denied. The contractor must submit their claim invoice in the following format:

8 NTC Maneuver Area Control Plan
8.1. Purpose. The National Training Center (NTC) and Fort Irwin have established Maneuver Area Control Operational Procedures and Activities within the NTC Training Area to ensure training fidelity, safety and compliance with NTC and Army Regulations.
The Maneuver Area Control Operational Procedures ensure that NTC has control over personnel entering and using the NTC maneuver area for tactical, training and support purposes.
8.2. Applicability. Maneuver area control procedures are applicable to all personnel (both military and civilian) who enter the training area in a non-tactical vehicle.
8.3. Responsibility. Organizations and activities requiring military, civilians or contractors access to the range complex are responsible for all approvals required by range regulations, SOPs and this directive. Sponsors will ensure that users understand the requirements and have the required equipment. Sponsors are the first source of Range Communications Systems (RCS) radios. IF RCS radios are not available, Range Support will issue an RCS for the duration of the requirement only.
8.4. Range Passes. Range Access passes will be issued only when the following criteria are met and only for the duration of the requirement:
NOTE: Increased security may delay contractor’s delivery time. It is the contractor’s responsibility to plan and prepare prior to the beginning of the period of performance to gain access to the installation.
(a) Valid driver’s license for type vehicle used.
(b) Valid range briefing and safety card.
(c) Possession of training area access handbook.
(d) Proof of need to go down range contract number and period of performance (not the contract, work order, etc.)
8.5. Range Safety Briefings and Range Cards. All users of the training area are required to have received the range safety briefing within the last year and must carry and present the range card on demand. Range cards are valid for the calendar year from 1 January to 31 December. Personnel who do not have a range safety card must be escorted in the maneuver area by a range safety card holder who accepts the responsibility for their control while down range.
8.6. NTC Vehicle Markings. All Non-Tactical Vehicles (NTV) that enter the training area are required to have the required Physical Markings. Vehicles will be marked on the left and right door and the front with markings that are clearly legible from 100 feet and indicate the parent or sponsor of the vehicle. Markings can be permanent, magnetic or other type signs that are temporarily used. Range Support will also have generic vehicle ID signs for vehicle not having other required markings. Rotation markings (such as UN or IP) may be used in addition to the identifying signs.
8.7. Range Communications. Range communications downrange must be maintained in one of two ways. FM communication may be used on the Range control frequency (38.90). The Range Communications System (RCS) radio is the other permissible means. Cell phones are not permissible communications means unless specifically approved by the NTC Chief of Staff. NTVs will not be allowed into the training area without an operating RCS or an escort of a vehicle with an operational
RCS.
8.8. Checkpoints. Checkpoints will serve as the entry control points to the maneuver area for all Non-Tactical Vehicles (NTV) entry into the maneuver area. The checkpoints may not be bypassed by non-tactical vehicles. All NTVs will be physically checked for compliance (marking, range pass, range safety card, and commo means) before admittance to the maneuver area. All checkpoints will be clearly marked with warning signs and access instructions. Common bypass routes will be clearly marked with instructions to use the nearest checkpoint.
a. Checkpoint Locations:
(1) North -- Barstow Road at the water tower.
(2) East -- Langford Lake Road east of the cantonment area.
(3) West -- NASA Security Checkpoint (on the tank trail)
(4) South -- Fort Irwin Road tank trail vicinity NU233967
8.9. Violators and Enforcement. Military personnel and range patrols are authorized to require violators to leave the maneuver area. Other personnel are encouraged to report violations to Range Support for action. The Range Control Officer will withdraw or suspend installation training area privileges upon determination that any person, organization or agency willfully violated this directive, local range regulations and procedures; or from any person whose ability or conduct is incompatible with the safe use of Government range facilities.
9 CONTRACTOR'S PROJECT MANAGER AND SUPERVISORS.
9.1 The contractor shall provide a project manager and supervisors to ensure the performance of the work. The project manager shall have full authority to act for the contractor during performance of work.
9.2 The contractor shall provide the telephone number of the project manager so that he/she may be contacted at all times during & after normal work hours. The project manager shall contact Government personnel within two hours of a request from the Contracting Officer or Contracting Officer representative.
10 IDENTIFICATION OF CONTRACTOR'S EMPLOYEES
10.1 Each employee of the contractor shall conspicuously display on his/her person while performing services in accordance with resultant contract, an identification card, which shall include the full of the employee, the legal name under which the contractor is doing business, and a badge serial number.
10.2 The contractor, before initiating the performance of work shall provide the Contracting Officer with a written List of all employees who shall perform the work under this contract. The List shall include the full name, and badge serial number of each employee. The contractor shall notify the Contracting Officer, in writing, of any addition or deletion to the personnel roster within one day of such change.
10.3 When directed by the Contracting Officer, the contractor shall remove any employee from assignment to perform services under this contract for any reasons of misconduct or breaches of security in connection with his/her employment. This will be verified by the Law Enforcement Agency on National Training Center, Fort Irwin.
11 LOST & FOUND PROPERTY. It is the responsibility of the contractor to ensure all articles of possible personal or monetary value found by the contractor's employee s are turned in to the Security Office, or the Provost Marshal's Office (PMO) Fort Irwin, California.
12 UNFORESEEN POST/RANGE CLOSURES. When an unforeseen post closure occurs on a regular scheduled day of work, the contractor shall not be required to perform the work scheduled for that day. Services shall be performed upon access to previously closed areas being granted. Failure to perform services could result in health and safety issues.
13 RANGE CLEARANCE & ROAD CLOSURES. The Contractor shall obtain a Range Pass from Range Support and ensure Range Support is contacted before entering any range area. In addition, during Live-Fire Week, Contractor shall ensure employees contact the Live Fire Operations Non-Commissioned d Officer in Charge, directly at
(760) 380-6063, prior to making any trips down range. Communication with range control is the responsibility of the Contractor as the Government will not provide communication devices/radios to the contractor.
14 HOURS OF OPERATION. Services under this contract shall be performed daily, including Saturday, Sunday and Federal Holidays.
15 GOVERNMENT FURNISHED PROPERTY AND SERVICES. The Government will furnish no materials, equipment, or services
16.0 CONTRACTING OFFICER'S REPRESENTATIVE AND THEIR AUTHORITY
16.1 The Contracting Officer may designate individual(s) to act as the Contracting Officer's Representative(s) (COR) under this contract. Such designations will be made by letter from the Contracting Officer with an information copy furnished the Contractor at time of contract award. The COR staff will represent the Contracting Officer in the administration of the contract but will not be authorized to change any of the terms and conditions of the contract.
16.2 No oral statements of any person, whosoever will in any manner or degree modify or otherwise affect the terms of this contract. The Contracting Officer shall be the only person authorized to approve changes in any of the requirements under this contract, notwithstanding any provisions contained elsewhere in this contract, and said authority shall remain solely with the Contracting Officer. COR's shall be limited to the authority specified in their letter of appointment.

APPENDIX A
Transportation Refrigeration Units (TRU) and TRU Generator Sets, and Facilities Where TRUs Operate.
All vendors looking to conduct business with the Government by leasing or renting vehicles and equipment to the Government will ensure those vehicles have been reported to the California Air Resources Board (CARB) by providing the installation contracting agency, MICC, with a copy of the report or other valid documentation showing that the vehicles and equipment being leased or rented to the Government have in fact been reported to CARB. In addition, the vendor shall show proof that each vehicle and/or piece of equipment to be leased or rented to the Government is compliance regulation(s) that is applicable to the vehicle or equipment:
1. CCR Title 13, Section 2449, General Requirements for In-Use Off-Road Diesel- Fueled Fleets.
2. CCR Title 13, Section 2025, Regulation to Reduce Emissions of Diesel Particulate Matter, Oxides of Nitrogen and Other Criteria Pollutants, from In-Use Heavy-Duty Diesel-Fueled Vehicles.
3. CCR Title 13, Section 2275, Large Spark-Ignition (LSI) Engine Fleet Requirements.
4. CCR Title 17, Section 93116, Airborne Toxic Control Measure for Diesel Particulate Matter from Portable Engines Rated at 50 Horsepower and Greater.
Equipment applicable to these regulations, but not in compliance with these regulations, shall not be leased to the Government under any circumstances.
Upon inspections of equipment(s) and if found to be non-compliance, contract will be modified or terminated at the convenience of the Government.
