About this file
This is a Questions and Answers document for federal contract solicitation W50S99-26-Q-1003 for a Flash Tester procurement.
The document addresses eight clarifications relevant to potential offerors. Key technical considerations include that the upper specification limit of 400 degrees may be amended to 370 degrees, units running D7094 standards will not be accepted, and the flash tester must include in-house calibration capabilities with necessary software and calibration devices included with the unit. Installation and onsite operator training are required as part of the delivery. The solicitation is structured as a total small business set-aside, and the Nonmanufacturer Rule applies, requiring that the offered end item be manufactured by a domestic small-business manufacturer. Country-of-origin, Buy American, and Balance of Payments requirements are governed by DFARS 252.225-7001, with offerors required to certify that the tester and accessories qualify as either a domestic end product or qualifying country end product; if the item meets COTS standards per FAR 2.101, the component content test is waived but U.S. or qualifying country manufacture is still required. Offerors should use 30 days or quickest delivery for pricing and technical evaluation purposes. Offerors with no past performance history may submit a truthful no-past-performance statement and will receive a neutral rating rather than being deemed technically unacceptable.

FLASH TESTER
Q & A
1. Is there any way the end user would consider amending the specification for the upper limit of the unit form 400 degrees to 370 degrees?
Yes
2. Would accept quotes for units that run D7094, which offers excellent correlation to ASTM D93?
No
3. The technical requirement states that calibration equipment for in-house calibration must be included. Please identify whether the complete system must include certified reference materials, temperature probes, calibration fixtures, software, or other specified items.
The calibration procedures must be able to be accomplished in house without sending the entire unit off to the manufacture. The unit must come with the software and calibration devices required to calibrate the unit on site. As different units have different procedures for calibration this question is too broad to list required items.
4. Are installation, startup, commissioning, or onsite operator training required, or is this a direct-delivery equipment purchase only?
Installation and training onsite are required
5. FAR 52.219-6 is included, but Kcamow did not locate FAR 52.219-33. Does the Nonmanufacturer Rule apply to this acquisition, and if so, is there an individual or class waiver or must the offered end item be manufactured by a domestic small-business manufacturer?
Yes, the Nonmanufacturer Rule (NMR) does apply to this acquisition because the solicitation includes FAR 52.219-6 (Notice of Total Small Business Set-Aside), provided the acquisition is for supplies/products and exceeds the Simplified Acquisition Threshold (SAT) The fact that FAR 52.219-33 is not explicitly located in the solicitation is likely due to the agency using a Class Deviation (such as Class Deviation 2020-O0008), which incorporates the NMR requirements directly into the deviation version of FAR 52.219-6 instead of listing it as a separate clause.
6. Please confirm the controlling country-of-origin, Buy American, and Balance of Payments requirements for the offered tester and its accessories
The requirements for country-of-origin, Buy American, and Balance of Payments are governed by DFARS 252.225-7001, Buy American and Balance of Payments Program, which is incorporated into this solicitation. The offered tester and its accessories must qualify as a "domestic end product" or a "qualifying country end product" as defined in the clause. Offerors must complete the certification at DFARS 252.225-7000 to identify

Q & A the origin of the end products. If the offered tester meets the definition of a Commercially Available Off-The-Shelf (COTS) item per FAR 2.101, the component content test of the Buy American Act is waived, though the end product must still be manufactured in the United States or a qualifying country
7. What delivery date or delivery period should offerors use for pricing and technical evaluation?
30 days or quickest delivery.
8. The solicitation states that an offeror with no past performance will be judged neutral. Kcamow currently has zero completed federal prime contracts. Please confirm that Kcamow may submit a truthful no-past-performance statement and receive a neutral rating rather than being found technically unacceptable.
You may submit a truthful no past performance statement and receive neutral rating.
