Section M - Evaluation Factors for Award
ADDENDUM TO FAR 52.212-2: EVALUATION CRITERIA
1. Basis for Award (Lowest Price Technically Acceptable)
The Government intends to award a single, firm-fixed-price purchase order to the responsible quoter whose conforming quotation represents the Lowest Price Technically Acceptable (LPTA) solution.
In accordance with RFO FAR 12.203, this streamlined evaluation process will evaluate quotes on an "Acceptable" or "Unacceptable" basis across all non-price factors. No adjectival ratings or formal scoring systems will be utilized. Award will be made to the lowest-priced quoter who meets the minimum acceptability standards for Technical Capability and Past Performance.
In accordance with RFO FAR 12.203(c)(1), the Government will consider all quotations received in a timely manner, and reserves the right to exercise sound business judgment when determining whether or not to accept a quotation received after the due date or time. The Government intends to award a single firm-fixed-price contract to the responsible quoter whose quotation provides the best overall value to the Government.
In accordance with RFO FAR 12.203(c)(2), this evaluation process is highly streamlined and is strictly not subject to the formal source selection procedures of FAR Part 15. The Government will not utilize a formal evaluation plan, assign adjectival scores or ratings, or establish a competitive range.
2. Factor 1: Technical Acceptability
The Government will evaluate the Technical Capability volume on an Acceptable / Unacceptable basis. A rating of "Acceptable" requires strict compliance with all requirements outlined in the Product Description, specifically verified through:
- Tumbler Compliance: The proposed tumbler specifications meet or exceed the Brand Name or Equal characteristics (30 oz capacity, double-wall insulation, 3.15-inch base diameter, 3-position screw-on lid, handle, reusable straw, dishwasher safe, BPA-free).
- Engraving Compatibility: The digital mock-up confirms the CA ANG logo is correctly centered on the front and meets the approximate 2.5 in x 1.5 in dimension requirements.
- Logistical Acceptability: The quoter affirmatively agrees to meet the exact split-shipment delivery quantities to all four (4) specified California military recruiting addresses.
3. Factor 2: Past Performance
In accordance with RFO FAR 12.203(a)(2), the Government will evaluate past performance on an Acceptable / Unacceptable basis.
- The Government will assess the quoter's record of performing contracts of similar scope, size, and complexity (bulk customized commercial merchandise distribution).
- In addition to references provided by the quoter, the Government may utilize past performance information from a wide variety of sources, including the Contractor Performance Assessment Reporting System (CPARS), Federal records, and other commercial or Government-wide directories.
- Neutral Rating: In accordance with FAR and statutory requirements, a quoter without a record of relevant past performance, or for whom information on past performance is not available, will not be evaluated favorably or unfavorably on this factor. Such quoters will receive a "Neutral" rating, which is considered Acceptable for award.
4. Factor 3: Price
The Contracting Officer will evaluate pricing in accordance with RFO FAR 12.204(a) to ensure that the final awarded price is fair and reasonable.
- Total Evaluated Price: The evaluation will be based on the sum of all location-specific CLINs (CLIN 0001, CLIN 0002, CLIN 0003, and CLIN 0004) to establish the total cost of all 1,000 engraved tumblers delivered to their respective locations.
- Fully Burdened Review: Each CLIN will be reviewed to ensure it is proposed as a fully burdened rate (including the cup, custom engraving, and shipping to destination). In accordance with RFO FAR 12.203(a)(3), prices will be evaluated inclusive of transportation charges from the shipping point of the supplier to the four delivery destinations (F.O.B. Destination).
- Prompt Payment Discounts: In accordance with RFO FAR 12.203(a)(3), prompt payment discounts will not be considered in the evaluation of prices.
