PERFORMANCE WORK STATEMENT (PWS)
VEGETATION & TREE CLEARING AT WARREN GROVE RANGE
SOLICITATION #: W912KN-20-Q-0004
MODIFICATION 01
ALL CHANGES HIGHLIGHTED IN YELLOW
Current as of: August 13, 2020
1. GENERAL
1.1. The contractor shall furnish all parts, labor, supplies and equipment necessary to complete the requirement in accordance with this PWS and the Solicitation requirements.
1.2. The contractor will comply with all applicable local (to include NJANG Base regulations), State, and Federal Environmental and Occupational Safety requirements.
1.3. Warren Grove Range is located in an environmentally sensitive area in Burlington County, NJ. The Range is home to numerous endangered and protected species.
Contractor MUST take all available precautions to protect these species and preserve their native habitat. Contractor must also avoid regulated wetlands.
2. SCOPE - Clear vegetation for range maintenance and safety in accordance with the NJ Forest Fire Service 5 Year Control Burn Plan Add Attachment: Warren Grove Gunnery Range Survey dated: June 1983. Attachment downloadable on beta.SAM.gov
2.1. CLIN 0001 – BASE BID: AREA #1
2.1.1. DESCRIPTION: Extend West Upper Cabin Rd. from:
2.1.1.1. North Allen Rd. to Property Line Concrete Monument (C.M.) 1450 along existing Sand Rd. / 4x4 Trail approximately 750’
2.1.1.2. Clear Property Line from C.M. 1450 to C.M. 1451 approximately 4000’
2.1.1.3. Contractor shall employ the services of a Professional Land Surveyor, licensed in the State on New Jersey to mark the property described above
2.1.2. Clear all underbrush, trees, and overhanging branches 22.5’ from the road centerline in each direction for a 45’ total width clearing.
2.1.2.1. Distance: 0.9 miles
2.1.2.2. All vegetation shall be cleared to no more than 6” above ground level.
2.1.2.3. Vegetation may be chipped / ground on site, but must not be piled up.
2.1.2.4. Vegetation not chipped / ground on site must be disposed of off-site by the contractor.

2.2. CLIN 0002 – BASE BID: AREA #2
2.2.1. DESCRIPTION: Clear 45’ Wide Firebreak along range Property Line from existing Sand Rd. / 4x4 Trail to Vehicle Gate on the intersection of North Andrews Rd. and the Range Property Line annotated by “ SET C.M. on LINE (1732) on the attached Survey to C.M. 1451. Approximately 2,319’
2.2.2. Contractor shall employ the services of a Professional Land Surveyor, licensed in the State on New Jersey to mark the property described above
2.2.3. Clear all underbrush, trees, and overhanging branches for a 45’ total width clearing.
2.2.3.1. Distance: 0.6 miles
2.2.3.2. All vegetation shall be cleared to no more than 6” above ground level.
2.2.3.3. Vegetation may be chipped / ground on site, but must not be piled up.
2.2.3.4. Vegetation not chipped / ground on site must be disposed of off-site by the contractor.

2.2.3.6. NOTE: Contractor shall propose a method / equipment that does not disrupt the soil. Vehicle with hydraulically operated attachment such as FECON Bullhog or Approved Equal.
2.3. CLIN 0003 – OPTION 01: AREA #3
2.3.1. DESCRIPTION: Widen East Upper Cabin Rd. from the “Turn Around” to the junction of East of Cabin Rd. and Lower Cabin Rd.
2.3.2. Clear all underbrush, trees, and overhanging branches 22.5’ from the road centerline in each direction for a 45’ total width clearing.
2.3.2.1. Distance: 0.6 miles
2.3.2.2. All vegetation shall be cleared to no more than 6” above ground level.
2.3.2.3. Vegetation may be chipped / ground on site, but must not be piled up.
2.3.2.4. Vegetation not chipped / ground on site must be disposed of off-site by the contractor.

2.3.3. NOTE: The Contractor’s pricing for OPTION 01 shall be good for 120 days After Contract Award.
2.4. CLIN 0004 – OPTION 02: AREA #4
2.4.1. DESCRIPTION: Maintain (brush hog / mow) & widen where necessary West
Upper Cabin Rd. from the junction of West of Cabin Rd. and Lower Cabin Rd. to the junction of West Upper Cabin Rd. and Allen Rd.
2.4.2. Clear all underbrush, trees, and overhanging branches 22.5’ from the road centerline in each direction for a 45’ total width clearing.
2.4.2.1. Distance: 0.8 miles
2.4.2.2. All vegetation shall be cleared to no more than 6” above ground level.
2.4.2.3. Vegetation may be chipped / ground on site, but must not be piled up.
2.4.2.4. Vegetation not chipped / ground on site must be disposed of off-site by the contractor.

2.4.3. NOTE: The Contractor’s pricing for OPTION 02 shall be good for 120 days After Contract Award.
2.5. CLIN 0005 – BASE BID: SAM (formerly eMCRA) - Contractor Manpower
Reporting:
2.5.1. The contractor will report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the New Jersey National Guard via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address https://cmra.army.mil, and then click on "Department of the Army CMRA" or the icon of the DoD organization that is receiving or benefitting from the contracted services. Reporting inputs will be for the labor executed during the period of performance during each Government FY, which runs from October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk by clicking on "Send an email" which is located under the Help Resources ribbon on the right side of the login page of the applicable Service/Component's CMR website at https://cmra.army.mil.)
2.6. GENERAL REQUIREMENTS
2.6.1. PRE-CONSTRUCTION CONFERENCE: Contractor shall attend an on-site
Coordination Meeting and Site Visit scheduled no more than two weeks after contact award. Contractor shall evaluate the site with WGR Personnel, NJ Forest Fire Service, and 177FW Environmental Personnel prior to beginning clearing activities. NJ Department of Environmental Protection, NJ Pinelands Commission, and Rutgers Research personnel may be in attendance. Meeting shall be scheduled in July or August timeframe prior to foliage variations and species beginning annual hibernation cycles. This meeting is required to:
2.6.1.1. Identify endangered and threatened wildlife species in or near the work area that are protected by the NJ Division of Fish and Wildlife's Endangered and Nongame Species Program (ENSP) and NJ Species of Special Concerns.
Any species identified shall be reported to the NJ Division of Fish and Wildlife on the Rare Wildlife Sighting Report Form.
2.6.1.2. Identify environmentally sensitive areas, including NJDEP managed wetlands, inside the site work area. Guidelines in the Federal Manual for Identifying and Delineating Jurisdictional Wetland, dated January 1989, will be used for delineation purposes. All work near Freshwater Wetlands will be in accordance with N.J.A.C. 7:7A Freshwater Wetlands Protection Act Rules amended 5/6/2019.
2.6.1.3. Site clearing limitations will be flagged during the meeting. Work will be restricted in areas identified as environmentally sensitive or containing endangered species.
2.6.2. MEANS & METHODS:
2.6.2.1. Contractor shall utilize a method / equipment that does not disrupt the soil.

2.6.2.2. Vehicle with flotation style air filled tires and hydraulically operated attachment such as FECON Bullhog or Approved Equal are generally deemed suitable.
2.6.2.3. Heavy tracked vehicles / bulldozers are prohibited.
2.7. ADD FAR 52.211-18 VARIATION IN ESTIMATED QUANTITY CLAUSE
2.7.1. If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract.
Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
3. PERIOD OF PERFORMANCE
3.1. Period of Performance is 01 August 2020 – 31 December 2020
3.1.1. BLACK OUT DATES – NO WORK ALLOWED
3.1.1.1. DECEMBER 5, 2020 – DECEMBER 12, 2020
3.2. WORK DAYS & TIMES
3.2.1. 7 days a Week: Sunday – Saturday
3.2.2. Hours: 24 Hours a day
3.2.2.1. Generally - Contractors may travel from the main building to the work site during the hours of darkness in the morning. Contractors must return from the work site to the main building with-in 30 minutes of sunset in the evening.
3.3. The contractor must schedule work days to correspond with Warren Grove Range Operations schedule. This schedule is mission based and subject to change with no additional cost to the Government.
4. PROPOSAL SUBMISSION REQUIREMENTS
4.1. Offorer MUST submit a Technical Capability Statement as part of their proposal.
4.1.1. Document shall be no more than three pages. If an offeror submits more than three pages, only the first three pages will be reviewed.
4.2. TECHNICAL CAPABILITY STATEMENT REQUIREMENTS
4.2.1. Contractors working at Warren Grove Range shall have experience and knowledge working in areas that contain Threatened and Endangered species.
4.2.2. Offerors must have the required experience, equipment, manpower, and resources necessary to complete the above PWS or the ability to obtain them.
4.2.3. Offeror shall describe the manpower, equipment, and methods that they propose to use to accomplish the project.
4.2.3.1. This descriptive narrative shall include, but is not limited to: describing equipment proposed, ownership or leasing of equipment, daily rate of production, delivery & hauling of equipment to the site, personnel training, personnel experience, utilization of specialty sub-contractors, completed work, current forestry contracts…
4.2.4. Offeror shall provide any documentation that they wish the Government to consider in this three page document.
4.2.5. If the offeror proposes an alternate method, they are required to describe how their proposal meets the intent of this PWS.
4.2.6. The burden of proof rests on the offeror to demonstrate that they can complete the scope and intent of this project in the time allowed using the proposed means & methods
4.2.7. Offerors may be required to provide substantiating documentation prior to award.
5. ANTI-TERRORISM / OPERATIONS SECURITY / INFORMATION PROTECTION
5.1. Access and General Protection/Security Policy and Procedures. This standard language is for contractor employees with an area of performance within Government controlled installation, facility, or area. The contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the Contracting Officer’s Representative (COR). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by the local installation’s Security Forces, Director of Emergency Services or local Security Office. The contractor shall ensure compliance with all personal identity verification requirements as directed by DoD, HAF and/or local policy. Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes.
5.2. For Contractors that do not require CAC, but require access to a DoD Facility and/or Installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (AFI 31-101 and AFI 10-245), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
6. AT LEVEL 1 TRAINING - This standard language is for contractor employees with an area of performance within a Government controlled installation, facility or area. All contractor employees, to include subcontractor employees, requiring access to Government Installations, Facilities and Controlled Access areas shall complete AT Level I awareness training within 10 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. Certificates of completion for each affected contractor employee and subcontractor employee will be maintained by the COR or Antiterrorism Representative. AT level I Awareness Training is available through ADLS by completing the Force Protection CBT.
