4. A complete bid package must contain the following:

(c) A Bid Bond and Power of Attorney is required along with the bid on the due date. The following is an alternative due to COVID changes, along with Policy Alert 020-084. "A copy of the bond and POA may be submitted with the proposal, with the original signed copy with Seal to be submitted no later than March 27, 2025. The bid bond must be on a SF24 form. Rejection of a bid bond shall be in accordance with FAR28.101-4 Noncompliance with bid guarantee requirements.

(e) When completing the "Offeror "portion of the SF 1442 (Blocks 14 - 20), an official having the authority to contractually bind the company must sign the SF 1442 in accordance with FAR4.102. One copy of the SF1442 is required to have an original signature.

(f) All amendments to the solicitation must be acknowledged.

(g) Mark the front of the envelope with the following: "BID No. W50S8A-25-B-A004", and the Name and Address of Bidder. See Block 13A of SF 1442 for required number of copies.

5. Joint Venture Requirements - Parties wishing to propose as a joint venture must submit, with the Pro Forma documents, an executed copy of the joint venture agreement. The joint venture agreement shall be executed in accordance with FAR 4.102(d). Each joint venture partner shall submit evidence satisfactory to the Contracting Officer that its Board of Directors has approved its participation in the joint venture or by an instrument of similarly binding character in the case of an unincorporated entity. Offerors are reminded that to obtain an award the awardee, to include a joint venture, must be registered in the System for Award Management (SAM) database. Applicable to set-aside solicitations: Joint Ventures must meet applicable size standards (See FAR Subpart 19.1). Submit with the proposal any size determination for the Joint Venture entity received from the Small Business Administration. A Joint Venture where-in one party is not a small business may be referred to the Small Business Administration (IAW FAR 19.302 (b)) to determine eligibility. INSTRUCTIONS TO BIDDERS

1. Instructions to Bidders:

1.1. You are invited to submit a bid in response to our Invitation for Bids (IFB) titled W50S8A-25-B-A004 titled Hangar 254 Renovation, at Pease

AFB, NH.

1.2. As a result of this solicitation, the Government intends to award a Firm Fixed Price (FFP) contract resulting from this solicitation to the responsible bidder whose bid, conforming to the invitation for bids, will be most advantageous to the Government, considering only price.

1.3. This solicitation is set-aside 100% for small businesses.

2. NOTICE OF PRE-BID CONFERENCE AND SITE VISIT:

A pre-bid conference will be conducted on Wednesday March 5, 2025, at 10:00 AM EST for the purposes of briefing on the bid requirements and answering questions regarding this solicitation. This conference will be held at New Hampshire Air National Guard, Joint Contracting Conference Room, Bldg.254, Pease ANGB, NH. Interested Contractors are highly encouraged to attend the pre-bid conference. The site visit will be held following the conference.

2.1. This information must be provided in advance, 4 business days prior to the meeting, in order to ensure access to the military base and conference site and ensure adequate seating for the conference attendees. Even if you have access to the base you must register to ensure adequate seating. The furnishing of the above information is voluntary; however, your failure to furnish all or part of the requested information may result in the Government's denial of your access to the pre-proposal conference. This information will be provided to the Base Security Forces who will authorize your entrance to the site.

2.2. Visitors must be escorted onto base through the Installation's Contractor Entry Gate prior to arrival. The Contractors & Visitors will meet in the parking lot right outside the Main Gate and once al Contractors have arrived and signed-in, a Government person will escort everyone through the Contractor Entry Date. You will be required to present a Valid Driver's License information upon arrival. Any of the above information furnished by you is protected under the Privacy Act and shall not be released unless permitted by law and/or you have consented to such.

2.3. Information provided at this conference or site visit shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation amendments shall apply.

2.4. A record of the conference shall be made and furnished to all prospective bidders via posting at www.SAM.gov. The record will include minutes of the meeting, including questions (on a non-attribution basis) and answers.

4. BID REPOSITORY AND BID OPENING:

4.1. A bid repository is provided for hand carried bids and is located at the Portsmouth Armory, 801 McGee Drive, Portsmouth NH. Bid repository will be established at 0900. Hand carried bids must be deposited in the repository prior to the time established for opening of bids. Late receipt of bids due to entry delays may not be deemed excusable and the Contracting Officer may declare the bid "late" in accordance with FAR 14.304.

4.2. The bid opening will occur at the time and date specified in Block 13 of the SF 1442 at the Portsmouth Armory, 801 McGee Drive, Portsmouth NH. All interested offerors and their major subcontractors are encouraged to attend the bid opening.

4.3. All mailed bids must be received prior to the time and date specified in Block 13 of the SF 1442 at 302 Newmarket St, Building 145, Portsmouth, NH 03801 ATTN: William Cole. Late receipt of bids due to delays in shipping may not be deemed excusable and the Contracting Officer may declare the bid "late" in accordance with FAR 14.304.

5. WAGE DETERMINATION:

5.1. Construction Wage Rates are applicable to this project are NH20250022, dated January 3rd, 2025, as shown in Section 00 73 00.

6. BID PREPARATION EXPENSES AND PRE-CONTRACT COSTS:

This IFB does not commit the Government to pay costs incurred in preparation and submission of bids or for other costs incurred prior to award of a formal contract.

7. CLAUSES:

7.1. Clauses and provisions from the Federal Acquisition Regulation (FAR) and supplements thereto are incorporated in this document by reference and in full text. Those incorporated by reference have the same force and effect as if they were given in full text.

8. DISPOSITION OF UNSUCCESSFUL BIDS:

Section 00 70 00 - Conditions of the Contract

52.216-4 ECONOMIC PRICE ADJUSTMENT--LABOR AND MATERIAL (JAN 2017)

(a) The Contractor shall notify the Contracting Officer if, at any time during contract performance, the rate of pay for labor (including fringe benefits) or the unit prices for material shown in the Schedule either increase or decrease.

The Contractor shall furnish this notice within 60 days after the increase or decrease, or within any additional period that the Contracting Officer may approve in writing, but not later than the date of final payment under this contract.

The notice shall include the Contractor's proposal for an adjustment in the contract unit prices to be negotiated under paragraph (b) of this clause, and shall include, in the form required by the Contracting Officer, supporting data explaining the cause, effective date, and amount of the increase or decrease and the amount of the Contractor's adjustment proposal.

(b) Promptly after the Contracting Officer receives the notice and data under paragraph (a) of this clause, the Contracting Officer and the Contractor shall negotiate a price adjustment in the contract unit prices and its effective date. However, the Contracting Officer may postpone the negotiations until an accumulation of increases and decreases in the labor rates (including fringe benefits) and unit prices of material shown in the Schedule results in an adjustment allowable under paragraph (c)(3) of this clause. The Contracting Officer shall modify this contract (1) to include the price adjustment and its effective date and (2) to revise the labor rates (including fringe benefits) or unit prices of material as shown in the Schedule to reflect the increases or decreases resulting from the adjustment. The Contractor shall continue performance pending agreement on, or determination of, any adjustment and its effective date.

(c) Any price adjustment under this clause is subject to the following limitations:

(1) Any adjustment shall be limited to the effect on unit prices of the increases or decreases in the rates of pay for labor (including fringe benefits) or unit prices for material shown in the Schedule. There shall be no adjustment for-

(i) Supplies or services for which the production cost is not affected by such changes,

(ii) Changes in rates or unit prices other than those shown in the Schedule, or

(iii) Changes in the quantities of labor or material used from those shown in the Schedule for each item.

(2) No upward adjustment shall apply to supplies or services that are required to be delivered or performed before the effective date of the adjustment, unless the Contractor's failure to deliver or perform according to the delivery schedule results from causes beyond the Contractor's control and without its fault or negligence, within the meaning of the Default clause.

(3) There shall be no adjustment for any change in rates of pay for labor (including fringe benefits) or unit prices for material which would not result in a net change of at least 3 percent of the then-current total contract price. This limitation shall not apply, however, if, after final delivery of all line items, either party requests an adjustment under paragraph (b) of this clause.

(4) The aggregate of the increases in any contract unit price made under this clause shall not exceed 10 percent of the original unit price. There is no percentage limitation on the amount of decreases that may be made under this clause.

(d) The Contracting Officer may examine the Contractor's books, records, and other supporting data relevant to the cost of labor (including fringe benefits) and material during all reasonable times until the end of 3 years after the date of final payment under this contract or the time periods specified in subpart 4.7 of the Federal Acquisition Regulation (FAR), whichever is earlier.

ECONOMIC PRICE ADJUSTMENT - MATERIAL. Contractor shall include a unit cost (excludes indirect costs and profit) for any commodity in the Schedule for which the contractor determines EPA to be applicable. Contractor may propose on the entire EPA list. Only those materials/commodities that the contractor proposes a unit cost will be subject to adjustments in accordance with FAR 52.216-4. Any items for which the Contractor chooses not to provide a price, Contractor shall put N/A in the unit cost. These items shall not be subject to any future adjustments.

Contractor shall provide documentation substantiating any increase to material cost, to be reviewed by the Government, when requesting adjustment.
