About this file

This is an Absence of Competition Memorandum for a simplified acquisition procedure purchase. The document justifies restricting competition for Purchase Request F6A1GR6042A001 to procure a multifunction utility vehicle (CAN-AM brand UTV) for maintenance and operations at the Alpena Combat Readiness Training Center (CRTC) and Grayling Air to Ground Range. The contracting officer, Timothy D. Frasier (ALE, Monroe), determined that only one source is available based on market research findings that the existing CAN-AM UTVs, attachments, and parts inventory at the facilities can only be used with modification from other brand products, and some attachments cannot be supplemented with alternative brands. Additionally, many components are interchangeable between current CAN-AM models and the new vehicle being procured. The memorandum was signed on May 26, 2017, and cites FAR RFO 12.102 as authorization for restricting competition under simplified acquisition procedures. The contracting officer noted that the formal written justification requirements under FAR 6.303 do not apply to this simplified acquisition procedure purchase.

A.03.11.01 Absence of competition memorandum Ver.1 26 May 2017

ABSENCE OF COMPETITION MEMORANDUM

(SIMPLIFIED ACQUISITION PROCEDURES)

PURCHASE REQUEST#: F6A1GR6042A001

1. FAR RFO 12.102 states that contracting officers may restrict competition, including the use of brand-name descriptions without allowing for “equal” products, for acquisitions valued at or below the simplified acquisition threshold (SAT), by documenting the decision that only one source is available and the basis for the decision.

2. Justification: The Alpena CRTC and Grayling Air to Ground Range has a need to procure a piece of equipment to multifunction utility vehicle for maintenance and operations within their property. The CRTC and ATG Range already maintain multiple CAN-AM UTVs including attachments and a stock of parts that can be used to service and repair these specific machine. Market Research indicated that the CAN-AM attachments currently maintained by the CRTC and ATG Range can only be used with modification from other brand products, and some cannot be supplemented at all. Additionally, with the current brand utility vehicles, many components are interchangeable between current models and the ones from this requirement.

3. Note that this determination satisfies the requirements of FAR RFO 12.102(a) The requirement to prepare a written justification IAW FAR 6.303 does not apply to purchases using simplified acquisition procedures.
