About this file

This document contains a justification for other than full and open competition for a federal contract opportunity. The contract requires roofing membranes, primers, interplay adhesives, flood coat, and aluminized coatings from The Garland Company to repair and renovate the roof of Building P-1 at South Portland Air National Guard Station in South Portland, Maine. Using alternative products would void the existing 20-year warranty on the roof that expires in March 2025. As the warrantor, The Garland Company must approve any repairs and products used to maintain the warranty. The solicitation for the opportunity will be available on SAM.gov as a small business set-aside with a NAICS code of 236220 and size standard of $39.5 million. The construction magnitude is between $250,000 and $500,000, with funds expected to become available by August 1, 2021. The award will be made based on the most advantageous price-based bid.

Justification and Approval for Other Than Full and Open Competition, Brand Name PN: VVRK182001 Emergency Repairs Bldg P-1

1. Contracting Activity: USPFO for ME, Purchasing and Contracting

2. Description of Action: The requirement is a new contract, awarded as a firm fixed price contract using SRM funds.

3. Description of Supplies/Services: Roofing membranes, primers, interplay adhesives, flood coat and aluminized coatings- UFC 3-110-03 requires that roofs have a minimum of a 20 year warranty. The P-1 roof has an existing warranty with The Garland Company, Inc. until March 29, 2025 (20 years). The terms of the warranty require that Garland products and Garland approved contractors must be used or it will void the warranty. UFC 3-110-03 also requires all roofs under warranty to have the warrantor recommend the correct course of action for the repairs and any sort of modifications done to the roof must be in accordance with the warranty requirements.

The warrantor (The Garland Company, Inc.) has been contacted and has provided repair recommendations. The warrantor has stated that the products listed above must be Garland products or the warranty will be void. Using Garland products will ensure that the roof meets the terms of the 20 year warranty required by the UFC. The warrantor has also stated using the Garland products should extend the quality of roof performance another 2-4 years beyond the warranty, if not more.

4. Authority Cited: 10 United States Code 2304(c)(1) as implemented in Federal Acquisition

Regulation 6.302 1(c), Only one responsible source and no other supplies or services will satisfy agency requirements Application for brand name descriptions.

5. Reason for Authority Cited: Using another manufacturer and/or a contractor not approved by the manufacturer, will void the warranty of the roof. If any of the roofing components fail between the completion of repairs and March 29, 2025, they will not be covered under warranty and will be an additional cost to the government. As part of the warranty, The Garland Company, Inc. provides periodical inspections and provides recommendations on maintenance, saving the government money by eliminating the need for a third party inspector and ensures preventative maintenance is completed to avoid costly repairs due to a poorly maintained roof. Voiding the warranty will eliminate this resource, which is currently at no cost to the government.

6. Efforts to Obtain Competition:

a. Effective competition. These items are from a single manufacture and must be purchased from the manufacture, however, there are multiple contactors approved by the manufacture. The actual cost to the Government will be on a competitive basis because of the multiple contractors available to bid on the project.

b. Subcontracting competition. Prime contractors will obtain quotes from multiple manufacturer approved subcontractors, resulting in competitive pricing.

7. Actions to Increase Competition: Competition is expected among the number of manufacturer approved contractors located in the area of work. Competition will be varied as it is dependent upon potential prime contractors to locate an approved subcontractor.

8. Market Research: All products must be purchased from the manufacturer but there are multiple manufacturer approved contractors in the local area. The manufacturer also requires
