Building P-1 Emergency Repairs - VVRK182001 This project consists of providing all plant, labor, transportation, materials, tools, equipment, appliances and supervision necessary for the construction of repair and renovation of the existing building P-1. All w ork to be completed at the South Portland Air National Guard Station, South Portland, ME 04106 (Cumberland County).

This project is being solicited as a Small Business Set Aside. The North American Industry Classif ication (NAICS) code is 236220, and the Small Business Size Standard is $39.5M in average annual receipts for the previous three years. Construction magnitude is betw een $250,000 and $500,000.

Persons w ho intend to bid are strongly encouraged to attend the Pre-Bid Conference. See Section 00100 for location and date.

All documents including plans and specif ications w ill be available only from w w w .beta.SAM.gov.

Funds are not presently available for this contract. Currently, the Government anticipates funds w ill become available prior to but no later than midnight 1 August 2021.

4. A complete bid package must contain the following:

(e) When completing the “Offeror” portion of the SF 1442 (Blocks 14 – 20), an official having the authority to contractually bind the company must sign the SF 1442 in accordance with FAR 4.102.

One copy of the SF1442 is required to have an original signature.

(f) All amendments to the solicitation must be acknowledged.

(g) Mark the front of the envelope with the following: “BID No. W50S83-21-B-0002 Emergency

Repairs Building P-1”, and the Name and Address of Bidder. See Block 13A of SF 1442 for required number of copies.

5. Joint Venture Requirements - Parties wishing to propose as a joint venture must submit, with the Pro Forma documents, an executed copy of the joint venture agreement. The joint venture agreement shall be executed in accordance with FAR 4.102(d). Each joint venture partner shall submit evidence satisfactory to the Contracting

Officer that its Board of Directors has approved its participation in the joint venture or by an instrument of similarly binding character in the case of an unincorporated entity. Offerors are reminded that to obtain an award the awardee, to include a joint venture, must be registered in the System for Award Management (SAM) database. Applicable to set-aside solicitations: Joint Ventures must meet applicable size standards (See FAR Subpart 19.1). Submit with the proposal any size determination for the Joint Venture entity received from the Small Business Administration. A Joint Venture where-in one party is not a small business may be referred to the Small Business Administration ( IAW FAR 19.302 (b)) to determine eligibility. All questions regarding Joint Ventures must be directed to the Small Business Administration (SBA) and not the Contracting Officer.

NOTE: An Original Bid bond and Original Power of Attorney is required with submission of the bid.

The bid bond is due on the date as stated on the SF1442 block 13. The bid bond must be on a SF24 form.

Rejection of a bid bond shall be in accordance with FAR 28.101-4 Noncompliance with bid guarantee requirements.

SECTION 00100 INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

1. Description of the Project: The intent of this project is to repair and renovate Building P-1 located at South

Portland Air National Guard Station (SPANGS), South Portland, ME 04106.

The scope of the work includes, but is not limited to:

Provide all plant, labor, transportation, materials, tools, equipment, appliances and supervision necessary for the Construction of repairing and renovating the existing building P-1. Exterior work includes removing exhaust fans, patching roof, seam sealing, wall transition flashing repairs, repairing built up roof, replacement of approximately 1,000 SF of wet insulation, cleaning approximately 4,000 SF of exterior walls, repairing 300 SF brick and 25 SF of EFIS exterior walls, repointing and sealing of approximately 2,750 SF of façade, and repair of exterior cracks in walls. Interior work consists of replacing approximately 14,309 SF of ceiling tiles and approximately 10,648 SF flooring (VCT, carpet, and paint), repair of seven (7) floor trench/plate cover panels, and replacement of weather stripping on 24 doors to create weather tight seals. Other exterior work consists of replacing exterior stairs and rails, repair of landing at the main entrance, and any required earthwork to complete installation and repairs.

2. Instructions to Bidders:

2.1. You are invited to submit a bid in response to our Invitation for Bids (IFB) entitled W50S83-21-B-0002 entitled Emergency Repairs Bldg P-1, Project Number VVRK182001, at SPANGS South Portland, ME 04106.

2.2. As a result of this solicitation, the Government intends to award a Firm Fixed Price (FFP) contract resulting from this solicitation to the responsible bidder whose bid, conforming to the invitation for bids, will be most advantageous to the Government, considering only price.

2.3. This solicitation is set-aside 100% for small businesses.

3. NOTICE OF PRE-BID CONFERENCE AND SITE VISIT:

3.1. A pre-bid conference will be conducted on 11 May 2021, 9:00 AM EST for the purposes of briefing on the bid requirements and answering questions regarding this solicitation. This conference will be held at South Portland Air National Guard Station, South Portland, ME 04106. Interested Contractors are highly encouraged to attend the pre-bid conference. The site visit will be held following the conference.

3.2. Due to security conditions, all offerors must register to attend this conference and site visit. A list of individuals attending shall be e-mailed to Major Daniel Trembley and MSgt Kate Hewitt at the following addresses:

3.3. This information must be provided in advance in order to ensure access to the military base and conference site and ensure adequate seating for the conference attendees. Even if you have access to the base you must register to ensure adequate seating.

3.4. Visitors will be escorted from the Installation’s Main Entry Gate. You will be required to present the following information upon arrival: Valid Identification. Any of the above information furnished by you is protected under the Privacy Act and shall not be released unless permitted by law and/or you have consented to such.

3.5. Information provided at this conference or site visit shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation amendments shall apply.

4.1. Any explanation desired by an offeror regarding the meaning or interpretation of the solicitation, or proposals, drawings, specifications, etc. must be requested in writing and with sufficient time allowed for a reply to reach bidders before the submission of their bid.

4.5. For security reasons, all technical and engineering data related to this solicitation will be distributed using the Contract Opportunities (beta.SAM.gov) system. Plans and specifications are locked on beta.SAM.gov and require Contractors to request explicit access from the Contracting Officer OR export controlled access through DLA. 5. BID REPOSITORY AND BID OPENING:

5.1. A bid repository is provided for hand carried bids and is located at Maine Air National Guard Base, 101

Maineiac Ave, Suite 505, Bangor, ME 04401. Hand carried bids must be deposited in the repository prior to the time established for opening of bids. Bidders are cautioned that they will be required to sign-in and obtain a visitor’s pass to enter the facility and should allow time to accomplish this. See instructions for obtaining access to the base in the Site Visit instruction. Follow the same instructions for obtaining entry to hand carry bids. Late receipt of bids due to entry delays may not be deemed excusable and the Contracting Officer may declare the bid “late” in accordance with FAR 14.304.

5.2. The bid opening will occur at the time and date specified in Block 13 of the SF1442 at Maine Air

National Guard Base, 101 Maineiac Ave, Suite 505, Bangor, ME 04401. All interested offerors and their major subcontractors are encouraged to attend the bid opening.

5.3. Due to security conditions, all offerors must register to attend the bid opening. A MEANG Form 4 BACKGROUND REQUEST, 20190801 shall be filled out for all attendees and e-mailed to Major Daniel Trembley and MSgt Kate Hewitt at the following addresses: daniel.trembley@us.af.mil and elisabeth.hewitt@us.af.mil .

5.4. This information must be provided in advance, 5 business days prior to the meeting, in order to ensure access to the military base and conference site and ensure adequate seating for attendees. Even if you have access to the base you must register to ensure adequate seating. The furnishing of the above information is voluntary;

however, your failure to furnish all or part of the requested information may result in the Government’s denial of your access to bid opening. This information will be provided to the Base Security Forces who will authorize your entrance to the site.

5.5. Visitors will be escorted from the Installation’s Main Entry Gate. You will be required to present the following information upon arrival: (1) Vehicle Registration, (2) Valid Drivers License, (3) Proof of Insurance for Vehicle, (4) Safety Inspection and Car Rental agreement if applicable. 2. BID PREPARATION EXPENSES AND PRE-CONTRACT COSTS: This IFB does not commit the Government to pay costs incurred in preparation and submission of bids or for other costs incurred prior to award of a formal contract.

3. CLAUSES:

3.1. Clauses and provisions from the Federal Acquisition Regulation (FAR) and supplements thereto are incorporated in this document by reference and in full text. Those incorporated by reference have the same force and effect as if they were given in full text.

4. DISPOSITION OF UNSUCCESSFUL BIDS:

In compliance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful bids including the bid bond.

5. OFFERORS QUALIFICATIONS:

To establish its responsibility, the apparent low bidder may be requested by the Government prior to award, to submit a statement regarding his previous experience in performing comparable work, his business and technical organization, financial and bonding resources and plant available to be used in performing the work. This action may be requested to determine if the contractor is responsible.

(a) Definitions. As used in this provision--

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business concern eligible under the WOSB Program.

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13

CFR 121.103.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

Women-owned small business concern means a small business concern--

(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (NOV 2020)

(a) Definitions. As used in this clause--

Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern--

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13

CFR 121.103.

(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts--

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract.

(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table-size-standards.

(e) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.

(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraph (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.
