Construct C-130J Flight Simulator Facility Questions and Answers

No. Question Response

I received confirmation from Mr. Van Otten on Monday, July 25th that our team members would be escorted to the meeting location on July 26th for the C-130J Flight Simulator Facility Project W50S7522B0001 site visit. <Name Redacted> and <Name Redacted> were at the meeting location stated in the “Instructions to Bidders” at 9:00 am on July 26th. Mr. Ochs and Mr. Van Otten both confirmed that someone was being sent to the gate to assist with escorting them, but no one showed. Due to this, we could not attend the site visit and would like to request the list of attendees and information from the meeting (i.e., Recorded Minutes, Video of Meeting, Site Photos, etc.). In the bid documents, it states that they will be uploaded to SAM. Can you advise on when you expect these to be uploaded?

Also, is it acceptable that we are approved to come look at the site ourselves a week before the bid date at the latest, if possible? In addition, we are very concerned and disappointed and do not want this situation to happen on the date of the bid. How can we ensure access ahead of time?

Thank you for your time and understanding. We look forward to hearing from you.

With respect to the site visit documents, a number of these are manual and will need to be transcribed before uploading. We anticipate being able to post these documents no later than Monday.

It is unfortunate that your personnel were unable to attend the site walk; however, I have conferred with onsite personnel (146 Security Forces Squadron, 146 Civil Engineer Squadron, and Mrs. Jackson-Garcia) regarding contractor personnel being held at the gate pending an escort. All of them have confirmed that your personnel did not check-in with Security Forces at the gate and there were zero privately-owned vehicles waiting at the installation gate prior at the scheduled start of the pre-bid conference. In light of your concern on the day of the site walk, the start of the conference was delayed by ~20 minutes while we made additional trips to the gate and patrolled the parking lot to look for individuals waiting in their vehicles. Again, there were no vehicles at the gate; there was nobody waiting in their vehicles.

In considering the 20 or so other attendees that were able to attend, I can only conclude the Government's instructions were clear and unambiguous.

Additionally, the Government went above-and-beyond to ensure anyone who wanted to attend could attend (i.e., the additional trips to the gate and patrolling the parking lot). There is only one entrance to Channel Islands ANGS--is it possible that they ended up at the Navy base next door?

For ensuring that this does not happen again at the bid opening, I would suggest ensuring your personnel are familiar with where they will need to clear security ahead of time. This security checkpoint, coincidentally, is also the location of the bid dropbox where your bid will need to be submitted prior to the public bid opening.

With respect to an additional site visit, I will need to determine the Civil Engineer's availability and, if we purse an additional site visit, we would only consider a second, public site walk. Notice of this site walk would need to be posted with enough time for any other potential bidder to see the post and make appropriate arrangements. Soonest we will have an answer for this would be early next week as well.

2 In the email dated 07/27/2022 it was stated that the schedule is 400 days from notice to proceed. Are those calendar days or workings days? The 400-day period of performance is calendar days.

3 Has the existing electrical service been confirmed by the Electrical Engineer to be adequate to fulfill the electrical needs as shown on the plan? Confirmed. The existing electrical service is adequate for this facility.

On sheets ES 101 & ES 102 it states that " contractor to pull fiber and copper telecom lines through existing conduit (TYP). ......" Have these lines' location and suitability been confirmed by the Electrical Engineer?

This was discussed with the Base Comm Systems Management group. The pathway has been identified as available to receive telecom cabling as stated.

5 Is there a building preferred Fire Life Safety Contractor? Who currently provides service for the rest of the base?

No, the Base does not have a preferred Fire Life Safety Contractor. Most fire protection services, when required, are procured on an as-needed basis.

6 Does this job have any anti-terrorism requirements other than using laminated glass? Please advise

Yes. In addition to the laminated glass, refer to the 33 Foot Unobstructed Space Limit indicated on A1 / LS101, the mechanical louvers elevated above the ground plane on the Building Elevations on sheets AE201 and AE202 and the HVAC Emergency Shut-Off Button located in the Entry Vestibule #101 on sheet MP101.

7 The plans don’t reference any Anti-Terrorism stand-offs or anything else related.

Please advise.

A 33ft Standoff Distance is shown on Sheet LS101. This offset line can be added to one of the Civil Sheets (if needed) in the Conformed Set. Not necessary for Bid.

Specification Section 08 11 16, 1.2.1.1- Minimum Antiterrorism Requirements refers to blast loads identified in section 08 41 14 which doesn’t exist. Please provide Specification Section 08 41 14. Specification 08 11 16 has been updated in Addenda 2.

Specification Section 08 11 16, Paragraph 1.6.1 Calls for Engineer qualifications for Blast Design. Please provide Blast requirements and Required Engineer requirements.

The attached specifications 33 16 15 for Water Storage Steel Tanks allow for either bolted or welded steel tanks. Based on our 45 years of experience, bolted steel tanks have a shorter life span, especially when subject to the harsh coastal marine environmental conditions, i.e. VAFB, and Port Hueneme, Camp Pendleton, Etc. so that the welded steel tanks, with proper epoxy lining and coating, combined with cathodic protection and lightning protection, (as required by NFPA 22), will have a useful life several times greater than a factory coated bolted tank with thinner steel than the welded tank.

Please confirm whether the bolted steel tank will be accepted as an unequal to welded steel tank?

Other above ground water storage tanks at the base are bolted and would allow for consistent maintenance requirements. Both welded and bolted steel tanks complying with the specifications, NFPA 22, and other referenced criteria are allowed. Bolted tanks are an acceptable option.

Section 013526 1.6.1.1.1 is unclear on whether the SSHO can also be the Superintendent. Please confirm Superintendent can also be the SSHO on this project as long as candidate meets requirement in specifications for both roles.

The SSHO can also be the Superintendent as long as they meet the required specifications for those roles and can optimally perform both roles without delay to the proposed schedule.

Please confirm per “limitations on subcontracting” [52.219-14] page [43]-45 second to the last paragraph that small business set aside contractor can subcontract to a small business subcontractor and have it not count towards the 85% amount paid by the government for contract performance.

These questions appear to reference FAR 52.219-14(e) (specifically (e)(3) and (e)(4)); please resubmit your question if this is incorrect. Based on this understanding, the referenced portions of the clause are provided below. Note that, to determine wither paragraph (e)(3) and/or (e)(4) applies, the project's

No. Question Response

23 Per page 44, last paragraph, please confirm that cost of materials are not included in the maximum amount the government will pay (75%) for contract performance.

NAICS code must be considered. It is the responsibility of the firm submitting its bid to ensure compliance with the clause.

(e) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees that in performance of a contract assigned a North American Industry Classification System (NAICS) code for—

(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 85 percent subcontract amount that cannot be exceeded; or

(4) Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 75 percent subcontract amount that cannot be exceeded.

Paragraphs (3) and (4) use the phrase “similarly situated entities” which is defined by the clause at Paragraph (b):

(b) Definition. Similarly situated entity, as used in this clause, means a first-tier subcontractor, including an independent contractor, that—

(1) Has the same small business program status as that which qualified the prime contractor for the award (e.g., for a small business set-aside contract, any small business concern, without regard to its socioeconomic status); and

(2) Is considered small for the size standard under the North American Industry Classification System (NAICS) code the prime contractor assigned to the subcontract.

Per Grading Plan Sheet C5.02, spec section 310000 paragraph 2, and Soil Foundation Note 7 on S001, please confirm that over-excavation is limited to 5’ below existing grade and no soil stabilization is required in the base bid.

Per section 3.2.5 in specification section 31 00 00: “Shore trench walls more than 4 feet high, cut back to a stable slope, or provide with equivalent means of protection for employees who may be exposed to moving ground or cave

in. Excavate trench walls which are cut back to at least the angle of repose of the soil.”

25 Per Note 7 on S001, please confirm that on-site material can be utilized as structural fill.

There is nothing that precludes the Contractor from using on-site materials as long as they are part of an acceptable mix consisting of the qualities required to be “structural fill.”

Please confirm Project Manager can also be CQC System Manager per 014500 on this project as long as candidate meets requirements in specifications for both roles.

The Project Manager can also be the CQC as long as they meet the required specifications for those roles and can optimally perform both roles without delay to the proposed schedule.

35 Per section 011400- Work Restrictions, Para 1.3 B, please identify contractor’s staging area and parking areas for contractor’s employees.

Refer to sheet C-101 for the site boundaries of the project. Additional parking/laydown space can potentially be utilized from the surrounding parking lots upon coordination/approval from the Base Civil Engineer after award and during the Pre-Construction phase.

For steel fabricator requirements outlined in section 014535 2.1, is an LA City Certified Fabrication Plant an acceptable alternate to an AISC Certified Fabrication Plant?

If LA City Certified Fabrication Plant is AISC Certified, then the inspections can be waived. If they are not, inspections will be required per section 01 45 35, Paragraph 2.1.

Please provide plan for landscaping around building that is to be priced as Alternate 0014 (ABI-8: Provide landscaping around building- I.L.0. specified native grass) per Bidding Schedule.

On the Drawing Cover Sheet and in Spec Section 00 22 13.00 20 - SUPPLEMENTARY INSTRUCTIONS TO OFFERORS, OLI #8, the "I.L.O. states "Specified Native Grasses," meaning seeding / or sod installation- the same as any disturbed area on the project site.

Solicitation Form & Bid Schedule Form identify Alternate #013 as ABI-12: Provide additional concrete sidewalk pavements as indicated on drawings. Sheet AE601 mentions OLI #13 in finish schedule note 6 as painting accent walls. Please clarify which is correct for Alternate #13 and if painting accent walls is an alternate, please provide number & location for this pricing on the bid form.

See the response to question 34 (above).

For Alternates 10 & 11 (ABI-9 and ABI-10) on Solicitation Contract Form & Bidding Schedule, please provide plan showing extent of horizontal & vertical translucent fiberglass wall panels to be priced for each alternate.

Dimensions on Building Elevation Sheets AE201 and AE202 indicate the extents of the vertical and the horizontal translucent fiberglass wall panels- as they relate to OLIs 9&10. In general, the horizontal bands will be full span, i.e., 64'-4"w x 4'- 0"h (typical - 4 elevations). Vertical bands start at the base of the horizontal band location (whether horizontal bands are provided or not), i.e., 17'-0"h x 7'-0"w (typical - 2 elevations).

On sheets AE201 and similar, the EIFS (1,2, and 3) are called out as OLI #12.

This does not appear to be an alternate and does not appear on the Solicitation Contract Form nor the Bidding Schedule. Please confirm EIFS shown is base bid and not an alternate.

To clarify, EIFS 1/2/3 are differing colors of the EIFS topcoat. All EIFS is Base Bid. The parentheses next to the EIFS notes state "(FWP 1/2/3 - OLI #12)". FWP is Fabricated Wall Panel and FWP 1/2/3 are differing colors of the FWP finish.

The FWP is always OLI #12.

41 Per life safety legend on G-003, fire extinguishers are NIC. Please confirm semi-recessed cabinets are also NIC.

All Semi-recessed Fire Extinguisher Cabinets (for Dry Chemical Extinguishers) and Wall Brackets (for Clean Agent Extinguishers) are in the project scope.

Stated extinguishers are Government Furnished / Government Installed.

Will flight simulator work/install (by others) be concurrent with the construction of this project? If so, what protection measures need to be figured and what is the anticipated start date of that construction.

No, the flight simulator will be installed separately and is not anticipated to conflict with the construction of the facility.

43 Please provide specifications for the Bridge Crane (Optional Line Item #2). Please reference the response to question 29.

Sheet AE601, FINISH SCHEDULE NOTES #6, states “OLI #13 – PAINT ACCENT

WALLS (PT5), SEE FIISH PLAN ON SHEET IN103 FOR LOCATIONS”.

Is the intent for the accent walls to be part of OLI #13?

Yes.

45 SB-103 shows the fire water storage tank foundation. Please provide foundation information for pricing purposes.

Refer Specification section 33 16 15 - WATER STORAGE STEEL TANKS.

Foundation design is included in contractor's scope of work.

There is a note to “REMOVE COMMUNICATION CONDUITS, 350LF”.

Please confirm these conduits are empty and no re-routing of any existing communications is required.

It is not anticipated that there is telecom cabling in the conduit being slated for demo. No rerouting is anticipated.

No. Question Response

Option Line Item #8 calls for landscaping around building in lieu of specified native grass.

1) Is the “native grasses” to be new sod or hydroseed?

2) Is temporary or permanent irrigation required?

3) Please confirm that all work shown on LS101 (edging, ground cover, rock mulch, ground cover) is the landscape option and only the native grass is base bid.

1) Per Spec Section 32 92 15, para. 3.2.2, "Seeding method must be hydroseeding."

2) Temporary irrigation is required for all plantings and areas not being served by a functioning irrigation system. Permanent "Drip Irrigation" is specified for the identified "Ground Cover" beds as shown on Sheet

LS101.

3) Confirmed as stated.

Reference detail A1/P-501.

Please see attached clarification needed.

The valved and capped 1-1/4” stainless steel breathing air piping on the left side of the detail is part of the Base Bid scope. All the rest of the diagram (compressor, storage cylinders, piping, valves and devices) shall be included in the OLI # 3 scope of work and shall be installed by Owner.

Document “W50S7522B0001_Construct_Flight_Sim_Building_Solicitation_SF1442”, page 20 of 103 includes DFARS 252.236-7007 which outlines how the government will evaluate additive or deductive items. However, document “W50S7522B0001_Construct_Flight_Sim_Building_Solicitation_Atch- 02_Specifications_(Div_00-21)” Section 00 22 13.00 20, page 5, Paragraph 1.2.1.c states: “Options will be evaluated in accordance with FAR 52.217-5 Evaluation of Options.” DFARS 252.236-7007 and FAR 52.217-5 are vastly different evaluation methods, where the former evaluates options based on priority ratings and the latter looks at the total of the base plus all options to determine the apparent low bidder. Please clarify which evaluation method applies to this solicitation?

Reference to “options” in the specifications is an error; this requirement does not include “options”, only “additive bid items” (ABIs). FAR 52.217-5 does not apply to this solicitation and, for purposes of determining the “apparent low bidder”, DFARS 252.236-7007 will be used.

No. Question Response

Please reference the evaluation method outlined in document “W50S7522B0001_Construct_Flight_Sim_Building_Solicitation_SF1442”, page 20 of 103, DFARS 252.236-7007. It is unclear how the Government will decide which bidder to “start” the process of adding the base plus priority items to reach the budget number. DFARS 252.236-7007 gives an example where there are two bidders being evaluated (“A” and “B”). To illustrate my question, I have included a third bidder (“C”) in the table below. Given this new scenario, who would the Government announce as the apparent low bidder? Would it be “A” again, or would it be “C”?

The example (table) from this question is provided below. Note that the question omits the funding limitation provided in the sample at DFARS 252.236-7007(c) which is stated as $100,000. Additionally, this question does not address the example’s notation that the apparent low bidder was determined by adding both bidders’ prices for the base plus ABI 1 plus ABI 4. ABIs 2 and 3 would have caused both bidders to exceed available funds and were not evaluated in the example. Here, the low bidder was “Bidder ‘A’” because their total bid was $99,000 vs. the bid from “Bidder ‘B’” of $100,000.

Note that there is no “starting bid”; all bids will be opened and their line-item pricing for the base and all ABIs will be read aloud. The Government’s available funding will also be read aloud. Once all of the bids have been opened, the Government will begin the evaluation described by DFARS 252.236-7007.

All bids will be evaluated for all offerors starting with the base requirement and, if there are still funds available to award ABIs, the Government will begin adding bid pricing for each ABI (one at a time) to all bids. The total pricing for the base and any included ABIs will be compared to available funds and additional ABIs will be added until funds are exhausted.

Pursuant to DFARS 252.236-7007(2), “The low offeror shall be the Offeror that—

(i) is otherwise eligible for award; and (ii) Offers the lowest aggregate amount for the first or base bid item, plus or m See Items # 6, 7, 8, 9, 10 (Above).inus (in the order stated in the list of priorities in the bid schedule) those additive… items that provide the most features with the funds determined to be available,” (emphasis added).

Note that, per DFARS 252.236-7007:

- All bids will be evaluated on the basis of the same ABI(s)

- If adding an ABI causes all bidders to exceed available funds, it will be skipped, and the next ABI considered if there are adequate funds remaining

- The priority list is only used to determine the apparent low bidder; award of any other combination of ABIs may be made so long as they are in the best interest of the Government, funds are available at the time of award, and the combination of the awarded ABIs is lower than prices offered by other bidders.

Considering the “Bidder ‘C’” added by the question, the Government would have evaluated ABIs 2 and 3 for all three bidders (the sample at DFARS 252.236-7007 skipped these). “Bidder ‘C’” would have been named the apparent low bidder because their base ($85,000) plus ABI 1 ($5,000), plus ABI 2 ($5,000), plus ABI 3 ($5,000) was $100,000; the other two bidders would have exceeded available funds (as stated in the Government’s example).
