(i) This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice.
This announcement constitutes the only solicitation. Proposals are being requested and a written solicitation will not be issued. The Government intends to use simplified acquisition procedures in accordance with FAR 13.106 and 13.5.
(ii) W50S73-23-R-0006 is issued as a request for proposals (RFP).
(iii) This solicitation incorporates provisions and clauses that are in effect through Federal Acquisition Circular 2023-04.
(iv) This is a 100% small business set-aside and the associated NAICS code is 812990 and the small business size standard is $7,500,000.00
(v) Contract line-item numbers (CLIN):
CLIN 0001 (Base Year) - QTY 12 - UNIT OF ISSUE MONTH – The contractor shall provide all non-personal services to include labor, equipment, and materials to accomplish the following HPO Services, Base Period.

(vi) Special Warfare Airmen (SWA)/Tactical Air Control Party (TACP)/ID Air National Guard (ANG) Members must always be ready to perform at their peak to accomplish their challenging mission set. Attaining and maintaining this level of peak human performance requires the implementation of a top-notch physical conditioning and maintenance program comparable to those seen in Olympic-level and professional sports organizations. The Human Performance Optimization (HPO) program will focus on the whole member concept to not only assist ID ANG in accomplishing their military missions in the short term, but also to emphasize the maintenance of peak performance over the long term to lengthen the service life of the "human weapon system” while ensuring high quality production. This long-term perspective means the HPO program must include rehabilitative services to provide rapid recovery from injuries and performance services to provide focused physical and mental conditioning. A successful program consists of two positions: Athletic Trainer and Strength and Conditioning Specialist. See attached performance statement of work for description and specifications of requirements.
(vii) The anticipated Period of performance for this contract will start 01 OCT 2023 at Gowen Field, Boise, ID 83705. A pre-proposal site visit is not planned for this requirement.

(ix) The provision at FAR 52.212-2, Evaluation—Commercial Products and Commercial Services (Nov 2021), applies to this acquisition:
(a) The Government will award one single award contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation represents the best value to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Each proposal will be evaluated using technical rating definitions. To support the adjectival rating, strengths and weaknesses shall be noted in the evaluations.
Contractors are required to provide both specialties listed in section 2.5.1 and 2.5.2 of the PWS this consists of an Athletic Trainer and Strength and Conditioning Specialist, in order to submit a quote for this contract. Any quote that does not offer this minimum level of service will not be considered for contract award.
(1) Technical Capabilities Rating Definitions. The Technical Capabilities Factor rating will be expressed as an adjectival assessment of: Outstanding, Good, Acceptable, or Unacceptable.
i. Outstanding - A proposal that meets or exceeds all of the Government's requirements, contains extensive detail, demonstrates a thorough understanding of the services, and is highly feasible (low risk).
ii. Good - A proposal that meets or exceeds all of the Government's requirements, contains at least adequate detail, demonstrates at least an understanding of the services, and is at least feasible (low to moderate risk).
iii. Acceptable - A proposal that at least meets all of the Government's requirements, contains at least minimal detail, demonstrates at least a minimal understanding of the services, and is at least minimally feasible (moderate to high risk).
iv. Unacceptable - A proposal that contains major error(s), omission(s) or deficiency(ies) that indicates a lack of understanding of the services or an approach that cannot be expected to meet requirements or involves a very high risk.
The evaluation process shall consider the following:
i. Key Personnel – Resumés of the key personnel such as the Business Owner or Project Manager and Lead Athletic Trainer shall be provided. The resumés should detail each key personnel’s experience performing similar functions as required by the Performance Work Statement both with the company and outside of the company. The resumés should also state the number of years of experience working with military pilots or elite collegian or professional athletes or Special Forces personnel, and with programs similar to optimizing the human weapon systems program.

ii. Project Management and Staffing and Startup Operations Plan – The offeror shall provide a written description of how work is to be performed to include the type(s) of discipline(s) or profession(s) to be employed, the minimum credentials and experience each employee must possess, and the offeror’s ability to effectively manage the contract and the contractor employee(s). The offeror shall include a description of any special technical training that will be provided to new or existing employees to ensure they are adequately prepared to provide services under the contract. The staffing and startup operations plan shall detail what services are to be provided by the prime contractor and any subcontractors. The plan shall provide a proposed schedule for startup operations and describe how planned and un-planned time off request for Contractor Employees will be processed. The plan shall also explain whether the Contractor intends to provide a replacement Contractor Employee during time off requests. The Contractor shall include a daily dollar amount to be subtracted from monthly invoices for unstaffed days not reflected in the Contractor’s pricing for each period of performance. The proposal shall be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The proposal shall be evaluated to determine the level of confidence provided the Government with respect to the offeror's methods and approach in successfully meeting and/or exceeding the requirements in a timely manner. Staffing Plans that provide for a minimum of 50 weeks of coverage will be looked at more favorably than those that do not.

iii. Project Equipment and Supplies Plan – The proposal shall provide a detailed description of the equipment and supplies provided by the Contractor needed to perform all services as described in the Performance Work Statement. The plan shall also demonstrate the capability to provide strength and conditioning for the neck and back.

iv. Understanding of Required Work and Reporting Requirements – The offeror shall provide in their proposal sufficient information to demonstrate their clear understanding of all requirements involved in providing the optimizing the human weapons system services as well as the reports that must be supplied to the Government (see Technical Exhibit 2 in the PWS). Proposals will be evaluated to determine the extent to which the offeror demonstrates their clear understanding of these requirements.

(2) Past Performance - Past performance information as identified in CPARS and FAPIIS for the last three years shall be rated (acceptable or unacceptable); Offerors with no past performance record in CPARS or FAPIIS shall be rated as acceptable. If CPARS or FAPIIS information is addressed in FAPIIS, the government reserves the right to evaluate responses.
(3) Price. Price will be evaluated on a total price basis including all options. Options shall be priced separately in proposals.

The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision—
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".
(d) Representation. The Offeror represents that—
(1) It □ will, □ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that—

The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.
(e) Disclosures. (1) Disclosure for the representation in paragraph (d)(1) of this provision.
If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand;
model number, such as OEM number, manufacturer part number, or wholesaler number;
and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services—
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand;
model number, such as OEM number, manufacturer part number, or wholesaler number;
and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

FAR 52.209-7 Information Regarding Responsibility Matters. (Oct 2018)
(a) Definitions. As used in this provision-
Administrative proceeding means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
Federal contracts and grants with total value greater than $10,000,000 means-
(1) The total value of all current, active contracts and grants, including all priced options;
and
(2) The total value of all current, active orders including all priced options under indefinite delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple award Schedules).
Principal means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

FAR 52.217-8, Option to Extend Services (Nov 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(a) This representation shall be completed if the Offeror received $7.5 million or more in Federal contract awards in the prior Federal fiscal year. The representation is optional if the Offeror received less than $7.5 million in Federal contract awards in the prior Federal fiscal year.
