a) Workers' Compensation and Employer's Liability. Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a contractor's commercial operations that it would not be practical to require this coverage. (See 28.305(c) for treatment of contracts subject to the Defense Base Act.)

The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.

Coverage for passenger liability bodily injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

Addendum to Evaluation - Commercial Product and Commercial Services

Miscellaneous text in this section has been modified to:

EVALUATION CRITERIA:

(a) Award shall be made to a single contractor. The basis for award of any contract resulting from this solicitation shall be the result of the evaluation factors specified herein, utilizing the Lowest Price Technically Acceptable methodology. The Government intends to award a single Firm Fixed Price (FFP) contract.

(b) The Government intends to award a contract without discussions with respective offerors.

However, the Government reserves the right to conduct clarifications or discussions if deemed in its best interest.

(c) Award shall be made to a single contractor. Award will be made to the lowest priced offeror determined technically acceptable and responsible, whose proposal meets the requirements of the Performance Work Statement (PWS) and this solicitation.

I. PRICE:

(a) Proposals shall include prices for each line item listed and a total price, in order that proposals may be properly evaluated.

(b) The Government will evaluate offerors for award purposes by adding the total price for all Contract Line Item Numbers (CLINs) (base period and option periods) for the total evaluated price.

In the event there is a difference between a unit price and the total CLIN amount, the unit price shall be held as the intended price multiplied by the number of units. If the offeror shows only the total amount but fails to submit a unit price, the total CLIN amount shall be divided by the quantity and held as the intended price. Evaluation of options shall not obligate the Government to exercise the option(s).

PARA. (b) WITH FAR 52.217-8: As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding six months of the offeror's final option period price to the offeror's final option period price. Offerors are required only to price the base and option periods. Offerors shall not submit a price for the potential six-month extension of services period. The Government may choose to exercise the Extension of Services at the end of any performance period (base or option periods), utilizing the rates of that performance period.

(c) Unbalanced pricing exists when, despite an acceptable total evaluated price, one or more contract line items are significantly overstated or understated as indicated by the application of cost and/or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

II. TECHNICAL:

(a) Technical acceptability will be evaluated on an acceptable/unacceptable basis. To be rated acceptable, the offeror must demonstrate an understanding of the requirements and a feasible technical approach capable of meeting the requirements of the PWS. Offerors shall provide a sufficient staffing plan not exceeding three (3) pages, identifying labor categories, number of personnel, labor hours, wage rates, and equipment to perform the tasks necessary as outlined in the schedules within the PWS.

III. PAST PERFORMANCE:

(a) The Government may review available past performance and integrity information, including the Contractor Performance Assessment Reporting System (CPARS) and Federal Awardee Performance & Integrity Information System (FAPIIS), as well as any other Government-sponsored information available may be utilized to help make a responsibility determination in accordance with FAR 9.104.

IV. Failure to provide any of the requested information may result in the proposal being deemed unacceptable and may not be eligible for award.

V. The Government will begin the evaluation process with a ranking based on the Total Evaluated Price from the lowest to highest price. Following the price ranking, only the lowest priced offeror will be evaluated for technical acceptability under the non-price factor(s) according to the evaluation criteria set forth in this addendum. If acceptable, the evaluation will stop at that point and an award will be made to the lowest priced technically acceptable offeror. If the offer is deemed unacceptable, the Government will continue to review proposals in order of price until evaluating an offer that is considered technically acceptable and eligible for award based on the criteria set forth in this addendum. The Government reserves the right to conduct additional technical evaluations as deemed necessary.
