Question and Answers #4:
36) Will the US Army consider granting a 4-week proposal due date extension, in addition to the two weeks already granted, to permit further best possible pricing and to permit a further detailed review of the six TDPs that were not available before the RFP was released?
A: There will be no further extensions granted for this solicitation due to the time constraints associated with the award of this contract(s).
37) The order limitation clause (FAR 52.216-19) as included in the solicitation does not address any limitations on the number of orders placed within a single ordering period. What is to preclude the Government from making multiple maximum quantity awards at a single unit price within an Ordering Period over 5 days apart, thereby work loading a facility through the entire period of performance at a single price? Would the contractor be required to honor the orders in such a circumstance, or would the Contractor’s option to return the order, as provided in FAR 52.216-19 (d), apply?
A: Per the solicitation, I-111 clause 52.216-19(b)(3) covers your concern of multiple max quantity awards because they would exceed paragraphs 52.216-19 (b)(1) and 52.216-19 (b)(2). In addition, in the highly unlikely situation that it was to happen, FAR 52.216-19(d) would apply.
