LTAMDS PROTOTYPE PROJECT OPPORTUNITY NOTICE (PPON)

Industry’s Questions & Comments Set 3

1. QUESTION:

A. Offeror A is using 1/3 cost share approach to qualify for award. Total project cost of 6 PRUs (before any reduction for cost share) is $100. Offeror A share is $33 and USG price is $67.

• Would the TEP be $67? Or 100?

• Would the OTA be a FFP agreement for $67?

• Should Offeror’s Enclosure D Total Proposed Price show only the 2/3 share to be paid directly by the USG ($67)? Or show the total project cost of $100?

ANSWER: The TEP would be $100. The OTA would be a FFP agreement for $67.

The Offeror’s share should show the total Project Cost of $100.

B. Offeror B is using NTDC approach with a $20 IP royalty applicable to 6 PRUs.

Total price for 6 PRUs (including royalties) would be $100.

• Would the TEP be $80, which excludes the $20 royalty which will be assessed only for affordability under Factor 5, Special License Agreement?

• Would the OTA be a FFP agreement for $100, which includes the $20 royalty that will be paid by the USG under this current OTA for the 6 PRUs?

• Should Offeror’s Enclosure D Total Proposed Price include the $20 cost of the IP royalty?

ANSWER: The total TEP be $80, which excludes the $20 royalty which will be assessed only for affordability under Factor 5, Special License Agreement.

2. QUESTION: The Government states in its answer to question 1 that “[i]f Offerors choose to 1/3 cost share and are selected for award, the Government would award an OTA for 2/3 of the TEP.” Is this statement correct? If not, should “TEP” be changed to “Total Project Cost” (see PPON, Section 5, Conditions for Award, Cost Share Requirements Section, pg. 28)?

ANSWER: Yes, this statement is correct. The Government would award an OTA for 2/3 of the

TEP

3. QUESTION: Is TEP the same as Total Project Cost? If not, what is the difference?

ANSWER: The Total Evaluated Price (TEP) is the total of all line item numbers proposed by the offeror. The total project cost is the same as the TEP.

4. QUESTION: In accordance with DD 254 requirement to meet chapter 8 of the National Industry Security Program Operating Manual (NISPOM), Offerors are required to meet Defense Security Service (DSS) compliance with the Defense Security Service (DSS) Assessment and Authorization Process Manual (DAAPM v2, dated 09 May 2019), which requires compliance with DoD Risk Management Framework (RMF). Under RMF requirements, all classified data leaving the confines of an Offeror’s controlled areas as described in DAAPM Appendix A: MP-5

(4) is required to be encrypted unless waived by the receiving Government authority.

Question: We respectfully request the USG waive for all offerors who are couriering and hand delivering classified material, including classified DVDs, the requirement to encrypt classified DVDs.

ANSWER: The NISPOM encryption requirement for offerors' proposal submittals is waived
