PERFORMANCE WORK STATEMENT (PWS)

FOR

PEST MANAGEMENT SERVICES

FORT DEVENS &

BARNES BUILDING, BOSTON

PERFORMANCE WORK STATEMENT

PART 1 GENERAL

1.0 DESCRIPTION: The contractor shall furnish all labor, materials, supplies, equipment, supervision and transportation, except those designated as government-furnished, to provide the required pest control services at Fort Devens, Massachusetts and the Barnes Building, in Boston, Massachusetts, in strict accordance with the terms and conditions specified herein. The tasks listed herein shall meet applicable standards, EPA and State of Massachusetts laws and regulations, inclusive of equipment or vehicles utilized to provide the required services and standards outlined in the Performance Work Statement.

1.0.1 The Barnes Building Complex: Located 495 Summer Street, Boston, Massachusetts. It is a single 9-story structure with a basement and it consists of approximately 560,000 square feet. The complex consists of 9 acres, including the buildings and adjacent parking areas. There are 18 mechanical rooms, 35 air handling units, 3 boilers with small domestic hot water heater for summer use. There are 5 passenger elevators and one freight elevator.

1.0.2 The Fort Devens Garrison: Consists of four main areas supported by pest management services:

1) Main Cantonment Area, 2) South Post Range Complex, 3) 3400-Area (accessed via Lovell Street), and 4) 3800-Area (formerly Moore Army Airfield).

1.0.3 Access: If access to the facility cannot be provided by the approved scheduled time, the Contractor will be notified of this no later than four (4) business hours prior to the scheduled time. The Contractor is obligated to reschedule the visit and meet the agreed‑upon time.

1.0.4 Changes to Scheduled Maintenance: The Contractor shall notify the COR of a change to the scheduled maintenance for that particular facility.

1.0.5 Scheduling Problems: The Contractor shall report any scheduling problems with Facility Managers to the COR within two working days of occurrence.

1.0.6 Call-backs: If the Contractor cannot gain access to the facility within thirty (30) minutes after the approved scheduled time, the Contractor shall leave a call‑back card and reschedule the visit. The Contractor shall then annotate the date and time he arrived for scheduled visit, and submit a copy of same to the COR. Upon verification by the COR, the Contractor will then be entitled to a “No-Show Service Charge”. Should the Contractor continue to encounter problems gaining access to a facility, the Contractor should notify the COR for assistance. The Contractor's efforts to gain access shall include picking up keys at other facilities as directed by the occupants.

1.1 SIGN-IN AND SIGN-OUT:

1.1.1 Fort Devens: During regular duty hours, Monday through Friday, the Contractor shall report to Room 313, Building 666.

1.1.2 Barnes Building: The Contractor shall sign in and sign out in the Facility Managers office.

1.2 UNOCCUPIED AREAS: The Contractor shall gain entry to unoccupied areas by checking out a key from the COR.

1.3: TERMITES: If upon answering a service order or during scheduled maintenance termites are found, the Contractor shall report the finding to the COR. The Contracting Officer will approve what actions will be taken

1.4 RECORDS AND REPORTING:

1.4.1 Records: The Contractor shall maintain complete and accurate records of all work performed on DD Form 1532, "Pest Management Report". The Contractor shall complete DD Form 1532 for each month's work, and submit this report to the COR within three (3) working days of the following month. The Contractor shall allow the COR to inspect the files upon request.

1.4.1.1 The Contractor shall prepare, submit, and maintain daily records of all pest control operations, including survey, chemical and non-chemical control.

1.4.1.2 The Contractor shall submit a copy of any equipment calibration reports for hydraulic sprayers used in the execution of this contract two (2) weeks prior to seasonal use, when repairs are performed and when the COR suspects inappropriate application of pesticide is occurring.

1.5 CONDITION OF FACILITIES: During the performance of the contract, if the Contractor discovers a deficiency within the facility which may affect performance of contract work, or an unhealthy or hazardous condition, the Contractor shall report the finding to the COR immediately or within 2 hours of the discovery. However, if a structural deficiency is discovered, the Contractor shall immediately notify the COR before the completion of the work.

1.6 DELAYS: The Contractor shall report any delays or interference of work by Government employee, other Government contractors or occupants immediately or within 2 hours to the COR.

1.7 WORKMANSHIP:

1.7.1 Intent: The performance of work shall conform to Federal and State laws, industry codes, and all other standards required in the contract. During pest control activities, adjacent surfaces and dwelling contents shall be protected. Work areas left unattended overnight shall be closed off with the necessary sign to protect the occupants from possible safety hazards and to protect the facility from weather damage, stray animals or criminal acts. Work deemed unsatisfactory by the Contracting Officer shall be re-performed at the expense of the Contractor. Any Government property damaged by the Contractor during work performance shall be repaired or replaced immediately by the Contractor at no expense to the Government.

1.7.2 Clean-up: Work areas shall be cleaned after the work has been performed and, as a minimum at the end of each workday. Cleaning shall include the removal of all smudges, grease, stain, dirt, drips, and refuse resulting from the Contractor's work.

1.8 INSPECTION SERVICE:

1.8.1 Scheduled Maintenance: The Contractor shall perform all required work as directed by the COR and establish a maintenance schedule to be submitted to the COR within 10 working days after the award of the contract.

1.8.2 Service Order: The Contractor shall respond to all service order calls and investigate the problem. Flushing agents shall be used for the applicable pests to determine if the pests are present. After the investigation, the Contractor shall inform the requester as to one of the following actions:

1.8.2.1 No Problem. Nothing Was Found: The Contractor shall advise the request or nothing was found. The Contractor shall close out the S/O and charge the Government for an inspection only.

1.8.2.1 Problem Exists: The Contractor shall advise the requester that a problem exists and offer to provide treatment. If the requester does not want treatment, the Contractor shall inform the COR. The Contractor shall close out the S/O and charge the Government for an inspection only.

1.8.3 Unsanitary Conditions: If the Contractor determines unsanitary conditions exist which allow pests to breed, the Contractor shall not apply any pesticides and immediately notify the COR. The COR will make the determination whether or not the Contractor shall provide the treatment. If no additional service is required, the Contractor shall charge the Government for an inspection only. If the COR determines that the conditions are sanitary, the Contractor shall perform the required treatment service and charge the Government for the particular treatment listed in the Bid Schedule. The Contractor will not be entitled to compensation for the inspection visit. This requirement applies to all services required in the contract whenever the Contractor responds to a S/O for the initial visit, a rescheduled S/O visit, or a scheduled maintenance visit.

1.8.4 Treatment: If the requester elects to have the treatment, the Contractor shall inform the requester of the necessary preparation requirements, for the particular pest control service, and provide the requester with the proper handout. The Contractor shall perform the treatment if it can be accomplished at that time. If not, the Contractor shall schedule with the requester a mutual agreed‑upon time for the service to be performed and obtain a statement along with the requester's signature indicating that the treatment service is desired. Upon completion, the S/O shall be appropriately closed out and the Government charged for the particular service listed in the Bid Schedule. The contractor will not be entitled to compensation for the inspection visit.

1.8.4.1 The Contractor shall investigate pest and disease infestations other than those in structures (e.g. trees, turf, soil and shrub), and obtain COR approval before accomplishing the necessary pest control service.

1.8.4.2 Emergency Service Orders for arthropod insect infestations require a site visit with 12 hours of submission to the Contractor.

1.8.5 Quality Standards: The Contractor shall properly diagnose the problem and level of infestation. Treatments made are subject to the appropriate quality standards for the particular facility or particular pest.

1.9 PEST CONTROL FOR FOOD SERVICE FACILITIES (DINING FACILITIES. FOOD AREAS IN PX FACILITIES, CLUBS, AND ANY FOOD HANDLING FACILITIES):

1.9.1 Monthly Scheduled Maintenance: Pests to be controlled are arthropods and rodents.

1.9.1.1 The Contractor shall advise the Facility Manager upon each visit of the necessary requirements during and after treatment for particular pest control services.

1.9.1.2 The Contractor shall apply the necessary treatments when and where needed for Arthropods. Any voids and hollow spaces shall be treated with a dust formulation of the appropriate pesticide. A flushing agent shall be used after pesticides are applied to force the pests to move into chemicals. Treatment shall include the sealing of holes, cracks and other openings. Treatment shall be accomplished during hours after the facilities are closed. Treatment for rodents shall be in accordance with paragraph 1.11, "Rodent Control".

1.9.1.3 If access to the treated area is to be restricted, the Contractor shall post warning signs. The Contractor shall remove the warning signs after the required waiting period, as specified on the label of the particular pesticide used, has passed.

1.9.1.4 During the months of March, April, May, June, July, August, September, and October, the Contractor shall, in addition to the treatment inside the building, treat the outside of the structure in the vicinity of the foundation for those insects and rodents which harbor in cracks and crevices and gain entry to the building at night. The Contractor shall accomplish inside and outside treatments at the same time.

1.9.1.5 In facilities treated after business hours the Contractor shall leave a written statement with the Facility Manager, which shall include the applicators signature, the date and any notes pertinent to the treatment, to include reentry instructions.

1.9.1.6 The Contractor is encouraged to use the least amount of chemicals necessary to achieve the results required in the Quality Standards, Para. 1.9.3.

1.9.1.7 The Contractor shall place at least twelve (12) surveillance glue boards in each food service facility. These boards shall be replaced when they become ineffective (dirty, wet or full of insects).

1.9.2 Service Order: Pests to be controlled are arthropods and/or rodents in food service facilities.

1.9.2.1 Upon arriving to apply the actual treatment, the Contractor shall again advise the Facility Manager of the necessary requirements during and after treatment for the particular pest control service.

1.9.2.2 The Contractor shall apply the necessary treatment when and where needed for Arthropods. Any voids and hollow spaces shall be treated with a dust formulation of the appropriate pesticide. A flushing agent shall be used after pesticides are applied to force the pests to move into chemicals. Treatment shall include the sealing of holes, cracks, and other openings. Treatment shall be accomplished during hours after the facilities are closed (8:00 p.m.). Treatment for rodents shall be in accordance with paragraph 1.11, "Rodent Control".

1.9.2.3 ULV may be directed by the COR to control infestations. If the Contractor determines that ULV is needed rather than the normal spray treatment, the Contracting Officer approval shall be obtained prior to any application. Payment shall be made for ULV space treatment as given in the Bid Schedule.

1.9.2.4 If access to the facility or treated area is to be restricted for a given amount of time, the Contractor shall post warning signs. The Contractor shall remove the warning signs after the required waiting period.

1.9.3 Quality Standards:

1.9.3.1 Arthropods: No healthy, live pests shall be observed within the treated area thirty (30) calendar days after date of treatment. If live, healthy pests are observed any time thirty (30) days after treatment; the Contractor shall perform the necessary re-treatment(s) at no additional cost to the Government.

1.9.3.2 Rodents: Areas ordered for rodent control shall remain rodent free for a period of thirty (30) calendar days after the Contractor removes his trap/poisons. If live, healthy rodents are observed any time thirty (30) days after treatment; the Contractor shall perform the necessary re-treatment(s) at no additional cost to the Government.

1.9.3.3 Structural Pest Infestations: Five (5) year warranty against re-infestation or damage due to re-infestation for (a) areas treated in their entirety; and (b) the treated portion of areas which were spot treated.

1.9.3.4 Swarmers: No healthy, live pest shall be observed within the treated area one year or (365) calendar days after date of treatment. If live, healthy pests are within 30 days after treatment, the contractor shall perform the necessary re-treatment(s) at no additional cost to the Government.

1.10 DISEASE VECTOR CONTROL: Pests to be controlled shall be flies, mosquitos, and ticks.

1.10.1 Larval Mosquito Control: The Contractor shall larvicide those areas as directed by the Facility Manager / QAR.

1.10.2 Adult Mosquito Control: The Contractor shall accomplish fogging at night of the same day of Facility Manager / QAR notification. Fogging shall not begin before 8:30 p.m. and shall not continue beyond 5:00 a.m. of the following day. Fogging shall only be accomplished when ground wind speeds are less than 8 mph. Fogging shall not be accomplished if it is raining. The Contractor shall comply with all State, County, and local statues.

1.10.3 Fly Control: The Contractor shall treat for flies where and when directed by the Facility Manager / QAR.

1.10.4 Quality Standards:

1.10.4.1 Larval Mosquito: No live larvae shall be found in treated areas for 30 days after treatment.

1.10.4.2 Adult Mosquito: Contractor shall provide immediate, temporary relief of flying mosquitoes.

1.10.4.3 Fly Control: Chemical sprayed on walls shall continue to work keeping the wall free from flies for a period of seven (7) calendar days after the application.

1.10.4.4 If live, healthy pests are observed within the time stated for each pest above after treatment, the Contractor shall perform the necessary retreatment(s) at no additional cost to the Government.

1.11 RODENT CONTROL: Pests to be controlled shall be rodents in all Fort Devens and Barnes Building facilities.

1.11.1 Scheduled Maintenance: None.

1.11.2 Service Order: The Contractor shall use snap traps, mechanical traps or poison. Glue boards will not be permitted except with Facility Manager / QAR approval. Dry or liquid poison baits shall be placed in distinctively marked, tamper‑proof bait stations made of wood, metal or plastic. The Contractor shall use a method of treatment when children and/or pets could have access to the trap and/or poison so that children and/or pets cannot gain access to the poisons or be injured by the traps. Treatment shall include the sealing of cracks, holes and other openings, placement of bait outside or underneath the building and around or under trash dumpsters, garbage containers and grease holding containers for the particular facility. The Contractor shall inspect the traps daily, and remove any dead rodent and dispose of at an off‑post State of Massachusetts approved dumpsite.

1.11.3 Quality Standard: Areas ordered for rodent control shall remain rodent free for a period of thirty (30) calendar days after the Contractor removes his trap/poison. If live, healthy rodents are observed anytime thirty (30) days after treatment, the Contractor shall perform the necessary re-treatment(s) at no additional cost to the Government.

1.12 ODOR CONTROL IN AREAS: Odor to be controlled in all types of facilities on Fort Devens and at the Barnes Building.

1.12.1 Scheduled Maintenance: None.

1.12.2 Service Order: The Contractor shall apply the particular masking deodorants for the particular application. They shall be applied either by spray or aerosol, within and/or under any enclosed building. The deodorant shall be strong enough to mask skunk and dead animal odors. The Contractor shall remove the source of odor (e.g. birds, rodents, bats, skunks, etc), and dispose of at any State of Massachusetts approved off‑post dumpsite.

1.12.3 Quality Standard: The odor being masked is not detectable after the masking agent is applied.

1.13 BIRD AND BAT CONTROL: Pests to be controlled are birds and bats removed from areas and/or application of repellents and screening of all harborage areas in all facilities.

1.13.1 Scheduled Maintenance: None.

1.13.2 Service Order:

1.13.2.1 Bird or Bat Removal from Living or Working Areas: The Contractor shall remove birds or bats present within any or all enclosed spaces of a structure such as living rooms, bedrooms, and offices. The Contractor shall remove birds or bats whether dead or alive. The Contractor shall remove nests, droppings, and other foreign materials to include dust pieces of insulation for all living and work areas. Removal shall be done without violating state or federal regulations. Areas shall not be modified or damaged during work performance. Bird or bat removal shall be through existing access points.

1.13.2.2 The Contractor shall release live birds at the exterior of the building and live bats at any area at least one mile from any building. The Contractor shall dispose of dead birds or bats at any State of Massachusetts approved off-post dumpsite. The Contractor shall remove all nests, droppings, and other foreign materials to include dust, pieces of insulation for all living and work areas.

1.13.2.3 Bird or Bat Removal from Enclosed Spaces: The Contractor shall remove birds or bats present within any or all enclosed spaces of a structure such as attics, space above suspended ceiling and crawl spaces. The Contractor shall remove birds or bats, whether dead or alive. Removal shall be done without violating state or federal regulations. The Contractor shall be required to remove and replace stove pipes and other similar fixtures that can be unbolted, unscrewed or otherwise disassembled in order to remove birds or bats. Areas shall not be modified or damaged during work performance. Bird or bat removal shall be through existing access points. If existing access is not adequate, the Contractor shall notify the Facility Manager / QAR. If the Facility Manager / QAR determines that additional access is required, the Government will be responsible for all construction involved. The contractor shall seal off all bird and bat access openings in accordance with paragraph 3.23.2.6. The Contractor shall release live birds at exterior of the building and live bats at any area at least one mile from any building. The Contractor shall dispose of dead birds or bats at any State of Massachusetts approved off post dumpsite.

1.13.2.4 Application of Chemical Bird and Bat Repellents: The Contractor shall remove nests, droppings, and other foreign materials to include dust and pieces of insulation from designated facilities and apply the repellent material. All debris removed shall be placed into sealed plastic bags and disposed of in any Off-Post Landfill. Most areas to be treated are high places, which require high lift equipment or ladders to reach. Examples of areas to be treated are aircraft hangers, warehouses, maintenance shops and historic family quarters. The Facility Manager / QAR will direct the building to be treated. The Contractor shall estimate the number of 10-linear-foot units required to perform the treatment. Any inspections required to estimate the number of 10-linear-foot units will be the responsibility of the Contractor. Contracting Officer approval is required before the Contractor begins any treatment. A cost estimate for the job, based on the unit price in the Bid Schedule, shall be submitted in writing with the request for approval.

1.13.2.5 Application of Mechanical Bird Repellants: The Contractor shall remove nests, droppings, and other foreign materials to include dust and pieces of insulation from the areas of facilities designated for application of mechanical repellants. All debris removed shall be placed into sealed plastic bags and disposed of in any steel trash dumpster. Examples of areas to be treated are administration areas, warehouses, barracks, and aircraft hangars. The Facility Manager / QAR will order the areas to be treated. The Contractor shall estimate the number of units required to perform the treatment. Any inspections required to estimate the number of units shall be the responsibility of the Contractor. Contracting Officer approval is required before the Contractor begins any treatment. A cost estimate for the job, based on the unit price in the Bid Schedule, shall be submitted in writing with the request for approval.

1.13.2.6 The Contractor shall fasten hail screen over pest access openings using staples, nails, and/or screws. Harborage elimination by screening openings is required to complete all work.

1.13.3 Quality Standard:

1.13.3.1 Bird or Bat Removal: All birds or bats shall be removed from the enclosed spaces, and living or working areas of a building with no birds or bats regaining access back into the enclosed space.

1.13.3.2 .Application of Bird and Bat Repellents. Areas ordered for application of bird and bat repellent shall remain bird and bat free for a period of thirty (30) calendar days after the Contractor applies the repellent. If birds and bats return within thirty (30) calendar days after treatment, the Contractor shall perform the necessary retreatment(s) at no additional cost to the Government.

1.14 CONTROL OF STINGING FLYING INSECTS: Pests to be controlled include wasps, bees, honey bees, cicada killer, bald face hornets, yellow jackets, biting flies, and filth flies from all areas and/or structures.

1.14.1 Scheduled Maintenance: None.

1.14.2 Service Order: The Contractor shall spray as required to control stinging, flying insects from areas, structures, playground equipment, dump sites, trees, burrows, latrines, training areas, and bleachers or as directed by the COR. The Contractor shall remove all active and inactive above ground nests. The Contractor shall transport honeybee swarms to a release point designated by the COR.

1.14.3 Quality Standard: All stinging flying insects shall be eliminated after treatment is applied and nests removed. Honeybee swarms shall be transported to a release point designated by the COR.

1.15 ROACH AND ANT CONTROL BY BAIT APPLICATION: The Contractor may use baits to control roaches and ants. Use of baits shall be by service order and may be required in conjunction with or in lieu of sprays, powders and sticky traps. Bait application may be required in any building included in this contract. The baits shall control all local species of roach.

1.15.1 Baits: Baits with the following characteristics are preferred: Consisting of an odorless waxy mass with suspended particulate matter packed in a childproof unbreakable plastic container. The container shall serve as a feeding station for roaches or ants. The bait shall contain a minimum of 1.65% and O.9% active ingredient for roach and ant baits respectively. The active ingredient shall be Hydramenthylnon which is slow‑acting, non‑resistant, non‑repellant stomach poison and is non‑mutagenic as determined by the Ames mutagenicity test. The bait container shall be capable of being temporarily adhered to any smooth surface. Alternative baiting procedures and materials must be approved by the COR prior to use.

1.15.2 Application: Placement of baits shall be done in accordance with the manufacturer's written instructions and as directed by the COR. Roach baits shall be placed at twelve stations per unit of application with a coverage rate of four to six baits per one hundred square feet of floor space. Ant baits shall be placed at two stations per unit of application with a coverage rate of one bait per one hundred square feet of floor space. The Contractor shall install the baits then remove and dispose of them three months later. Disposal shall be done in accordance with the manufacturer's written recommendations.

1.15.3 Quality Standards: No healthy, live pests shall be observed within the treated areas within fifty (50) calendar days after date of placement of baits. If live, healthy pests are observed any time after the first fifty days of the treatment, the Contractor shall perform the necessary Re-treatments(s) at no additional cost to the Government.

1.16 ANIMAL CONTROL: Animals to be controlled include, but are not limited to, live or dead skunks, cats, rats, raccoons, squirrels, possums, snakes, and ground hogs. The Contractor shall trap, transport and release live animals and remove, transport and dispose of dead animals. Handling of animals shall be in accordance with all applicable state and federal regulations.

1.16.1 Scheduled Maintenance: None.

1.16.2 Service Order:

1.16.2.1 Dead animals shall be removed, transported and disposed of in an approved landfill.

1.16.2.2 Live animals shall be trapped in a cage, transported to one of the appropriate locations stated herein and released. Wild animals shall be transported to a remote location far enough away so that the animal will not return to the site where it was captured. Wild animals shall not be released in populated areas.

1.16.2.3 The Contractor shall be responsible for gaining access to a given space within a structure to retrieve a live or dead animal. Access shall be through openings that can be made in the existing structure without cutting or damaging the structure. The Contractor shall provide the necessary hand tools (i.e. screw driver, hammer, pliers) and equipment needed to gain access. Only those portions of a structure, which can be reassembled, shall be dismantled by the Contractor. If access is not possible, the Contractor shall notify the Facility Manager / QAR and the Government will arrange access.

1.16.2.4 All Feral and Domestic animals shall be controlled on both installations as directed by the Facility Manager / QAR.

1.16.3 Quality Standard:

1.16.3.1 Dead Animal Removal: Carcass removal shall be performed as Priority 1 service order action. Disposal shall be at an approved off-site facility.

1.16.3.2 Live Animal Control: The Contractor shall trap the designated animal in a humane manner and attain 100% control within 10 days. Traps shall be of a cage type that will not harm the animal and be marked "CAUTION TRAP". Set traps shall be checked twice daily (Morning and Afternoon). Captured and released wild animals shall not return to the area where they were trapped. Evidence such as droppings, tracks, commodity damage, structural damage, grounds damage or actual sightings within 30 days after capture and release shall indicate the quality standard has not been met. If a wild animal returns to the site of its capture and removal within

30 days, the Contractor shall trap the animal again, transport and release the animal at a different location at no additional cost to the Government. Domestic animals include any animal that lives with and is considered a pet. If an animal leaves an area without being trapped, the Contractor shall be reimbursed for setting and checking the traps only.

1.17 ANIMAL WASTE CLEANUP & SCREEN INSTALLATION: The Contractor shall remove animal waste from in and around areas and restrict pests from re-entering the building by installing screen material over openings in a structure. Work shall include scraping and removal of animal waste adhered to hard surfaces, collecting loose material on hard surfaces and collecting waste contaminated soft materials, such as blown-in insulation and soil. The primary source of waste for this work requirement is birds and bats. Animal waste includes droppings, carcasses, feathers, fur and nesting materials.

1.17.1 Scheduled Maintenance: None.

1.17.2 Service Order:

1.17.2.1 The Contractor shall remove all waste materials from hard surfaces by means of scraping and sweeping or vacuuming. Washing with water will not be allowed without specific prior approval. Removal of stains is required only in locations visible to the residence. Such locations include exterior surfaces of areas, interior living spaces and interior public spaces. Locations, which do not require stain removal, are unfinished, unoccupied attics or basements, spaces above suspended ceilings and crawl spaces. Loose materials such as blown-in insulation and soil which have been contaminated with animal wastes shall be removed with the wastes. The Contractor shall not remove any more of the loose material than is necessary or than is allowed by service order. The Contractor shall replace soil with an approved material of similar composition. Blown-In insulation shall be replaced with cellulosic loose fill insulation conforming to ASTM A194.1, Type IV, Class 1.

1.17.2.2 The Contractor shall fasten hail screen over pest access openings by means of staples, nails and/or screws. If an opening is too large to effectively be covered with hail screen, the Contractor shall notify the Facility Manager / QAR and describe in writing or with a sketch the size and location of the opening.

1.17.3 Quality Standard:

1.17.3.1 All animal wastes shall be removed from hard surfaces and stains removed in spaces visible to the residences. All building components moved during cleaning shall be put back the way they were found.

1.17.3.2 All animal wastes and contaminated loose materials shall be removed from the designated spaces.

1.17.3.3 Contaminated loose materials shall be replaced with new materials of equal or better value/quality and in the same location as the original material. Hail screen shall be securely fastened in one piece over the pest access opening. No jagged edges shall protrude and the patch shall be cut straight and square. Screening shall be concealed as much as possible in locations visible to the residence.

1.18 DEFINITIONS:

1.18.01 Acceptable Quality Level (AQL): The maximum percent defective the maximum number of defects per hundred units, or the number of defects in a lot that can be considered satisfactory on the average; the allowable leeway or variance from a standard before the Government will reject the service. It implies that the Government recognizes that defective performance sometimes happens unintentionally. As long as the percent of defective performance does not exceed the AQL, the service will not be rejected by the Government. However, the Contractor must re-perform the defective service.

1.18.02 Arthropods: Scientifically, any numerous invertebrate organisms of the phylum Arthropod, which includes insects, crustaceans, arachnids, and myriapods having a horny segmented external covering and jointed limbs. For this contract, any insect that is referenced separately, where scientifically it belongs to any of the numerous invertebrate organisms of the phylum arthropod, is not considered under the term “arthropods”.

1.18.03 Call Back. A request for additional service following the initial service which has not provided the control required. Repeated call backs are possible.

1.18.04 Check: To examine or compare with a standard to verify that the unit or equipment is operating within design specifications. Checks include adjustment, calibration, and replacement or repair (requiring 20 minutes or less) if the unit is not operating within design specifications.

1.18.05 Clean: Free from dirt, contamination, or impurities; unsoiled, unstained, or recently laundered.

1.18.06 Compliance: Action in accordance with clean air or water standards and/or the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). It also means actions in accordance with a schedule or plan ordered or approved by a court of competent jurisdiction, the State of Massachusetts or the Environmental Protection Agency as dictated by the Air Act, Water Act, or FIFRA, and regulations issued pursuant thereto.

1.18.07 Contractor. The term Contractor as used herein refers to both the prime Contractor and any subcontractors. The prime Contractor will be responsible for insuring that his/her subcontractors comply with the provisions of this contract.

1.18.08 Contracting Officer (CO): Any person who, either by virtue of position of by appointment in accordance with the Federal Acquisition Regulation (FAR), or supplement thereto, is currently a Contracting Officer with the authority to enter into and administer contracts and make determinations and findings with respect thereto, or with any part of such authority.

1.18.09 Contracting Officer’s Representative (COR): Government personnel in the functional area who oversees and the activities of all assigned Contractor actions under this contract in the performance of contract surveillance to include inspection and acceptance of supplies/services.

1.18.10 Deficiency: A shortcoming in the quality or state of service performed.

1.18.11 Emergency Work/Service Request: Any unforeseen circumstance or combination of circumstances that requires immediate action. Emergency Service Orders require an onsite response and initiation of inspection and control treatment(s) within 24 hours of the Contractor’s receipt of an Emergency work order request.

1.18.12 Facility: An identifiable piece of real property. A facility may be part of a larger entity; such as a part of a utility plant system or road, or it may be an individual object, such as a structure or range.

1.18.13 Facility Manager: The contact person responsible for a particular building, facility or site within the garrison. For this contract, the person responsible for initiating the DPW service order request for pest management services at a particular building or facility.

1.18.14 Hazardous Waste: Materials that are toxic, poisonous, corrosive, irritating, sensitizing, radioactive, biologically infectious, explosive or flammable, and present a hazard to human health and the environment. Special handling procedures and disposal facilities are required for their disposal in compliance with Federal, State, and local regulations.

1.18.15 Inspection: The critical examination of a facility, structure, mechanism, system or procedure to discover and remedy problems, discrepancies and/or inefficiencies.

1.18.16 Integrated Pest Management (IPM). IPM is a pest population management system that uses all suitable control techniques (chemical, bio-rational, cultural, resistant varieties, physical) to maintain pest populations at or below tolerable levels.

1.18.17 Pests: Arthropods, commensal rodents, nematodes, fungi, bacteria, viruses, algae, snails, marine borers, snakes, weeds, skunks, raccoons, other animals domestic and wild and other organisms (except for human or animal disease causing organisms) that adversely affect the well-being of personnel and animals; harmful to real property, supplies, or equipment, or vegetation; or are otherwise undesirable.

1.18.18 Pest Management. Pest control or prevention by a comprehensive approach that considers various suppression techniques, the habitat of the pest, and interrelationships between the pest populations and the ecosystem.

1.18.19 Pesticide: Any substance or mixture of substances, including biological control agents, that may prevent, destroy, repel, or mitigated pest; also, any substance or mixture of substances used as a plant regulator, defoliant, or desiccant.

1.18.20 Pesticide Applicator: Any Certified individual who applies pesticides or supervises the use of any pesticide by others.

1.18.21 DOD Certified Pesticide Applicators: Persons certified in accordance with the DOD Plan for the Training and Certification of Pesticide Applicators.

1.18.22 EPA Certified Pesticide Applicators: Persons certified by the EPA (in States without an approved certification plan) in accordance with 7 USC 136 and in the category in which a pesticide will be applied.

1.18.23 State Certified pesticide Applicators: Persons certified in accordance with 7 USC 136 by the State of Massachusetts using an EPA approved certification plan and certified in the category in which the pesticides will be applied.

1.18.24 Preservation: Application of protection measures to prevent deterioration, including cleaning, drying, and preservation materials, barrier materials and cushioning.

1.18.25 Quality Assurance (QA): Any surveillance used by the Government to check goods or services to determine whether or not they meet the requirements of the contract.

1.18.26 Quality Assurance Evaluation: Government personnel assigned as the COR will perform quality assurance review of all phases of operation. The COR possesses expertise for the specific purpose of exercising general surveillance over the contract operation and performance evaluation.

1.18.27 Quality Control (QC). A method used by the Contractor, to measure the quality of goods and/or services provided.

1.18.28 Repair (General): The restoration of a failed or failing piece of equipment or real property facility (or component thereof) to such condition that it may be effectively used for its designated purpose.

1.18.29 Replacement: A complete installation of new property in place of property destroyed or damaged beyond the point at which it may be economically repaired.

1.18.30 Reportable Spill: A release to the environment of a substance as designated under the Clean Water Act, Toxic Substance Control Act, Resource Conservation Recovery Act, or the Comprehensive Environmental Response Compensation and Liability Act.

1.18.31 Restricted Use Pesticide: A pesticide that the Administrator of the EPA or a State regulator agency determines in accordance with 7 USC 136 to have potential for causing unreasonable adverse effects on the environmental when applied in accordance with its labeling. Therefore, it is necessary to impose additional regulatory restrictions.

1.18.32 Scheduled Maintenance: A system and cyclic check, inspection and correction of minor deficiencies and/or problems as well as the recording and reporting of deficiencies beyond the scope of scheduled maintenance.

1.18.33 Uncontrolled pesticide: A pesticide available without EPA restrictions as to who can apply them.

1.18.34 Unoccupied Areas (Vacant): No one using the facility at that time.

1.18.35 Where "as shown", "as required", "as detailed" or words of similar meaning are used, it shall be understood that reference is made to the drawings accompanying this specification unless stated otherwise.

1.18.36 Where "as directed", "as required", "as permitted", "approval", "acceptance" or words of similar meaning are used, it shall be understood that direction, requirement, permission, approval or acceptance of the CO or COR is intended unless stated otherwise.

1.18.37 Acronyms: As used throughout the contract or in material referenced in the contract. The following acronyms shall mean the following:

PART 2 EXECUTION

2.0 WORK PROCEDURES:

2.1 PERSONNEL: The Contractor shall provide sufficient qualified personnel to perform the requirements of this contract that is to insure continuous coverage at the installation during regular working hours. The contractor shall not hire off-duty civilian and military employees where employment of would result in a conflict with DOD Directive 5500.7, “Joint Ethics Regulation”.

2.1.1 Identification of Contract Personnel: The Contractor shall provide identification for all employees, to be worn at all times, while on duty. Identification badges shall include:

2.1.2 Personnel List: The Contractor shall furnish to the Contracting Officer prior to commencement of work under the contract, a written statement containing the complete name and duties of each employee having access to Government areas and facilities on this installation. In the event of a change in employees or change of duty, the Contractor shall advise the Contracting Officer of the change and shall furnish in writing the name and duty of the new employee within two days after such change is made.

2.2 STANDARDS OF PERFORMANCE

2.2.1 Conduct and appearance: The Contractor shall ensure that the conduct of their employees shall not in any way be discourteous and shall present themselves in a professional appearance at all times. The conduct and appearance of Contractor employees shall not reflect discredit upon either installation or upon the Department of the Army.

2.2.2 Hours of Operation:

2.2.2.1 Regular Working Hours: The Contractor shall perform work between the hours of 0730 and 1600 (7:30 a.m. and 4:00 p.m.), Monday through Friday, unless otherwise specified.

2.2.2.2 After Hours: The Contractor shall provide the Contracting Officer with a local telephone number or pager on a local phone number, which shall be answered 24 hours a day Monday through Sunday and cited Federal holidays for receipt of emergency work requests. This telephone number shall be answered by a Contractor Representative, who shall have full authority to commit the Contractor’s resources to perform the requirements of this contract. Notification time shall begin when the message is received by the Contractor or contractor’s representative.

2.2.3 Pager or Cell Phone: The Contractor shall obtain, maintain and carry with him at all times a pager or cellular phone. The pager or cellular phone shall have a local number and that number shall be furnished to the Contracting Officer at the Pre-Performance Conference.

2.2.4 Safety Requirements: The Contractor shall conduct all work in a safe manner and in compliance with the Occupational Safety and Health Act (OSHA), Federal, State and Army requirements. If the Contractor Fails, or refuses, to promptly comply with safety requirements, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop order shall be made the subject of claim for extension of time or for excess costs or damages to the Contractor. The Contractor shall provide to the Contracting Officer at the Pre-Performance Conference a copy of the Safety plan for approval.

2.2.5 Inspection by Regulatory Agencies: The Contractor shall notify the Facility Manager / COR immediately, by phone, of any inspection visit by an agent(s) of any regulatory agency. Contractor shall submit a written report to the Facility Manager / COR by close of business of the work day following completion of the inspection or visit, to include the name, identification number, agency of the inspectors and the reason for the visit. The Contractor shall submit a copy of any reports received from any regulatory agencies (e.g. EPA, State of Massachusetts) to the Facility Manager / COR. Such reports shall be submitted to the Facility Manager / COR before close of business of the next business day.

2.2.6 Citations: Citations for non-compliance shall be immediately reported to the Contracting Officer. The Contractor shall hold harmless and indemnify the Government from and against all claims, demands, violations, or liabilities whatsoever arising out of or in any matter predicated upon the conduct of the contractor or any of the contractor’s subcontractor’s.

2.2.7 Fire: The Contractor shall comply with the most current edition of the National Fire Codes, installation fire prevention standards, Army Regulation 420-90, and Navy Regulations. Any disconnection, connection, or installation of fire protection alarms or suppression systems shall require an acceptance test performed by the Contractor and witnessed by the Fire Prevention Bureau. All fire alarm system components, including all smoke and heat detectors, shall be protected from dirt, dust, and damage during demolition, construction, or other work. These requirements also apply to fogging, some spraying operations, and certain other types of pest control treatments.

2.3 QUALITY CONTROL: The Contractor shall establish a complete Quality Control Program to assure the requirements of the contract are provided as specified. Two copies of the Contractor’s Quality Control Plan shall be submitted to the Contracting Officer for approval at the Pre-Performance Conference. An updated copy must be provided to the Contracting Officer for approval as changes occur. The Quality Control Plan shall include the following:

2.3.1 Inspection System: The Contractor shall implement a quality control inspection system covering all the services stated in the contract. It shall specify areas to be inspect on both a scheduled or unscheduled basis and the individual who will do the inspection. The Contractor’s inspection system shall assure that all services performed under this contract conform to contract requirements.

2.3.2 Deficiencies: The Contractor shall implement a method of identifying and correcting deficiencies in the quality of services performed so that the level of performance will be acceptable by the standards established in this document.

2.3.3 Documentation: The Contractor shall establish procedures to maintain a file system of all inspections conducted by the Contractor and the corrective action to be taken. This documentation shall be provided to the contracting officer at any time during the term of the contract and upon termination or completion, turned over to the Contracting Officer.

2.3.4 Inspection Reports: One copy of all inspections, conducted by the Contractor shall be submitted to the COR and one copy to the appropriate facility manager within one day after completion of the inspection.

2.3.5 Personnel: The Quality Control Person shall perform Pest Control services, however must be a certified employee in pest control application.

2.4 QUALITY ASSURANCE: The contract will be monitored by an appointed Quality Assurance Evaluator. The Fort Devens and Barnes Building Integrated Pest Management Plan will be the governing factor in determining the method of operations for pest management when detailed procedures are not understood.

2.5 LICENSING: The contractor shall be licensed by the State of Massachusetts to apply restricted and non-restricted use pesticides in the State of Massachusetts, and, in accordance with the DOD Plan for certification and training of pesticide applicators in all appropriate categories to which the Performance Work Statement (PWS) specifies. The contractor shall submit a copy of his license and of all employees likely to be assigned work on the installation with his bid. The Contractor’s personnel shall have valid certifications to apply restricted use pesticides upon contract award and throughout the duration of the contract.

2.6 CERTIFICATION: Contractor personnel performing pest control work shall be certified under the Environmental Protection Agency (EPA) Plan contained in the Pesticide Control Act for the Certification of Pesticide Applicators, as accepted or modified by the State of Massachusetts, for Core education requirements plus categories 7 and 8 (Industrial, Institutional, Structural and Health-Related Pest Control and Public Health Pest Control respectively). Contractor personnel will not be permitted to apply any pesticide at the DRFTA Areas without the appropriate certification. Application of pesticides shall be restricted to the level of certification held by each Contractor employee assigned to perform pest control actions on the premises. Proof of certification shall be carried at all times by Contractor personnel, while performing work under this contract.

2.6.1 Massachusetts Regulations: The Contractor’s pesticide applicators maintain certification in accordance with State of Massachusetts law and regulation for the categories of pest control to be performed.

2.6.2 Current Practices: All Contractor personnel using pesticides shall keep abreast of current developments in the use of pesticides.

2.6.3 Documentation: The Contractor shall provide a copy of the current certification of all personnel applying pesticides on Fort Devens and the Barnes Building to the Contract Officers Representative (COR) within seven (7) working days after contract award. Upon expiration of a current certification the Contractor shall submit a copy of the renewed certification within seven (7) working days.

3.0 ENVIRONMENTAL PROTECTION: The Contractor shall comply with all Federal, State, and local regulations concerning environmental protection, hazardous and toxic material, pesticide use and application, mixing and storage, disposition, protective equipment, transportation, spills and fires.
