The purpose of Amendment 0004 is to:

1) Provide responses for the following questions regarding MIL-PRF-32312 Specification:

QUESTION: Table VI, Note 8: Requesting clarification on the double sample retest:_________

* 8: Failure of the sample cartridges to comply with the applicable requirement shall result in a second sample of double the quantity to be tested for the requirement that was not met. For Accuracy, the results of the first and second samples shall be treated as a cumulative sample. Failure of the cumulative sample to comply with the applicable requirement shall result in failure of the lot. For

Dispersion, any target in the second sample that fails to meet the requirement shall result in failure of the lot.

- For function and casualty testing, if the lot fails due weapon stoppages that occur at cold temperature, is the double sample re-test performed only at this temperature?

RESPONSE: If the stoppage is deemed to be caused by a weapon malfunction, the stoppage shall be noted, but will not count towards the_________ cumulative rejection quantity. An additional round shall be fired to meet the quantity required per the specified test. If the stoppage is deemed to be caused by the ammunition, and the rejection quantity exceeds the allowed quantity, a double sample re-test shall be performed for only the temperature at which the failure occurred.

- For accuracy, how does the cumulative sample work? Is it the average of the first and double sample targets combined?

RESPONSE: If the accuracy requirement is not met, a double sample retest shall be performed for the weapon that did not meet the_________ requirements. To determine if the double sample retest passed, the average of the 3 targets from the original test shall be averaged with the results of the 6 targets for the double sample retest. The average of the 9 targets shall meet the accuracy requirement in order to pass the test.

If the dispersion requirement is not met, a double sample retest shall be performed for the weapon that did not meet the requirements.

Since each target is evaluated separately, any target that does not meet the requirements shall result in a lot failure.

QUESTION: Table VIII, Note 7: Requesting clarification on what the defect rate should be during FAT & LAT._________

RESPONSE: The defect rates shall scale linearly. Major defects that were listed as not greater than 15 per 1000 rounds translates to_________ not greater than 16 per 1080 rounds for FAT and not greater than 11 per 720 rounds for LAT. Minor defects that were listed as not greater than 40 per 1000 rounds translates to not greater than 43 per 1080 rounds for FAT and not greater than 29 per 720 rounds for

LAT.

2) Update Section B Contract Line Item Numbers (CLINs) as follows:

Remove CLIN 0012 and CLIN 0013 and add CLIN 0014 for Government Purpose License Rights. In order to remove "NSP" from CLIN 0012, it is required to delete CLIN 0012 from the solicitation. Due to this deletion, it is required to add a new CLIN (CLIN 0014). CLIN 0012 and

CLIN 0013 cannot be re-used on the solicitation. Therefore, CLIN 0014 reflects the updated CLIN for Government Purpose License Rights.

This CLIN also includes an updated narrative including further detailed instructions to the offeror.

Offeror to provide cost to obtain the Government

Purpose License Rights (GPLR). The proposal shall clearly outline all terms and conditions required to grant data rights with clear definitions as to what will trigger the grant of the data rights. This may be accomplished through a royalty, minimum units to be purchased, lump sum license fee, or alternative approach for the data rights. The proposal must list all costs to the Government, including any minimum quantity required to be purchased by the Government, any cost to purchase data rights, minimum time in months to acquire data rights and any limitations that may be imposed.

If the offeror elects to submit a lump sum license fee for data rights, the offeror shall specify that portion of the proposed lump sum price that is associated with the cost to the Government to obtain these rights to background intellectual property.

The pricing shall be provided for each separate item of data or software for which limited technical data rights or restricted rights is claimed. The offeror shall provide a brief description of the methodology or rationale used in determining the value of the data rights for each separate item or data or software claimed.
