THIS SOLICITATION IS WOMEN OWNED SMALL BUSINESS SET ASIDE

1. Solicitation W15QKN-20-Q-5417 is issued for the procurement of construction services to provide Testing/Repairs/Replacement and Installations of 364 Cross-Connection Controls and Backflow Prevention Assemblies (BFPA) Devices.. Contractor shall furnish all plant, labor, equipment, materials, transportation, supervision and technical expertise to perform requirements in accordance with the specifications and allotted period of performance described in this Specifications Of Work (SOW). The Contractor shall have 120 Calendar Days from the Notice to Proceed Date to complete ALL TASKS associated with the Specification of Work.

2. This solicitation document incorporates provisions and clauses of those in effect through Federal Acquisition Circular 2019-01. The North American Industry Classification System (NAICS) code that applies to the principal nature of the acquisition: 238220 Plumbing Contractors with a size standard of $16,500,000.

4. 5. The offeror must be registered/active status in the System for Award Management (SAM) in order to be eligible for award. 6. Contractor Proposals Shall Include:

a. Unit and extended (total) pricing for all Contract Line Item Numbers (CLINs)

b. DUNS number, CAGE code, Federal TIN and any small business preference or socioeconomic (8(a)certified, HUBZone Certified, WOSB, etc.) Concern under the applicable NAICS code 238220.

c. Complete the SF 1442 and sign and return at the time of quote submittal. In addition, the contractor shall sign and acknowledge any potential resulting amendments to this solicitation. In doing so, the offeror accedes to the contract terms and conditions as written in the Request for Proposal.

d. Provide the name, title, address, email address and telephone number of the company/division point of contact regarding business decisions made with respect to the proposal and who can contractually obligate the company.

7. Pricing:

The Price proposal shall include an itemized breakdown of all parts, supplies, material and labor required to successfully accomplish the requirements at section 3 of the Performance Work Statement. Contractors shall list pricing for each element required to complete the work required so the Government may properly evaluate price.

Pricing shall include unit and total pricing for all items to include material and labor.

**Evaluation Criteria:

Award will be made to the responsive, responsible contractor whose total proposed price is the lowest priced technically acceptable that meets or exceeds the requirements of the Performance Work Statement. The Government intends to award a single Firm Fixed Price (FFP) contract. The Government intends to award a contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions if in its best interest.

Cross-Connection Control and Backflow Prevention Remediation

UNITED STATES ARMY GARRISON FORT HAMILTON KINGS COUNTY, NEW YORK

1. Introduction

Situated at the far western end of Long Island, Fort Hamilton is located on the eastern shore of the Narrows (at the foot of Verrazano-Narrows Bridge) directly across from Staten Island in Brooklyn, Kings County, New York. Fort Hamilton covers approximately 148 acres (59.9 hectares), of which about 128 acres (51.8

ha) are on land and about 20 acres (8.1 ha) are submerged by the Narrows, west of the facility.

Fort Hamilton obtains potable water from three connections to the New York City Department of

Environmental Protection (DEP) distribution system. A 10-inch main near the gate of 101st Street, an 8-inch main near the gate of 7th Avenue, and an 8-inch main behind the Commissary, just inside the fence line at Battery Avenue. The distribution system does not contain any storage tanks and is composed of approximately seven miles of pipe. The installation has the responsibility of having a cross-connection control (XC2) and backflow preventive measure program to prevent contamination to and from the installation.

2. General

2.1 – Background

Cross-connections are the links through which it is possible for polluting or contaminating substances to enter the potable water supply and set-forth contamination. A cross-connection is defined as any actual or potential connection between a potable water supply and a contamination source, such as chemicals, industrial process water, steam, and any matter that may change the color or taste of water or add odor to water.

In order to protect potable water systems from cross-connections or backflow, approved backflow prevention assemblies (BFPA)/devices are installed on the potable water supply lines that are connected to non-potable systems and equipment to prevent backflow. The degree of hazard associated with each cross-connection will determine the type of BFPA or device to use.

2.2 – Scope

The Contractor shall furnish all labor, transportation, equipment, materials, and any other items necessary to complete the tasks identified below. These tasks include correcting 364 existing and/or potential cross-connections on Fort Hamilton. This excludes commodes, urinals, kitchen and bathroom sinks identified. The deficiencies are outlined in the independent survey conducted by the U.S. Army Public Health Center. The “Environmental Health Engineering Report No. S. 0052012a-17, Cross-Connection Control and Backflow Prevention Survey Report for USAG Fort Hamilton, 21-31 AUG 2017.”

2.3 - Personnel

Key staff shall be professionally qualified and responsible for the accuracy and professionalism of all field work, archival research and report production.

2.4 - Physical Security

The Contractor shall be responsible for all Government property provided for Contractor use. At the conclusion of each work period, all Government facilities, equipment and materials shall be secured. Physical Security shall be provided a list of all Contractor personnel that will be working on Fort Hamilton regardless of duties. This lists shall include personnel present for meetings, inspections, construction, sub-contractors, and those performing other unspecified duties.

2.5 - Quality Assurance

The Contractor shall provide monthly updates to the Contracting Officer Representative (COR) and Construction Control Representative (CCR) on the progress of the tasks identified below. These reports shall include the progress of the repairs, replacements, and or protection materials IAW the as fore mentioned independent survey/assessment.

Inspections and system testing shall be documented. The reports shall include the Contractor’s schedule, vendor or transportation delays, and the impacts to schedule.

2.6 - Hours of Operation

The Contractor shall perform work during normal duty hours, 0800-1630hrs, Monday through Friday. Weekend work must be requested at least 72 hours in advance for consideration, at no additional cost to the Government. The Contractor shall coordinate with the COR to determine if there are any days in which Garrison activities will impede upon the project schedule. No work will be done on Federal Holidays (July 4th, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, Christmas Day, New Year’s Day, Martin Luther King Day, President’s Day, and Memorial Day).

2.7 – Safety

The Contractor shall comply with the Occupational Safety and Health Act (OSHA). The Contractor shall provide all necessary safety controls for the protection of life and health of its employees and all other persons and prevent damage to property, supplies, equipment and materials. The Contractor shall submit for review and approval to the Garrison Safety Officer, a Health and Safety Plan and Activity Hazard Analysis (AHA) for the field activities included in this task order. The location of the nearest hospital, emergency routes and contact list for this area will be included.

The contractor shall comply with all applicable local, state and Federal laws with respect to the environment and safety. The Contractor shall be held liable for all fines, penalties or costs that arise from any violations of law.

The Contractor shall immediately correct all safety deficiencies upon notification of the deficiencies by the COR and shall notify the COR of the corrective action taken.

2.8 - Accident Protection and Emergency Medical Treatment

The Contractor shall have competent personnel trained and capable of dealing with minor personnel injuries. The Contractor shall also have on-site at all times fully stocked emergency first-aid kits that comply with OSHA. The Contractor shall also have a list of all pertinent emergency numbers and contact information on-ssite as well as know the location of the nearest medical facility.

2.9 - Debris Removal

The Contractor shall remove all trash, debris, or surplus material from the work site at the end of each working day.

The work site shall be clean of all debris when the work is completed.

2.10 - Contractor Damages

The Contractor shall be responsible for all damages to Government property. Any damages occurring as a result of this work will be repaired at no cost to the Government and to the satisfaction of the Government. Ground disturbance activities that may be directly related to the performance of this contract are obviously exempt from this requirement. The Contractor will furnish all equipment needed to carry out the work identified below. No government-furnished equipment will be provided as part of this task order.

3 Previous Research

The Contractor shall conduct research to include, but not be limited to, the existing Fort Hamilton cross-connection controls and backflow prevention assemblies/devices (BFPA) inventory developed by the U.S. Army Public Health Command Region North in August 2013.

4 Statement of Services

To ensure conformity with law, project deliverables shall include:

I. Inventory and document repairs, replacements, and or protections of cross-connection controls and backflow prevention assemblies/devices (BFPA).

II. All repairs, replacements, and or protections shall be IAW the deficiencies are outlined in the independent survey conducted by the U.S. Army Public Health Center. The “Environmental Health Engineering Report No. S. 0052012a-17, Cross-Connection Control and Backflow Prevention Survey Report for USAG Fort Hamilton, 21-31 AUG 2017.” This includes the locations of such devices.

III. Development of a comprehensive preventative measure inspection plan IAW the recommendations outlined in the as fore mentioned independent survey/assessment.

IV. Recommendations as to the applicability of Under the Safe Drinking Water Act Amendments of 1986, the State of New York Codes, Rules, and Regulations (NYCRR), Title 10 Department of Health, Chapter 1, State Sanitary Code, Part 5-1, Public Water Systems, 31 Cross-Connection Control (10 NYCRR Part 5- 1.31); U.S. Army Regulations AR 200-1 and AR 420-1, Department of the Army Technical Bulletin Medical 576; and Unified Facilities Criteria (UFC) 3-230-02 (references 2-7), and other applicable rules, regulations, and codes.

4.1 – Quality Assurance, Testing, and Analyses

The primary goal of this project is to comply with New York, Federal, and Army regulations for environmental compliance criteria. This for cross-connection control and backflow prevention measures. This is in accordance with the independent survey conducted by the U.S. Army Public Health Center. The “Environmental Health Engineering Report No. S. 0052012a-17, Cross- Connection Control and Backflow Prevention Survey Report for USAG Fort Hamilton, 21-31 AUG 2017,” which outlines the corrective actions to be completed at USAG Fort Hamilton.

Project activities will include: Repair, replacement, and or providing protection materials per Army, New York City, Federal and State requirements, along with the as fore mentioned independent survey/ assessment. This includes testing, providing Quality Assurance (QA), Quality Control (QC), report preparation, report production, and comparison of current data/information to applicable regulatory standards.

5 - Overall Report Requirements/Deliverables

Results from inspections and assessments conducted by the Contractor shall be completed per section 4 and other applicable requirements and provided to USAG Fort Hamilton per general instructions as indicated.

The final report shall detail all findings from the activities described in Section 4. The individual deliverables will follow any requirements provided in the relevant task discussions as well as the general requirements identified. For all draft submissions, the Contractor will provide a digital copy of the Draft Report to the COR for distribution to Fort Hamilton’s POCs. For all final deliverable submissions, the Contractor will provide two paper copies and two CDs.

5.1 - Monthly Billing and Progress Reports

Monthly reports shall be submitted by the Contractor to the COR each month with the submission of the invoice for the work completed during the previous month. These reports may be in brief letter format and should document specific work/progress to date and any problems that occur. In addition, any matters requiring an action or decision by the COR shall be reported.

5.2 - Work Plan

The Contractor will submit a detailed activity and milestone work plan within 30 calendar days of contract award date with a schedule that identifies the tasks identified above and the various activities associated with those tasks and their schedule for completion, and include any critical path considerations. The work plan will be submitted to the COR for review, with the installation POCs for acceptance. The work plan and schedule may be revised based on comments provided to allow for installation activities, holidays, etc., that may affect the Contractor’s proposed plan for accessing sites on the installation. Once accepted, the work plan and schedule will be used to track the progress of all required tasks.

5.3 – Report

The Contractor shall prepare a draft and final report in accordance with Section 4 above. The Contractor will provide an electronic version only of the draft report to the COR for review by the COR and the installation POCs.

The COR and installation POCs will have 14 calendar days to review and provide comments to the Contractor for use in the revision of the draft report and the development of the final report.

There will be a brief conference call with the Contractor after the government’s submission of comments in order to review the comments and discuss the preparation of the final report. The final report with all identified revisions will be submitted to the COR 14 calendar days after the conference call is held to review the comments. As noted above, the two paper copies and two CDs both with the complete Government-approved report, will be provided to the

COR.

5.5 - General Report Requirements

Final legible copies of the report shall be provided on double-sided, 8 ½” x 11” white bond paper and on CD. Tables and other tabular information shall also be on 8 ½” x 11” paper. Maps, figures, charts, and other graphics can be on 8 ½” x 11” paper, or 11” x 17” paper (folded). The Contractor shall provide copies of all correspondence, records of telephonic or verbal conversations, electronic-mail correspondence, archival research, field notes, photographic and digital images, miscellaneous data, computations, references, studies, etc. utilized in the preparation of this assessment. The Contractor will provide all GIS metadata/maps created for this project.

General requirements for the report are:

- The appearance shall be professional;

- The deliverables shall include a Table of Contents, including list of figures, tables and appendices;

- Measurements shall be classified using the English system, with Metric conversions provided in parenthesis (i.e. “The north parapet wall is 23 feet (7 meters) in length.”);

- Deliverables shall include the use of either footnotes or endnotes, and shall include a bibliography;

- Deliverables shall be prepared in accordance with either Kate L. Turabian, Manual for Writers of Term

Papers, Theses, and Dissertations (University of Chicago Press) or The Chicago Manual of Style (University of Chicago Press);

- Deliverables shall include page numbers on each page;

- An acronym and definitions list will be provided;

- Title page shall state the title of the report, version of the report, and that the report was prepared for Fort Hamilton. The sources of funds used to conduct the report, the title and number of the contract and work order, and the date the report was submitted shall also be inscribed; and

- If applicable, the Contractor must provide survey information, in GIS format, for inclusion into the Fort Hamilton GIS Data Base. The data shall conform to the following: the North American Datum 1983, Universal Transverse Mercator Zone 18N must be utilized; all survey end points and corner points will be provided as GPS surveyed points; and the Contractor shall provide computer files in a shapefile (.shp) format.

Random Sampling: Random sampling works best when the number of instances of the services being performed is very large and a statistically valid sample can be obtained.

Periodic Inspection: This method, sometimes called “planned sampling,” consists planned sampling at specific dates or time intervals. It may be appropriate for tasks that occur infrequently, and where 100 percent inspection or random testing is not desired.

Customer Input: Although usually not a primary method, this is a valuable supplement to more systematic methods. For example, in a case where random sampling indicates unsatisfactory service, customer complaints can be used as substantiating evidence. In certain situations where customers can be relied upon to complain consistently when the quality of performance is poor, e.g., dining facilities, building services, customer surveys and customer complaints may be a primary surveillance method, and customer satisfaction an appropriate performance standard. In all cases, complaints should be documented, preferably on a standard form.

6 - Project Schedule

6.1 The kick-off conference call/meeting will be held no later than 10 working days after the notice to proceed has been issued.

6.2 Tentatively, the Contractor shall identify, within 20 working days subsequent to the kick-off conference call or meeting, or earlier, the overall project schedule as part of the work plan, which will be reviewed by the COR and the installation. All work-related activities are expected to begin and end prior to Fiscal Year 2020. Work activities may be extended to the subsequent fiscal year under certain circumstances.

6.3 The Contractor shall provide a health and safety plan with activity hazard analyses and a final work plan prior to the start of field activities. These items need to be provided at least 10 working days before field efforts are scheduled to take place.

6.4 The Contractor shall provide a draft report and all supporting documentation, to include all field notes, images, GIS maps/data, etc., 14 calendar days, after the completion of all field activities, or earlier. The Contractor shall provide the final report 30 calendar days, tentatively, after the conference call to discuss the comments and the preparation of the final report.

52.219-1 SMALL BUSINESS PROGRAM REPRESENTATIONS (MAR 2020)

(a) Definitions. As used in this provision--

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127.
