About this file
This is a Request for Proposals (RFP) issued by the East Central Wisconsin Regional Planning Commission (ECWRPC) on behalf of Valley Transit (VT) and the City of Appleton for the development of an updated Transit Development Plan (TDP). The project involves a comprehensive review and update of VT's current transit system plan, which was last updated in 2009. The primary services to be evaluated include 19 fixed-route bus routes operating across approximately 117 square miles serving a population of 216,154 in the Fox Cities area, as well as paratransit service for ADA-certified customers, senior transportation service, The Connector service for second and third-shift workers, and a seasonal downtown trolley. The scope of work encompasses reviewing ridership trends for fixed-route, Connector, and paratransit services; identifying major transit generators and destinations; recommending a more efficient transit system structure; developing a partner funding structure recommendation; and conducting comprehensive public outreach. Proposals were due by 3:00 p.m. (CST) on Friday, September 8, 2017, with a question deadline of August 18, 2017. The anticipated contract start date was October 30, 2017, with project completion scheduled for July 9, 2018. Five in-person steering committee meetings were required throughout the planning process.
Proposals were evaluated on a 1,000-point scale: Approach (300 points), Timeline/Work Plan (200 points), Organization Capabilities (150 points), Staff Qualifications (100 points), References (50 points), Innovative Approaches/Ideas (100 points), and Budget (100 points). Cost proposals were scored using a proportional formula with the lowest cost proposal receiving the maximum available points. The contract is federally funded through Section 5304 FTA grant funds (CFDA 20.505), requiring compliance with applicable federal regulations including Buy America Act requirements for rolling stock over $100,000, Federal Motor Vehicle Safety Standards, and various federal clauses related to civil rights, debarment, clean air and water standards, lobbying restrictions, and DBE participation. Proposers were required to submit four printed copies and a PDF version of all materials, including a separate cost proposal envelope, along with an Affidavit of Non-Collusion and Bid Opportunity List form. Insurance and hold harmless provisions were required at the discretion of the ECWRPC Executive Director. Award was to be made to the highest-scoring responsive and responsible proposer, with contract negotiations anticipated between September 25 and October 9, 2017, followed by ECWRPC approval by October 23, 2017.

INTRODUCTION
Valley Transit (VT) with assistance from East Central WI Regional Planning Commission (ECWRPC) will update their Transit Development Plan (TDP) in 2017-2018, updating the current plan from 2009. The purpose of a TDP is to guide the development of the transit system over the next five to ten years ensuring efficient and effective transit services. A TDP takes an in depth look at transit system operations including such service elements as: routes, times, policies, demographics, input from public comment/surveys, input from a steering committee as well as additional recommendations from public outreach efforts.
Current transit services provided by VT include:
Fixed Route Bus Service: core service which consists of 19 fixed bus routes with service from 5:45 a.m. to 10:30 p.m. on weekdays and 7:45 a.m. to 10:30 p.m. on Saturdays. Many routes operate every 30 minutes during peak periods and every 60 minutes during off-peak periods.
Valley Transit II Paratransit Service: paratransit service is for people with disabilities who are unable to use the fixed-route bus system and is provided under the guidelines of the Americans with Disabilities Act (ADA). The service is available to ADA certified customers within the Valley Transit service area.
Valley Transit II Senior Transportation Service: Seniors who are age 60 or over and who live in the Fox Cities portion of Outagamie or Calumet County are able to use Valley Transit II from 9:00 a.m. to 5:00 p.m. Monday through Friday.
The Connector: This service is designed to provide safe, convenient, and affordable access to public transportation for Fox Cities residents who work second or third shift schedules or who need to travel throughout the community beyond the bus service area.
Trolley: VT partners with Appleton Downtown, Inc. to provide a special summertime trolley that operates throughout downtown Appleton from June through September.
VT’s fixed route bus service covers approximately 117 square miles and serves a population of approximately 216,154 within the Fox Cities (portions of Calumet, Outagamie and Winnebago
Counties). The City of Appleton has owned and operated the current fixed route system since
1978. Through this TDP update, VT is considering changing their fixed route bus service to better meet the needs and demands of its customers.
2 East Central Wisconsin Regional Planning Commission
PURPOSE
A TDP is a strategic plan used to guide the near and medium term future of the transit system.
As part of this planning process, VT would like to evaluate their current route system as well as seek recommendations to potentially improve upon their transit system. VT currently operates a hub-and-spoke system which is functioning at capacity.
Transit model:
Hub-and-spoke transit model: bus system and routes radiate out from a central downtown transfer center; Advantage of hub-and-spoke system: They are simple; new ones can be created easily; scheduling is convenient for passengers since there are few routes, with frequent service, so they may find the network more intuitive.1
The purpose of this request for proposal includes the following tasks:
A. Review VT ridership trends (origin and destinations)
B. Identify major generators
C. Recommend a more efficient system that incorporates the major generators and destinations identified in task A.
D. Recommend a partner funding structure with participating municipalities/partners based on recommended system in task B

The Procuring Agency shall make an equitable adjustment in the delivery schedule or contract price, or both, and the contract shall be modified, in writing, accordingly, if— o The Stop-Work Order results in an increase in the time required for, or in the
Contractor’s cost properly allocable to, the performance of any part of this contract; and o The Contractor asserts its right to an adjustment within 30 days after the end of the period of work stoppage; provided that if the Procuring Agency decides the facts justify the action, the Procuring Agency may receive and act upon a proposal at any time before final payment under this contract.
If a Stop-Work Order is not canceled and the work covered by the Order is terminated for convenience, the Procuring Agency shall allow reasonable costs resulting from the Order in arriving at the termination settlement.
If a Stop-Work Order is not canceled and the work covered by the Order is terminated for default, the Procuring Agency shall allow, by equitable adjustment or otherwise, reasonable costs resulting from the Order.
The Procuring Agency’s rights to terminate this contract at any time are not affected by action taken under this clause.
K. End of Contract Transition (Services)
This clause is effective if the contract provides for the provisioning of services. In the face of an impending contract expiration or termination and in recognizing that unforeseen circumstances may arise in the placement of a successor contract, as well as the importance of providing continued services with minimal interruption in services, the
Contractor agrees to:
Fully cooperate in ensuring an orderly transition of services during the transition to a successor contractor.
12 East Central Wisconsin Regional Planning Commission

Such extension shall only be executed by the authorized individual with prior approval from WisDOT and shall be evidenced by a bilateral (signed by both parties) contract modification for each 30-day extension, not to exceed a total of 90 days.
Within 90 days prior to final contract expiration or termination, provide the Agency with a complete and accurate inventory, including an asset condition report, of any assets leased from the Agency which will be returned to the Agency or may subsequently be leased by any successor contractor.

CONTRACT WORK HOURS AND SAFETY STANDARDS ACT
Background and Application The Contract Work Hours and Safety Standards Act is codified at 40 USC 3701, et seq. The Act applies to grantee contracts and subcontracts “financed at least in part by loans or grants from … the [Federal] Government.” 40 USC 3701(b)(1)(B)(iii) and (b)(2), 29 CFR 5.2(h), 49 CFR 18.36(i)(6). Although the original Act required its application in any construction contract over $2,000 or non-construction contract to which the Act applied over $2,500 (and language to that effect is still found in 49 CFR 18.36(i)(6)), the Act no longer applies to any “contract in an amount that is not greater than $100,000.” 40 USC 3701(b)(3)(A)(iii).
The Act applies to construction contracts and, in very limited circumstances, non-construction projects that employ “laborers or mechanics on a public work.” These non-construction applications do not generally apply to transit procurements because transit procurements (to include rail cars and buses) are deemed “commercial items.” 40 USC 3707, 41 USC 403 (12).
